Article 4. To see what action the town will take in relation to salaries of elected town officials for the ensuing year. Sponsored by the Board of Selectmen.


Article 5. To see what action the town will take in relation to the recommendations not calling for the appropriation of money, as contained in the reports of officers, boards or committees. Spon- sored by the Board of Selectmen.


Article 6. To see what action the town will take in relation to the recommendations calling for the appropriation or expenditure of money, and creation of a debt, or the disposition of town prop- erty, as set forth in the reports of officers, boards or committees. Article 7. To see what action the town will take in relation to the appropriation of money for departmental and other expenses, as listed in the budget in the Selectmen's report on pages 220 and 221 of the annual town report. Sponsored by the Board of Select- men.


Article 8. To see if the town will authorize the Board of As- sessors, the Board of Park Commissioners and the Planning Board each, to appoint a member of such boards to act as secretary there- of and receive pay therefor, as provided by Chapter 41, Section 4A, of the General Laws (Ter. Article 9. To see if the town will appropriate a sum of money for the treatment of mosquito breeding places. Sponsored by the Board of Selectmen and the Board of Health.


'Article 10. To see if the town will vote to appropriate to the account of unpaid bills the sum of $835.78 covering bills contracted prior to January 1, 1940, and remaining unpaid at the time of clos- ing the books for the year 1939, according to the records of the Town Accountant. Article 11. To see if the town will vote to remove any or all of the car tracks now located in Swampscott and/or resurface the streets from which the said car tracks are removed and appropriate money therefor. Sponsored by the Board of Selectmen.

Article 12. To see if the town will accept Chapter 403 of the Acts of 1936 providing for the inclusion of additional public employ- ees within the provisions of the Workmen's Compensation Law, as petitioned for by Clarence W. Horton et al.


Article 13. To see if the town will authorize the Board of Pub- lic Welfare to appoint one of its own members as agent and invest- igating officer and fix the salary of such an appointee at $1500 and appropriate money therefor as provided by Chapter 41, Section 4A, of the General Laws (Ter. Ed.). Sponsored by the Board of Pub- lic Welfare.


Article 14. To see if the town will authorize the Bureau of Old 'Age Assistance to appoint one of its own members as agent and in- vestigating officer and appropriate money therefor, or take any ac- tion relative thereto. Sponsored by the Bureau of Old Age Assist- ance.


Article 15. To see if the town will authorize the Park Depart- ment to purchase a one and one-half ton dump body truck to re- place the present six-year old truck and appropriate money there- for. Sponsored by the Board of Park Commissioners.


Article 16. To see if the town will authorize the Board of Park Commissioners to raise the grade of a portion of that section of Phillips Park adjacent to the easterly side of the football field and appropriate money therefor, or take any action relative thereto. Sponsored by the Board of Park Commissioners.


Article 17. To see if the town will authorize the Board of Park Commissioners to build approximately 180 lineal feet of ten (10) row bleachers duplicating the present steel bleachers to be located on the westerly side of the football field at Phillips Park and appro- priate money therefor, or take any action relative thereto. Spon- sored by the Board of Park Commissioners.


Article 18. To see if the town will vote to exchange a parcel of land at the corner of The Greenway and Essex street containing about 1340 square feet with the Almy Estate for an adjoining lot marked A on a plan entitled "Progress Park" drawn by Charles W. Gay, dated November 30, 1934, containing about 1997 square feet. Sponsored by the Board of Park Commissioners.


Article 19. To see if the town will vote to relay the water main in Salem street, a distance of about 3650 feet, and appropriate money for the same. Sponsored by the Water and Sewerage Board.


Article 20. To see if the town will vote to lay a water main in Lewis road, a distance of about 350 feet and appropriate money for the same. Sponsored by the Water and Sewerage Board.


Article 21. To see if the town will vote to lay a water main in Walnut road, a distance of about 330 feet, and appropriate money for the same. Sponsored by the Water and Sewerage Board.

Article 32. To see if the town will vote to purchase a new three and one-half ton truck for the use of the Highway Department re- placing the old White truck which has been in service for thirteen years and appropriate money therefor. Sponsored by the Surveyor of Highways.


Article 33. To see if the town will vote to remove the car tracks in Humphrey street between Atlantic avenue and the Marblehead line, and resurface, with bituminous macadam or other suitable material, the said street between these two points, a distance of about 4,800 feet, and appropriate money therefor. Sponsored by the Surveyor of Highways.


Article 34. To see if the town will vote to appropriate or trans- fer the sum of seventy dollars to the account of Accounting Wages for the purpose of paying the Town Accountant the full salary for the year 1939, as petitioned for by Roger J. Connell et al.


Article 35. To see if the town will vote to transfer from the Excess and Deficiency Fund of the town to the account of Current Revenue such sum of money as the Board of Assessors may deem advisable, said sum to be used and applied by the Board of Asses- sors in reduction of the tax levy, or take any action relative there- to. Article 36. To see if the town will vote to appropriate a sum of money as the town's contribution to the Federal Music Project from September 1, 1939 to December 31, 1939, or take any action relative thereto. Sponsored by the Board of Selectmen.

Article 40. To see if the town will vote to purchase a new ser- vice truck to replace the old one now in use and appropriate the sum of $800 therefor or take any action relative thereto. Sponsored by the Board of Fire Engineers.


Article 41. To see if the town will vote to make such repairs, renovations, alterations or changes as has been ordered by the Board of Health at the Central Fire Engine House on New Ocean street, and appropriate the sum of $3,000 therefor or take any action relative thereto. Article 42. To see if the town will vote to replace or repair the floor at the Phillips Beach Fire Engine House and make such other repairs as have been recommended by the Building Inspector and appropriate money therefor or take any action relative thereto. Article 43. To see if the town will vote to install oil burners and indirect hot water heaters at both the Phillips Beach Fire Engine House and the Central Fire Engine House and appropriate the sum of $875 therefor or take any action relative thereto. Sponsored by the Board of Fire Engineers.

To see if the town will vote to accept a three-year plan for the purchase of necessary equipment for the Fire Depart- ment and appropriate the sum of $1,000 for purchases to be made during the year 1940 under said plan, or take any action relative thereto. Article 46. To see if the town will vote to authorize the Board of Fire Engineers to appoint two permanent men to the regular force of the Fire Department and appropriate the sum of $3,600 therefor or take any action relative thereto. Sponsored by the Board of Fire Engineers.

To see if the town will vote to purchase a woods fire truck and equipment for the same, said truck to be designed and equipped to the satisfaction of the Chief of the Fire Department and appropriate the sum of $3,000 therefor or take any action rela- tive thereto. Article 48. To see if the town will vote to accept Cardillo ter- race, so-called, as a public way as laid out by the Board of Selectmen in accordance with plans drawn by W. W. Article 49. To see if the town will vote to appropriate the sum of $500.00 to be used for a full time police officer to patrol Fishermen's Beach during the bathing season, or take any action relative thereto, as petitioned for by Herbert W. Andrews et al.


Article 50. To see if the town will vote to appropriate $300 for the Joseph L. Stevens Post 1240 Veterans of Foreign Wars to be used in entertaining delegates and guests attending the annual State convention at Lynn of the department V. F. W. during the month of June, and appropriate money for the same, as petitioned for by Frank E. Morrison et al.


Article 51. To see if the town will vote to accept Allen road as a public way as laid out by the Board of Survey, in accordance with the plans drawn by W. W. Pratt, Town Engineer, as petitioned for by William Edgar Carter et al.

Article 52. To see if the town will take land by eminent domain for the purpose of extending Sherwood road to Forest avenue, a dis- tance of about 150 lin. ft., and appropriate money for the same, as petitioned for by Winthrop M. Sears et al.


Article 53. To see if the town will vote to establish the yearly salary of the Board of Selectmen, as follows: Chairman $200.00 and the other members $150.00 each, as petitioned for by Clarence W. Horton et al.


Article 54. To see if the town of Swampscott will vote to ap- propriate the sum of $1,250 under the provisions of Chapter 115 of the Acts of 1939, for the purpose of providing proper facilities for public entertainment at the time of the National Convention of the American Legion to be held in Boston, in September of the current year, and for the paying of expenses incidental to such entertain- ment as petitioned for by the Leon E. To see if the town will vote that Chapter XII rel- ative to the zoning by-law of the Building By-Laws of the Town of Swampscott in 'Article II relative to General Residence Districts and Article III relative to Single Residence Districts be amended so that said Article II shall read as follows:

Article 76. To see if the town will vote to rescind the vote passed under Article 40 of the Warrant for the Annual Town Meet- ing of February 28, 1939, relating to an exchange of land between the town and the Universalist Church Society of Boston, Mass. Spon- sored by the Board of Selectmen.


Article 77. To see if the town will vote to exchange certain land adjacent to the Public Library on Burrill street in the Town of Swampscott, for land now owned by the Swampscott Universalist Society, of said Swampscott, and adjacent to the church property now occupied by the Public Library, in accordance with a plan drawn by W. W. Pratt, Town Engineer, entitled "Plan of exchange of land between the Town of Swampscott and the Swampscott Universalist Society," dated February, 1940; said exchange is to be made with- out expense to either party and is made for the purpose of straight- ening the line between the said property; and to authorize the Board of Selectmen to execute and deliver a proper deed conveying legal title to the said land; or take any action relative thereto. Article 78. To see if the town will vote to accept the laying out of a footway in Foster road, so-called, as made by the Board of Selectmen and as shown on a plan drawn by W. W. Pratt, Town En- gineer, and construct the same and appropriate money therefor or take any action relative thereto. Sponsored by the School Commit- tee and the Boasd of Selectmen.


Article 79. To appropriate and raise by borrowing or otherwise, under any general or special law which authorizes the town to raise money by borrowing or otherwise, such sum or sums of money as may be necessary for any or all of the purposes mentioned in the foregoing articles.


The polls will close at 7 P.M.


'And you are directed to serve this warrant by posting an at- tested copy thereof at the Town Hall, the Post Office, and at least two public and conspicuous places in each precinct in the town, and at or in the immediate vicinity of each railroad station in the town not less than seven days before the day appointed for said meeting.
