SPECIAL TOWN MEETING June 11th, 1940


Meeting called to order at 7:30 P. M. by Moderator Clark.


A quorum not being present it was voted to take a fifteen minute recess.


The meeting was again called to order at 7:50 P. M. and a count of those present showed an attendance of 173.


Voted another fifteen minute recess. The meeting was again called to order at 8:10 P. M. A count showed 184 being present. Voted another fifteen minute recess. The meeting was again called to order at 8:30 P. M. There were 191 present according to a count taken.


Voted to adjourn to next Monday evening, June 17th at 7:30 o'clock.


ADJOURNED TOWN MEETING June 17th, 1940


Meeting called to order at 7:30 by Moderator Clark.


A count was taken of those present and the Moderator declared that there was a quorum present.


Article 1. To hear the report of any committee of officers of the Town, to appoint any committee, or take any action relative thereto.


No action taken on this article.

Article 2. To see if the Town will vote to transfer the sum of one thousand five hundred eleven ($1511.57) dollars and fifty-seven cents from the Road Machinery Fund to the Road Machinery Account, and act any- thing thereon.


Voted that the town transfer the sum of $1,511.57 from the Road Machinery Fund to the Road Machinery Account. Unanimous.


Article 3. To see if the Town will vote to raise and appropriate the sum of fifteen hundred ($1500.00) dollars for the construction and oiling of Plymouth St., said construction to extend from the end of the 1939 construction, said sum to be expended in conjunction with State and County Funds and to act anything thereon.


Voted that the town raise and appropriate the sum of $1,500.00 for the construction and oiling of Plymouth Street, said construction to extend from the end of the 1939 construction provided the County or the State and County will assist financially in doing this work. Unanimous.


Article 4. To see if the Town will vote to accept Mayflower Ave. as laid out by the Board of Selectmen, and to act anything thereon.


Voted to accept Mayflower Avenue as laid out by the Board of Select- men as follows:

Beginning at a stone monument situated at the intersection of the southwest street line of Mayflower Ave. (so-called) and the southeast street line of So. Main St., said monument being 71.30 ft. from the North corner of the house at 94 So. Main St., now or formerly owned by Mabel B. Sears, said monument also being 99.15 ft. from the north corner of an ell on said house; thence running south 45° 21' East 228.43 ft. by the land now or formerly owned by Mabel Sears and the land of the town of Middleboro to an iron pin, said iron pin being an angle point in the Southwest sideline of May- flower Avenue and is located 48.70 ft. from the North corner of the founda- tion of the house now or formerly owned by Frederick S. Scheidrick, said pin being also 64.80 ft. from the north-west corner of the foundation near the rear porch, which corner is 24.70 ft. distant from the front north corner hereinbefore mentioned; thence running south 51° 47" east 188.23 ft. by the land now or formerly of the town of Middleboro and the land now or formerly of Frank Scheidrick to an iron pin; thence at right angles to the last mentioned course and running in a northeasterly direction 50.0 ft. to a point in the northeasterly street line on Mayflower Avenue; thence north 51° 47' west 185 ft. by the land now or formerly of Hannah G. Harlow to an iron pin which marks an angle point in the northeast sideline of Mayflower Avenue; thence north 45° 21' west 221.0 ft. by the land now or formerly of Orrin Smith to an iron pin in the northeast street line of So. Main St., thence south 50° 45' west along the northeast street line of So. Main St. 51.30 ft. to the point of beginning.

Article 5. To see if the Town will vote to accept School St. Extension as laid out by the Board of Selectmen, and to act anything thereon.


Voted to accept School Street Extension as laid out by the Board of Selectmen as follows: Unanimous.

School St. Extension


Beginning at an iron pin set in the easterly side line of School Street Extension at the end of the street lay-out of December 1926, said pin being 36.27 feet distant from the west corner of the concrete steps of the house at No. 83 School St. Extension now or formerly owned by Elliott Harlow, said pin also being 28.88 ft. distant from the north corner of the same herein- before described steps; thence in a northerly direction along the line which is the extension of the present easterly side line of said School Street Ex- tension by the land of Albert E. Drake and John Cushman 250 ft. to an iron pin; thence at right angles to the last described line by the land of John Cushman 40 ft. to an iron pin set in the westerly side line of the herein- described lay-out; thence at right angles to the last described line and parallel to the first described line of this discription by the land now or formerly of John Cushman and land now or formerly of Lloyd Perkins, 250 ft. to an iron pin set in the westerly side line of School St. Extension, said pin being 640.30 ft. from the northerly street line of North Street, said pin being also 26.10 ft. distant from the east corner of the piazza of the house at No. 84 School St. Extension now or formerly owned by Lloyd Perkins; thence at right angles to the last described line and in a southeasterly direction 40 ft. to the point of beginning.


Article 6. To see if the Town will vote to accept Jackson St. as laid out by the Board of Selectmen, and act anything thereon.


Voted that the Town accept Jackson Street as laid out by the Board of Selectmen as follows: Unanimous.


Jackson Street


Starting at a stone bound which is on the southeast side of No. Main St. and also a corner of Jackson St., said bound standing 8.8 ft. from the North corner of Churbuck's law office and 20 ft. from the west corner of said building; thence at an angle of 96° 58' from No. Main Street 34.090 ft. through the land now or formerly of Florence Robinson to a stone bound said bound standing 4.53 ft. from the east corner of Churbuck's law office and 23.65 ft. from the north corner of said building; thence at an angle of 175° 01', 46.48 ft. through land now or formerly of Florence Robinson to a stone bound said bound standing 73.4 ft. from the north corner of Chur- buck's law office and 8 ft. from the north corner of a wooden garage stand- ing on the property now or formerly of Florence Robinson; thence at an angle of 175° 18' 995.87 ft. through the land now or formerly of Florence Robinson, Walter Morris, Peirce Trustees; thence crossing Lincoln Street through the land now or formerly of the Maxim Motor Co. and John H. Kelley to a stone bound said bound standing 4.95 ft. from the southeast side of a 10" pine tree and 32.70 ft. from the northwest side of pole No. 6. Said street to extend 40 ft. on the northeast side of the above described line.


Article 7. To see if the Town will vote to accept Maple Ave. as laid out by the Board of Selectmen, and act anything thereon.


Voted to accept Maple Avenue as laid out by the Board of Selectmen as follows:


Maple Avenue


Starting at an iron pin set at the intersection of the northwest side of Oak Street and the south side of Maple Ave., said pin is 436.895 ft. from the stone monument at the intersection of the north side of Sproat Street and the northwest side of Oak Street. Said pin is tied in as follows;

24.95 feet from the east corner of house No. 90 Oak Street, and 40.85 feet from the south corner of same house. Said intersection of the south side of Maple Avenue turning at an angle of 90° 00' 50" with Oak Street and running a distance of 380.491 ft. to an iron pin set at the intersection of the northwest side of Park Street and the south side of Maple Avenue. Said pin tied in as follows; 6.13 ft. from the southeast side of a 26" Maple tree and 31.51 ft. from the Northwest side of a 28" Maple tree; thence turning at an angle of 88° 06' 20" and running a distance of 40.02 ft. to an iron pin set in the north side of Maple Ave., said pin tied in as follows: 3.95 ft. from the northeast side of an 18" Maple tree and 32.45 ft. from the northwest side of a 36" Maple tree; thence turning at an angle of 91° 53"40" and running a distance of 380.491 feet to an iron pin at the intersection of the north side of Maple Avenue and the northwest side of Oak Street. Said pin tied in as follows: 23.31 feet from the southeast corner of house No. 92 Oak Street and 38.38 feet from the northeast corner of said house; thence turning at an angle of 90° 00'50" and running 40.02 ft. to the first mentioned pin. Said street to be 40 ft. in width.


Article 8. To see if the Town will vote to raise and appropriate the sum of thirty ($30.00) dollars for witness expenses of the Charles Liber suit, and act anything thereon.


Voted to raise and appropriate the sum of thirty ($30.00) dollars to be used for the payment of witness expenses in the Charles Liber suit against the town.


Article 9. To see if the Town will vote to raise and appropriate the sum of two hundred ($200.00) dollars for the purpose of purchasing fish and game to be liberated in the forests, ponds and streams in the Town of Middleboro, and act anything thereon.

Article 10. To see if the Town will vote to extend the Water Mains on Center St. from Crowell St. to Taunton St. along Taunton St. to the house now or formerly owned by the Middleboro Savings Bank on Cross St. from Taunton St. to Center St. and on Center St. from Taunton St. to Cross St. Money for same to be raised by loan or otherwise, and act thereon.

Article 11. To See if the Town will vote to extend the Water Main on Everett St. from North St. to Cross St. in co-operation with the Federal Government as a W. P. A. Project, the appropriation to be raised by loan or otherwise in accordance with Chapter 44 of the General Laws and act anything thereon.


No action taken on this article.


Article 12. To see if the Town will vote to extend the Water Mains on School St. Extension a distance of approximately two hundred and fifty feet in co-operation with the Federal Government as a W. P. A. Project, the appropriation to be raised by loan or otherwise in accordance with Chapter 44 of the General Laws, and act anything thereon.

Article 13. To see if the Town will vote to extend the Water Main on Wood St. a distance of approximately sixteen hundred feet in co-opera- tion with the Federal Government as a W. P. A. Project, the appropriation to be raised by loan or otherwise in accordance with Chapter 44 of the General Laws, and act anything thereon.


No action taken on this article.


Article 14. To see if the Town will vote to extend the Water Main on Cherry St. a distance of approximately thirteen hundred and fifty feet in co-operation with the Federal Government as a W. P. A. Project, the ap- propriation to be raised by loan or otherwise in accordance with Chapter 44 of the General Laws, and act anything thereon.

Article 15. To see if the Town will vote to appropriate the sum of twenty-five thousand ($25,000.00) dollars by transfer from the available funds in the Middleboro Gas & Electric Dept. for the use of the Assessors in fixing the tax rate for the year 1940.

Article 16. To see if the Town will vote to accept the deed of the property on Spruce St., Formerly owned by George H. Sherwin, conveyed by the said George H. Sherwin to the Town, and to act anything thereon.


Voted to accept the deed from George H. Sherwin, to the town of Middleboro of land and buildings situate Spruce St. in said Middleboro. Unanimous.


Article 17. To see if the Town will vote to authorize the Board of Selectment to sell by public auction the property on Spruce St., formerly owned by George H. Sherwin, and to act anything thereon.


Voted to empower and authorize the Board of Selectmen to sell at public auction the land and buildings situate Spruce St. in said Middleboro conveyed by deed to the town by George H. Sherwin and accepted by the town. Unanimous.


Article 18. To see if the Town will vote to discontinue that portion of the old lay-out of Wood St. between East Grove St. and the new lay-out of Wood St., said discontinuance being bounded on the North by land now or formerly of Jesse W. Hall and land of the Town of Middleboro, and to act anything thereon.

Article 19. To see if the Town will vote to authorize the Board of Selectmen to sell by public auction a triangular shaped lot of land lying on the Southwesterly side of East Grove St. near Wood St., and act anything thereon.

Article 20. To see if the Town will vote to raise and appropriate the sum of fifty-two ($52.00) dollars as additional compensation for the Clerk of the Police Dept., and to act anything thereon.


Voted to raise and appropriate the sum of fifty-two ($52.00) dollars for additional compensation for the Clerk of the Police Department for the year 1940. Unanimous.


Article 21. To see if the Town will take any action relative to pro- viding for annual audits of the Town records, and act thereon.


Voted that the General By-Laws of the Town approved Sept. 7, 1927 be amended by adding Article 15 to read as follows: Unanimous.


Article 15. Annual Audits.


Section 1. The accounts of the Town shall be audited annually be- ginning January 1, 1941 under the supervision of the Director of Accounts of the Commonwealth as provided by Section 35, Chapter 44, of the General Laws.
