UNDER ARTICLE 16:


Mr. Howard E. Humphrey moved that the Town vote to transfer from the Road Machinery Fund the sum of $16,223.00 for the purpose of purchasing one (1) front end loader and plow for the Highway Department, said purchase to be made under the supervision of the Board of Selectmen.


It was so voted.


ARTICLE 17. To see if the Town will vote to acquire by purchase or eminent domain a parcel of land situated on the easterly side of Park Road shown as Lot 3 on a plan of land entitled "Plan of Land in Chelmsford, Mass. Belonging to Sidney E. Dupee and Ralph E. and Harriette F. House, Scale 60 Feet to an Inch, Aug. 21, 1961 Brooks, Jordan and Graves, Civil Eng'rs. Lowell, Mass.", which said plan is record- ed in Middlesex North District Registry of Deeds, and being thus bounded, Northerly by land of Dupee and House, 201.00 feet; Easterly by land of Dupee and House, 150.00 feet; Southerly by an unnamed street, 181.00 feet; Southeasterly in a curved line by said unnamed street and Park Road, 31.42 feet; and Westerly by Park Road, 130.00 feet. Containing 30,064 square feet of land. And to raise and appropriate a certain sum of money to pay for said land and the expenses of acquiring same; or act in relation thereto.


UNDER ARTICLE 17:


Regarding the New Fire House in South Chelmsford, Mr. Howard E. Humphrey moved that the Article be dismissed.


It was so voted.


ARTICLE 18. In the event of an affirmative vote under Article 17, to see if the Town will vote to appoint a committee consisting of five members, one of whom shall be the Fire Chief, for the purpose of proceeding with the preparation of plans and specifications for the construction of a firehouse on the said described premises, said committee to report back to the next Annual Town Meeting, and to raise and appropriate the sum of one thousand dollars for the use of said committee; or act in relation thereto.


UNDER ARTICLE 18:


Regarding committee for the New Fire house in South Chelmsford, Mr. Charles Egerton moved that this article be dismissed.


It was so voted.


ARTICLE 19. To see if the Town will vote to amend Section 9 (signs) of the Zoning By-Laws by adding section 9.5 as follows: Signs of the traveling light or animated type and all beacons and flashing devices whether a part of, attached to, or apart from a sign shall be discontinued. This By-law shall become effective one (1) year from the date of publication by the Planning Board, provided subsequent approval is given by the Attorney General.

UNDER ARTICLE 19:


Mr. St. Germain moved that Section 9 be amended by striking out the original wording in its entirety and substituting the following:


Signs of the traveling light or animated type and all beacons and flashing devices whether a part of, attached to, or apart from a sign, except traffic and safety lights or signal devices installed by the Town or Commonwealth shall be discontinued within one year of the effective date of this amendment.


It was so voted unanimously.


ARTICLE 20. To see if the Town will vote to amend Section VI in General Regulations of the Town of Chelmsford's protective zoning by-laws as adopted at the special Town Meeting held on June 17, 1963 by adding the following paragraph:


6.1.6 Single Family Dwelling-Any single family dwelling as defined herein, in any use district shall not be considered a Non-Conforming use and may be altered, modified, improved, repaired or reconstructed, so long as it remains a single family dwelling, Provided that:


(A) The zoning by-laws applicable to single family dwellings shall apply in all cases, regardless of use district.


(B) A single family dwelling in any use district other than "RA" "RC" "RB" "CA" or "CB" must have been existing and in continuous use as such for a period of 2 years immediately preceeding July 24, 1963, provided further that the owner have the burden of showing such continuous use.


UNDER ARTICLE 20:


Mr. Thomas E. Firth, Jr. moved that the Town vote to Amend Section VI in General Regulations of the Town of Chelmsford's protective zoning by-laws as adopted at the special Town Meeting held on June 17, 1963, by adding the following paragraph:


6.1.6. Single Family Dwelling-Any single family dwelling as defined herein, in any use district shall not be considered a Non-Conforming use and may be altered, modified, improved, repaired, or reconstruc- ted, so long as it remains a single family dwelling; Provided that:

ARTICLE 21. To see if the Town will vote to amend Section 5.5- Intensity of Use Schedule of the Town of Chelmsford's protective zoning by-laws as adopted at the special Town Meeting held on June 17, 1963 by deleting the following paragraph:


"For apartment houses, 10,000 square feet per unit for first two units, 5,000 square feet for the next two families to be accommodated and thereafter one thousand (1,000) square feet of lot area for each additional family accommodated",


and substituting the following paragraph;


(A) For apartment houses, 30,000 square feet per unit for first two units, 5,000 square feet each for the next two families to be accommodated and thereafter two thousand (2,000) square feet of lot area for each additional family accommo- dated.


UNDER ARTICLE 21:


Mr. David Dutton moved that the Town vote to amend Section 5.5- Intensity of Use Schedule of the Town of Chelmsford's protective zoning by-laws as adopted at the special Town Meeting held on June 17, 1963 by deleting the following paragraph:


"For apartment houses, 10,000 square feet per unit for first two units, 5,000 square feet for the next two families to be accommo- dated and thereafter one thousand (1,000) square feet of lot area for each additional family accommodated," and substituting the following paragraph:


(A) For apartment houses, 30,000 square feet per unit for first two units, 5,000 square feet each for the next two families to be accommodated and thereafter two thousand (2,000) square feet of lot area for each additional unit.


It was so voted unanimously.

To see if the Town will vote to amend Section II in Definitions of the Town of Chelmsford's protective zoning by-laws as adopted at the special Town Meeting held on June 17, 1963 by striking out that portion of Section II-Definitions, defining Sign in its entirety and substituting the following two definitions:

UNDER ARTICLE 22:


Mr. Bradford O. UNDER ARTICLE 23:


Mr. Bradford O. Emerson moved that the Town vote to amend Section IX of the Chelmsford Zoning By-Laws, by adding the following para- graph:


"No non-accessory sign shall be erected in any residential district as defined by this Zoning By-Law. No non-accessory sign shall be erected or maintained in any other district without a permit lawfully issued and remaining in full force and effect, by the Outdoor Advertising Division under Section 29 to 33 inclusive of Chapter 93, G.L.


It was so voted unanimously.


ARTICLE 24. To see if the Town will vote and appropriate the sum of $1,000 for the purpose of hiring a part time professional planning consultant for the Planning Board, or act in relation thereto.

Mr. Thomas St. Germain moved that the Town vote to appropriate the sum of $1,000 for the purpose of hiring a part time professional planning consultant for the Planning Board.


It was so voted.


ARTICLE 25. To see if the Town will vote to change that portion of Old Westford Road from the Route 3 rotary to the Lowell line from Old Westford Road to Drum Hill Road, or act in relation thereto.


UNDER ARTICLE 25:


Mr. Robert McKittrick moved that the Town vote to change that portion of Old Westford Road from the Route 3 rotary to the Lowell line from Old Westford Road to Drum Hill Road.


It was so voted.


ARTICLE 26. To see if the Town will vote to raise and appropriate a certain sum of money over and above the sum of $107,500 voted at the Special Town Meeting held November 4, 1963 for the purpose of construc- ting and originally equipping a police station building, said amount to be spent under the authorization of the committee appointed for the purpose of proceeding with the said project; or act in relation thereto. UNDER ARTICLE 26:


Mr. Malcolm D. Weeks moved that the Town vote to transfer from the Excess and Deficiency Fund the sum of $55,000.00 over and above the sum of $107,500.00 voted at the Special Town Meeting held November 4, 1963 for the purpose of constructing and originally equipping a police station building, said amount to be spent under the authorization of the committee appointed for the purpose of proceeding with the said project.


It was so voted unanimously.


ARTICLE 27. To see if the Town will vote to adopt the following by-law: Every owner of an outdoor pool shall be required to erect and maintain around such pool a six foot high protective chain link fence with suitable gates, said requirement to apply to existing pools and those to be constructed or installed in the future.


UNDER ARTICLE 27:


Regarding fencing of swimming pools, Mr. Howard E. Humphrey moved that this article be dismissed.


It was so voted.


ARTICLE 28. To see if the Town will vote to accept a deed of land situated on the southerly side of Dalton Road from Bradford O. Emerson, said land being for the purpose of improving Dalton Road and being shown as "Proposed Relocation" on a plan of land entitled, "Plan of Land in Chelmsford Mass. owned by Bradford O. Emerson Scale-1" = 80' Nov. 16, 1964 Dana F. Perkins & Sons Inc. Civil Engineers & Surveyors Lowell, Mass." which said plan is recorded in Middlesex North District Registry of Deeds, Plan Book 101, Plan 19.

Emerson said land being for the purpose of improving Dalton Road and being shown as "Proposed Relocation" on a plan of land entitled, "Plan of Land in Chelmsford, Mass. owned by Bradford O. Emerson Scale-1" = 80' Nov. 16, 1964 Dana F. Perkins & Sons Inc. Civil Engineers & Surveyors Lowell, Mass." which said plan is recorded in Middlesex North District Registry of Deeds, Plan book 101, Plan 19.


It was so voted.


ARTICLE 29. To see if the Town will vote to accept a deed of land on the northerly side of Galloway Road from Robert M. Hicks, Inc. in accordance with an agreement made May 18, 1964 between said Robert M. Hicks, Inc. and the Town pertaining to the improvement of said road, said land consisting of seven parcels containing respectively 1675, 1575, 1050, 623, 1140, 856 and 1460 square feet and shown on a plan of land entitled "Plan of Land in Chelmsford, Mass. and Westford, Mass. Belonging to Robert M. Hicks, Inc. Scale 100 Feet to an inch May, 1964 Brooks, Jordan and Graves, Civil Eng'rs. Lowell, Mass." which said plan is recorded in Middlesex North District Registry of Deeds, Plan Book 100, Plan 72B.


UNDER ARTICLE 29:


Mr. William L. Harvey moved that the Town vote to accept a deed of land on the northerly side of Galloway Road from Robert M. Hicks, Inc. in accordance with an agreement made May 18, 1964 between said Robert M. Hicks, Inc. and the Town pertaining to the improvement of said road and land consisting of seven parcels containing respectively 1675, 1575, 1050, 623, 1140, 856, and 1460 square feet and shown on a plan of land entitled "Plan of Land in Chelmsford, Mass. and Westford, Mass. Belonging to Robert M. Hicks, Inc. ARTICLE 30. To see if the Town will vote to raise and appropriate $500.00 or some other sum to permit Chelmsford's Regional Technical Vocational Planning Committee working with committees from Groton, Littleton and Westford to complete recommendations to the Town on the feasibility of joining a technical vocational school district, and to authorize that the said amount may be pooled with funds provided by said other towns; or act in relation thereto.


UNDER ARTICLE 30:


Mr. Franklin D. Hunt moved that the Town vote to raise and appropriate $500.00 to permit Chelmsford's Regional Technical Vocation- al Planning Committee working with committees from Groton, Littleton,

and Westford to complete recommendations to the town on the feasibility of joining a technical vocational school district and to authorize that the said amount may be pooled with funds provided by said other towns.


It was so voted.


ARTICLE 31. To see if the Town will vote to name the triangular parcel of land situated at the corner of Billerica Road and Turnpike Road the John B. Gallagher Square; or act in relation thereto.


UNDER ARTICLE 31:


Mr. William L. Harvey moved that the Town vote to name the triangular parcel of land situated at the corner of Billerica Road and Turnpike Road the John B. Gallagher Square.


It was so voted.


ARTICLE 32. To see if the Town will vote to accept the 86 acre Town Forest which lies a short distance to the south of Mill Road the name of "The Mill Road Forest"; or act in relation thereto.


UNDER ARTICLE 32:


Mr. Martin Bovey moved that the Town vote to accept for the 86 acre Town Forest which lies a short distance to the south of Mill Road the name of "the Mill Road Forest".


It was so voted.


ARTICLE 33. To see if the Town will vote to amend the Town Building Code by inserting after Article VIII, Section 2, the following sentence: The outside finished grade at the foundation shall in no instance be less than 12 inches higher than the grade of the street on which the building is located.


UNDER ARTICLE 33:


Regarding building code changes, Mr. Howard E. Humphrey moved that this article be dismissed.


It was so voted.


ARTICLE 34. To see if the Town will vote to adopt the following resolution:


WHEREAS the General Court sitting as a Constitutional Convention, did on July 16, 1963, give initial approval to a Home Rule amendment to the State Constitution, and


WHEREAS this bill of rights for local governments requires a second approval by the members of the General Court during this legislative session, and


WHEREAS we, as members of this Town Meeting, feel competent to handle the affairs of our town without strict supervision by the Commonwealth of our every act and deed.


NOW THEREFORE BE IT RESOLVED that this town meeting hereby instructs its representatives to the General Court to vote in favor of the Home Rule proposal (H 1384 of 1963 as revised)-or, take any other action relative thereto.

UNDER ARTICLE 34:


Mr. Charles Egerton moved the adoption of the following resolution:


WHEREAS the General Court sitting as a Constitutional Convention did on July 16, 1963, give initial approval to a Home Rule amendment to the State Constitution, and


WHEREAS this bill of rights for local governments requires a second approval by the members of the General Court during this legislative session, and


WHEREAS we, as members of this Town Meeting, feel competent to handle the affairs of our town without strict supervision by the Commonwealth of our every act and deed.


NOW THEREFORE BE IT RESOLVED that this town meeting hereby instructs its representatives to the General Court to vote in favor of the Home Rule proposal (H 1384 of 1963 as revised).


It was so voted unanimously.


ARTICLE 35. To see if the Town will vote to authorize the Board of Selectmen to expend funds for certain designated projects in accord- ance with the provisions of Chapter 822 of the Acts of 1963, Massachus- etts General Laws; or act in relation thereto.


UNDER ARTICLE 35:


Regarding this article, Mr. Howard E. Humphrey moved that the article be dismissed.


It was so voted.


ARTICLE 36. To see if the town will vote to transfer from the Sale of Lots Account a certain sum of money for the erecting of approxi- mately 775' of chain link fencing in the Heart Pond and West Chelmsford Cemeteries, and installing four catch basins and approximately 470' of drainage pipe in the West Chelmsford and Pine Ridge Cemeteries; or act in relation thereto.


UNDER ARTICLE 36:


Mr. Frank H. Hardy moved that the Town vote to transfer from the Sale of Lots Account $2,300.00 for the erecting of approximately 775' of chain link fencing in the West Chelmsford Cemetery and installing four catch basins and approximately 470' of drainage pipe in the West Chelms- ford Cemetery and Pine Ridge Cemetery.


Mr. Leslie Dukeshire moved to amend the motion by striking out the words "erecting 775 feet of chain link fencing," and substituting the following, "for the repairing and painting of the wooden fences."


This motion was defeated.


Mr. Cristy Pettee, President of the Historical Society moved that Commissioners defer action on Cemetery fencing until a later date. This motion was defeated.


The original motion was defeated.


Mr. Arthur J. Colmer moved for reconsideration of Article 36.

ARTICLE 37. To see if the Town will vote to raise and appropriate, transfer from available funds or borrow a certain sum of money to install a water system in the Pine Ridge Cemetery, money to be reimbursed to the Town of Chelmsford by the Nashua Trust Company, as trustee of the estate of Vileata S. Douglas; or act in relation thereto.


UNDER ARTICLE 37:


Mr. Arthur J. Colmer moved that the Town vote to borrow the sum of $14,000.00 to install a water system in the Pine Ridge Cemetery, money to be reimbursed by the Nashua Trust Company, as trustee of the estate of Vileata S. Douglas.


It was so voted.


ARTICLE 38. To see if the Town will vote to change the present voting precinct lines so that in place of the present six precincts there will be eleven, bounded and described as follows:


Precinct One: Beginning at the junction of Boston Road and Putnam Avenue in an easterly direction to First Street, turning southerly on First Street to East Putnam Avenue proceeding easterly on East Putnam Avenue to the junction of Third Street and East Putnam Avenue in a diagonal line thence northeasterly to the junction of Warren Avenue and River Meadow Brook thence following the course of River Meadow Brook until it crosses Turnpike Road thence northerly along center line of Turn- pike Road and Golden Cove Road to the intersection of Rte. 495 and westerly along center line of Rte. 495 to the intersection of Hunt Road thence southerly along center line of Hunt Road to intersection of High Street, thence easterly along center line of High Street to Locust Road and southerly on Locust Road to Byam Road, thence southeasterly down the center line of Byam Road to Acton Road and Parker Road and con- tinuing down the center line of Parker Road to Boston Road then turning and followng the center line of Boston Road in a northerly direction to point of beginning at intersection of Boston Road and Putnam Avenue.


Precinct Two: Beginning at the junction of Old Westford Road and the City line of Lowell and proceeding westerly along the center line of Old Wesftord Road to the intersection of Old Westford Road and Rte. 3 and thence northwesterly along Rte. 3 to the intersection of the Canal and Rte. 3 then turning northerly along the center line of the Canal to Crystal Lake or Newfield Pond and then following the southerly and easterly lines of said pond to the center of Adams Street and running easterly on Adams Street to Vinal Square crossing said square and proceeding down Wotton Street to the Merrimack River. Then easterly along the Merrimack River to the city line and southerly along the city line to the point of beginning at Old Westford Road.


Precinct Three: Beginning at the intersection of Rte. 3 and Old

Westford Road - proceeding in a westerly direction along the center line of Old Westford Road to the Westford Town line. Then turning northerly and following the Westford Town line until it intersects Rte. 3, thence southeasterly along center line of Rte. 3 to point of beginning at inter- section of Old Westford Road and Rte. 3.


Precinct Four: All the land easterly of a line beginning at the Billerica-Chelmsford Town line and proceeding northerly along the center line of Rte. 3 to the rear lot lines at the southerly end of McFarlin Road, thence westerly along said lines to the rear lot lines of the houses on the westerly side of McFarlin Road then northerly along said rear lot lines to the center of Riverneck Road, thence turning easterly and proceeding along the center line of Riverneck Road to the intersection of Rte. 3 and thence northerly along the center line Rte. 3 to the junction of Rte. 3 and the Lowell city line.


Precinct Five: Beginning at the junction of the center line of Acton Road and Parker and Byam Roads diagonally southerly to the Carlisle Town Bound on Proctor Rd. thence westerly along the Carlisle line and northerly to the Westford line continuing along the Westford line to Rte. 495 and thence easterly on Rte. 495 to the junction of Hunt Road thence southerly along the center line of Hunt Road to High Street, thence easterly along the center line of High Street to junction of Locust Road and thence southerly along the center line of Locust Road to the junction of Byam Road and easterly along the center line of Byam Road to point of beginning at center of junction of Byam Road, Parker Road and Acton Road.


Precinct Six: Beginning at the intersection of Rte. 495 and North Road and following the center line of North Road in a northerly direction to the Rte. 3 Traffic circle and the intersection of Old Westford Road thence turning easterly on Old Westford Road and following the center line of Old Westford Road to the City Line, then turning southerly and proceeding along the center line of Stedman Street to the intersection of Stedman Street and Rte. 495, thence turning Westerly along the center line of Rte. 495 to the intersection of Rte. 495 and North Road the point of beginning.
