ANNUAL BUSINESS MEETING March 14, 1949


The annual business meeting of the Town of Chelmsford was called to order at 7:30 P. M. on March 14th, 1949 in the High School Auditorium by John C. Monahan presiding as Moderator and Harold C. Petterson as Town Clerk.


On a motion made by Wendell P. Harvey, it was voted to waive the reading of the Warrant.


UNDER ARTICLE ONE: Clifford Hartley was elected as a Mem- bér of the Varney Playground Commission for two years and John W. Dixon was elected as a member of the Varney Playground Com- mission for three years.


It was voted that the Finance Committee and the Board of Se- lectmen be appointed as a committee to study the question of salaries


It was voted to accept the Town Report as printed.


for all employees and officers of the Town excepting the School teach- ers and principals and report at the next annual town meeting.


Harry Shedd and Henry Quinn were appointed by the Moderator as Tellers.

· At this point of the meeting it was voted to adjourn until March 14, 1949 at 7.30 P. M. The meeting was resumed at 7.30 P. M. on March 14, 1949.


UNDER ARTICLE THREE: It was voted to authorize the Select- men to act as its agent in any suit or suits which may arise during the current year with authority to settle and adjust any claim or de- mands for or against the Town and to employ counsel whenever in their judgment it is necessary.


UNDER ARTICLE FOUR: It was voted that the Treasurer be. authorized with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the current financial year, beginning January 1st 1949, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


UNDER ARTICLE FIVE: It was voted to raise and appropriate the sum of $4,581.67 for the purpose of paying unpaid bills of previous years; this vote was unanimous.


UNDER ARTICLE SIX: In regard to appropriation of money for foreclosing tax titles, it was voted to dismiss this article as this amount had been included under article two.


UNDER ARTICLE SEVEN: It was voted to raise and appropriate the sum of $2,500.00 to meet the Town's share of the cost of Chapter 90 work on Highway Maintenance, subject to the State and County of Middlesex contributing a like amount each.


UNDER ARTICLE EIGHT: It was voted to transfer from the Excess and Deficiency account the sum of $5,000.00 to meet the State and County of Middlesex share of the cost of the work; reimbursements from the State and County to be restored to the Excess and deficiency account upon their receipt from said source by the Town Treasurer. This vote refers to Chapter 90 Highway Maintenance work.

the sum of $5,000.00 to be used for Chapter 90 work in construction of the Boston Road, subject to the State and County of Middlesex con- tributing a like amount or more for said work.


UNDER ARTICLE TEN: It was voted to transfer the sum of $15,000.00 from Excess and Deficiency account for Chapter 90 work on construction of the Boston Road; this transfer to be commensurate with the State and County of Middlesex share of the cost of the work; the reimbursement from the State and County to be restored upon their receipt by the Town Treasurer to the Excess and Deficiency account.


UNDER ARTICLE ELEVEN: It was voted to dismiss this article, in regard to appropriating the sum of $3,000.00 for the construction of the Groton Road.


UNDER ARTICLE TWELVE: It was voted to dismiss this article in regard to the Groton Road.


UNDER ARTICLE THIRTEEN: It was voted to raise and appro- priate the sum of $3,679.00 to pay the Treasurer of Middlesex County Retirement System the Town of Chelmsford's share of the Pension and Expense Fund.


UNDER ARTICLE FOURTEEN: It was voted to transfer from the Overlay Reserve Fund the sum of $5,000.00 to be used as a Re- serve Fund at the discretion of the Finance Committee as provided in the General Laws Chapter 40, Section 6.

UNDER ARTICLE EIGHTEEN: It was voted to authorize the Cemetery Commissioners to appoint any or all of the members of said Board as laborers to work in the Cemetery Department at the rate of $1.00 per hour.


UNDER ARTICLE NINETEEN: It was voted to authorize the Park Commissioners to appoint any or all of the members of said Board as laborers to work in the Park Department at the rate of $1.00 per hour.

UNDER ARTICLE TWENTY: It was voted to raise and appro- priate the sum of $1,500.00 for the purpose of purchasing a truck for the Highway Department. The purchase to be made under the super- vision of the Board of Selectmen.


UNDER ARTICLE TWENTY ONE: It was voted that the Mode- rator appoint a Committee of persons consisting of two taxpayers, two members of the Fire Engineers and One Finance Committee Member, a Committee to study the needs and the advisability of purchasing a new fire truck to be housed at North Chelmsford and to bring in the cost of such apparatus and make complete report at the next annual town meeting. The Moderator appointed as this Committee. Harry Shedd, John Dusseault, Walter Edwards, Gilbert Perham and Arthur Nystrom.


UNDER ARTICLE TWENTY TWO: It was voted that the Mode- rator appoint a Committee consisting of two Selectmen, two tax- payers and two· Finance Committee Members, a Committee to inves- tigate and report at the next annual town meeting the need and ad- visability of purchasing an Austin Western or other make of grader for use in the Highway Department and to make their report at the next annual town meeting.


UNDER ARTICLE TWENTY THREE: It was voted to raise and appropriate the sum of $1,680.00 for the purpose of purchasing gas masks for the Fire Department under Chapter 337 of the Acts of 1948.


UNDER ARTICLE TWENTY FOUR: It was voted to raise and appropriate the sum of $1,750.00 for the purpose of purchasing for the Police Department one automobile, said purchase to be made under the supervision of the Board of Selectmen.


UNDER ARTICLE TWENTY FIVE: It was voted to authorize the Board of Selectmen to transfer title by good and sufficient bill of sale a. Ford automobile now used by the Police Department.


UNDER ARTICLE TWENTY SIX: In regard to the appropriation of $5,350.00 for completing survey for Board of Assessors, it was voted to dismiss this article.


UNDER ARTICLE TWENTY SEVEN: It was voted to raise and appropriate the sum of $238.50 with which to purchase an adding machine for the office of the Treasurer and Collector of Taxes.


UNDER ARTICLE TWENTY EIGHT: It was voted to raise and appropriate the sum of $500.00 for the purpose of graveling and oiling the road leading from the Swain Road in North Chelmsford to the North Chelmsford Dump so-called.

UNDER ARTICLE TWENTY NINE: It was voted to raise and appropriate the sum of $1,000.00 for the purpose of reconstructing Quigley Ave. in North Chelmsford.


UNDER ARTICLE THIRTY: It was voted to raise and appro- priate the sum of $1,048.00 for the purpose of constructing a fence at the Westlands School Playground.


UNDER ARTICLE THIRTY ONE: In regard to the appropria- tion of $3,600.00 for lights in the McFarlin School, it was voted to dismiss this article.


UNDER ARTICLE THIRTY TWO: It was voted to authorize the Selectmen to secure by purchase or otherwise a parcel of land for a school site at North Chelmsford, said parcel of land is now owned by the North Chelmsford Water District and is described as follows; bounded by Crystal Lake, by Washington Street, by Grant Street and by Adams Street and comprising approximately six acres of land. One hundred twenty three voted yes and 42 voted no.


UNDER ARTICLE THIRTY THREE: It was voted to dismiss this article, regarding land for school site on Dunstable Road.


UNDER ARTICLE THIRTY FOUR: It was voted to accept a bequest of $3,207.35 from the late Anna J. Brake, by will dated Oct. 24, 1940 and duly probated in the Middlesex Probate Court.


UNDER ARTICLE THIRTY FIVE: It was voted to use the be- quest of $3,207.35 as accepted under article 34 from Anna J. Brake will for the purpose of altering, reconstructing, changing and im- proving the Anna C. MacKay Memorial Library in North Chelmsford and that this money be expended by the Library Trustees.


UNDER ARTICLE THIRTY SIX: It was voted to accept a be- quest of $10,000.00 made to the Town of Chelmsford by will of Mary B. Proctor, late of Boston, dated January 16, 1914 and duly probated in the Suffolk Probate Court, for the Chelmsford Public Library.


UNDER ARTICLE THIRTY SEVEN: It was voted that the sum of $10,000.00 accepted under article 36 made to the Town of Chelms- ford under the will of Mary B. Proctor dated January 16, 1914 and duly probated in the Suffolk Probate Court be used according to the conditions set forth in said will and that the Library Trustees be instructed to comply with Section 12, Chapter 78 of the General Laws, which reads as follows: "The Board shall make an annual report to the Town of its receipts and expenditures and of the property in its custody, with a statement of any unexpended balance of money and of any gifts or bequests which it holds in behalf of the Town, with its recommendations."

UNDER ARTICLE THIRTY EIGHT: It was voted to raise and appropriate the sum of $6,792.65 to be expended under the supervision of the Library Trustees for the purpose of converting the home of the late Stewart Mackay into a library in accordance with the will of the late Stewart Mackay.


UNDER ARTICLE THIRTY NINE: It was voted that the Town accept a tract of land in the rear and adjacent to the property of the late Stewart Mackay in accordance with the deed given by John and Elsie N. Greig, dated March 7, 1949.


UNDER ARTICLE FORTY: It was voted to accept all the assets including land, building, funds, equipment and any other assets of the North Chelmsford Library Corporation, said assets to be under the control of the Library Trustees for the benefit of the Anna C. Mac- Kay Memorial Library.


UNDER ARTICLE FORTY ONE: It was voted that the follow- ing Committee Charles Boles; Clifford Hartley; Norman Mason; Roger Welch and Leslie Adams be appointed to make a study of the Selectman-Town Manager form of government for the Town of Chelmsford, said Committee to report back at the next annual town meeting.


UNDER ARTICLE FORTY TWO: It was voted to raise and appropriate the sum of $100.00 for the purpose of printing and publish- ing the proposed new building laws.


UNDER ARTICLE FORTY THREE: It was voted that the Board of Selectmen be authorized to sell the following parcels of land owned by the Town of Chelmsford and formerly owned by Helen B. Avery, Grace W. Dawson, Percy A. Douglas, Frank Gallagher, Edith L. Gerrish, Anna Landers, Fred F. Wiggin, Sarah Meigs and Harry J. Roche.


UNDER ARTICLE FORTY FOUR: It was voted that the Town accept Priscilla Ave. as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE FORTY FIVE: It was voted that the Town raise and appropriate the sum of $300.00 for the purpose of recon- structing Priscilla Ave.


UNDER ARTICLE FORTY SIX: It was voted to accept Pine Hill Ave. as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE FORTY SEVEN: It was voted to raise and appropriate the sum of $250.00 for the purpose of reconstructing Pine Hill Ave.

UNDER ARTICLE FORTY EIGHT: It was voted to accept Pine and Birch Streets and a portion of Warren Ave. as laid out by the Selectmen and shown by their report and plan duly filed in the office of the Town Clerk.


UNDER ARTICLE FORTY NINE: In regard to the appropria- tion of $1,000.00 for the purpose of reconstructing Pine and Birch Streets and a portion of Warren Ave., it was voted to dismiss this article.


It was voted to adjourn this meeting at 11.07 P.M.

WARRANT FOR SPECIAL TOWN MEETING June 13th 1949

To Lawrence W. Chute, Constable, or any suitable person of the Town of Chelmsford:


GREETING:


In the name of the Commonwealth aforesaid, you are hereby re- quested to notify and warn the legal voters of said Chelmsford to meet in the Town Hall at Chelmsford on Monday, the thirteenth day of June, 1949, at 7:30 o'clock in the evening, then and there to act upon the following articles,. viz:


ARTICLE 1. To see if the Town will vote to raise and appro- priate the sum of Five Hundred Dollars ($500.00) or some other sum for the purpose of hiring an extra clerk for the Assessors' Office; or act in relation thereto.


ARTICLE 2. To see if the Town will vote to transfer from the Excess and Deficiency Account the sum of Eight Hundred Dollars ($800.00) to be used for the improvement of land at Vinal Square for a parking lot described in Middlesex North District Registry of Deeds Book 725, Page 337; or act in relation thereto.


ARTICLE 3. To see if the Town will vote to transfer from the New Equipment Account in the Highway Department Budget to the Machinery Repairs and Maintenance Account, the sum of One Thous- and Dollars ($1,000.00); or act in relation thereto.
