QUESTIONS Question No. 1 Proposed Amendment to the Constitution.
Do you approve of the adoption of an amendment to the constitution summarized below which was approved by the General Court in a joint session of the two branches held May 13, 1959, received 143 votes in the affirmative and 118 in the negative, and in a joint session of the two branches held March 29, 1961, received 144 votes in the affirmative and 121 in the negative?

SUMMARY
The proposed amendment imposes no new taxes but gives the General Court the power to pass an income tax at graduated or proportioned rates and is a change in the constitutional limitations now in effect on the power of the General Court to pass tax measures. The proposed amend- mend would add a new Article to the Constitution of the Commonwealth by which full power and authority is granted to the General Court, in the alternative to the power and authority to tax incomes in the manner pro- vided in Article XLIV of the Amendments to the Constitution, to impose a tax on incomes at rates which are proportioned or graduated according to the amount of income received, irrespective of the source from which it may be derived, and to grant reasonable exemptions, deductions and abatements. It further provides that any property, the income of which is taxed under the provisions of the proposed Article, may be exempted from the imposition and levying of proportional and reasonable assess- ments, rates and taxes as at present authorized by the Constitution, and that the Article shall not be construed to limit the power of the General Court to impose and levy reasonable duties and excises.

Gentlemen:
I submit herewith my report of an audit of the books and accounts of the town of Chelmsford for the period from May 17, 1961 to March 23, 1962, made in accordance with the provisions of Chapter 44, General Laws. This is in the form of a report made to me by Mr. William Schwartz, Assistant Director of Accounts.

Boston, Massachusetts Sir:
As directed by you, I have made an audit of the books and accounts of the town of Chelmsford for the period from May 17, 1961, the date of the previous audit, to March 23, 1962, preparatory to a transfer of funds to the newly appointed temporary treasurer, and a recommitment of outstanding accounts to the newly appointed temporary collector, and submit the following report thereon:
The records of financial transactions of the several departments re- ceiving or disbursing money for the town or committing bills for col- lection were examined and checked with the records of the town treasurer and the town accountant.
The books and accounts in the town accountant's office were examined and checked in detail. The receipts, as recorded, were checked with the treasurer's books, while the recorded payments were compared with the treasurer's cash book and with the treasury warrants. The appropriations and transfers were checked with the town clerk's records of town meet- ing votes and with the finance committee's records of transfers au- thorized from the reserve fund.
An analysis was made of the ledger accounts, a trial balance was taken off proving the accounts to be in balance, and after the necessary adjustments resulting from the audit were made, a balance sheet, a copy of which is appended to this report, was prepared showing the financial condition of the town as of March 23, 1962.

The books and records of the town treasurer were examined and checked in detail. The cash book additions were verified, and the recorded receipts were compared with the town accountant's books, with the records of the several departments collecting money for the town, and with other sources from which money is paid into the town treasury. The recorded payments were checked with the selectmen's warrants authorizing the treasurer to disburse town funds and with the ac- countant's records.
The bank balances were reconciled with statements furnished by the banks of deposit, the savings bank books were examined and listed, and the final reconciliation of the treasurer's cash indicated that the sum of $2,803.52 was due from him on March 23, 1962, which sum was paid into the town treasury by him on July 18, 1962.
The payments on account of maturing debt and interest were veri- fied by comparison with the amounts falling due and with the cancelled securities and coupons on file. The outstanding coupons and payments in advance of the maturity date were listed and reconciled with a state- ment furnished by the bank of deposit.
The records of payroll deductions on account of Federal and State taxes, the county retirement system, and group health insurance pre- miums were examined and checked in detail. The deductions were footed, the payments to the proper agencies and refunds to individuals were verified, while the balances, as shown on the individual employees' rec- ords, were listed and reconciled with the respective controls in the accountant's ledger.
The savings bank books and securities representing the investments of the several trust and investment funds in the custody of the town treasurer and the trustees were personally examined and listed. The income was proved, and all transactions and balances were verified by comparison with the books of the accountant.
The records of tax titles and tax possessions held by the town were examined and checked. The amounts transferred to the tax title ac- count were checked with the collector's books, and the tax titles and tax possessions on hand were listed, proved, and checked with the records at the Registry of Deeds.
The books and accounts of the town collector were examined and checked in detail. The taxes, excise, and departmental accounts receivable outstanding at the time of the previous examination, together with all subsequent commitment lists, were audited and checked with the war- rants issued for their collection and with the accountant's books. The collections, as recorded, were compared with the payments to the treasur- er as shown by the treasurer's and the accountant's books; the recorded abatements were proved with the assessors' and other departmental

records of abatements granted; the transfers to the tax title account were proved; and the outstanding accounts were listed and reconciled with the respective controlling accounts in the accountant's ledger.
Further verification of the outstanding accounts was made by mailing notices to all persons whose names appeared on the books as owing money to the town. Several replies were received claiming payment of the amount in question, and after investigation credits aggregating $2,061.92 were posted to 33 accounts for which payment had been made but not recorded on the books, this amount being transferred to the final re- conciliation of the treasurer's cash.
The detailed checking required to affect a proper reconciliation of the treasurer's and collector's accounts added materially to the time consumed in making the audit.
The financial records of the town clerk were examined and checked. The receipts on account of licenses, permits, recording fees, etc., were compared with the payments to the treasurer. The records of dog and sporting licenses issued were examined and checked, and the amounts paid to the treasurer and the Division of Fisheries and Game were proved. The cash balance on March 23, 1962 was proved by actual count of the cash in the office.
The available records of cash collections by the board of selectmen, the sealer of weights and measures, and the inspectors of buildings, wiring, and gas, as well as by the police, fire, health, highway, school, library, and cemetery departments, and by all other departments in which money was collected for the town, were examined and checked. The payments to the treasurer were compared with the treasurer's and the accountant's books, and the cash on hand in the several departments, including petty cash advances, was proved by actual count.
The surety bonds furnished by the several town officials for the faithful performance of their duties were examined and found to be in proper form.
In addition to the balance sheet, there are appended to this report tables showing reconciliations of the treasurer's and town clerk's cash, summaries of the tax, excise, tax title, tax possession, and departmental accounts, together with schedules showing the condition and transactions of the several trust and investment funds.
During the progress of the audit cooperation was received from all the town officials, for which, on behalf of my assistants and for myself, I wish to express appreciation.
