ARTICLE 2


Town Meetings


Section 1. The Annual Town Meeting shall be held on the first Saturday of March of each year, at the hour designated by the Selectmen.


Election of Officers


Section 2 The election of officers designated on the official ballot shall take place on the second Saturday of March in each year, also voting on such questions or matters as may hereafter properly be submitted to vote in the official ballots, the hour of opening the polls to be designated by the Selectmen.


Special Town Meetings


Section 3. A Special Town Meeting may be called by the Selectmen when occasion warrants, the date and hour of the meeting to be designated by them, and in addition to posting copies of the warrant for said special town meeting as provided in Section 4 of this article, a copy of the warrant shall be published in two or more Plymouth County newspapers at least seven days before the time of holding said special town meeting and a post card notice shall be sent to each registered voter at least seven days before the time of holding said special town meeting.


Warrants


Section 4. All warrants for Town Meetings shall be served by posting an attested copy thereof in not less

than five public places in the Town, seven days, at least, before the time of holding the Annual Meeting, and seven days, at least, before the time of holding any special Town Meeting. The warrant for the An- nual Town Meeting shall be closed on the thirty-first day previous to the day of the Meeting.


Procedure


Section 5. Quorum: The number of voters neces- sary to constitute a quorum at the Annual Town Meet- ing shall be one hundred (100) and at any Special Town Meeting held for the purpose of appropriating money the number shall be one hundred (100).


Section 6. The Moderator for all town meetings shall be a qualified voter of the Town who holds no other Town Office, and shall be elected at the Annual Town Meeting for a term of one year.


Section 7. All articles in the warrant shall be acted on in the order of their arrangement, unless the Meet- ing, by vote, determines otherwise.


Section 8. When a question is under debate, no motion shall be entertained, except to adjourn the meeting, to lay on the table, to postpone to a certain time, to commit, or refer to recommit, to amend, or to postpone indefinitely, which several motions shall have the precedence in the order in which they are herein mentioned.


Section 9. All motions shall be reduced to writing when requested by the Moderator.

Section 10. Upon taking the question, if the decision of the Moderator is questioned, the Moderator shall request all persons to be seated and those voting in the affirmative or negative respectively, shall rise and stand until they shall have been counted by the tellers.


Section 11. The Moderator's decision shall not be questioned on matters of decorum or disorder in the meeting. On other matters it can only be over-ruled by a two-thirds vote of the persons voting, on a direct appeal to the meeting.


Section 12. All members of a committee chosen by the Meeting, shall be informed of their appointment by the Town Clerk in writing, stating the duties which such committee was appointed to perform. If appointed by the Moderator, after the adjournment of the Meet- ing, he shall inform each member in writing of his appointment, and after the list of members who have accepted the service is complete, he shall send the names of the same to the Town Clerk for record. When the Meeting names the committee it shall make pro- vision for filling vacancies on such committee.


Section 13. The first named on the committee shall be its temporary chairman, who shall see that its mem- bers meet and organize by the choice of a permanent chairman and secretary. A record of the meetings shall be kept by the secretary, and the record shall be sub- ject to inspection.


Section 14. A committee shall be considered dis- charged when its work is completed ; and a Town Meet- ing may discharge any of its committees for causes satisfactory to the Meeting.

Section 15. The duties of the Moderator, not pre- scribed by the Statutes or by the foregoing by-laws, shall be determined by the general rules of parliamen- tary law as set forth in Robert's Rules of Order.


ARTICLE 3.


Selectmen


Section 1. The Selectmen shall exercise a general supervision over all matters affecting the interests or welfare of the Town. ยท


Section 2. The Selectmen shall hold regular meet- ings at the Town Offices at least once each week.


Section 3. Beginning with the year 1948, and every five years thereafter, the Selectmen shall cause to be printed in the Annual Report for that year, a complete list of both real and personal property, other than motor vehicles, taxed during the year covered by said annual town report, together with its valuation as determined by the Assessors, and. also a list of those persons subject to a poll tax.


Section 4. The Selectmen may institute, prosecute, defend, compromise and settle claims, actions, suits, or other proceedings brought by, in behalf of, or against the Town, provided, however, that they shall act on advice of counsel when the amount to be paid exceeds one hundred (100) dollars, and they may employ counsel in suits by or against the Town, and also whenever they deem it advisable.


Section 5. The Selectmen may appear (either per- sonally or by counsel) before any committee of the

Legislature, or board, or commission, to protect the interests of the Town, but are not authorized by this by-law to commit the Town to any course of action.


Section 6. All officers and committees of the Town shall file their annual reports with the Selectmen on or before January 15th of the following year.


Section 7. For the purpose of making an accurate estimate of the Summer population, the Selectmen shall cause to be made, beginning in the year 1950, and every five years thereafter, a numerical census of the population of the Town, said census to be made after July 10th, and not later than July 25th.


Section 8. Whenever any land held by the Town is to be sold, the department making the sale, shall send by registered mail a notice of the time and place of such sale to each abutter as shown by the Assessors' records, seven days at least before such sale.


ARTICLE 4.


Town Clerk


Section 1. The Town Clerk shall furnish all boards, committees, and officers, with a copy of all votes af- fecting them.


Section 2. The Town Clerk shall see that every conveyance to the Town, or by the Town, of any in- terest in land is properly recorded in the Registry of Deeds, and shall keep a true copy in a book to be kept for that purpose alone, of all deeds and conveyances executed by the Selectmen, and shall keep on file all deeds delivered to the Town.

ARTICLE 5.


Financial


Section 1. The Selectmen may, without further au- thorization from the Town, sell at public auction prop- erty taken by the Town under tax title procedure, other than property taken under the provisions of Section 79, Chapter 60, of the General Laws, after first giving notice of the time and place of such sale by posting notice thereof in some convenient and public place in the Town fourteen days at least before such sale, and provided further that the Selectmen, or whomsoever they may authorize to hold such public auction, may reject any bid which they may deem inadequate.


Section 2. That a bounty of fifteen (.15) cents be paid by the Treasurer of the Town for each crow killed in the Town.


Section 3. That all collectors and junk dealers shall pay the sum of fifteen ($15.) dollars for annual li- censes; licenses to run from May 1st of each year.


ARTICLE 6. Finance Committee


Section 1. A finance committee of nine qualified voters of the Town, who shall hold no other town office, shall be appointed by the Moderator, three members for three years, three members for two years, and three members for one year, and thereafter three members for a term of three years. The committee to consider all municipal questions of finance, for the purpose of making reports and recommendations to the Town in accordance with Article 16, Chapter 39 of the General Laws.

Section 2. The appointments under the preceding section shall be made during April of each year to be effective upon the first day of May following.


Section 3. Whenever a vacancy shall occur in said committee, by resignation, or otherwise, said vacancy shall be filled by the Moderator. A successor shall fill out the unexpired term of the member whose office has been vacated.


Section 4. The Selectmen, before publishing a war- rant for a Town Meeting, shall transmit a copy thereof to the chairman of the finance committee, and such committee shall hear all citizens known to it to be in- terested in any article of the warrant, and shall con- fer or consult with such departments, officers, commit- tees or employees as may have information concerning the subject matter of the articles in the warrant, fol- lowing which, the Committee shall return the warrant to the Selectmen together with their recommendations thereto which shall be included with a copy of the warrant when published for distribution.


ARTICLE 7. Town Counsel


Section 1. No town department or official shall re- quest the services of Town Counsel, as such, without first obtaining the consent and approval of the Board of Selectmen.


ARTICLE 8. Town Landings


Section 1. No portion of any town landing shall be leased to any private party and no building shall be

erected or maintained on any town landing except it be by the Town and for public use.


ARTICLE 9.


Traffic Rules and Orders


Section 1. Regulations of September 9, 1935, and approved by W. F. Callahan, Commissioner, Depart- ment of Public Works, are made a part of these by- laws.


ARTICLE 10.


Protective By-Law of the town of Duxbury


Section 1. By-Law as published under separate cover in 1944 and approved April 26, 1944 by Robert T. Bushnell, Attorney General, is made a part of these by-laws.

Under Article 3, it was voted that the meeting re- solve itself into a committee of the Whole, and chose Mr. Harry B. Bradley, Chairman and Miss Isabelle Freeman, Secretary. After a lengthy discussion of the subject, with explanations of the plans by Mr. Douglas Orr, Architect, it was voted that the Town accept Plan I as the plan to be used for the new elementary school building and that the sum of fifty seven hundred ($5700.00) dollars be appropriated from availble funds to be used to procure complete working plans and spec- ifications and that the elementary school building com- mittee be authorized to obtain bids from various con- tractors so that a definite figure may be presented to the voters in March 1948, and that the Moderator be authorized to fill any vacancies that may occur on the building committee. (Yes 194-No 66)


A vote of thanks was extended to the Moderator for his gracious, courteous and efficient conduct of the meeting.


At 10:45 o'clock P. M. voted to adjourn.

REPORT OF TOWN ACCOUNTANT


I am pleased to submit the following statement of all receipts and expenditures of the Town of Duxbury for the financial year ending December 31, 1947, in accord- ance with Chapter 41, Section 61, General Laws.


An increase in the number of bills paid by the town, the requirements of the newly established retirement system, and State participation in Veterans' Benefits, have placed an unusually heavy burden on this office. Therefore, I am taking the liberty of submitting an ab- breviated form of report, and hope that it will meet with general approval.


This abbreviated form is arranged in accordance with the classifications prescribed by the Director of Accounts and is actually a recapitulation of the totals in the classi- fication book which is subject to State audit, and which is, of course, open to inspection by the public at all rea- sonable hours.


It is my hope that the tax payers will consider this substantially shorter form of report a desirable economy.
