The meeting was called to order at 7:40 P.M. by Moderator John C. Monahan, who requested the Town Clerk, Harold C. Petterson to read the Warrant. After the Warrant was partly read, on a motion made by Raymond H. Greenwood, it was voted to waive the further reading of the Warrant.


UNDER ARTICLE ONE. On a motion made by John Dusseault, it was voted to raise and appropriate the sum of $31.69 to meet unpaid bills for the year 1946, and also to raise and appropriate the sum of $1558.81 to meet unpaid bills for the year 1946, this required a 9/10 vote and 189 voted in the affirmative and no one voted in the negative.


UNDER ARTICLE TWO. On a motion made by Edwin Jewett, it was voted to accept a portion of the westerly side of Hornbeam Hill Road as laid out by the Selectmen and shown in their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE THREE. On a motion made by Edwin Jewett it was voted to raise and appropriate the sum of $500.00 for the pur- pose of reconstructing the westerly part of Hornbeam Hill Road.


UNDER ARTICLE FOUR. On a motion made by Raymond H. Greenwood, it was voted to accept Harvey Road, so-called, as laid out by the Selectmen and shown in their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE FIVE. On a motion made by Raymond H. Greenwood, it was voted to raise and appropriate the sum of $250.00 for the purpose of reconstructing Harvey Road.


UNDER ARTICLE SIX. In regard to the acceptance of Tower Road, on a motion made by Raymond H. Greenwood, it was voted to dismiss this article.


UNDER ARTICLE SEVEN. In regard to an appropriation for reconstructing Tower Road, on a motion made by Raymond H. Green- wood it was voted to dismiss this article.


UNDER ARTICLE EIGHT. On a motion by T. W. Emerson, it was voted to raise and appropriate the sum of $500.00 for the purpose of increasing the salaries of public building janitors.

UNDER ARTICLE NINE. On a motion made by John Dusseault it was voted to raise and appropriate the sum of $125.00 for repair and maintenance of the Town Clock.


UNDER ARTICLE TEN. After lengthy arguments both pro and con, a motion to dismiss this article by Mr. Fraser of the Finance Committee was lost, a motion made by Mr. Dixon of the Fire Engineers was lost. On a motion made by Alvin Snell, it was voted:


To appropriate and transfer from the Excess and Deficiency Ac- count the sum of $4,000.00 for the purpose of purchasing a new motor- ized fire truck to be housed in the fire station at West Chelmsford.


UNDER ARTICLE ELEVEN. On a motion made by Raymond H. Greenwood, it was voted to transfer from the Excess and Deficiency Account the sum of $5,000.00 for highway construction and repair.


UNDER ARTICLE TWELVE. It was voted to instruct the School Committee to keep the South Chelmsford School open.


UNDER ARTICLE THIRTEEN. On a motion made by Thomas Campbell, it was voted to accept from the Chelmsford Salvage Com- mittee the proceeds from sale of salvage, the same to be used as a special fund for the benefit of veterans of World War II and ad- ministered by a committee of veterans consisting of one veteran from each voting precinct to be appointed by the Selectmen. The sum ac- cepted was $2,929.92.


Voted to adjourn this meeting at 9 P.M.

GREETING:


In the name of the Commonwealth as aforesaid, you are hereby required to notify and warn the legal voters of said Chelmsford to meet in the Town Hall at Chelmsford Center on Monday, the twenty- ninth day of September, 1947, at seven-thirty o'clock in the evening, then and there to act on the following articles, viz:

ARTICLE 1. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund the sum of $1,000.00 for Old Age Assistance; or act in relation thereto.


ARTICLE 2. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund the sum of $4,000.00 for Aid to Dependent Children; or act in relation thereto.


ARTICLE 3. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund the sum of $600.00 to continue 24 hour service of the Police Department until December 31, 1947; or act in relation thereto.


ARTICLE 4. To see if the Town will vote to accept Chapter 265, Acts of 1947, which reads as follows, or act in relation thereto:


"Chapter 41 of the General Laws is hereby amended by inserting after section 110 the following section: Section 110A. Any public office in any city or town may remain closed on any or all Saturdays as may be determined from time to time, in a city by the city coun- cil, subject to the provisions of the city charter, or in a town, by vote of the town at a special or regular meeting, and the provisions of section nine of chapter four shall apply in case of such closing of any such office on any Saturday to the same extent as if such Saturday were a legal holiday. Approved 4-17-47."


ARTICLE 5. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund a certain sum of money to purchase a snow plow for the Highway Department; or act in relation thereto.


ARTICLE 6. To see if the Town will vote to authorize the Se- lectmen to sell for the sum of $1.00 to the South Chelmsford Gun & Rod Club, a Voluntary Association, or to its corporate successor, ap- proximately 33.82 acres of land located on Turnpike and Mill Roads and being Lot 187, Plat 137, Block 36, on file in the office of the Town Assessors; or act in relation thereto.


ARTICLE 7. To see if the Town will vote to accept the pro- visions of Section 42, 43, and 44 of Chapter 48 of the General Laws: The provisions of said sections are as follows:


42. Fire Departments in Certain Towns-Towns accepting the provisions of this and the two following sections or which have ac- cepted corresponding provisions of earlier laws may establish a fire department to be under the control of an officer to be known as the Chief of the Fire Department. The Chief shall be appointed by the Selectmen, and shall receive such salary as the Selectmen may from time to time determine, not exceeding in the aggregate the amount annually appropriated therefor. He may be removed for cause by

the selectmen at any time after a hearing. He shall have charge of extinguishing fires in the town and the protection of life and property in case of fire. He shall purchase subject to approval of the select- men and keep in repair all property and apparatus used for and by the fire department. He shall have and exercise all the powers and dis- charge all the duties conferred or imposed by statute upon engineers in towns except as herein provided, and shall appoint as deputy chief and such officers and firemen as he may think necessary, and may re- move the same at any time for cause and after hearing. He shall have full and absolute authority in the administration of the depart- ment, shall make all rules and regulations for its operation, shall report to the selectmen from time to time as they may require, and shall annually report to the town the condition of the department with his recommendations thereon; he shall fix the compensation of the permanent and call members of the fire department subject to the approval of the selectmen; and in the expenditure of money the chief shall be subject to such further limitations as the town may from time to time prescribe.


43. Chief to Act as Forest Warden-The chief of the fire depart- ment shall act as forest warden in all such towns, and shall have authority to appoint deputy wardens and fix their compensations subject to the approval of the selectmen.


. 44. Effect of Two Preceding Sections on Firemen under Civil Service. The two preceding sections shall not affect the tenure of office nor apply to the removal of permanent and call members of fire departments in towns which have accepted chapter thirty-one or corresponding provisions of earlier laws. Said sections shall not apply to cities; or act in relation thereto.


ARTICLE 8. To see if the Town will vote to accept Summit Avenue as laid out by the Selectmen and shown on their report and plan duly filed in the office of the Town Clerk; or act in relation thereto.


ARTICLE 9. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund a certain sum of money for the purpose of reconstructing Summit Avenue; or act in relation thereto.


ARTICLE 10. To see if the Town will vote to accept Marinel Avenue as laid out by the Selectmen and shown on their report and plan duly filed in the office of the Town Clerk; or act in relation thereto.

ARTICLE 16. To see if the Town will vote to accept Columbia Street as laid out by the selectmen and shown on their report and plan duly filed in the office of the Town Clerk; or act in relation thereto.


ARTICLE 17. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund a certain sum of money for the purpose of reconstructing Columbia Street; or act in relation thereto.


ARTICLE 18. To see if the Town will vote to accept Woodbine Street as laid out by the Selectmen and shown on their report and plan duly filed in the office of the Town Clerk; or act in relation thereto.


ARTICLE 19. To see if the Town will vote to appropriate and transfer from the Excess and Deficiency Fund a certain sum of money for the purpose of reconstructing Woodbine Street; or act in relation thereto.

ARTICLE 22. To see if the Town will vote to accept the follow- ing parcels of land by quitclaim deed from the following owners, the Town of Chelmsford at present holding a tax title on same. If the Town acts on this Article in the affirmative the conveyances will be made subject to all taxes and tax titles held by the Town of Chelms- ford;

SPECIAL TOWN MEETING September 29th, 1947


At a special town meeting held in the Upper Town Hall at Chelmsford Center on September 29, 1947 at 7:30 P. M. the following business was transacted.


The meeting was called to order at 7:30 P. M. by Moderator John C. Monahan, who requested the Town Clerk, Harold C. Petterson to read the warrant. After the warrant was partly read, Arthur Nystrom made a motion that further reading of the warrant be waived and it was so voted.


UNDER ARTICLE ONE: On motion made by Raymond H. Greenwood, it was voted to appropriate and transfer from the Excess and Deficiency account the sum of $1,000.00 for Old Age Assistance.

UNDER ARTICLE SEVEN: On motion made to accept Sections 42, 43 and 44 of Chapter 48 of the General Laws on a hand vote taken, 56 voted in the affirmative and 93 voted in the negative, the motion lost and the article dismissed. This article referred to the appoint- ment of a Chief for the Fire Department.


UNDER ARTICLE EIGHT: It was voted to accept Summit Avenue as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE NINE: It was voted to appropriate and transfer from the Excess and Deficiency account the sum of $850.00 for the purpose of reconstructing Summit Avenue.


UNDER ARTICLE TEN: It was voted to accept Marinel Av- enue as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.

UNDER ARTICLE EIGHTEEN: It was voted to accept an Extension of Woodbine Street as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE NINETEEN: In regard to an appropriation for the reconstruction of Woodbine Street, it was voted to dismiss this article.


UNDER ARTICLE TWENTY: It was voted to accept a portion of Delwood Road as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE TWENTY-ONE: It was voted to appro- priate and transfer from the Excess and Deficiency account the sum of $720.00 for the purpose of reconstructing Delwood Road.

To see if the Town will vote to take by eminent domain an easement seven (7) feet wide for the purpose of draining Evergreen Street and the surrounding area, said taking to begin at a point approximately three hundred seventy-five (375) feet north from the intersection of Evergreen and Chelmsford Streets and then running in a direction from east to west a distance of approximately nine hundred (900) feet to the Old Middlesex Canal and running under the land of George and Adelia R. Taylor, Galbraith and Isabelle Winters, Victor Petterson and Tateoss Dulgarian.

SPECIAL TOWN MEETING November 17th, 1947


A special town meeting was held in the Upper Town Hall at Chelmsford Centre on November 17th, 1947, at 7:30 P. M. The meeting was called to order by Moderator John C. Monahan who requested the Clerk, Harold C. Petterson, to read the warrant. After the war- rant was partly read on motion made by Arthur Nystrom it was voted to waive the further reading of the warrant, from then on the follow- ing business was transacted:


UNDER ARTICLE ONE:


On a motion made by Raymond H. Greenwood it was voted to take by eminent domain an easement seven feet wide for the purpose of draining Evergreen Street and surrounding area, said taking to be- gin at a point approximately three hundred seventy five feet north from the intersection of Evergreen Street and Chelmsford Street and then running in a direction east and west a distance of approximately nine hundred feet to the Old Middlesex Canal and running under the land of George and Adelia R. Taylor, Galbraith and Isabelle Winters, Victor Petterson and Tateoss Dulgarian, all as shown on a plan en- titled, "easement plan prepared for the Town of Chelmsford by J. C. & W. T. Monahan, Civil Engineers" which plan is now recorded in the North District Registry of Deeds.


UNDER ARTICLE TWO:


On a motion made by John Dusseault, it was voted to transfer from the account entitled "Garbage Collection, Health Department" the sum of $1,500.00 for the purpose of draining Evergreen Street over land area to be taken for the Town by eminent domain.


UNDER ARTICLE THREE:


On a motion made by Theodore W. Emerson, it was voted to transfer from the account entitled "Garbage Collection, Health De- partment" the sum of $700.00 for the purpose of Snow Removal from the streets and highways.


UNDER ARTICLE FOUR:


On a motion made by John Dusseault, it was voted to transfer from the account entitled "Tailings," the sum of $300.00 for the pur- pose of settling a claim in full for damages against the Dog Officer, the said claim being brought by Albert G. Scaplan.


Voted to adjourn this meeting at 7:45 P. M.

To see if the Town will vote to transfer from the "Excess and Deficiency Fund" to the Account called "Boston Road Reconstruction" Account, a certain sum of money until such time as the County of Middlesex and the Commonwealth of Massachusetts pay into the Treasury of the Town of Chelmsford their proportional part of Reconstruction of said Boston Road as set forth in a contract on file or to be filed with the Town Accountant by said County and State, and to instruct the Town Accountant upon payment by County and State into the Town Treasury to replace said transfer to the Excess and Deficiency Account; or act in relation thereto.
