This report is being submitted as a progress report in accordance with Section 8 of the Personnel Plan, in order to keep the Board of Selectmen and the citizens of Swampscott informed of the progress and activities of the per- sonnel Board.


After the Selectmen and the Moderator had appointed M. Stanley Metz, three year term expiring 1962; John G. McLearn, three year term expiring 1962; Frederick N. Balsor, 2 year term expiring 1961; Captain Warren J. Doherty, two year term expiring 1961; and Robert L. Yasi, one year term ex- piring 1960, as members of the Personnel Board, the first meeting was held on May 20, 1959. M. Stanley Metz was elected Chairman and John McLearn, Clerk. Thereafter the Personnel Board met weekly. It was agreed that em- ployees wishing to appear before the Board first submit their problem to their department head so that the Personnel Board could be advised of the position of the heads of the various departments concerning any problem presented.


We met with employees of many departments, and as a result of these meetings, and because of certain inequities which showed up in the Person- nel Plan, we shall recommend to the Town Meeting the following changes. All votes taken by the Personnel Board were unanimous.


1. Any Town employee who has a minimum of twenty years' service for the Town of Swampscott and has reached age of mandatory re- tirement, shall retire at top step in his classification. This by-law is intended to benefit only those people now in service and shall be- come null and void in 1962. It was the Personnel Board's thought that an employee's retirement age should not be affected by his age at the time the plan was adopted.


2. The Deputy Fire Chief and the Police Captains be placed in Step 4 of Grade 8. You will note that the Deputy Fire Chief and the Police Captains did not maintain the percentage of difference be- tween their pay and that of the patrolmen and firefighters in Grade 6. It should also be noted that the Assistant Engineer, who is in the same grade, is one step higher.

We also recommend that the Public Works Foremen be placed in Step 4 of Grade 6. You will note that the difference between Step 3 of Grade 6, and Step 4 of Grade 5A, is only $2.17 per week. You will also note that all other workers in Grade 6 are in Step 4. This was due to their respective earnings at the time the plan was ad- opted. 'The Committee agreed this was not fair.


3. Policemen and Firefighters shall be placed in the next highest step on the day that their regular, plus reserve service reaches one year. For example, if a policeman serves as a reserve for a period of eight months and is then appointed as a regular, he would start at Step 1 and be placed in Step 2 four months from date of appoint- ment. This is for purpose of clarification.


4. The Plan shall be amended to provide that Craftsmen Craftsmen MEO Craftsmen MEO-L Craftsmen MEO-M


shall all be in Grade 4. Craftsmen MEO-H


shall be in Grade 5. Craftsmen MEOS


shall be in a new Grade 5A with an increase in pay of five cents an hour over Grade 5. The purpose of the changes, which were made by Civil Service, is to clarify titles and to grant an increase in accordance with the wishes of the Public Works Department, for craftsmen that have the knowledge and ability to work with certain special equipment.


5. The Administrative Assistant be advanced to Grade 8. This amend- ment is being made on the basis of the recommendation of the Board of Public Works and the Superintendent of Public Works, and as a result of a change of job description presented to the Per- sonnel Board. It was agreed that this reclassification would cover the duties of the Administrative Assistant as Secretary to the Board of Public Works, and there will be no additional pay for such du- ties. Based on this, the Personnel Board had no alternative but to reclassify this job.


6. That portion of Section 7 of the Compensation Plan which states that an employee promoted to a higher rated position shall continue to receive his present pay rate until the expiration of six months, shall be done away with. The Personnel Board agreed with the heads of the departments that it was not fair to give promotions with the extra responsibility, without extra money immediately.


The Personnel Board reviewed and made an exhaustive study concerning all the part-time jobs in the Town. Although many part-time employees have requested classification by the Personnel Board, we do not believe it would be feasible to do this at this time. It is almost impossible to obtain accurate information concerning number of hours that our part-time people work. In many cases it is difficult to tell whether their part-time work is done during their regular working hours, where they also hold a full-time job. It is for these reasons that we recommend that they continue to be paid in the same manner as in the past. We are continuing our study of this problem.


The Personnel Board has received sick leave and vacation policies from all departments covered by the Compensation Plan. The Board is now in the process of studying this information. Therefore, it has no recommendation at this time.


We are enclosing Schedule A, representing our expenditure to date to- gether with reconciliation.

The Swampscott Citizens Traffic Committee held 12 regular monthly meetings with almost full attendance of the Committee at each meeting. A representative of the Police and School Departments attended along with a representative of the Department of Public Works when necessary.


The Committee handled all citizen complaints, reporting its findings to the Selectmen. Special emphasis was placed on the White Line Program, Traffic Signals and Islands, Traffic Enforcement, All-Night Parking, Studies of Congested Areas, Bus Stop Locations and School Yard Conditions.


The Citizens Committee and Selectmen were cited again by the Massachu- setts Safety Council for their program of outstanding cooperation in a pro- gram to reduce traffic accidents in Swampscott. A study is underway, in coop- eration with the Police Department, to determine Swampscott's Most Danger- ous Locations during 1959. This list will be used to determine Priority Im- provements for 1960.

Submitted herewith is my Annual Report:


During the past year it has been necessary for me to attend the weekly meetings of the Board of Selectmen and various meetings of the Board of Public Works, all meetings and public hearings of the Board of Appeals, and work closely with all other Town Boards and Committees. Advice on various legal matters and assistance in preparation of legal documents and contracts in the conduct of their official duties has been required.


I have negotiated for and prepared contracts with the architect for build- ing the new Central Fire Station. I prepared all documents relative to trans- fer of the property for the Post Office Building including material necessary for approval by the United States Government.


The Warrant for the Annual Town Meeting of 1959 and all necessary votes including approvals by Bond Counsel was prepared by my office.


I assisted the Transportation Committee and was assigned, by Vote of the Board of Selectmen, to attend all Hearings on Petition by the Boston and Maine Railroad to abandon service on its Marblehead-Swampscott branch. I attended and prosecuted opposition at extended hearings from week to week at the Department of Public Utilities in the State House at Boston. I joined with the Town Counsel of Marblehead in an Appeal, of the Order of the De- partment of Public Utilities authorizing abandonment, to the Supreme Judi- cial Court, Commonwealth of Massachusetts. Arguments upon motions were presented and I joined with Town Counsel for Wilmington on Motions to Stay and Report to the Full Court. These motions and arguments were held before a single Justice of the Supreme Court.


One serious personal injury suit in Essex Superior Court was disposed. Two other personal injury claims were disposed of by settlement after suit

was brought in the District Court of Southern Essex. Several claims against the Town for personal injury and property damages arising out of alleged de- fects are pending against the Town in connection with a broken water main on Rock Avenue at the junction of New Ocean Street resulting in collapse of the highway involves personal injuries and substantial property damage to motor vehicle, and flooded premises of two residential owners. There are sev- eral cases pending before the Appellate Tax Board. I was appointed to act on the Tax Title Study Committee with the Chairman of the Planning Board and the Town Treasurer to make a study and recommendations relative to all property that the Town had acquired or instituted procedures to acquire for non-payment of taxes. In the course of the investigation and study the Com- mittee found that there were approximately ninety lots of land involved, and that the Town had not perfected its title. These have not been bearing revenue and in all but three instances require legal action to secure marketable title to the Town. It involves complete title examinations and abstracts in each case and it is hoped that the entire project will be completed in the next three to six months.


There will continue to be a constant need to provide legal assistance to the Board of Selectmen and other departments affected by the development of the shopping center at Vinnin Square to insure to the Town that the develop- ment conforms to the requirements of the Restrictive Agreement entered into by the Pine Realty Trust and the Town of Swampscott as amended during the year.

Situation: About 15 miles northeast of Boston.


Population: 13,075.


Area: 3.05 square miles.


Assessed Valuation: $33,385,600.00.


Tax Rate: $69.00.


Form of Government: Representative Town Meeting (accepted May 17, 1927. First Meeting held February 27, 1928).


Governing body of Town: Board of Selectmen.


Administration Building: 22 Monument Avenue.


Senators in Congress: Leverett Saltonstall and John F. Kennedy.


State Senator: Charles V. Hogan of Lynn (1st Essex District).


Representative in Congress: William H. Bates of Salem (6th Congress- ional District).


Representatives in General Court: George B. Thomson of Swampscott; John A. Davis of Marblehead; and Thomas M. Newth of Swampscott (14th Essex District).


Member of Governors' Council: Augustus Means of Essex (5th District).


Qualifications of Voters: Must be 21 years of age, born in United States or fully naturalized; a resident of Massachusetts one year and Swampscott six months. Registration Monday through Friday, 9-12 A.M., 1-5 P.M. Special sessions held preceding elections.
