REPORT OF THE TOWN CLERK


For the Year Ending December 31, 1936


Record of the annual town meeting January 20, 1936, with its adjournments.


Article 1. To choose all necessary town officers, the following officers to be voted on one ballot, viz: A Mod- erator for one year, a Town Treasurer and Collector of Taxes for one year, two Selectmen for three years, two members of the School Board for three years, one member of the Planning Board for five years.


To vote Yes or No on the following question: Shall an Act passed by the General Court in the year nineteen hundred and thirty-five, entitled "An Act providing for certain changes in the Town Manager Form of Govern- ment in the Town of Middleborough," be accepted?


Meeting called to order at eleven o'clock A. M. by Moderator Clark, and the warrant was read by the clerk.


Voted that the polls be opened at 11:30 A. M. and remain open until 8 P. M.

Article 2. To raise such sums of money by tax or otherwise, as may be necessary to defray the expense of the town for the current year, appropriate the same and to act on anything in relation to the assessment and collection of taxes for the year.


Voted that the budget of estimated expenditures for the ensuing year prepared by the Board of Selectmen, be referred back to the Selectmen with instructions that the Selectmen prepare and present for our considera- tion, at an adjournment of this Meeting a revised esti- mate of expenditures for the ensuing year, in such amount that the probable net amount to be levied and raised by taxation on property in the current year shall not exceed the sum of $38.20 per thousand dollars on our total 1935 valuation of real and personal property amounting to $8,001,365.

Article 3. To see if the town will vote to authorize the Town Treasurer, with the approval of the Select- men, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1936, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

Article 4. To hear the report of any committees or officers of the town; to appoint any committee, and act thereon.


Voted: That a committee of not less than eleven nor more than twenty-one be appointed by the Moderator to study the needs and to report on the needs of school buildings at the next annual meeting.

To see if the town will vote to appropriate a sum of money not exceeding five hundred dollars ($500), to be paid to St. Luke's Hospital, established in said town, for the establishment and maintenance of a free bed in the hospital for the care and treatment of persons certified by the Selectmen of said town to be residents of the town and unable to pay for such care and treatment, and act thereon.


Voted: The sum of $500.00 under appropriations.


Article 6. To see if the town will vote to raise and appropriate for the use of the Plymouth County Trus- tees for County Aid to Agriculture, a sum not exceeding three hundred dollars ($300), and choose a Town Direc- tor for one (1) year, as provided in Sections 41 and 45 of Revised Chapter 128 of the General Laws, and act thereon.

Article 7. To see if the town will vote to appropriate the sum of five hundred dollars ($500), for the employ- ment of the District Nurse, same to be spent by the Board of Health under the direction of the Selectmen, and act thereon.


Voted: The sum of $500.00 under appropriations.


Article 8. To see if the town will vote to extend the water mains on Center Street from Crowell Street to

Taunton Street; along Taunton Street to the house now or formerly owned by the Middleborough Savings Bank, on Cross Street from Taunton Street to Center Street, and on Center Street from Taunton Street to Cross Street, appropriate money for the same to be raised by loan or otherwise, and act thereon. Agreeable to the petition of William Broadbent, et al.

Article 9. To see if the town will vote to extend the water main on South Main Street from the end of the present main to the Lakeville-Middleborough Town line, appropriate money for the same to be raised by loan or otherwise, and act thereon.

Article 10. To see if the town will vote to authorize the Board of Selectmen or a person or persons appointed by them, to have charge of or sale of any property ac- quired by the town through tax titles, and act thereon.


Voted: To indefinitely postpone action on Article 10.


Article 11. To see if the town will vote to appropri- ate the sum of thirteen hundred dollars ($1300) for the repair of the West Side Portable School building, and act thereon.

Article 12. To see if the town will vote to accept Clara Street from Forest Street to Cambridge Street as laid out by the Board of Selectmen, appropriate a sum of money for the repair of the same, and act thereon. Agreeable to the petition of Elsie M. Alberts, et al.

Article 13. To see if the town will vote to appropri- ate the sum of eight hundred fifty dollars ($850) for the purchase of a cruising car for the use of the Police De- partment, and act thereon.


Voted: To appropriate the sum of $850.00 for the pur- chase of a cruising car for the Police Department.


Article 14. To see if the town will vote to assign a name to that portion of the road leading from the Traf- fic Circle toward Taunton that lies in Middleborough, as suggested by the Board of Selectmen, and act thereon.


Voted: To assign the name "Harding Street" to that portion of road leading from the traffic circle toward Taunton that lies in Middleborough.


Article 15. To see if the town will vote to accept Jack- son Street and Lincoln Street as laid out by the Board of Selectmen, as public ways, appropriate money for the expense and repair of the same, and act thereon.

Article 16. To see if the town will vote to instruct the Board of Selectmen to prepare a division of the town into convenient voting precincts, and act thereon.


Voted: That the town instruct the Board of Selectmen to divide the town into convenient voting precincts.


Article 17. To see if the town will vote to accept Courtland Street, so called, leading easterly from South Main Street, as laid out by the Board of Selectmen, ap- propriate money for the repair of the same, and act thereon. Agreeable to the petition of Frank J. Schei- derick, et al.

Article 18. To see if the town will install water into the school house at the Green, appropriate money there- for, and act thereon. Agreeable to the petition of John H. McNeece, et al.


Voted: To appropriate the sum of $135.00 to install water at the Green School, $75.00 of which to be paid from the Water Department and $60.00 of which to be . paid from the School Department.


Article 19. To see if the town will vote to direct the Selectmen to further divide the Town of Middleborough into voting precincts by establishing a voting precinct in that part of Midleborough known as the Rock and South Middleboro, and act thereon. Agreeable to the petition of John H. McNeece et al.

Article 20. To see if the town will instruct the Select- men to convey as a memorial a certain parcel of land with buildings thereon situated on School Street and known as the old Fire Station, to the Grand Army of the Republic, the Sons of Union Veterans of the Civil War, and the Women's Relief Corps, and act thereon. Agreeable to the petition of George W. Thomas et al.

Article 21. To see if the town will vote to retire E. Kimball Harrison, Janitor of the Town Hall, on a pension, appropriate money for the same, and act thereon.


Voted: To retire E. Kimball Harrison, janitor of the Town Hall, on a pension of $600.00 per year and that the sum of $600.00 be appropriated for the year 1936.


Article 22. To see if the town will accept Section 20 of Chapter 39 of the Acts and Resolves of the General

Court for the year one thousand nine hundred and thirty-four, and act thereon. Agreeable to the petition of Joseph A. Picone et al.


Voted: To sustain decision of the Chair that motion to accept Section 20 of Chapter 39 of the Acts and Re- solves of the year 1934 was out of order.


Voted: To indefinitely postpone action on Article 22.


SPECIAL TOWN MEETING April 6, 1936


Article 1. To see if the town will vote to increase the appropriation made at a special town meeting held September 3, 1935, whereby it appropriated the sum of thirty-two thousand dollars ($32,000.00) for the purpose of remodeling the P. H. Peirce Grocery Store into quar- ters for a Police Station, Fourth District Court of Plym- outh and for Public Comfort Stations for men and women, by appropriating the sum of six thousand five hundred dollars ($6,500.00), to be raised by loan or otherwise, to take care of contingencies which were not foreseen when the original plans were made; and to instruct the Selectmen to proceed in accordance with the Federal Relief Appropriation Act of 1935 and with Chapter 404 of the Acts of 1935, Commonwealth of Massachusetts; and to authorize the Selectmen to accept on behalf of the Town an additional Federal Grant of money for use in remodeling, restoration and construc- tion of addition to the said Police Station and Fourth District Court in Plymouth, and act thereon.


A letter from the Peirce Trustees was read by Mr. Harding.


Voted : That a vote on this article be taken by a rising vote.

Voted: That the courtesy of the floor be extended to Mr. Roberts to speak, who as a representative of the gov- ernment spoke in regard to the Police Station and Court House project.


Voted: That the Town of Middleborough increase the appropriation made at a special town meeting held Sep- tember 3, 1935, whereby it appropriated the sum of thirty-two thousand dollars ($32,000) for the purpose of remodeling the P. H. Peirce Grocery Store into quarters for a Police Station, Fourth District Court of Plymouth and for Comfort Stations for men and women, and for this purpose the town raise and appropriate the sum of sixty-five hundred dollars ($6,500), six hundred and fifty dollars ($650) of which shall be included in the tax levy of the year 1936, and the remainder shall be raised by the issue of bonds or notes of the town, and the Treasurer, with the approval of the Selectmen, be and hereby is authorized and empowered to issue bonds or notes of the town therefor, in the sum not to exceed five thousand eight hundred fifty dollars ($5,850), pay- able in accordance with the provisions of Section 1 of Chapter 17 of the Acts of 1932 in such a manner that the whole loan shall be paid off in not more than ten years from the date of the first bond or note or at such earlier date as the Treasurer, with the approval of the Selectmen, shall determine.


The Selectmen are directed to request assistance on this project from the Federal Government through the Federal Relief Appropriation Act of 1935, or any sub- stitute or Public Works Program; any grant of money so received shall be applied to the cost of the project or to the payment of the loan herein authorized.


The Selectmen are hereby authorized and directed to accept on behalf of the Town, for use in carrying out such project, a Federal Grant of money pursuant to the Emergency Relief Appropriation Act of 1935, and the

Selectmen are authorized to do all other acts and things necessary or convenient for obtaining said grant, said grant to be applied to the cost of the project or to the payment of the loan herein authorized. The vote was : Yes, 192. No, 1.


Article 2. To see if the town will vote to raise and appropriate for the use of the Plymouth County Trus- tees for County Aid to Agriculture, a sum not exceeding three hundred dollars ($300), and choose a Town Direc- tor for one (1) year, as provided in Sections 41 and 45 of Revised Chapter 128 of the General Laws, and act thereon.


Voted: That the Town of Middleboro raise and ap- propriate for the use of the Plymouth County Trustees for County Aid to Agriculture, three hundred dollars ($300), and to appoint H. Arthur Standish as Town Di- rector for one (1) year, as provided in Sections 41 and 45 of Revised Chapter 128 of the General Laws.


Article 3. To see if the town will vote to amend the vote passed at the Annual Town Meeting held February 17, 1936 (whereby the items in the budget were appro- priated as separate appropriations), so that the total of cach departmental appropriation shall be the same as originally voted, so that the appropriations will read as follows :
