WARRANT FOR SPECIAL TOWN MEETING


At Upper Town Hall, Chelmsford Centre, Wednesday Evening, June 6, 1928 COMMONWEALTH OF MASSACHUSETTS


Middelsex, ss .:


To John E. Johnson, a constable of the Town of Chelmsford.


GREETING :


In the name of the Commonwealth aforesaid you are hereby re- quired to notify and warn the legal voters of said Chelmsford to meet in the upper Town Hall, at Chelmsford Centre on Wednesday, the sixth day of June current at seven thirty (7.30) in the evening, then and there to act upon the following articles, viz .:


ARTICLE 1. To see if the Town will vote to hear at this meeting the report of the Committee appointed pursuant to vote taken under Article 24 at the Annual Town Meeting, February 13, 1928. Said vote was as follows, "Voted that a committee of three be appointed by the Moderator to investigate the advisability of accepting the lot of land offered by Dr. F. E. Varney at North Chelmsford for playground or recreational purposes, this committee to report its

recommendation at the next Annual Town Meeting." The com- mittee appointed by the Moderaor is Stuart Mackay, John J. Mona- han and James A. Grant; or act in relation thereto.


ARTICLE 2. To see if the Town will vote to accept from Fred E. Var- ney, M. D., the gift of a certain lot of land, to wit: lots numbered 147, 166 and 136 on a plan of land entitled, "Plan of land in North Chelmsford, Mass., belonging to Thomas J. Adams Estate and Charles W. S. Adams, scale 100 feet to an inch, surveyed July and September, 1892, by Melvin B. Smith and Brooks Co., C. E., and additions to August, 1919." Recorded with the Middlesex North District Registry of Deeds, Book of Plans 44, Plate 17; subject to the express reservation and condition that said land is to be for- ever kept open as land for a public playground or recreation cen- ter under the provisions of Chapter 45, Section 14, of the General Laws, and that such playground be named and known as, "The Varney Playground," or act in relation thereto.


ARTICLE 3. To see if the Town will vote to raise and appropriate the sum of Six Thousand Dollars ($6000) or some other sum for the following purposes: to construct new sidewalks, grading, grass- ing and improving the common at Chelmsford Centre, in general; or act in relation thereto.


ARTICLE 4. To see if the Town will vote to raise and appropriate the sum of Six Thousand Dollars ($6000) or some other sum for the purposes of purchasing for playground purposes a lot of land now called "Silesia Park" at North Chelmsford, described as fol- lows: bounded on the northwest side of land owned by the Mor- ten Real Estate Trust, and the Southwell Wool Combing Company ; on the southeast by a "Deep Brook," so-called; and on the north- east by the Merrimack River. Being a triangle lot of land con- taining about twelve acres of land more or less, including the buildings thereon, and being part of lot five as shown on a plan of land in North Chelmsford belonging to the United States Worsted Corporation scale 100 feet to an nch, surveyed by Brooks, Jordan and Graves, C. E., Lowell, Mass., April, 1928; or act in relation thereto.


ARTICLE 5. To see if the Town will vote to sell by public auction, or otherwise the building, with the contents therein situated on the land purchased from Hildreth P. Dutton on the easterly side of the North Road, so-called, and known as the Old Grammar School Building, and appropriate the sum of One Hundred Dol- lars ($100) or some other sum, for the expense of said sale. The supervision of said sale to be under the jurisdiction of the Board of Selectmen; or act in relation thereto.


ARTICLE 6. To see if the Town will vote to raise or appropriate the sum of Forty Dollars ($40) to pay for the premium of the bond of the Treasurer of the Insurance Fund Commissioner; or act in rela - tion thereto.


ARTICLE 7. To see if the Town will vote to raise and appropriate the sum of Three Hundred and Thirty Dollars ($330) for the purpose of repairing the buildings at, the Town Infirmary or act in relation thereto.


ARTICLE 8. To see if the Town will vote to raise and appropriate the sum of Thirty-three Hundred Dollars ($3300) or some other sum for the purpose of repairing the North Road, so-called. Two- thirds of the expense of said repair to be borne equally by the Commonwealth and the County of Middlesex; or act in relation thereto.

ARTICLE 9. To see if the Town will authorize the Selectmen to con- tract with the Lowell Electric Light Corporation for the installation of four additional lights on the Acton Road; or act in relation thereto.


ARTICLE 10. To see if the Town will vote to raise and appropriate the sum of One Thousand Dollars ($1000) or some other sum for the purpose of purchasing fire hose for the fire department; or act in relation thereto.


ARTICLE 11. To see if the Town will vote to accept from Frank W. Sadler of Newton, Massachusetts, the gift of a strip of land on the southerly side of Mallock Road in Chelmsford and being lot numbered 214 on plan of land entitled "Fairacres, Chelmsford, Massachusetts owned by Frank W. Sadler," and recorded in the Middlesex North District Registry of Deeds, Book of Flans 37, Plate 40; or act in relation thereto.


ARTICLE 12. To see if the Town will vote to raise and appropriate the sum of One Hundred and Seventy-eight Dollars and Thirty- nine cents ($178.39) with which to meet unpaid bills of 1927: or act in relation thereto.


ARTICLE 13. To see if the Town will vote to raise or appropriate One Hundred Sixty Dollars $160) with which to pay land damages arising out of the relocation of the Billerica and Russell Mill Roads; or act in relation thereto.


ARTICLE 14. To see if the Town will vote to accept and allow Mana- han Street as laid out by the Selectmen as shown by their report duly filed in the office of the Town Clerk; or act in relation thereto.


ARTICLE 15. To see if the Town will vote to accept and allow Man- ning Road as described and laid out by the Selectmen as shown by their report duly filed in the office of the Town Clerk: or act in relation thereto.


,ARTICLE 16. In event of a negative vote under Article 15, to see if the Town will vote to accept and allow a portion of Manning Road as shown by their report duly filed in the office of the Town Clerk; or act in relation thereto.


ARTICLE 17. To see if the Town will vote to discontinue a portion of the public or Town way opposite the property of William H. and Fred G. Baldwin, now or formerly, on the Manning Road: or act in relation thereto.


And you are Directed to serve this Warrant by posting attested copies thereof at the Post Offices in the Centre of the Town, South Chelmsford, North Chelmsford and West Chelmsford, and at the school House, East Chelmsford and at the Golden Cove School House. West- lands, seven days at least before the time appointed for holding the meeting aforesaid.


Hereof Fail Not, and make return of this Warrant with your doings thereon, to the Town Clerk, at the time and place of holding the meeting aforesaid.

BUSINESS TRANSACTED AT SPECIAL TOWN MEETING June 6, 1928


At a legal meeting of the Inhabitants of the Town of Chelmsford, qualified to vote in Town Affairs, held pursuant to Warrant duly posted, at the Upper Town Hall, Chelmsford Centre, Wednesday Evening, June 6, 1928 at 7.30 p. m. the following business was transacted, to wit:


The meeting was called to order by Moderator Walter Perham and on a motion made by Selectmen George Rigby it was voted to waive the reading of the Warrant by Town Clerk Harold C. Petterson.


lnler Article 1. On a motion made by George E. Gagnon it was voted to hear the report of the committee appointed at the Town Meet- ing, February 13, 1928, to investigate the advisability of accepting the lots of land offered to the Town by Fred E. Varney, M. D. and more particularly described in deed offered to the Town by said Fred E. Var- ney M. D.


Stewart Mackay reported for this committee and stated that the committee had very carefully investigated the land in question that the land was adjacent to the land already accepted from Fred E. Varney as playgorund, and that it would mean a considerable im- provement to accept this plot offered as there was a considerable area that was fairly level and could be used for tennis courts and that plans were at present under way for the construction of the same. Mr. Mackay closed by stating that the committee's report was favorable toward the acceptance.


It was voted to accept this report and place the same on file.


Under Article 2. On a motion made by John T. Crowley it was voted to accept from Fred E. Varney, M. D., the gift of certain lots of land in North Chelmsford and more particularly described in a deed offered to the Town by the said Fred E. Varney and which will be recorded in the Middlesex North District Registry of Deeds.


Under Article 3. On a motion made by Mr. Roy Clough, it was voted that the sum of $6000,00 be appropriated from the Excess and Deficiency account for the purpose of improving the "Common at Chelmsford Centre" according to plan submitted by Warren Manning with minor changes as the committee may suggest for further im- provement, the money to be expended by the same committee which had charge of procuring above mentioned plan.


Under Article 4. On a motion made by Dr. F. E. Varney it was voted, that the Town purchase from the United States Worsted Co. of Boston a certain tract of land situated in North Chelmsford. and called "Silesia Park." which is bounded on the Northwest by


land of the Morten Real Estate Trust and the Southwell Wool Combing Company now or formerly, on the Southwest by a "Deep Brook." so-called; and on the Northeast by the Merrimack River. Being a triangular lot of land containing about twelve acres of land more or less, including the buildings, bridges and all other appurtenances be- longing thereto. That the purchase shall be under the supervision of the Board of Selectmen who shall have full power to make said nego- tiations, adjustments and determine where the right of way shall be

and all other powers necessary to effect the consummation of said pur- chase. That the sum of Six Thousand and Fifty Dollars be appro- priated from the Excess and Deficiency Fund for said purchase and necessary expenses thereto.


Under Article 5. On a motion made by George W. Day, it was voted that the Selectmen be authorized and empowered to sell by pub- lic auction on or before June 28, 1928, the building and contents therein, now called the "Old Grammar School," situated on the land purchased from Hildreth P. Dutton on the easterly side of the North Road now so-called, and $100.00 be appropriated at this time for the expense of such sale, also that the Selectmen be instructed to enter into an agreement either by themselves or their agents with the pur- chaser of said building that all material excepting the stone or granite be removed from the said premises on or before November 1, 1928 and that the purchaser be obliged to post a substantial sum of money as a forfeit for the fulfillment of such agreement.


Under Article 6. On a motion made by Selectman George Rigby, it was voted to raise and appropriate the sum of Forty Dollars ($40) to pay for the premiums of the bond of the Treasurer of the Insurance Fund Commission.


Under Article 7. On a motion made by Selectman Eliphalet G. Brown, it was voted to raise and appropriate the sum of Three Hun- dred and Thirty Dollars ($330) for the purpose of repairing the build- ings of the Town Infirmary.


Under Article 8. On a motion made by Selectman George Rigby, it was voted to raise and appropriate the sum of Thirty-three Hundred Dollars ($3300) for the purpose of repairing the North Road so-called, this amount being one-third of the cost thereof; the other two-thirds being shared by the County and Commonwealth equally.


Under Article 9. On a motion made by Selectman George Rigby, it was voted to authorize the Selectmen to contract with the Lowell Electric Light Corporation for the installation of four additional lights on the Acton Road.


Under Article 10. On a motion made by Selectmen George Rigby, it was voted to raise and appropriate the sum of One Thousand Dollars ($1000) for the purpose of purchasing fire hose for the fire depart- ment.


Under Article 11. On a motion made by Selectman George Righy, it was voted to accept the gift of a certain lot of land from Frank W. Sadler of Newton, Mass., on Manning Road, sometimes called Mallock Road. Said strip of land is more particularly described in a deed offered to said Town of Chelmsford and which will be recorded in the Middle- sex North District Registry of Deeds, in the event said gift is accepted.


At this time on a motion made by John C. Monahan, it was voted to reconsider Article 8 pertaining to the North Road so-called.


On a motion made by John C. Monahan it was voted to appropriate from the Overlay Reserve Account the sum of Thirty-three Hundred Dollars ($3300) for the purpose of repairing the North Road so-called, This amount being one-third of the cost thereof; the other two-thirds being shared by the County and Commonwealth equally.


Under Article '12. On a motion made by Selectman George Rigby, it was voted to raise and appropriate the sum of One Hundred and Seventy-eight Dollars and Thirty-nine cents ($178.39) with which to pay claims of 1927.


Under Article 13. On a motion made by Selectman George Rigby, it was voted to raise and appropriate the sum of One Hundred and

Sixty Dollars ($160) for the purpose of paying damages arising out of the relocation of the Billerica and Russell Mill Road. Said sum to be expended as follows: Seventy-five Dollars to Joseph LaBelle, Seventy- five Dollars to Edward R. Blood and Ten Dollars to Rosalfa Auger.


Under Article 14. On a motion made by Selectman George Rigby, it was voted to accept and allow Manahan Street as laid out by the Selectmen as shown by their report duly filed in the office of the Town Clerk.


Under Article 15. On a motion made by Selectman George Rigby, ti was voted to dismiss this Article pertaining to Manning Road so- called.


Under Article 16. On a motion made by Selectman George Rigby, it was voted to dismiss this Article pertaining to Manning Road so- out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article 17. On a motion made by Selectman George Rigby, it was voted to dismiss this Article pertaining to the discontinuance of a portion of the Manning Road so-called opposite the property of William H. and Fred G. Baldwin.


On a motion made by Selectman George Rigby, it was voted to adjourn this meeting at 9.45 p. m. WALTER PERHAM, Moderator.

Pursuant to the within Warrant, I have notified and warned the inhabitants of the Town of Chelmsford by posting up attested copies of the same at the post offices in the Centre of the Town, South Chelms- ford, North Chelmsford, West Chelmsford and at the School House at East Chelmsford, and at the Golden Cove School House at the Westlands seven days before the date hereof as within directed.
