ARTICLE I. To see if the town will vote to lay a water main in Arbutus road and appropriate the sum of $1, 110 for the same, as recommended by the Board of Water Commissioners.

find that the streets named therein are not yet constructed and no houses built or started thereon, and as it has never been the policy of the town to lay water mains unless need was shown for the same, and inasmuch as this article has not been recommended by the Water Commissioners, we recommend that this article be indefinitely postponed.


ART. 8. To see if the town will vote to extend its water pipe in the westerly end of Bradlee avenue, beginning at Stanwood road, so called, and appropriate money for the same as petitioned for by Carroll R. Brown and others.


Your committee favors this article, provided interest at the rate of 6 per cent is paid on the investment until the water rates of the users equal the interest. We recommend that a water main be laid under above condi- tions and the sum of $350 be appropriated for the same, to be raised by bonds or notes of the town.


ART. 9. To see if the town will vote to construct a sewer in Bay View avenue and appropriate money for the same, as petitioned for by M. J. Ryan and others.


The needs for a sewer in Bay View avenue have been investigated by your committee and it is imperative that immediate steps be taken to relieve the present conditions. We recommend that $3,500 be appropri- ated for the construction of the Bay View avenue sewer, to be raised by bonds or notes of the town.


ART. 10. To see if the town will vote to construct a sewer in Cedar Hill terrace, and appropriate money for the same, as petitioned for by Selwyn B. Parker and others.


It has been shown by previous reports of your committee that the con- struction of a sewer in Bay View avenue would necessarily mean that a sewer must first be constructed in Cedar Hill terrace, as this is the natural course for sewage to flow to the pumping station. We recommend that the sum of $4,500 be appropriated for the construction of a sewer in Cedar Hill terrace, to be raised by bonds or notes of the town.


ART. II. To see if the town will vote to lay a 6-inch water main in Cedar Hill terrace, and appropriate money for the same, as recommended by the Water and Sewerage Boards.


There are at the present time, nine houses on Cedar Hill terrace, which get their water from a small galvanized iron pipe, with no hydrant pro- tection. If a sewer is to be built in the street, it will be an opportune time to lay a new water main, as it can be laid in the trench that is to be blasted out for the sewer. We recommend that the sum of $600 be appro- priated for the purpose of this article, to be raised by bonds or notes of the town.


ART. 12. To hear and act upon the report of the Water and Sewerage Board with reference to Phillips park drain, and appropriate money for the completion of the same.


We have consulted with the Water and Sewerage Board with reference to this matter and are advised by them that a further appropriation of $1,200 is necessary to finish the work. We recommend that appropria- tion of $1,200 for the completion of the Phillips park drain, this sum to be raised by bonds or notes of the town.


ART. 13. To see if the town will vote to authorize the Water and Sewerage Board to exchange land with the E. R. Grabow Company in accordance with the plan drawn by the Town Engineer, as recommended by the Water and Sewerage Board.


Your committee has examined the plans showing the proposed exchange of land between the E. R. Grabow Company and the Town of Swamp- scott in order to straighten property lines near the pumping station and believe that it is for the best interest of the town to make the exchange as proposed. We recommend the adoption of this article.


ART. 14. To see if the town will vote an additional appropriation of $1,000 for sewer maintenance, as recommended by the Water and Sewer- age Board.

At the annual town meeting of 1916, the sum of $846.30 was appropri- ated for use of a committee, consisting of the Board of Selectmen and Water and Sewerage Board, to investigate conditions at the Sewer Pumping Station. As this money has not been used for this purpose, it is available for other purposes if the town so votes. We recommend that $846.30 be transferred to the account of sewer maintenance, as recommended by Water and Sewerage Board.


ART. 15. To see if the town will grant permission to the Board of Engineers of the Fire Department to dispose of the old boiler and fittings removed from the Central Engine House. We recommend that the Board of Engineers of the Fire Department be authorized to dispose of the old boiler and fittings, removed from the Central Engine House, to the best advantage, the proceeds to revert to the town treasury.


ART. 16. To see if the town will vote to convey certain land to E. R. Grabow Company, in consideration of the conveyance of certain other land to the town by said company for the purpose of straightening boundary lines between land owned by the town and by said company, as recommended by the Park Commissioners.


This article, as proposed, would straighten the property line between the E. R. Grabow Co. and Phillips Park. After careful deliberation, your committee believes that the exchange would be beneficial to the town and recommends that the Park Commissioners be authorized to make the transfer.


ART. 17. To see if the town will vote to increase the pay of all town laborers twenty-five cents per day, and make appropriations therefor, said increase not to void present conditions relative to holidays, as petitioned by Elias G. Hodgkins and others.


Your committee has always taken the position that requests of this na- ture should properly be presented to the annual town meeting when the budget for the year is made up. We recommend that this article be re- ferred to the next annual town meeting.


ART. 18. To see if the town will vote an increase of fifty cents per day, making pay of laborers of the Highway Department $3.00 per day, or on the basis of a weekly wage of $15.00, as recommended by John Fin- negan and others. The same objection applies to this article as in the case of Article 17, and we recommend its reference to the next annual town meeting.


ART. 19. To see if the town will appropriate the sum of $1,000 for the purchase of ashes, and for the spreading of the same at Phillips Park, as recommended by the Board of Park Commissioners.


We are advised by the Town Counsel that as there is no money available at this time, such an appropriation cannot be legally made, and we rec- ommend that this article be indefinitely postponed.


ART. 20. To see if the town will appropriate the sum of $3,000 to build a house for the Superintendent of Cemeteries on the lot now owned by the town on Essex street, opposite the cemetery, as recommended by Edward A. Maxfield and others.


Your committee is advised by Town Counsel that this article does not sufficiently show on its face that the money is to be used for municipal purposes, and, consequently an appropriation could not legally be made. We recommend that this article be indefinitely postponed.


ART. 23. To hear and act upon the recommendation of the committee appointed to look into the situation at the Machon School, and appropri- ate money for the same.


We have read the report and examined the plans presented by the com- mittee appointed to look into the situation at the Machon School, and we recommend that a committee be appointed with power to secure the se- cure the services of an architect to provide plans and specifications for an 8-room building as recommended, in the report of the committee, and that this committee report at the next annual town meeting, the total cost of this project. No appropriation is necessary at this time.


ART. 25. To see if the town will vote to transfer from the appropria-

tion made for the construction of the drain on Monument avenue the un- expended balance of $45.19 to the Monument avenue appropriation of the Park Department, as recommended by the Park Commissioners.


Your committee considers that the appropriation of $700 made at the annual town meeting for the maintenance of Monument avenue park, is sufficient for the current year and recommend that this article be indefi- nitely postponed.


ART. 26. To see if the town will vote to transfer the unexpended bal- ance of overlay for 1914, amounting to $998.83 to the overlay account of 1916, as recommended by the Board of Assessors.


We are informed by the Town Counsel that this unexpended balance of the overlay for 1914 cannot be used for the purpose of this article. We recommend that the article be indefinitely postponed.


ART. 27. To see if the town will vote to appropriate money for the de- pendent families of soldiers called to the colors in connection with the trouble on the Mexican border, as recommended by the Board of Select- men.


We recommend an appropriation of $900 for the purpose specified in this article, the money to be raised by a note of the town, in accordance with the provisions of Chap. 314 of the Acts of 1916. The town will be reimbursed for this expenditure by the Commonwealth.


ART. 28. To see if the town will appropriate the sum of $256.80 to es- tablish a pension fund for town employees as provided for under Chap- 503, Acts of 1912.


As this appropriation is asked for to take care of an extraordinary and unforseen expense, it may, according to the Municipal Finance Act, be appropriated from the Reserve Fund. We recommend that $256.80 be transferred from the Reserve Fund for the purpose of this article.


ART. 29. To see if the town will appropriate the sum of $175 for the maintenance of the office of Dog Officer.


By some oversight or accident, there was no article in the warrant for the Annual Town Meeting, which called for an appropriation for the Dog Officer. As this obviously is an unforseen expense, we recommend that the sum of $175 be transferred from the Reserve Fund for the purpose of this article.


ART. 30. To see if the town will appropriate additional appropriation for the use of the Legal Department, as recommended by the Board of Selectmen.


An unexpected bill for legal services in a previous year had to be paid out of this year's appropriation, which left practically nothing for the expenses of the Law Department for the current year. We recommend that the sum of $500 be transferred from the Reserve Fund for the expenses of the Law Department.


ART. 31. To appropriate and raise by borrowing, or otherwise, such sum or sums of money as may be necessary for all or any of the purposes mentioned in the foregoing articles. We recommend that the following be fixed as the particulars of the bonds or notes to be issued by the town pursuant to and for the purposes specified in Articles 1, 2, 3, 4, 5, 6, 8 and II, relating respectively to the appropriation of $1,110 for a water main in Arbutus road; $640 for a water main in Sargent road; $460 for a water main in Stimpson street; $1,800 for a water main in Prospect avenue ; $700 for a water main in Aspen road; $840 for a water main in Bradlee avenue; $350 for the extension of the water pipe in the westerly end of Bradlee avenue, beginning at Stanwood road; $600 for a water main in Cedar Hill terrace, said appropriation aggregating $6,500.


There shall be 13 bonds or notes of the town for the sum of $500 each, numbered I to 13 inclusive. They shall be dated during the current year. The bond or note numbered I shall be payable one year from the date thereof, and one bond or note shall be payable each year thereafter in their numerical order. Said bonds or notes shall bear the town seal, shall be signed by the Town Treasurer and countersigned by a majority of the Board of Selectmen and of the Water Commissioners (now Water and

Sewerage Board), shall bear interest at a rate not exceeding four and one- half per centum per annum, payable semi-annually, shall be authenticated by some Bank or Trust Company, or by the Massachusetts Bureau of Statistics, shall be subject to registration at the holder's option on the presentation to the Town Treasurer for cancellation of coupons, if coupon bonds or notes are issued, and appropriate endorsement.


Principal and interest shall be payable at the office of the Town Treas- urer or at such Bank or Trust Company as the Town Treasurer and Board of Selectmen shall designate. Said bonds or notes shall bear on their face the words " Swampscott Additional Water Loan, Act of 1912." Said bonds or notes shall be sold under the direction of the Town Treasurer and the Board of Selectmen.


All other particulars as to form, issuance and sale of said bonds or notes shall be determined by the Town Treasurer and the Board of Select- men, but said bonds or notes shall not be sold for less than par and interest.


We recommend that the following be fixed as the particulars of the bonds or notes to be issued by the town, pursuant to and for the purposes specified in articles 9, 10 and 12, relating respectively to the appropria- tion of $3,500 for a sewer in Bay View avenue, $4,500 for a sewer in Cedar Hill terrace, and $1,200 for the completion of Phillips Park drain, said appropriation aggregating $9,200.


There shall be 18 bonds or notes of the town, one for the sum of $700, numbered 1, and 17 for the sum of $500 each, numbered 2 to 18, inclusive. They shall be dated during the current year. The bond or note numbered I shall be payable one year from the date thereof, and one bond or note shall be payable each year thereafter in their numerical order. Said bonds or notes countersigned by a majority of the Board of Selectmen, shall bear interest at a rate not exceeding four and one-half per centum per annum, payable semi-annually, shall be authenticated by some Bank or Trust Company, or by the Massachusetts Bureau of Statistics, shall be subject to registration at the holder's option on the presentation to the Town Treas- urer for cancellation of coupons, if coupon bonds and notes are issued, and appropriate endorsement.

In accordance with adjournment the voters of the town assembled at the Town Hall on Friday evening, October 6, 1916, the required number being present for the transaction of business.


Meeting called to order by Daniel F. Knowlton, Moderator. The record of last meeting read and approved.


ART. 24. By-laws.


Voted, Article 24. To lay Chapter I upon the table and to act upon Chapter 2.


Voted, Article 24. Upon the several motions made to accept and adopt the following by-laws as read.


CHAPTER II.


SECTION I. The annual town meeting shall be held on the third Monday in February in each year. For the election of officers polls shall be open at six o'clock in the forenoon, and they shall remain open until 4.30 o'clock in the afternoon, after which time a vote may be passed to close them in not less than ten minutes. After the declaration of votes for officers the meeting shall be adjourned to the Tuesday next thereafter at 7.45 P. M., when the remaining articles of the warrant shall be acted upon.


SECT. 2. The number of voters necessary to constitute a quorum at a town meeting shall be 100, except at a meeting devoted exclusively to the election of town officers.


SECT. 3. The warrant for a town meeting shall be served by posting an attested copy thereof at the Town Hall, Post Offices, and three other public and conspicuous places in the town, seven days before the day appointed for said meeting.


SECT. 4. The warrant shall conform to the provisions of the Statutes of the Commonwealth, and the Selectmen shall append to each article

therein, the insertion of which is requested by ten or more voters, the name of the first person signing said request, and the words " and others."


SECT. 5. Whenever the warrant for any town meeting contains an article appropriating or involving the expenditure of inoney, creating a debt, or disposing of town property, the Selectmen shall send a copy of the warrant containing such article to the Finance Committee six days before the day named in the warrant for holding said town meeting. The committee shall consider the same, and make report thereon with their recommendations to the town meeting.


SECT. 6. The Moderator, while occupying the chair, shall not partici- pate in any discussion before the meeting.


SECT. 7. Every voter speaking upon a subject in any meeting shall confine his remarks to the question before the meeting, avoid personali- ties and be seated when he has finished.


SECT. 8. No voter rising to move a question shall proceed to speak thereon until the motion has been distinctly stated to the meeting by the Moderator, and no person speaking shall be interrupted by another but by rising to state a question of order.


When called to order by the Moderator, the person having the floor shall be seated until the point of order is decided, and if the decision be that the point of order is not well taken, the original speaker immediately be given the floor.


SECT. 9. Every question of order shall be decided by the Moderator, but upon an appeal to the meeting from the decision of the Moderator, the ground of such appeal shall be briefly stated, and the question decided by the meeting without debate.


SECT. 10. Upon taking the question, if the decision of the Moderator is doubted, or a division of the house called for, the Moderator shall request the house to be seated, and shall appoint tellers. The question shall then be distinctly stated, and those in the affirmative and negative, respectively, shall be requested to rise and stand until they are counted by the tellers, who shall carefully count each side and make report thereof to the Moder- ator, and no persen shall be counted who does not occupy a seat, provided that the tellers under the direction of the Moderator may count the votes of those who are unable to obtain seats.


SECT. II. No voter shall speak upon the same question more than twice, nor more than twenty minutes, nor until others who have not spoken upon the question shall speak if they desire it, without first leave of the meeting, except for the correction of an error, or to make an ex- planation.


SECT. 12. When a question is under debate, no motion shall be re- ceived but to adjourn the meeting, to lay on the table to commit, to amend, to refer, to postpone to a day certain, or to postpone indefinitely, which several motions shall have precedence in the order named.


SECT. 13 Articles in the warrant shall be acted upon in their order, unless two or more articles relate to the same subject matter, when they may be considered jointly.
