Article 27. To see if the Town will vote to acquire the following parcels of open land, or any rights or easements therein, and make an appropriation therefor: (1) at the inter- section of Training Field Road and Glezen Lane; (2) at the intersection of Glezen Lane and Concord Road; (3) at the intersection of Commonwealth Road, West Plain Street and School Street, or do or act.


Voted unanimously that the Selectmen be and hereby are authorized to acquire title by gift, purchase, by right of eminent domain, or by any other lawful means to the following parcels of land ; the irregular lot lying within the intersection of Train- ing Field Road, Glezen Lane and Moore Road in front of the

Patterson Estate : the triangular lot lying within the two arms of Glezen Lane at the westerly intersection of said lane with Concord Road : the triangular lot lying within the intersection of Commonwealth Road, East Plain Street and School Street formerly the Schoolhouse lot, all for highway, park and other municipal purposes.


Said parcels shall thereafter be placed under the jurisdic- tion of the Park Department.


The sum of $300 is hereby appropriated and assessed for this purpose.


Voted that the Town express its thanks to Edward M. Woodward of Worcester for his offer of a gift to the Town of the lot at the intersection of Commonwealth Road, East Plain Street and School Street in memory of Carrie L. Loker and Edgar Loker subject only to payment of the outstanding taxes, for park purposes.


Article 28. To see if the Town will vote to transfer Lot 111 in that part of the Town known as "Castle Gate South" and shown on a plan recorded in Middlesex South District Deeds, Plan Book 271, Plan 3, from Tax Titles Account or Tax Title Possessions Account, where it is now held, to the Park Depart- ment to be held with the property in the vicinity acquired by the Town for recreational purposes and used as part of the bathing beach on the shore of Dudley Pond, and under the supervision and control of the Board of Park Commissioners, or will take any other action in regard to the transfer or disposal of the said lot and the interest of the Town therein, or do or act.


Voted unanimously to transfer Lot 111 in that part of the Town known as "Castle Gate South" and shown on a plan recorded in Middlesex South District Deeds, Plan Book 271, Plan 3, from Tax Titles Account or Tax Title Possessions Account, or any other account in which it is now held, to the Park Department Account, to be held with the property in the vicinity acquired by the Town for recreational purposes and used as part of the Bathing Beach on the shore of Dudley Pond, and under the supervision and control of the Board of Park Commissioners, and that the Town Treasurer and Town Accountant be and they hereby are authorized to take such action as may be necessary to carry out the foregoing vote and the purposes thereof.


Article 29. To see if the Town will vote to transfer cer-

tain property acquired by the Town by foreclosure of tax titles and now held either in the Tax Title Account or Tax Title Possessions Account from such accounts to the Park Depart- ment to be held, together with property in the vicinity acquired by the Town for recreational purposes, said property being situ- ated in that part of the Town known as Riverview Circle, and being shown on plan entitled "Wayland, Mass. Plan of River- view Terrace" May 1924, Edward H. Howard, C. E., recorded with Middlesex South District Deeds, Book 339, Page 41, as lots numbered on said plan as follows : 49-60, 64-71, 107, 213- 215, 226-228, 231-233, 243-250, 253-256, 262-266, 268-276, 279, 280, 282-287, 298, 299, or will take any other action in regard to said lots, or any of them, or do or act.


Voted unanimously to transfer the property situated in that part of the Town known as Riverview Circle and being shown on plan entitled "Wayland, Mass. Plan of Riverview Terrace" May, 1924, Edward H. Howard, C. E., recorded with Middle- sex South District Deeds, Book 339, Page 41, as lots numbered on said plan as follows : 49-60, 64-71, 107, 213-215, 226-228, 231-233, 243-250, 253-256, 262-266, 268-276, 279, 280, 282-287, 298, 299, from Tax Titles &Account or Tax Title Possessions Account, or any other account in which such properties are now held, to the Park Department Account, to be held together with property in the vicinity heretofore or hereafter acquired by the Town for recreational purposes, and that the Town Treasurer and Town Accountant be and they hereby are authorized to take such action as may be necessary to carry out the foregoing vote and the purposes thereof.


Article 30. To see if the Town will vote to authorize the Board of Public Welfare as a committee on behalf of the Town to sell the land and buildings on Sunset Road, Cochituate, deeded to the Town by Emma M. Jones and Ida G. Jones, being Lots 110 and 111, Wayland Manor, and all as described in Certificate of Title No. 50585 recorded in Middlesex South Registry Dis- trict in Book 338, Page 241, to Maurice A. Elliott or his nom- inee, in accordance with a written agreement (which agreement is in possession of the Welfare Board and will be presented to the Town Meeting for consideration) between the Welfare Board and Maurice A. Elliott, which agreement provides for such sale at a price set forth therein, subject to authorization by the Town, and will vote to authorize the Board of Public Wel- fare as a committee on behalf of the Town, or some one else,

to execute and deliver a deed in the name of the Town convey- ing said property to the purchaser, or will otherwise authorize the sale or disposal of the interest of the Town in said property, the net proceeds to be used in reimbursement of expenditures made, or to be made, by the Board of Public Welfare, as pro- vided by statute, or do or act.


Voted unanimously that the Board of Public Welfare be and it hereby is appointed as a Committee on behalf of the Town to sell the land and building on Sunset Road, Cochituate, deeded to the Ton by Emma M. Jones and Ida G. Jones, being Lots 110 and 111, Wayland Manor, and all as described in Certificate of Title No. 50585, recorded in Middlesex South Registry District in Book 338, Page 241, to Maurice A. Elliott or his nominee, in accordance with the written agreement be- tween the Welfare Board and Maurice A. Elliott for Two Thousand Dollars ($2,000), less the principal of the mortgage now existing thereon and any principal payments made by said Elliott, as provided in said agreement, and said Board of Public Welfare be and it hereby is authorized as a Committee, upon receipt of the purchase price as above provided, to execute and deliver in the name of and on behalf of the Town a deed con- veying the interest of the Town to said Maurice A. Elliott, or his nominee.


Article 31. To see if the Town will vote to authorize the Board of Public Welfare or the Town Treasurer, to sell the interest of the Town in the property on State Road East deeded to the Town for Jennie E. P. Sanderson, et al, subject to cer- tain life estates, at public or private sale at such time and place as seems to the Board of Public Welfare or to the Town Treas- urer best and proper, and will vote to authorize the Board of Public Welfare or the Town Treasurer, as a committee on be- half of the Town, to execute and deliver a deed in the name of the Town conveying said property to the purchaser, the net pro- ceeds to be used in reimbursement of expenditures made or to be made by the Board of Public Welfare as provided by statute, or will vote to take any other action in regard to the disposal of the interest of the Town in said property, or do or act.


Voted unanimously that the Town Treasurer be and he hereby is authorized to sell the interest of the Town in the prop- erty on State Road East deeded to E. Sanderson and Jennie E. P. Sanderson, as joint tenants for and during the term of their joint lives and the life of the survivor and at and after the

death of such survivor to the Town of Wayland, by Katherine D. Bennett, Executrix, by deed dated June 17, 1939, recorded in Book 6316, Page 6, subject to any life estate existing therein, at public sale, at such time and place as seems to the Town Treasurer best and proper, public notice to be given of any pub- lic sale in the same manner as is given in the case of sales of property acquired by tax title, and that when, as, and if such a sale is made the Board of Selectmen of the Town be and it hereby is authorized to execute and deliver in the name of and on behalf of the Town a deed conveying said property to the purchaser, and that the net proceeds of such sale be used in reimbursement of expenditures heretofore made or hereafter made by the Board of Public Welfare for the benefit of the said Sandersons,, all as provided by the statutes of the Com- monwealth of Massachusetts, as provided by the laws relating to reimbursement of public welfare expenditures.


Article 32. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.


Voted unanimously that the sum of $35,000 be transferred from available funds to meet any of the appropriations made under the foregoing articles.


Voted to dissolve the meeting at 11:20 P. M.

VOTES ENACTED AT THE SPECIAL TOWN MEETING, OCTOBER 9, 1946

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and did the following business.


Article 1. To see if the Town will vote to appropriate and assess the sum of $1,500 for "Highway Department," or do or act.


Voted unanimously that the Town appropriate the sum of $2,500 for Highway Department."


Article 2. To see if the Town will appropriate and assess the sum of $1,000 for "Snow Removal," or do or act.


Voted unanimously that the Town appropriate the sum of $1,000 for Snow Removal."


Article 3. To see if the Town will vote to appropriate and assess the sum of $600 for "Insurance," or do or act.


Voted unanimously that the Town appropriate the sum of $500 for "Insurance"


Article 4. To see if the Town will vote to appropriate and assess a sum of money for "Fire Department : Maintenance," or do or act.


Voted unanimously that the Town appropriate the sum of $900 for "Fire Department : Maintenance."


Article 5. To see if the Town will vote to appropriate and assess the sum of $700 to reimburse the First Parish in Way- land and the Methodist Church in Cochituate for the repair, resurfacing and gold-leafing of the four faces of the two clocks operated in the respective belfrys as Town clocks, allocation of the reimbursement to be made by the Board of Selectmen, or do or act.

Voted unanimously that the Town appropriate the sum of $700 to reimburse the First Parish in Wayland and the Metho- dist Church in Cochituate for repairs, resurfacing and gold- leafing of the four faces of the two clocks operated in the respective belfrys as Town clocks, the Board of Selectmen to make the allocation of the reimbursement.


It was stated in the Town Meeting that the two clocks located in the First Parish in Wayland and the Methodist Church in Cochituate were purchased by the Town and permis- sion was given the Town to place the clocks in the belfrys of the two churches, therefore the responsibility of repairs belongs to the Town.


Article 6. To see if the Town will vote to appropriate and assess for "Elections : Officers" $75 and "Elections : Expense" $25.


Voted unanimously that the Town appropriate the sum of $75 for "Elections : Officers" and $25 for "Elections : Ex- pense."


Article 7. To see if the Town will vote to appropriate and assess for "Notices of Town Meetings" $100.


Voted unanimously that the Town appropriate the sum of $100 for "Notices of Town Meetings."


Article 8. To see if the Town will vote to authorize the Board of Selectmen to sell or otherwise dispose of worn out equipment at the Town Hall and other equipment and supplies remaining at the closing of the Works Progress Administration and Civilian Defense Departments.


Voted that the Town authorize the Board of Selectmen to sell or otherwise dispose of used equipment and supplies, now located in the Town Hall, remaining in the Town's possession as a result of the closing down of the Works Progress Admin- istration and Civilian Defense Departments.


Article 9. To see if the Town will vote to authorize the Water Commissioners to acquire a proper site or sites, drive test wells, install a gravel-packed well with pump and pump- house, auxiliary equipment and pipe from the well to present mains and will appropriate and transfer from "Water Available Surplus" therefore the sum of $20,000, or do or act.

Voted unanimously that the Town appropriate and transfer from "Water Available Surplus" the sum of $500 for the print- ing and distribution of the complete report of the special Water Committee.


Article 11. To see if the Town will appropriate and assess or otherwise provide a sum of money for the purchase and installation of fire alarm wires to a box to be provided at the end of Beechwood Point.


Voted to pass over the Article.


Article 12. To see what sum, if any, the Town will vote to transfer from Available Funds to meet any of the appropria- tions made under the foregoing articles.


Voted unanimously that the Town transfer from Available Funds to meet the appropriations voted under Articles 1, 2, 3, 4, 5, 6 & 7 the sum of $5800.


Article 13. To see if the Town will vote to amend Section X of the Zoning By-Laws by inserting in the first line thereof after the words "Members" the following: "and two associate members" so that the first paragraph of this section shall read : "A Board of Appeals of three members and two associate mem- bers to be appointed by the Selectmen is hereby created under provisions of Chapter 40 of the General Laws and amendments thereto to assume the duties and powers given to such Board hereinbefore stated and further powers as follows; . . "

To see if the Town will vote to amend the existing Zoning By-Laws, Section V, by adding in the fourth line the words, "for the landing or taking off of aircraft or" so that the first paragraph shall read: "In a single residence dis- trict no building or premises shall be used and no building or structure shall be erected which is intended or designed to be used in whole or in part for the landing or taking off of aircraft or for any industry, trade, manufacturing or commercial pur- poses except as provided in paragraph (1) or for other than the following specified purposes."


Voted not to pass over the Article.
