In the name of the Commonwealth of Massachusetts you are directed to notify the inhabitants of the Town of Swampscott quali- fied to vote in elections and in town affairs, to assemble in their respective precincts, in said Swampscott, to wit-


In Precinct One-Polling Place-Machon School on Burpee Road.


In Precinct Two-Polling Place-Phoenix Bowling Alleys, 217 Bur- rill Street.


In Precinct Three-Polling Place-Town Hall on Burrill Street.


In Precinct Four-Polling Place-Clarke School, adjoining Abbott Park.


In Precinct Five-Polling Place-Odd Fellows' Hall, 115 Elmwood Road.

Article 1. To choose a Moderator for one (1) year. To choose a Town Clerk for three (3) years.


To choose a Town Treasurer for one (1) year to fill vacancy. To choose three members of the Board of Selectmen for one (1) year.


To choose one member of the Board of Assessors for three (3) years.


To choose one member of the School Committee for three (3) years.

To see if the town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time, in anticipation of the revenue of the financial year beginning January 1, 1944, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws. Sponsored by the Board of Selectmen.


Article 4. To see what action the town will take in relation to salaries of elected town officials for the ensuing year. Sponsored by the Board of Selectmen.


Article 5. To see what action the town will take in relation to the recommendations not calling for the appropriation of money, as contained in the reports of officers, boards or committees. Sponsored by the Board of Selectmen.


Article 6. To see what action the town will take in relation to the recommendations calling for the appropriation or expenditure of money, and creation of a debt, or the disposition of town property, as set forth in the reports of officers, boards or committees. Spon- sored by the Board of Selectmen.


Article 7. To see what action the town will take on the matter of requiring all town officers receiving, filing, recording, or other fees to account for them to the town. Sponsored by the Board of Selectmen.


Article 8. To see what action the town will take in relation to the appropriation of money for departmental and other expenses, as listed in the budget in the Selectmen's report of the annual town report for the year 1942. Sponsored by the Board of Selectmen.


Article 9. To see if the town will authorize the Board of As- sessors, the Board of Park Commissioners and the Planning Board each, to appoint a member of such boards to act as secretary thereof and receive pay therefor, as provided by Chapter 41, Section 4A, of the General Laws (Ter. Ed.), Sponsored by the Board of Assessors, the Board of Park Commissioners and the Planning Board.

account of unpaid bills a sum of money to pay bills contracted prior to January 1, 1943 and remaining unpaid at the time of closing the books for the year 1942. Sponsored by the Town Accountant.


Article 11. To see if the town will vote to remove or cover over any or all of the car tracks now located in Swampscott and/or re- surface the streets from which the said car tracks are removed and appropriate money therefor. Sponsored by the Board of Selectmen.


Article 12. To see if the town will vote to raise and appropriate a sum of money for the improvement of Humphrey Street, or such other streets as the town meeting may determine; said money to be used in conjunction with any money which may be allotted by the Federal authorities, State, or County, or all of them, for this purpose; or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 13. To see if the town will vote to raise and appropriate a sum of money for the maintenance of Humphrey Street, or such other streets as the town meeting may determine; said money to be used in conjunction with any money which may be allotted by the Federal authorities, State or County, or all of them, for this pur- pose; or take any other action in relation thereto. Sponsored by the Board of Selectmen.


Article 14. To see if the town will authorize the Board of Public Welfare to appoint one of its own members as agent and investi- gating officer and fix the salary of such an appointee at $1,320.00 and appropriate money therefor as provided by Chapter 41, Section 4A of the General Laws (Ter. Ed.). Sponsored by the Board of Public Welfare.


Article 15. To see if the town will authorize the Bureau of Old Age Assistance to appoint one of its own members as agent and investigating officer and fix the salary of such an appointee at $330.00 and appropriate money therefor, or take any action relative thereto. Sponsored by the Bureau of Old Age Assistance.


Article 16. To see if the town will vote to appropriate a sum of money for the control and supervision of the gypsy and brown tail moth and tent caterpillar, as requested by the Department of Con- servation, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 17. To see if the town will appropriate a sum of money for the purpose of clearing the public ways of the Town of Swamp- scott of ragweed and/or other obnoxious weeds, and appropriate money therefor or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 18. To see if the town will vote to appropriate a sum of money to be used on and in connection with the W.P.A. Recrea- tional Project so called, or take any action relative thereto. Spon- sored by the Board of Selectmen.


Article 19. To see if the town will vote to appropriate a sum of money for the proper observance of the Fourth of July, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 20. To see if the town will vote to appropriate a sum of money for the proper observance of Armistice Day, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 21. To see if the town will vote to appropriate money with which to carry on a street and/or sidewalk construction pro-

gram in the town, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 22. To see if the town will vote to transfer from Excess and Deficiency Fund of the town to the account of Current Revenue such sum of money as the Board of Assessors may deem advisable, said sum to be used and applied by the Board of Assessors in reduction of the tax levy, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 23. To see what action the town will take on the matter of adopting the following regulations concerning the disposition of tax titles and lands, and real estate now owned by the town by virtue of foreclosure of the rights of redemption and by other means:


1. The possession and management of all lands now held or which may hereafter be acquired by the Town by virtue of takings and sales of land for the non-payment of taxes and by virtue of the foreclosure of the right of re- demption of the same under General Laws, Tercentenary Edition, Chapter 60, Sections 64 to 79 inclusive and any amendments thereto; and of any land acquired under the sale of lands of low value under the provisions General Laws, Tercentenary Edition, Chapter 60, Sections 79 to 81 inclusive and any amendments thereto, be, and hereby is, vested in the Board of Selectmen and that in the management of said lands the Selectmen, be, and hereby are, authorized to use the same for any municipal purpose they deem necessary and proper.


2. The Selectmen, together with the Town Treasurer, be, and hereby are, authorized to sell any lands that the Town now holds, or which it may hereafter acquire, by virtue of the foreclosure of the right of redemption of tax titles or by virtue of the purchase of lands of low value under the provisions of law; and that in the event of such a sale or sales, that the Town Treasurer, with the approval of a majority of the Selectmen, be, and hereby is, authorized to execute, acknowledge and deliver in the name and on behalf of the Town such releases, deeds, or other instrument or instruments that may be necessary to complete such con- veyance or conveyances.


3. The Treasurer, be, and hereby is, authorized to assign any and all tax titles now held or which may hereafter be acquired by the Town upon payment of all sums due it for taxes, interest and charges thereon at the date of such as- signment; and to execute, acknowledge and deliver in the name and behalf of the Town any assignment of assignments and all other instruments that may be necessary to complete the transfer of the same.

Article 24. To see what action the town will take on the matter of providing projects, for employment of certain persons in need thereof within the town; and for the purchase of materials to be used in connection therewith, and appropriate a sum of money there- for, or take any action relative thereto. Article 25. To see if the town will vote to repair or replace certain Air Pressure Tanks, so called, at present located in the Town

Hall, the same being a part of the present Fire Alarm System, and appropriate a sum of money therefor, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 26. To see what action the town will take on the mat- ter of establishing classifications as firemen, if those persons, who as a substantial part of their duties tend to boilers and heating apparatus in the public buildings of the town. Sponsored by the Board of Selectmen.


Article 27. To see if the town will vote to raise and appropriate a sum of money for the purpose of constructing a drain for Ellis Terrace in accordance with the plan of Howard L. Hamill, Town Engineer, dated March, 1942, entitled "Ellis Terrace Drain," or take any action thereto. Sponsored by Surveyor of Highways.


Article 28. To see if the town will vote to resurface Salem Street and appropriate money therefor, or take any action relative thereto. Sponsored by the Surveyor of Highways.


Article 29. To see what action the town will take on the matter of purchasing and providing tor street signs, the same to be prepared and placed by the Highway Department, and appropriate money therefor, or take any action relative thereto. Sponsored by the Sur- veyor of Highways and the Board of Selectmen.


Article 30. To see if the town will vote to appropriate the sum of fourteen hundred dollars ($1400) for the purchase of two 1943 two door police patrol sedans, as recommended by the Chief of Police. Sponsored by the Board of Selectmen.


Article 31. To see if the town will vote to accept Lexington Park so-called as a public way, as laid out by the Board of Select- men in accordance with plans taken by Howard L. Hamill, Town Engineer, and appropriate a sum of money therefor, and for work thereon, or take any action relative thereto, as petitioned for by Rudolph J. Cullen, Jr. et al.


Article 32. To see if the town will vote to repair Prospect Ave- nue, a distance of approximately 300 feet from Sargent Road, and appropriate money therefor, as petitioned for by Glenn W. Bar- tram, et al.


Article 33. To see if the town will vote to amend Article 11 of Chapter XII of the Town By-Laws by adding the words :-


"Strict compliance with Chapter 145 of the Massachu- setts General Laws is required."

ARTICLE II General Residence District


In District 2, except as herein otherwise provided, no building shall be used, and no building shall be erected or altered which is intended or designed to be used for a store or shop, or for manufacturing or commercial purposes, or any other purpose except one or more of the following :-


1. Residence for not more than two families.


2. Boarding, rooming, or lodging house. Strict compli- ance with Chapter 145 of the Massachusetts General Laws is required.

3. Church.


4. Public School or other municipal building.


5. Private school, library, museum, or other building of an educational character.


6. Club, except a club which carries on a business or is in the nature of a business.


7. Park, playground, or community purpose.


8. Farm, market garden, nursery or greenhouse.


9. Private garage to be used by the occupants or owners of the premises, except that space in the same for not more than two cars may be rented.


10. Private stable with provision for not more than two horses.


11. Such accessory purposes as are customarily incident to the foregoing purposes, and are not injurious to a neigh- borhood as a place of residence, but such accessory purposes shall not include any business, industry, trade, manufactur- ing or commercial purpose. Article 34. To see what action the Town will take on the mat- ter of transferring certain unexpended balances, as shown on the books of the Town Accountant as of December 31, 1942, to the Ex- cess and Deficiency Fund, and take any action relating thereto. Sponsored by the Board of Selectmen.


Article 35. To see if the town will vote to appropriate a sum of money to provide an adequate Air Raid Signal System that can eventually serve as a replacement for the existing Fire Alarm Audible Signal system to be purchased, installed and maintained under the direction of the Fire Department, or take any action rela- tive thereto. Sponsored by the Committee on Public Safety and the Board of Fire Engineers.


Article 36. To see if the town will vote to repair a brook drain extending from Roy Street to Crescent Street, and appropriate money therefor, or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 37. To see if the town will vote to accept the Greenway, as a public way, as laid out by the Selectmen in accordance with plans drawn by Howard L. Hamill, Town Engineer, subject to the release of the abutting owners, as petitioned for by the Board of Park Commissioners.


Article 38. To see if the town will vote to raise and appropriate a sum of money by transfer from surplus revenue, for purchase of defense bonds, issued by the Federal Government, as provided by Chapter 4, Acts of 1942, or any other substitute therefor. Sponsored by the Board of Selectmen.


Article 39. To see what action the town will take to provide for such means as may be necessary in the National Emergency for the protection of persons and properties in the Town of Swampscott; and to appropriate money therefor. Sponsored by the Board of Selectmen.


Article 40. To appropriate and raise by borrowing or otherwise, under any general or special law which authorizes the town to raise money by borrowing or otherwise, such sum or sums of money as

may be necessary for any or all of the purposes mentioned in the foregoing articles. Sponsored by the Board of Selectmen.


And you are directed to serve this Warrant by posting an at- tested copy thereof at the Town Hall, Post Office and in at least two public and conspicuous places in each precinct in the Town and at or in the immediate vicinity of each railroad station in the Town not less than seven days before the day appointed for said meeting.


The polls will close at 7:00 P.M.


Hereof fail not, and make due return of this Warrant, with your doing's thereon, to the Town Clerk at the time and place of meeting aforesaid.
