ARTICLE 56. To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money for the purpose of chlori- nating that portion of Sunset Lake comprising the bathing area during the summer of 1949 and designate the Department which shall be responsible for the expenditure of such appropriation, or take any action relative thereto.


Voted: That there be raised and appropriated the sum of $1,700.00, to be expended under the direction of the Water Department, for the pur- pose of. chlorinating that portion of Sunset Lake comprising the bathing area during the summer of 1949.


ARTICLE 57. ON PETITION. To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money to con- struct and maintain during the current year, toilet facilities at "Swift's Beach", or take any action relative thereto.


Voted: That a committee of three be appointed by the Moderator for the purpose of investigating toilet facilities at Swift's Beach and report back not later than next Annual Town Meeting.


ARTICLE 58. To see if the Town will vote to raise and appropriate the sum of $50,000 for the acquisition of land and for the construction thereon of a public airport, and to authorize the Airport Commission to select and acquire for such purposes a suitable airport site, using condem- nation proceedings therefor if necessary .- No action.


ARTICLE 59. To see if the Town will vote to hereby authorize the Airport Commission to apply to the Civil Aeronautics Administration for Federal funds to aid in financing the construction of a public airport and to execute any and all requests, applications, grant agreements, sponsor's assurance agreements, and other instruments necessary to obtain, accept and expend such Federal Funds .- No action.


ARTICLE 60. To see if the Town will vote to hereby authorize the Airport Commission, within the dollar limitations set out above, plus Fed- eral and State funds to enter into, 'execute and deliver on behalf of the Town any and all contracts and agreements with architects, engineers, con- tractors or other persons, together with other instruments or certificates,

necessary or desirable for the construction of said airport, hereby ratifying all action in this matter thus far taken .- No action.


ARTICLE 61. To see if the Town will vote to raise and appropriate or transfer from available funds a sum of money to feed and water the large oak tree in the circle of Washington Park Road, or take any action relative thereto.

ARTICLE 62. ON PETITION. To see if the Town will vote to establish a board of five selectmen, each member serving for a term of three years; the said board to be established in the following manner: by the election in 1950 of three members to serve together with the current unexpired terms; the one receiving the highest vote being elected for three years; the next highest two years and the third highest one year, and there- after the election of members to fill the terms currently expiring for three years each .- No action.


ARTICLE 63. ON PETITION. To see if the Town will vote to appoint a committee to examine and report to the next annual meeting its findings as to the location of the boundary line between the City of Quincy and the Town of Braintree, and appropriate a sum of money for the use of said Committee .- No action.


ARTICLE 64. ON PETITION. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $1,000.00 to be expended by the Airport Commission for improvements to existing air strip, or take any action relative thereto.


Voted: That $1,000.00 be raised and appropriated for the develop- ment of the Braintree Airport, so-called, said sum to be spent under the direction of the Braintree Airport Commission.


ARTICLE 65. To see what sums the Town will vote to raise and appropriate or transfer from available funds to enable the members of the Municipal Retirement System to be covered by Group Life Insurance, as defined in Section 133 of Chapter 175 of the General Laws as most recently amended by Chapter 346 of the Acts of 1946, or take any action relative thereto .- No action.


ARTICLE 66. To see if the Town will vote to use all or part of the Post-War Rehabilitation Fund established under the authority of Section 1 of Chapter 5 of the Acts of 1943 to meet appropriations voted under any of the articles of this warrant for any purpose permitted by said Chapter 5. -No action necessary.


ARTICLE 67. To see if the Town will vote to instruct the Selectmen to petition the County Commissioners for the discontinuance of North Street · between its northerly terminus near the Quincy line on the easterly side of Granite Street and Rockdale Street, so-called, or take any action relative thereto.


Voted: That the Selectmen be instructed to petition the County Com- missioners for the discontinuance of North Street between its northerly ter- minus near the Quincy line on the easterly side of Granite Street and Rockdale Street, so-called.

ARTICLE 68. To see what disposition the Town will vote to make of the income of the Thayer Fund .- No action necessary.


ARTICLE 69. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds to meet the payment of certain bills contracted prior to January 1, 1949, or take any action rela- tive thereto. .


Unanimously voted: That there be raised and appropriated the sum of $1,347.05 for the payment of bills unpaid prior to January 1, 1949, as follows: Infirmary $78.00; Highway-Street Lighting $1,183.05; Tree Warden (1947) $86.00.


ARTICLE 70. To determine what amount, if any, of the balance in the Electric Light Operation account at the close of the year 1948 or what amount in the Construction account if the Operation balance has been closed, shall be paid into the general funds of the Town, and what disposi- tion shall be made of the amount so paid. (Taken up in conjunction with Article 7, Item 35.)


ARTICLE 71. To see what sums of money, in addition to that appro- priated under any other article the Town will vote to raise or borrow and appropriate for Land Damages.


Voted: That there be raised and appropriated the sum of $475.00 for Land Damages.


Special Town Meeting


IN CONJUNCTION WITH ANNUAL TOWN MEETING


ARTICLE 1. To see if the Town will vote to raise or borrow and appropriate or transfer from available funds any sum or sums of money, to be expended by the Board of Sewer Commissioners, for the construction of sewers for sanitary purposes, or take any action relative thereto.


Voted: That there be raised and appropriated the sum of $145,000.00 for the construction of additional sewers for sanitary purposes under the direction of the Sewer Commissioners, and that to meet said appropriation the sum of $40,912.54 shall be taken from the Stabilization Fund, the sum of $4,622.43 from Sale of Real Estate Funds, and the sum of $49,465.03 shall be included in the tax levy of the current year and that the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $50,000.00 and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than 10 years from the date of issue of the first bond or note, or at such earlier time as the Treasurer and Selectmen may determine.


ARTICLE 2. To see if the Town will vote to change the zoning from Residential B to Business for the following described parcel of land; the

plot of land at the junction of Hancock and Washington Streets in South Braintree beginning at the southerly corner of the said junction and going southerly for a distance of approximately 25 feet; then southwesterly along the property line of plot No. 1 as shown on Assessors' map No. 1046, which map is on file at the Office of the Assessors, Town Hall, South Braintree, and there available for inspection, for a distance of approximately 150 feet; then northwesterly across said plot approximately 55 feet; then northeasterly along Washington Street to the point of beginning for a distance of approxi- mately 150 feet, to include all the land in the foregoing described area .- No action.


ARTICLE 3. To see what action the Town will take relative to the erection of a permanent stadium to be built with toilet facilities on Hollis Field, Braintree; determine how the money shall be provided for, by bor- rowing, by appropriation from available funds in the Treasury, by appro- priation from the Post-War Rehabilitation Fund, by appropriation from the Hollingsworth Fund, and/or from the Stabilization Fund, or take any action relative thereto .- No action.

Special Town Meeting


July 18, 1949


ARTICLE 1. To see if the Town will vote to appropriate a sum of money by transferring the same from available funds or otherwise providing therefor for the purpose of erecting a chain link fence around the Town property at Sunset Lake in order to restrict the use of the bathing facilities to residents of Braintree .- No action.


ARTICLE 2. ON PETITION. To see what sums the Town will vote to raise and appropriate or transfer from available funds for the purpose of granting an additional 5% wage adjustment to those Town Employees who were granted a 5% wage adjustment by the March 1949 Town Meeting. This additional adjustment to be retroactive to January 1, 1949 .- No action.


ARTICLE 3. To see what sums of money the Town will appropriate, transfer from available funds or otherwise provide for the purchase of new heating equipment for the Town Hall, or take any action relative thereto.


Voted: That the sum of $5,000.00 be appropriated for the purchase of new heating equipment for the Town Hall, said sum to be raised from available funds in the treasury.


ARTICLE 4. To see what sums of money the Town will vote to appropriate, transfer from available funds or otherwise provide for addi- tional salaries in the Police Department .- No action.

ARTICLE 5. To see what sums of money the Town will vote to appropriate, transfer from available funds including the Reserve Ambulance Account, so-called, or otherwise provide for the purchase of a new ambu- lance for the Police Department, or take any action relative thereto .- No action.


ARTICLE 6. To see if the Town will vote to amend Article X-A of the "Revised By-Laws of the Town of Braintree, Massachusetts 1940", which Article was duly inserted therein after the original adoption of said By-Laws, by adding after the word premises the following: "Except that the transfer of an existing license may be granted within said 500 feet limit provided the location or premises to which the transfer is to be made is not less than the distance between the existing location and the nearest church or school premises." So that said Article if so amended will read as fol- lows: "No license in any form other than a renewal shall be granted by the Selectmen or Licensing Board for the sale of alcoholic beverages at any location within the Town within 500 feet of any church or school premises, except that the transfer of an existing license may be granted within said 500 feet limit provided the location or premises to which the transfer is to be made is not less than the distance between the existing location and the nearest church or school premises."-No action.


ARTICLE 7. To see what sums of money the Town will appropriate, transfer from available funds or otherwise provide for the salary or other remuneration for the personal services of the Tree Warden and for the expenses of the Tree Warden's Department, including the purchase of equip- ment, or take any action relative thereto.


Voted: That the Town appropriate $1800.00 for the salary of the Tree Warden to be retroactive as of March 1, 1949, said sum to be raised from a transfer of available funds in the Treasury.


ARTICLE 8. To see if the Town will vote to accept as and for a Town Way, Glenrose Avenue, as laid out by the Selectmen, from Vinedale Road, 360 feet in an easterly direction, and to appropriate $3,087.00 by transfer from available funds or otherwise providing therefor for the im- provement of said way, or take any action relative thereto.


Unanimously voted: That Glenrose Avenue from Vinedale Road 360 feet in an easterly direction, as laid out by the Selectmen, be accepted as and for a town way, and that the sum of $3,087.00 be appropriated for the improvement of same; said sum to be raised by transferring $1110.15 from the "Material" account of Item 29, Article 7, as voted at the Annual Town Meeting in March 1949; and that the transferring of $1976.85 from the ac- count "Other Wages, including Snow Removal and Dump," as voted in Item 29, Article 7 of said Town Meeting, and that betterments be assessed to the extent of 66 2/3% of the cost of said improvements.


ARTICLE 9. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the purchase or taking of drainage easements and the construction of drains in and through lands opposite the Jonas Perkins School on or off Commercial Street; lands on or off Conrad Street and lands on or off Union Street or take any other action relative to drainage easements in either or all of said localities.

Unanimously voted: For the purchase or taking of drainage easements and the construction of drains in and through lands opposite the Jonas Perkins School, on or off Commercial Street, and that the sum of $901.00 for the purpose of acquiring said easements and construction of drains, and that said sum be transferred from available funds in the treasury.


Unanimously voted: For the purchase or taking of drainage easements and the construction of drains on or off Conrad Street, and that the sum of $350.00 for the purpose of acquiring said easements and construction of drains, and that said sum be transferred from available funds in the treasury.


Voted: No action for the purchase or taking of drainage easements on or off Union Street.


ARTICLE 10. To see what sums of money the Town will vote to ap- propriate, transfer from available funds or otherwise provide for the pur- chase or taking by eminent domain of land for the purpose of a town dump off Union Street to the south, contiguous to that already owned by the Town and said to belong to George A. Arnold .- No action.


ARTICLE 11. To see if the Town will vote to authorize and empower the Selectmen to convey to John A. and Richard H. Wilken a triangular strip of land bounded Northerly by Union Street, ten and 01/100 (10.01) feet; Easterly by a stone wall marking the present Westerly boundary of land of said John A. and Richard H. Wilken about five hundred fifty (550) feet; and Westerly by land of the Town of Braintree about five hundred fifty . (550) feet obtaining in return therefor the conveyance of an easement for drainage purposes over and through about five hundred and fifty (550) square feet of land being the rear portion of their present premises.


Unanimously voted: That the Town authorize and empower the Select- men to convey to Richard H. Wilken a triangular strip of land bounded northerly by Union Street 10 feet; easterly by a stone wall marking the westerly boundary of land of Richard H. Wilkin 213.30 feet; and westerly by land of the Town of Braintree 220 feet more or less obtaining in return therefor the conveyance of an easement for drainage purposes over and through about 1174 square feet of land being the rear portion of the land of said Wilken. All is shown on plan entitled "Town of Braintree, Plan Show- ing Proposed Drainage Easement and Land to be conveyed by the Town of Braintree to Richard H. Wilken" dated July 1949, John J. Drinkwater, Town Engineer.


ARTICLE 12. To see if the Town will authorize the sale or exchange of land on Liberty Street being Plots 6 and 6-A on Assessors' Plan 1083 containing about 3,500 and 5,500 square feet of land respectively and the sale or exchange of the Town's land on the Easterly side of said Liberty Street formerly used as the Town gravel pit and rock quarry or any of said lands and by vote establish the consideration therefor, or take any action relative thereto .- No action.


ARTICLE 13. To see if the Town will vote to accept Elliot Street from Birchcroft Road to the end of the layout just north of Stetson Street as shown on plan entitled, "Town of Braintree, Plan Showing Widening of a Portion of Elliot St., John J. Drinkwater, Town Engineer", dated Decem- ber 1948, as laid out by the Selectmen and authorize the Selectmen, in the

name of the Town, to take by eminent domain such land as may be re- quired in connection with said acceptance and transfer to and for the pur- pose the sum of $937.50 appropriated as Item 29 of Article 7 at the Annual Town Meeting of this year .- Unanimously voted.


ARTICLE 14. To see what sums the Town will vote to raise and appropriate or transfer from available funds or otherwise provide such sums to enable the members of the Municipal Retirement System to be covered by · Group Life Insurance, as defined in Section 133 of Chapter 175 of the Gen- eral Laws, as most recently amended by Chapter 346 of the Acts of 1946, or : take any action relative thereto .- No action.


ARTICLE 15. Whiton arising out of the taking of certain land on the South side of Allen Street for the purposes of the Municipal Light Plant or for the payment of any judgment arising out of said claim.


Voted: That the Town appropriate $19,199.96 for the settlement of the judgment of Joseph L. Whiton, arising out of the taking of certain land on the south side of Allen Street, for the purpose of the Municipal Light Plant, and that the sum be raised by transferring $5500.00 from the reserve for enlargement, which was appropriated at the Special Town Meeting June 24, 1946, under Article V, and that the balance of $13,699.96 be raised from the current income of the Municipal Light Plant.


ARTICLE 16. To see what sums of money the Town will vote to appropriate, transfer from available funds or otherwise provide for the pur- chase or taking by eminent domain for school purposes of land off Com- mercial Street shown on Assessors' Plan 3064, substantially bounded and described as follows: Northwesterly by Plot 7 as shown on said plan; Northeasterly by a part of Plot 6 as shown on said plan; Northeasterly again by a part of said Plot 6; Easterly by Plot 5 and a part of Plot 1 as shown on said plan; Southeasterly by a part of Plot 3 as shown on said plan; Southwesterly by Plot 38 as shown on said plan and by a portion of . Braeview Road; Southeasterly again by a part of Plot 19 as shown on said plan and Southwesterly again by Plots 18, 17, 40, 16, 15, 14 and 13 as shown on said plan in addition to the above described land the fee and soil of said Braeview Road extending from said land to Commercial Street but leaving that portion of said Braeview Road subject to the existing rights of way of the owners of Plots 18, 38 and 39 as shown on said plan, said premises are also a part of those appearing on Land Court Plan 10287-D filed with Certificate of Title No. 25854 Registry District of Norfolk County, or pro- vide for such purchase or taking by eminent domain of any other land shown on said Plan 3064 or said Plan 10287-D or any rights therein or of any other land in the vicinity, or take any action relative thereto.


Voted: That the Town authorize, empower and direct the Selectmen to purchase or take by eminent domain for school purposes the land in that part of Braintree known as East Braintree bounded and described as fol- . lows: Southerly by Hayward Street 347 feet; Westerly by lands now or formerly of Mary G. Preston, Bessie Swinimer and of others unknown in part by a stone wall 465 feet; northerly by Lot B as shown on plan herein-

after referred to and by land now or formerly of Katherine M. Coughlan et al 400 feet more or less; and Easterly by land now or formerly of Bertha A. Williams 453 feet more or less. Being Lot A on "Plan of Land in Braintree, Massachusetts", dated May 29, 1944, John J. Drinkwater, Civil Engineer, which plan was filed in Norfolk Deed Book 2503, Page 400, and contains according to said plan about 3.85 acres of land, and that there be appropriated for said purchase or taking and expenses incident thereto the sum of $250.00. The same to be raised by transfer from available funds in the Treasury.


ARTICLE 17. To see what sums of money the Town will vote to appropriate, transfer from available funds or otherwise provide for the Set- tlement of Claims.


Voted: That the town appropriate the sum of $960.00 for the settle- ment of claims, and that this sum be transferred from available funds in the treasury.


Special Town Meeting


December 19, 1949


ARTICLE 1. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the purchase or taking by eminent domain for school purposes of land, with the buildings thereon, on Commercial Street in that part of Braintree known as East Braintree, being Plot 3 on Assessors' Plan 3064 of the Town of Braintree, and land at the corner of said Commercial Street and Hayward Street, being Plot 2 on said plan, or either of said plots or for the purchase or taking of any other land in the vicinity of said plots for said purposes.


Voted: That there be raised and appropriated the sum of $25,047.00 for the purchase or taking by eminent domain, for school purposes, of the land with the buildings thereon in that part of Braintree commonly called East Braintree, being Plots 2 and 3 on Assessors' Plan of the Town of Braintree No. 3064.


ARTICLE 2. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the purchase or taking by eminent domain for school purposes of land being Lot B on "Plan of Land in Braintree, Mass.", dated May 29, 1944, John J. Drinkwater, Civil Engineer, filed with Norfolk Deeds, Book 2503, Page 400, bounded and described as follows: Northwesterly by Lot C as shown on said plan one hundred seventy-seven (177) feet, more or less; Northeasterly by land now or formerly of Agnes G. Coughlin et al three hundred ten (310) feet, more or less; Southerly by Lot A as shown on said plan one hundred eighty-four (184) feet, more or less; and Southwesterly by a portion of the land de- scribed in Certificate of Title No. 102870 filed with the Norfolk County Land Registration Office. ARTICLE 4. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the Contagious Dis- eases Account of the Board of Health, or take any action relative thereto .- No action.


ARTICLE 5. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for compensation for such special counsel as may be appointed by the Selectmen to act for the Board of Health, or take any action relative thereto.


Voted: To transfer from available funds the sum of $1,000.00 for compensation for special counsel as may be appointed by the Selectmen to assist the Town Counsel in the case of the Braintree Board of Health vs .. John L. Ray Oil Company, Norfolk Superior Court Equity No. 46233.


ARTICLE 6. To see if the Town will take such action as may be deemed proper to ratify the action of the Selectmen in requesting the re- linquishment and transfer of the Federal Government's rights in the "Union Village" Project, so-called, and in approving the waiver of removal provi- sions as contained in Section 313 of the Lanham Act, so-called.
