Mr. Rice moved: In consideration of one ($1.00) dollar and other valuable considerations, to abandon any right which the Town may have acquired by an Order of Taking of the Sewer Commissioners in 1931 to raise the grade of the sewer line or mains as they cross the property then belonging to Philip H. Sulli- van on Allen Street, East Braintree, above the present existing grade of the syphon arrangement now lo- cated on the premises. Not a vote-10:42.

GRAVEL SUPPLY: Mr. George A. Walker gave the following report:


Reportof Committee appointed by vote of the Town under Article 45 at Annual Meeting, March 1936.


At the Annual Town Meeting held in March, 1936, under Article 45, it was


Voted-That a Committee of three be appointed by the Moderator to investigate the leas- ing or purchasing of land for the use of the Highway Department, this committee to report at the next Annual Town Meeting. :


The Moderator appointed on that committee, J. W. Parker, Ernest G. Smith, George A. Walker. The Committee respectfully reports, -


That the leasing or purchasing of land for the use of the Highway Department is not necessary at this time.


That a parcel of land already standing in the name of the Town of Braintree has been found to contain sand, gravel, and suitable road building material.


That the Superintendent of the Highway Depart- ment has examined the property and it meets with

his approval.


That a sum of money should be appropriated for the use of the Highway Department for the purpose of moving their equipment to land referred to and for work on road to the property.


That land referred to is under the jurisdiction of the Boad of Water Commissioners.


That the Board of Water Commissioners have no objection to use of it by the Highway Department.

Mr.Rice commended the committee, stating that tney examined eleven properties in the Town and found a source of gravel supply without costing the Town any money to obtain land and the present prom- ise of that land would indicate that there might be 25 years gravel supply there.


Voted: That the Town use as a gravel pit the property now standing in the name of the Town and specified in the report of the committee of three ap- pointed by the Moderator in accordance with the vote under Article 45 at the 1936 Annual Town Meeting, and that the sum of $1,500.00 be appropriated for re- moving the Town's gravel plants to the pit location and for improving and constructing a way to same.

The Committee appointed by the Moderator under vote passed under Article 48 of the 1936 Annual Town Meeting submitted the following report:


The question before this Committee is to suggest a method of disposal of the property owned by the Town which has been taken under foreclosure of tax title.


The matter has been given careful consideration and discussed with the State Tax authorities.


It would seem that the Board of Selectmen is the proper Town body to be authorized to dispose of such

property. This authority can be given in one of two ways:


FIRST-by an amendment to the Town By-laws.


SECOND-by vote of the citizens passed at each Annual Town Meeting.


We do not recommend the adoption of the first method, but do recommend the latter suggestion, namely, that at each Annual Town Meeting a vote be passed to authorize the Selectment to sell under the provisions of a motion which is submitted herewith.

Mr. Ewart moved: That the Selectmen be and are hereby authorized to sell property, title to which has been acquired by the town under tax title procedure and land which has been acquired at sales of low value land, either at public or private sale upon the following conditions :


(1) There shall be no such private sale unless the price realized shall be at least equivalent to the orig- inal tax for which the property was sold plus the in- tervening taxes, interest, and costs including fore- closure costs.


(2) Any sale at public auction must be pursuant to a notice of such sale published in one or more news- papers published in the Town at least one week before the date of said sale.


Mr. Ellsworth moved: Indefinite postponement. Not a vote.

Mr. Ira Young offered the following amendment: That all reference to private sale be eliminated from the motion. So voted.

Mr. Foley offered the following Resolution :


RESOLVED :


That the American way shall be made permanent in Braintree, that the Braintree Town Employees as an association has been consulted in the making of its budget and arrangement relative to wages and con- ditions, and that it is the sense of this meeting that this be recognized.


The principle of collective bargaining having been established that we go further by giving recognition to the system of seniority rating for the further pro- tection of our employees.


That these facts be submitted to the Commissioner of Civil Service and to his Excellency the Governor that he may issue an executive order so placing our employees under the protection of our Commonwealth.


This is necessary that the principle of social se- curity will become a fact.

Mr. Kelly moved: That Section 2 of Article 1 of the Code of By-laws of the Town of Braintree be hereby amended under the terms of Section 1 of Ar-

Section 2. The polls shall be opened not later than 6 o'clock in the morning and shall not close earlier than 6 P. M.

approximate cost thereof, including site and cost of incidentals, and shall report its recommendations and findings to the next Annual Town Meeting to be held in 1938.


Mr. Colbert offered the followed amendment: That the same consideration be given the Veterans of the War with Spain-1898. So voted.

Fox. So voted-10:50.
