Also those qualified to vote in Town elections and Town affairs to assemble in the Town Hall on Wednesday, March 15, A.D. Nine- teen Hundred and Thirty-Nine, at Eight O'clock, to hear and act on the following articles, viz:


Article 1. To hear and act on reports of Committees.


Art. 2. To see what sums of money the Town will raise and appropriate for Town Charges for the year 1939.


Art. 3. To see if the Town will vote to authorize the Town Trea- surer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year be- ginning January 1, 1939, and to issue a note or notes therefor, pay- able within one year, and to re- new any note or notes as may be given for a period of less than one year in accordance with Sec- tion 17, Chapter 44, of the General Laws, and any amendments there- to, agreeable to the petition of Harold E. Dodge.


Art. 4. To see if the Town will vote to authorize the Treasurer, with the approval of the Select- men, to borrow in accordance with the provisions of Chapter 49 of the Acts of 1933, as most recently amended by Chapter 57 of the Acts of 1938, for the purpose of pro- viding funds to meet ordinary maintenance expenses and revenue loans of 1938, such borrowing in no event to exceed the amount of the tax titles held in excess of the amount jowing to the Common- wealth for similar loans previous- ly made or to see what action the Town will take in the matter, agreeable to the petition of Harold E. Dodge.


Art. 5. To see if the Town will vote to raise and appropriate a


sum of $3500 for the continuation of the reconstruction of Woodbury Avenue-Hesper Street; said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, or to take any other action in relation thereto. Board of Selectmen.


Art. 6. To see if the Town will vote to raise and appropriate a sum of $3500 for the improvement of Main Street; said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, or to take any other action in relation thereto. Board of Selectmen.


Art. 7. To see if the Town will vote to raise and appropriate a sum of $2000 for the maintenance of Chapter 90 streets in the Town; said money to be used in con- junction with any money which may be allotted by the State, for this purpose, or to take any action in relation thereto. Board of Se- lectmen.


Art. 8. To see if the Town will vote to raise and appropriate a sum of $551 for damages result- ing from land takings on Section No. 3 Woodbury Avenue-Hesper Street, said sum to be used in con- junction with any unexpended por- tion of the 1938 appropriation for this purpose, or to see what other action the Town will take in the matter, agreeable to the petition of the Board of Selectmen.


Art. 9. To see if the Town will vote to raise and appropriate a sum of $500 to be used in conjunction with a balance of approximately $300 of the 1938 appropriation, for relocating and replacing water main on Hesper Street; work to be done in conjunction with the Chapter 90 work for the improve- ment of Hesper Street; or to see what action the Town will take in the matter. Art. 10. To see if the Town will vote to raise and appropriate a sum of $6625.00 for replacing the

present 16-inch cement water main on Main Street with a 12-inch cast iron main from Irving Road to- ward Vine Street, for a distance of approximately 1400 feet; to in- clude also approximately 50 feet on Vine Street; work to be done in conjunction with the Chapter 90 work for the improvement of Main Street; or to see what other action the Town will take in the matter. Board of Selectmen.


Art. 11. To see if the Town will vote to raise and appropriate a sum of $850 for the purpose of maintaining during the ensuing year, the mosquito control work as estimated, and certified to, by the State Reclamation Board in ac- cordance with the provisions of Chapter 112, Acts of 1931.


Art. 12. To see if the Town will vote to raise and appropriate a sum of $3000 for the purpose of installing water services as re- quested, or to see what other ac- tion the Town will take in the matter. Agreeable to the petition of the Board of Selectmen.


Art. 13. To see if the Town will vote to raise and appropriate a sum of $2000 for the continuation of the widening of Central Street from a point above the mills to- ward Walnut Street; or to see what other action the Town will take in the matter; agreeable to the petition of Chester Gibson and others.


Art. 14. To see if the Town will vote to take by right of eminent domain a plot of land of approxi- mately 4700 plus or minus square feet shown as part of Lot A-4, Plan 3018, and located at the junc- tion of Ballard and Dudley Streets; or to see what other action the Town will take in the matter. Board of Selectmen.


Art. 15. To see if the Town will vote to change the Zoning By-Law and Zoning Map so that property of Henry J. Penney at 125 How- ard Street shall be rezoned from residential to business purposes, agreeable to the petition of Ellery E. Metcalf and others.


Art. 16. To see if the Town will vote to take by right of eminent domain a plot of land of approxi- mately 1960 plus or minus square feet shown as a part of Lot A-4, Plan 3018, and located at the junc- tion of Ballard and Dudley Streets; or to see what other action the Town will take in the matter. Board of Selectmen.


Art. 17. To see if the Town will vote to appropriate the sum of $9500.00 for the purchase of a 750-gallon triple combination fire pump for the Fire Department, or to see what action the Town will take in the matter, agreeable to" the petition of the Board of Fire Engineers.

Art. 22. To see if the Town will vote to raise and appropriate sum of $1350 for resurfacing Pratt Street and a part of Grand- view Avenue, or to see what other action the Town will take in the matter; agreeable to the petition of Reginald Hutton and others.


Art. 23. To see if the Town will vote to raise and appropriate a sum of $5500 for the purchase of a power roller, or to see what other action the Town will take in the matter. Board of Selectmen.


Art. 24. To see if the Town will appropriate the sum of Twenty-Six Hundred and Seven Dollars and Fifty Cents ($2607.50) for the pur- pose of constructing Beech Street from Vine Street to Elmwood Ave- nue, agreeable to the petition of Charles A. Turcotte and others.


Art. 25. To see if the Town will adopt the following By-Law and Ordinance regulating the de- livery hours of milk in the Town of Saugus or to see what action the Town will take in the matter:


"During the period from May 15th to October 15th, inclusive, of each year, no person, firm or cor- poration shall deliver or cause to be delivered milk or cream from any vehicle, wagon, cart or other conveyance whether motor, horse- drawn or however propelled, to, into or left upon any residential premises or part thereof, and in- tended for consumption by resi- dent or residents therein, except between the hours of five o'clock A. M. and six o'clock P. M. of any day; provided that nothing herein contained shall be construed to prohibit such delivery at any time to hotels or restaurants for public use or to hospitals. The word "milk" as used in this regulation shall include milk and cream in- tended for human consumption as milk or cream, but shall not in- clude condensed or evaporated milk in hermetically sealed cans."

Art. 26. To see if the Town will vote to amend the Zoning Map and Zoning By-Law so that the proper- ty on or near Cliff Road, shown as Lots A-160, A-135, and A-159, on Plan No. 1027, on file in the Asses- sors office shall be zoned for in- dustrial purposes, or to see what action the Town will take in the matter agreeable to the petition of Eugene B. Fiske and others.


Art. 27. To see if the Town will vote to name. the Saugus High School Addition building "The Ar- thur D. Hitchings Building" in memory of the late Arthur D. Hitchings, a member of the Build- ing Committee, or to see what ac- tion the Town will take in the matter, agreeable to the petition of the School Committee.


Art. 28. To see if the Town will vote to rezone for business purposes a parcel of land being part of Lot A-6, Plan 1046, on file with the Assessors and described as follows:


Starting at a point on the east- erly side of Broadway, said point being a stone-bound at station 172+57.36 on a new State layout

1936; thence the line runs north- erly along Broadway, a distance of one hundred and twenty-five (125.0) feet; thence turning at a right angle and running in an easterly direction eighty (80.0) feet; thence turning at a right angle and running in a southerly direction one hundred and twenty- five (125.0) feet; thence turning at a right angle and running in a westerly direction a distance of eighty (80.0) feet, to the point of beginning and containing approxi- mately 10,000 square feet, Agree- able to the petition of Charles W. Donovan and others.


Art. 29. To see if the Town will vote to take by eminent domain proceedings Waverly Avenue and Overlook Terrace, agreeable to the petition of William Baker and others.


Art. 30. To see if the Town will vote to appropriate the sum of $1000.00 for the purpose of con- structing a gravel sidewalk on either side of Bristow Street, or to see what action the Town will take in the matter agreeable to the petition of the Bristow Street Civic Association.


Art. 31. To see if the Town will vote to appropriate the sum of $850 to be expended under the dir- ection of the Town Treasurer to- investigate and to determine the validity of tax titles held by the Town; or to see what action the Town will take in the matter, agreable to the petition of the Town Treasurer.


Art. 32. To see if the Town will vote to raise and appropriate a sum of $2000 for the repair and improvement of the upper end of Elm Street from Walnut Street to Lenox Avenue; agreeable to the petition of O. F. Perrson and others.


Art. 33. To see if the Town will vote to indemnify Joseph A. Lam- bert, Jr., for damages incurred by him in the defense or settlement of claims of Joseph M. Stapleton and Winifred Stapleton against him for bodily injuries arising out


of the operation of a motor vehicle owned by the Town while acting within the scope of his duties as a police officer, and appropriate a sum of money for said purpose; or to see what action the Town will take in the matter, agreeable to the petition of Edward Gibbs, Jr., and others.


Art. 34. To see if the Town will vote to appropriate the sum of $2600.00 for the purpose of in- stalling a two-way radio system in the Police Department, or to see what action the Town will take in the matter, agreeable to the petition of John T. Stuart and others.


Art. 35. To see if the Town will vote to appoint a committee of five to investigate the advisability of having the Collector of Taxes receive an annual salary as may be designated and appropriated by the Town Meeting and that all fees as defined by law in accord- ance with Sections 15 and 15A, Chapter 60 of the General Laws, and all subsequent laws concern- ing fees, that are now retained by the Collector, shall be turned into the Treasury of the Town as a Town income; said committee to make their report at any subse- quent Special Town Meeting, if possible, but not later than the Annual Town Meeting of 1940, ac- cording to the petition of Russell E. Chesley and others.


Art. 36. To see if the Town will vote to prohibit the sale of Alco- holic Beverages within a radius of 300 feet of any public of private school, church, library or play- ground, or to see what action the Town will take in the matter, agreeable to the petition of Sam- uel A. Phinney and others.


Art. 37. To see if the Town will vote to have the Board of Public Welfare, consisting of three members, elected as follows: one to be elected for a term of three years, one to be elected for a term of two years, and one to be elect- ed for a term of one year at the Annual Town Meeting of 1940, and that thereafter there shall be an-

nually elected one member of the Board of Public Welfare for a term of three years, or to see what action the Town will take, agreeable to the petition of Jo- seph G. Fisher and others.


Art. 38. To see if the Town will vote to amend the Zoning By-Law and Zoning Map of the Town of Saugus so that the land shown on Assessors' Plan Number 2051 as Lots A-83 to A-80 inclusive, con- taining 6644 square feet of land, and Lots A-84 and A-85 containing 2906 square feet of land, and Lots A-90 to A-104 inclusive contain- ing 23,916 square feet of land, and Lots 45, 46, 47, and 48 on said plan, be rezoned for residential purposes, agreeable to the petition of Harold L. Sweeney and others.


Art. 39. To see if the Town will vote to acquire by purchase or by eminent domain, under Chap- ter 79 of the General Laws, three parcels of land on the southwester- ly side of Essex Street shown as Lots 1-A, 2-A, and 3-A on Plan 2062 on file in the Assessors' of- fice for the purpose of erecting thereon a building as a memorial to persons who served in the mili- tary or naval service of the United States in the World War, and/or as a fire station, and appropriate a sum of money therefor, or to see what action the Town will take in the matter, agreeable to the petition of the Playground Com- mission.


Art. 40. To see if the Town will vote to appropriate the sum of $600.00 for the purpose of remov- ing a ledge about opposite No. 72 Jasper Street, and putting the road into passable condition, or to see what action the Town will take in the matter, agreeable to the petition of Theodore R. Schu- macher and others.


Art. 41. To see if the Town will vote to appropriate a sum of $8075 for the improvement of Fairmount Avenue from Walnut Street to the Lynn line, or to see what action the Town will take in the matter, agreeable to the peti- tion of the Lynnhurst Men's Club.


Art. 42. To see if the Town will appropriate the sum of $3000.00 for the purchase and installation. of a thirty (30) ton Scale and Scale House, and approve a loca- tion for the same, or to see what action the Town will take in the matter, agreeable to the petition of Edward Gibbs, Jr., and others.


Art. 43. To see if the Town of Saugus will appropriate the sum of $1800.00 for material for a water main on Walden Pond Ave- nue, a distance of 1380 feet, more or less, labor to be supplied under a W. P. A. project, or to see what action the Town will take in the matter, agreeable to the petition of Peter S. Petkewich and others.


Art. 44. To see if the Town will vote to appropriate the sum of $1700.00 to gravel, oil, and shape Walden Pond Avenue for a dis- tance of about 1200 feet, or to see what action the Town will take in the matter agreeable to the petition of R. W. Abbott and others.


Art. 45. To see if the Town will vote to raise by borrowing, or otherwise, and appropriate the sum of Four Thousand Dollars ($4,000) for the purpose of widen- ing and resurfacing Central Street from No. 144 Central Street north- erly, or to see what action the Town will take in the matter, agleeable to the petition of Ches- ter P. Gibson and others.


Art. 46. To see if the Town will vote to accept Charlotte Road in accordance with plan and profile on file with the Town Clerk.


Art. 47. To see if the Town will' vote to accept Trull Circle in ac- cordance with plan and profile on file with the Town Clerk.


Art. 48. To see if the Town will' vote to accept Waverly Avenue in accordance with plan and profile on file with the Town Clerk.


Art. 49. To see if the Town will' vote to accept Overlook Terrace, in: accordance with plan and profile on file with the Town Clerk.

Art. 57. To see if the Town will vote to raise and appropriate the sum of $6,855.66, said sum be- ing the portion of the Town of Saugus of the net sum so incurred for the care, maintenance and re- pair of a hospital for the treat- ment of those suffering from tu- berculosis and apportioned by the County Commissioners upon the inhabitants of the Town of Sau- gus.


Art. 58. To see what action the Town will take upon the following question: Shall the Selectmen of the Town of Saugus be instructed to control and regulate the taking of eels, any and all kinds of shell- fish and sea worms from the flats and waters in the Town of Saugus under authority of Section 48, Chapter 130 of the General Laws as amended by Chapter 329 of the Acts of 1933.


Art. 59. To see if the Town will vote to change the Zoning Laws, so that the following parcel of land may henceforth be used for business purposes:


Being a certain tract of land situated on the East side of the Newburyport Turnpike and des- cribed as follows: Beginning at the junction of this land with that of Delaney and thence running along the center of a fifteen Right of Way by a broken line, the northerly side of which Right of Way is described as follows, eight lines, the one nearest the Turn- pike being 17.97 feet, thence 30.48, thence 70.24; thence 70.00 feet; thence 50.0 feet; thence 153.15 feet; thence 36.5 feet; thence 101.32-this latter being the last line of these eight lines, thence the line runs northerly 40.0, thence easterly 250.00, thence southerly 290.0 feet, thence westerly 300.0 feet; thence southerly 131 feet, thence westerly 349.0 feet to the Turnpike, thence the line turns and runs northerly along the Turn- pike to a Stone Bound, 93.29 feet, thence northerly again from the Stone Bound 44.71 feet to land of Shute, thence the line turns and runs easterly by land of Shute 300.0 feet, thence the line runs northerly 146.0 feet, thence the line runs along the Turnpike -- northerly to the center line of the fifteen Right of Way-a distance of 381.0-containing five acres; agreeable to the petition of John DeCotis and. others.


Art. 60. To see if the Town will vote to amend the Zoning By- Laws and Zoning Map by rezoning for business purposes the property owned by Fred M. Berry located at Walnut Street and adjacent to land owned by Cogger and Moses now zoned as single residence and described as follows:


Beginning at a point 12.0 feet S. E. from a stone bound marked E. C. on county layout of 1926, said bound being on the westerly side of said Walnut Street; thence the line runs Easterly by Walnut 257.71 feet; thence Southeast by land now or late of Cogger 667.00 feet; thence Northwest by a stone-

wall and a brook 430.00 feet; thence Northeasterly by land now or late of Moses 132.25 feet;


Northerly by said Moses land 182.12 feet; again Easterly by said Moses land 50 feet; and again Northerly by said Moses land 102.12 feet to point of beginning. Be all of said measurements more or less. The same being shown as Lot A-1 on Plan 1046 on file in the Assessors' Office.


Or to see what action the Town will take in the matter, agreeable to the petition of Fred Mitchell Berry and others.


Art. 61. To see if the Town will vote to have a fire alarm box installed on Walden Pond Avenue, agreeable to the petition of Clara L. Roberts and others.


Art. 62. To see if the Town will vote to appropriate a sum of $600 for the purpose of installing a 6-inch cast iron water main for a distance of approximately 260 feet on Douglas Road; this 6-inch main to replace a three-quarter-inch galvanized pipe that is now ser- vicing four homes; or to see what other action the Town will take in the matter, agreeable to the peti- tion of the Board of Selectmen.


Art. 63. To see if the Town will vote to locate and maintain the following street lights: one at the junction of Lindsell Street and Venice Avenue, one at Seagirt Avenue and one at Harlow Street, agreeable to the petition of the Bristow Street Civic Association.


Art. 64. To see if the Town will vote to appropriate the sum of $2,000 to repair Fairmount Ave- nue from Walnut Street to the Lynn line by leveling it and roll- ing it down and give it a good coat of tar and sand, or to see what action the Town will take in the matter, agreeable to the Lynn- hurst Men's Club.


Art. 65. To see if the Town will vote to accept Section 2 of Chapter 420 of the Acts of 1938 entitled "An Act providing for one day off in every six for police officers of certain cities and


towns," or to see what action the Town will take in the matter, agreeable to the petition of John J. Bucchiere and others.


Art. 66. To see if the Town will vote to accept from New England Home Builders, Inc., two lots of land situated in that part of Sau- gus, Massachusetts, known as Oaklandvale. Said lots being shown as Lots 59 and 60 on a plan of lands belonging to the New Eng- land Home Builders, Inc., dated October 16, 1937, and filed with the Land Court Division of the Essex Registry of Deeds as Plan 16764-B, and bounded and des- cribed as follows:


Southwesterly by Bennett Ave- nue, one hundred thirty-five and 76/100 (135.76) feet; westerly by lot 61 as shown on said plan, eighty-one and 69/100 (81.69) feet; northwesterly by Lots, 1, 2, and 3 as shown on said plan, one hundred ninety-three and 20/100 (193.20) feet; northeasterly by land now or formerly of Kiley, one hundred ninety-three and 51/100 (193.51) feet; and southeasterly by Lot 58 as shown on said plan, one hundred eighty-seven and 52/100 (187.52) feet. Said lots together containing 40,459 square feet.


Said premises are to be used for school and playground purposes only, or, with the consent of the said grantor, may be used for any other purposes. Planning Board.


Art. 67. To see if the Town will appropriate a sum of money for the reconstruction and sur- facing of Kenwood Avenue for a distance of approximately 1100 feet, said street being bounded by Waban Street on the South and Winter Street on the North, agree- able to the petition of Gustaf A. Bardh and others.


Art. 68. To see if the Town will vote to purchase or take by eminent domain for the develop- ment of the East Saugus River Basin the following land as des- cribed by Lots A-1, A-2, A-43, A-47, A-5, A-9, A-42, A-41 and part of A-3, as shown on plan 3011
