UNDER ARTICLE 75:


Mr. Robert F. McAndrew moved that the Town vote to accept Kris- tin Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk. It was so voted.


ARTICLE 76. To see if the Town will vote to rescind action taken at the Special Town Meeting held June 5, 1961 under Article 4, relative to the construction of a permanent Band Stand on the Common in the Center in memory of Bernard Larkin.


UNDER ARTICLE 76:


Mr. Harold J. Davis moved that the Town vote to rescind action taken at the Special Town Meeting held June 5, 1961 under Article 4, relative to the construction of a permanent Band Stand on the Common in the Center in memory of Bernard Larkin. Mr. Louis Hannaford re- quested a ruling on the legality of this article. Town Counsel ruled the article to be illegal because money had already been expended by the Junior Chamber of Commerce under vote of a Special Town Meeting held June 5, 1961 under Article 4. After some discussion relative to the possibility of a vote on this article a motion to dismiss carried.


ARTICLE 77. To see if the Town will vote to abolish the one Acre House lot Building or Zoning By-Law with all provisions as passed at the 1961 Town Meeting. And set the minimum size of a house lot at 7 thousand five hundred square feet. In all new sub-divisions and where it is expedient in old sub-divisions, at the discretion of a land owner.


UNDER ARTICLE 77:


Bradford O. Emerson, on behalf of the Planning Board moved that Article 77, regarding abolishing Acre House Lot be dismissed. It was so voted.

ARTICLE 78. To see if the Town will vote to amend the Zoning By-Laws and change that part of Gorham Street in East Chelmsford not already zoned for General Business, from General Residence to Gen- eral Business. This area to include all land on the easterly and south- easterly side of Gorham Street between the City of Lowell and Town of Billerica lines and extending easterly or southeasterly to the Concord River.


UNDER ARTICLE 78:


Bradford O. Emerson, on behalf of the Planning Board moved that Article 78, regarding rezoning of Gorham Street be dismissed. It was so voted.


ARTICLE 79. To see if the Town will vote to amend the Zoning By-Law as follows: PROPOSED AMENDMENT TO ZONING LAW SECTION 3, SINGLE RESIDENCES, A1, A2 A3 DISTRICTS for the purpose of protective by-laws the following uses of buildings and land shall be permitted in all portions of the towns except in the RE- STRICTED industrial districts. A4 Farms, including, livesstock, (but not a piggery) poultry and dairy farms, market gardens, orchards, nur- series, greenhouses, and the sale of produce raised on the premises pro- vided buildings for such use are at least fifty feet from a street or public way, and further such livestock, poultry and dairy farms shall not en- compass an area of less than one and one-half (11/2) acre.


UNDER ARTICLE 79:


Bradford O. Emerson, on behalf of the Planning Board, moved that Article 79, regarding uses of buildings and land under the Zoning By- Law be dismissed. It was so voted. Mr. Leslie Dukeshire requested ap- peal of Articles 77, 78 and 79. Motion failed.


ARTICLE 80. To see if the Town will vote to instruct the Board of Assessors to use the sum of Two Hundred Thousand Dollars ($200,- 000.00), or some other sum, from free cash in the Treasury for the re- duction of the 1962 Tax Rate; or act in relation thereto.


UNDER ARTICLE 80:


Mr. Edward S. Marshall moved that the Town vote to instruct the Board of Assessors to use the sum of Two Hundred Thousand Dollars ($200,000.00) from free cash in the Treasury for the reduction of the 1962 Tax Rate. It was so voted.


ARTICLE 81. To see if the Town will vote to raise and appropriate the sum of $1,250.00 for the purpose of settling a personal injures claim against the Town by Alfred Longval as a result of a defect in a public way; or act in relation thereto.

WARRANT FOR SPECIAL TOWN MEETING April 23, 1962 COMMONWEALTH OF MASSACHUSETTS


MIDDLESEX, ss.


To Ralph J. Pederson, Constable, or any other suitable person of the Town of Chelmsford:


GREETING:


In the name of the Commonwealth aforesaid, you are hereby re- quested to notify and warn the legal voters of the Town of Chelmsford to meet in the High School Auditorium at Chelmsford, on the 23rd day of April, 1962 at 8:00 o'clock P.M., then and there to act upon the fol- lowing articles, viz:


SPECIAL TOWN MEETING Monday Evening, April 23, 1962


The meeting was called to order at 8:05 P.M. in the High School auditorium by Moderator Daniel J. Coughlin. On motion of Selectman Raymond J. Greenwood, it was moved to recess the meeting to the High School gymnasium. Selectman Raymond J. Greenwood moved that the reading of the Warrant be waived. It was so voted. Moderator Daniel J. Coughlin then re-convened the meeting to the High School gymna- sium. He called upon the following Tellers; M. Edward Riney, Herbert Lamprey, Malcolm Weeks and Andrew R. Sides, to count those in at- tendance. They reported 211 present, more than the required 200.


ARTICLE 1. To see if the Town will vote to raise and appropriate, transfer from available funds or borrow a sum of money for the purpose of constructing and originally equipping and furnishing an addition to the Senior High School in Chelmsford; determine how the money shall be provided for, by taxation, by appropriation from available funds in the treasury, by borrowing from time to time under authority of Chapter 44 of the General Laws and Chapter 645 of the Acts of 1948, as amended; or act in relation thereto.


UNDER ARTICLE 1:


Mr. Cristy Pettee moved that the Town vote to raise and appropriate a sum of $497,000 for the purpose of constructing and originally equip- ping and furnishing an addition to the Senior High School building, and that to meet said appropriation, the sum of $7,000 be appropriated from available funds in the treasury, and that the treasurer, with the ap- proval of the Selectmen, be authorized and directed to issue and sell as one issue or from time to time as two or more separate issues, serial bonds or notes of the town, aggregating $190,000 in principal amount under authority of Section 7, of Chapter 44 of the General Laws, and that the treasurer, with the approval of the Selectmen and subject to

the approval of the State Emergency Finance Board, be authorized and directed to issue and sell as one issue or from time to time as two or more separate issues, serial bonds or notes of the Town aggregating $300,000 in principal amount under authority of Chapter 645 of the Acts of 1948, as amended, and that all of the bonds or notes be issued and sold in accordance with the applicable provision of said Chapter 44 of the General Laws, as amended, but each issue of bonds or notes to be a separate loan which shall be paid in not more than ten years from the date thereof.


This was voted unanimously.


ARTICLE 2. In the event of an affirmative vote under Article 1, to see if the Town will vote to authorize the Elementary School Needs Committee to proceed with the constructing, originally equipping and furnishing of an addition to the Senior High School in Chelmsford, and to enter into all necessary and proper contracts and agreements in re- spect thereto, and to do all and any the acts necessary for the con- struction of said project; or act in relation thereto.


UNDER ARTICLE 2:


Mr. Cristy Pettee moved that the Town vote to authorize the Ele- mentary School Needs Committee to proceed with the construction, originally equipping and furnishing of an addition to the Senior High School building, and to enter into all necessary and proper contracts and agreements in respect thereto, and to do all and any of the acts neces- sary for the construction of said project.


This was voted unanimously.


ARTICLE 3. To see if the Town will vote to accept Monument Hill Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk; and to raise and appropriate, or tranfer from available funds, a certain sum of money for the purpose of reconstructing Monument Hill Road; or act in rela- tion thereto.


UNDER ARTICLE 3:


Mr. Bradford O. Emerson moved that the Town vote to accept Monument Hill Road as laid out by the Board of Selectmen, and shown by their report and plan duly filed in the Office of the Town Clerk.


This was voted unanimously.


ARTICLE 4. To see if the Town will vote to raise and appropriate and/or transfer from available funds a certain sum of money for the purchase of a 75' Aerial Ladder Truck type of vehicle for the Fire De- partment, equipped as specified by the Fire Chief, said purchase to be made under the supervision of the Board of Selectmen; or act in rela- tion thereto.

UNDER ARTICLE 4:


Mr. Ernest G. Byam moved that the Town vote to transfer from the Excess and Deficiency Fund, the sum of $39,487.94 for the purchase of a 75' Aerial Ladder Truck type of vehicle for the Fire Department, equipped as specified by the Fire Chief, said purchase to be made under the supervision of the Board of Selectmen.


This was voted unanimously.


ARTICLE 5. To see if the Town will vote to authorize the Board of Selectmen to enter into a contract with Boston and Maine Railroad on behalf of the Town covering installation and maintenance of 1-30" steel drain pipe under the main line of said railroad in the Middlesex Street area of North Chelmsford; or act in relation thereto.


UNDER ARTICLE 5:


Mr. Robert F. McAndrew moved that the Town vote to authorize the Board of Selectmen to enter into a contract with Boston and Maine Railroad on behalf of the Town covering installation and maintenance of 1 - 30" steel drain pipe under the main line of said railroad in the Middlesex Street area of North Chelmsford.


This was voted unanimously.


The Meeting adjourned at 8:35 P.M. on motion of Raymond J. Greenwood.
