ADJOURNED ANNUAL TOWN MEETING Tuesday, March 25, 1952


In accordance with the adjournment of Monday, March 17, 1952, the Town Meeting Members were called to order by the Moderator, Vincent P. O'Brien, at 7:58 P.M., the necessary quorum being present (135).


Rev. Winslow F. Beckwith, Minister of the Holy Name Church, offered the following Invocation:


"Almighty God, Creator of all men, who hast given us this good land for our heritage; We humbly beseech thee that we may always prove ourselves a people mindful of Thy favor and glad to do Thy will. Bless our land with honorable in- dustry, sound learning, and pure manners. Save us from violence, discord, and confusion ; from pride and arrogancy, and from every evil way. Defend our liberties, and fashion into one united people the multitudes brought hither out of many kindreds and tongues. Endue with the spirit of wisdom those to whom in Thy

Name we entrust the authority of government, that there may be justice and peace at home, and that, through obedience to Thy law, we may show forth Thy praise among the nations of the earth. In time of prosperity fill our hearts with thank- fulness, and in the day of trouble, suffer not our trust in Thee to fail. Especially we beseech Thee that the deliberations of this Town Meeting may be wise and good in Thy sight, O Eternal God, whoever liveth and reigneth, One God, world without end. Amen."


One minutes silence was observed by the Town Meeting Members for the former Town Officers.


Town Clerk, Malcolm F. Maclean, Jr., was sworn in by A. Doris Whipple, Justice of the Peace.


Moderator, Selectmen, and other elective officers were sworn in by the Town Clerk, Malcolm F. Maclean, Jr.


The warrant with the return thereon was read by Malcolm F. Maclean, Jr., Town Clerk.


Voted: That the reading of the records of the last meeting be omitted.


Voted: Article 2. That the reports of town officials, boards and com- mittees be accepted.


Voted: Article 3. That the report of the Committee appointed to plan for the observance of the 100th anniversary of its incorporation be accepted; that the Committee be continued and that the sum of $15,000.00 be appropriated to cover the expenses of observing the Town's 100th Anniversary.


Voted: Article 4. That the Town authorize the Town Treasurer, with the approval of the Board of Selectmen, to borrow from time to time, in anticipation of the revenue of the financial year beginning January 1, 1952, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Chapter 44 of the General Laws. Unanimous.


Voted: Article 5. That the Town authorize the Town Treasurer, with the approval of the Board of Selectmen, to borrow from time to time, in anticipation of the revenue of the financial year beginning January 1, 1953, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for period of less than one year, in accordance with Chapter 44 of the General Laws. Unanimous.


Voted: Article 6. That action on this article be indefinitely postponed.


Voted: Article 7. That the Town grant a temporary cost of living wage increase to all permanent full-time employees of the various departments of the Town with the exception of the School Department, said increase to be in the amount of $140.00 for the year 1952 and that the sum of $19,460.00 be appro- priated therefor.


Voted: Article 8. That the Town grant a wage adjustment increase in the annual salary of the permanent members of the Police Department in the amount of $2.00 per week, effective April 1, 1952, and that the sum of $1,794.00 be appropriated therefor.

All effective from January 1, 1952. The appropriations necessary to provide for the payment of these rates are recommended in the budgets of the various departments under Article 10.


Voted Article 12. That the Town authorize the Board of Public Welfare to appoint one of its own members as agent and fix the salary of such appointee at $572.00 as provided by Section 4-A, Chapter 41, General Laws. The appro- priation to pay this salary has been recommended under Article 10.


Voted Article 13. That the Town authorize the Bureau of Old Age Assis- tance to appoint one of its own members as agent and fix the salary of such ap- pointee at $3,028.00 as provided by Section 4-A, Chapter 41, General Laws and that the said $3,028.00 be appropriated as follows: $1,000.00 from the U. S. Grant O.A.A. Administration and $2,028.00 from the tax levy which has been recommended under Article 10.


Voted Article 14. That the Town authorize the Board of Assessors, the Board of Park Commissioners and the Planning Board each to appoint a member of such board to act as secretary thereof and that the salary of such incumbents be fixed at $50.00 each per year, as provided by Section 4-A, Chapter 41, General Laws. The appropriations necessary to pay these salaries have been provided for under Article 10.


Voted Article 15. That the Town appropriate the sum of $574.24 to the account of Unpaid Bills for the purpose of settling all bills contracted prior to January 1, 1952 and remaining unpaid at the time of closing of the Town's books for the year 1951, according to the records of the Town Accountant in conformity with the provisions of Section 64, Chapter 44, General Laws. Voted Article 16. That the Town transfer from the Excess and Deficiency Fund Account to the Current Revenue Account the sum of $150,000.00, said sum to be used and applied by the Board of Assessors in reduction of the Tax Levy for the year 1952.


Voted Article 17. That the Town appropriate the sum of $4,200.00 to be used with the monies appropriated under Article 4 of the Warrant of the Special Town Meeting of December 4, 1951, to carry out the purposes set forth in said Article 4. (This article covers additional monies to supplement the $100,000.00

appropriated at the Special Town Meeting of December 4, 1951 for constructing drain culverts on the New Ocean House property.


Voted Article 18. That the Town authorize the Board of Selectmen to pur- chase or take be eminent domain for public school purposes the land hereinafter de- scribed and on said land and on the Stanley School lot, the Town construct and orig- inally equip and furnish an addition to the present Stanley School building; and that the sum of $460,000.00 be appropriated for acquiring said land and constructing and equipping said addition to be raised as follows:


That $10,000.00 be raised and appropriated from the tax levy of the current year and that the Treasurer, with the approval of the Board of Selectmen, be au- thorized to borrow a sum not to exceed the remainder; viz., $450,000.00; and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than twenty years from the date of issuance of the first bond or note or such earlier dates as the Treasurer, with the approval of the Board of Selectmen, may determine.


Said school building shall be constructed by a committee to be composed of the Chairman of the Finance Committee and two members of the School Com- mittee and two citizens to be appointed by the Moderator, said Committee to be known as the Stanley School Building Committee, which committee shall have the power to engage an architect, enter into contracts and do all things necessary to complete, equip and furnish said addition to the Stanley School.


The land to be taken for the above purposes is bounded and described as follows:


Beginning at the Southerly end of Whitman Road at the intersection of the Westerly side line of Whitman Road and the Northerly side line of Forest Avenue, a private way; thence running Northeast along the Westerly side line of Whitman Road for a distance of three hundred sixty-six and seven one-hundredths (366.07) feet, thence curving to the East with a radius of one hundred and thirty-eight one hundredths (100.38) feet, for a distance of sixty-three and nine one-hundredths (63.09) feet, to the Southwest corner of land owned now or formerly by Morris and Lillian Block; then running Northwest by land owned, now or formerly by Morris and Lillian Block, land of the Town of Swampscott and land now or formerly of Charlotte B. Galpert, for a distance of about three hundred and thirty-three (333.00) feet, plus or minus to the intersection of the Southwest corner of land owned now or formerly by Charlotte B. Galpert and the Easterly side line of Cedar Road; thence curving Southwesterly with a radius of about twenty-four hun- dred and fifty-three (2453.00) feet, for a distance of about two hundred (200) feet, plus or minus ; thence running Southwest for a distance of about two hundred and seventy-five (275.00) feet, plus or minus, to the Northerly side line of Forest Avenue; thence running Southeast along the Northerly side line of Forest Avenue for a distance of three hundred and twenty (320.00 ) feet to the point of beginning.


The above described parcel be the easterly portion of Lot E as shown on Plate 22 of the Assessors Plans of the Town of Swampscott and contains about 3.33/100 acres. For: 124, Against, 2. The Planning Board made their report.


Voted: To adjourn until Wednesday, March 26, 1952 at 7:45 P.M. at the Hadley School Hall.

ADJOURNED ANNUAL TOWN MEETING Wednesday, March 26, 1952


In accordance with the adjournment of Tuesday, March 25, 1952, the Town Meeting Members were called to order by the Moderator, Vincent P. O'Brien at 8:01 P.M., the necessary quorum being present (98).


New Members were sworn in by Town Clerk Malcolm F. Maclean, Jr.


Voted: That the reading of the records of last meeting be omitted.


Voted Article 19. That the Board of Selectmen appoint a Committee of five to investigate the possibilities of a Public Works Department for the Town and the experience of other towns of the Commonwealth with such a department, review their findings with the Board of Selectmen and then report at the next Annual Town Meeting.


Voted Article 20. That action on this Article be indefinitely postponed.


Voted Article 21. That the Town adopt the following by-law:


Section 1. All regular employees of the town other than those appointed by the School Committee, the Police Department and the Fire Department, shall be granted holiday leave without loss of pay on the following legal holidays; January 1, February 22, April 19, May 30, July 4, the first Monday of September, October 12, November 11, Thanksgiving Day and Christmas Day, or on the day following when any of the five days first mentioned or October 12, November 11 or Christmas Day occurs on Sunday. Unanimous.


Voted Article 22. That the Town accept Chapter 147, Section 16-C of the General Laws as amended by Chapter 346, Acts of 1951, which provides that members of the Police Department shall be excused from duty two days out of every seven without loss of pay. For: 66, Against: 26.


Voted Article 23. That the Moderator appoint a committee of five, con- sisting of two registered architects, one registered professional engineer, the Build- ing Inspector, and one other recognized Swampscott builder to review and revise the Building By-Laws of the Town and report at the next Annual Town Meeting and that $50.00 be appropriated for their use for typing and similar expenses.


Voted Article 24. That the Town authorize the Board of Selectmen to pur- chase or take by eminent domain for cemetery purposes the premises shown on Plate 13, Lot 2 and Plate 13, Lot 3 of the Assessor's Plans of the Town of Swamp- scott and that the sum of $1.00 be appropriated for said purchase or taking.


Voted Article 25. That action on this Article be indefinitely postponed.


Voted Article 26. That the Town authorize the Board of Selectmen to make the necessary repairs and paint the Central Fire Engine House and that the sum of $2,000.00 be appropriated therefor.


Voted Article 27. That the Town purchase an automobile for the Chief of the Fire Department, authorize the Board of Selectmen to trade a 1949 DeSoto on account of the purchase price and that the sum of $1,000.00 be appropriated for the purpose of this Article.

Voted Article 28. That the Town purchase an automobile to be used as a patrol car for the Police Department, authorize the Board of Selectmen to trade a 1949 DeSoto on account of the purchase price and that the sum of $1,200.00 be appropriated for the purpose of this Article.


Voted Article 29. That the Town purchase an automobile to be used by the Engineering Department, authorize the Board of Selectmen to trade the car pres- ently being used by the Engineering Department on account of the purchase price, and the sum of $1,600.00 be appropriated therefor.


Voted Article 30. That the Town lay a drain from Allen Road through Sumner Street to Hawthorne Brook, a distance of approximately 450 feet and that the sum of $6,000.00 be appropriated therefor.


Voted Article 31. That the Town authorize the Surveyor of Highways to purchase a front end shovel loader tractor with rubber tires and that the sum of $4,300.00 be appropriated therefor.


Voted Article 32. That the Town carry on a sidewalk construction program under the provision of General Laws, Chapter 83, Sections 25 and 26, and that the sum of $6,000.00 be appropriated therefor.


Voted Article 33. That the Town appropriate the sum of $7,000.00 for the purpose of this Article.


Voted Article 34. That the Town appropriate the sum of $1,200.00 for the purpose of this Article.


Voted Article 35. That the Town appropriate the sum of $1,000.00 for the purpose of this Article.

Voted Article 37. That the Town continue the summer recreational program and that the sum of $3,000.00 be appropriated therefor.


Voted Article 38. That the Town authorize the Board of Park Commissioners to make the necessary repairs at the Fish House and that the sum of $3,500.00 be appropriated therefor.


Voted Article 39. That the Town authorize the Board of Park Commissioners to purchase a stake-bodied truck for tree work and that the sum of $3,000.00 be appropriated therefor.

Voted Article 41. That the Town authorize the Board of Park Commis- sioners to seed, loam, and fertilize a section of Phillips Park for additional play area and that the sum of $1,000.00 be appropriated therefor.


Voted Article 42. That the Town authorize the Moderator to appoint a committee to investigate and study the wage scales paid to all Town Employees

Voted Article 43. That action on this Article be indefinitely postponed.


Voted Article 44. That the Town reimburse the Ellen Realty Company for digging and backfilling water pipe trench on Dale Street and appropriate the sum of $236.00 therefor. Unanimous.


Voted Article 45. That action on this Article be indefinitely postponed.


Voted Article 46. That the Town authorize the Water and Sewerage Board to install necessary drains and catch basins at Elmwood and Thomas Roads; Nor- folk Avenue and State Road; and at Burrill Street and Middlesex Avenue and that the sum of $4,525.00 be appropriated therefor.
