GENERAL I


Article 2. To hear and act on the reports of Town Officials, Boards and Committees.

Article 3. To see if the Town will vote to authorize the Town Treasur- er, with the approval of the Board of Selectmen, to borrow money from time to time in anticipation of the revenue for the financial year beginning Jan- uary 1, 1960, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.

Article 4. To see what action the Town will take in relation to the rec- ommendations calling for the appropriation or expenditure of money, and creation of debt, or the disposition of town property as set forth in the re- port of officers, boards or committees.

Article 5. To see what action the Town will take in relation to salaries of elected town officials for the ensuing year.

Article 6. To see if the Town will vote to amend its General By-Laws by inserting therein the following provisions:

JOB CLASSIFICATION AND WAGE SCALE COMMITTEE


Section 1 .- The Plan


There is hereby established a classification and salary plan, herinafter designated as "The Plan" for the Town of Swampscott, under author- ity of Section 108a of Chapter 41 of the General Laws, and all other acts thereto enabling, for positions in the service of the Town, classi- fying certain employees other than those filled by popular election and those under the direction and control of the School Committee, into groups and classes doing substantially similar work or having substan- tially equal responsibilities.


Section 2 .- Classification of Jobs.


The Official Classification Plan for positions in the service of the Town shall consist of the classes listed by titles in Section 7a of this Article IX, which is hereby made a part hereof.


Section 3 .- Personnel Board.


(a) There shall be a Personnel Board to administer The Plan, consist- ing of five (5) members. They shall be appointed by the Moderator and Board of Selectmen of the Town of Swampscott. Two (2) mem- bers shall be selected from among employees covered by the Plan.


(b) Forthwith, after the effective date of this by-law, the Moderator and Board of Selectmen shall appoint two (2) members for three years, two (2) members for two years, and one (1) member for one year. Thereafter and not later than April 1, of the year in which the term of a member expires, the Moderator and the Board of Selectmen shall appoint his successor for a term of three years.


(c) If a member appointed by the Moderator and the Board of Select- men resigns or his office becomes vacant by his removal from the Town, or other cause, the Moderator and the Board of Selectmen shall appoint a successor for the balance of the unexpired term of such member.


(d) The Personnel Board shall administer The Plan and shall estab- lish such procedures as it deems necessary for the proper adminis- tration of The Plan.


(e) Forthwith after appointment and thereafter annually, the Board shall meet and organize by electing a Chairman and Clerk. A ma- jority of the Board shall constitute a quorum for the transaction of business. A majority vote of the Board shall determine the ac- tion the Board must take on all matters upon which it is author- ized or required to pass under The Plan. The Personnel Board may employ assistance and incur expenses as it deems necessary, sub- ject to appropriation of funds therefor. The Personnel Board shall serve without compensation.

(f) The Board shall maintain adequate personnel records of all em- ployees subject to this plan, said records shall be kept in the cus- tody of the Personnel Board. Department Heads shall provide such information as the Personnel Board shall request.


Section 5 .- Adjustment Policy.


All regular full time permanent employees in the service of the Town holding positions subject to the classification and compen- sation plan provided herein shall be eligible for consideration for advancement to the next higher step until such time as the em- ployee is receiving the maximum rate for such position in accor- dance with the following rules:


(1) Annual Salary Schedule


After serving one year at the minimum and one year in each in- termediate step rate until reaching a maximum rate after comple- tion of the 5th year.


(2) Single-Rate Positions


Employees occupying positions for which single rates have been established in the compensation Plan shall not be eligible for step- rate increases.


COMPENSATION PLAN


Section 6 .- Salary Schedule


(a) As provided hereinafter, the schedule entitled "Proposed Pay Scales" sets forth the job classification, the grade assigned to it, the minimum step rate and successive step rate increases con- cluding with a maximum step rate. Salary range of a group shall be the salary range for all positions classified in such group.


(b) All employees shall continue to be paid on an hourly, weekly, monthly, or other basis, as at present, unless otherwise authorized by the Personnel Board or by subsequent amendment of the Salary Plan.


(c) No board, officer, or head of a department shall fix the salary of any employee in a position so classified except in accordance with such Plan.


(d) No person shall be appointed, employed, or paid as an employee in any position, or permitted to


perform duties under any title other than as provided in the classification schedule. The job title in the Plan shall be the official title for the position and shall be used in all administrative and employment records.


(e) All employees included in The Plan shall be eligible for re-classi- fication and pay adjustment, subject to the recommendation of the Board or authority having immediate jurisdiction over such employees and the approval of the Personnel Board.


(f) Promotions from minimum to maximum salaries shall be success- ive steps annually.


CLASSIFICATION OF PRESENT TOWN EMPLOYEES


Section 7.


The wage or salary established in The Plan for each position shown on the schedule hereinafter provided, will become applicable to each person who is an employee immediately upon the effective date of this By-Law. All employees' salaries are fixed at the next highest step above their present salary. Any employee whose salary was within $50.00 of a step was moved to the next succeeding step. For example: if a salary were $4875 in grade six, the employee would start at step four instead of step three.

An exception was made for the Superintendent of Parks, Highways, and Water departments. These salaries are fixed and do not qualify for step increases under the plan.


Sick leave allowance and vacation pay shall remain in its present status until reviewed by the Personnel Board.


Overtime compensation shall be paid on the same basis as at pres- ent until such time as it is reviewed by the Personal Board. However, overtime shall not be paid to any employee whose duties include author- ization and approval of overtime pay for subordinates.


Reserves in Police and Fire Departments shall be given credit for each year of service prior to appointment. One year of service shall be defined as 52 weeks of service for which pay was received. It is the in- tent that a reserve with one year of service shall start at Step two and a reserve with two years of service shall start at Step three (3), etc.


An employee promoted to a higher rated position shall enter it at the minimum rate of the range for the appropriate compensation grade; however, if his existing rate is the same or higher than the minimum for the higher rated position, he shall continue to receive his existing rate until the expiration of six (6) months of service at which time he shall be moved to the next higher step.


The Board shall, from time to time, review the salary and wage schedules and policies pertaining to the administration of the Classifica- tion and Pay Plans. It shall keep informed as to pay rates and policies outside the service of the Town. It shall recommend to the Town Meeting any action which it deems desirable in order to maintain a fair and equit- able pay level.


Upon recommendation of a Department Head, supported by a writ- ing satisfactory to the Personnel Board, setting forth special reasons and exceptional circumstances, the Board may authorize an entrance rate higher than the minimum rate for a position, and such other variance in the Plan as it may deem necessary for the proper functioning of the services to the Town. No variance shall become effective unless, or until, the necessary funds have been appropriated therefor. The Board shall make an annual report in writing to the Board of Selectmen on, or be- fore, December 31 st of each year.


Section 8 .- Amendment of the Classification and Pay Plans.


(a) The Classification and Pay Plans may be amended in the same manner that other By-Laws may be amended; provided, however, that no amendment shall be made unless a request therefor, in writing and signed by the petitioner, or petitioners, is addressed to and submitted to the Personnel Board, and a copy thereof filed with the Town Clerk.


(b) Upon receipt of such request, the Board shall hold a hearing thereon at which all persons interested shall be entitled to be present and heard. Written notice of such hearing shall be given, not less than three days preceding the date thereof, to the peti- tioner, or petitioners, and to heads of departments and employees affected.


(c) The Board shall, after such hearing, submit a report with recom- mendations to the Annual or to a special Town Meeting.


(d) The Board may of its own motion, after like notice to all persons interested and after a hearing, submit to the Town Meeting a pro- posal for amending the Plans.


Section 9 .- Civil Service Laws.


Nothing in this By-Law shall be construed to conflict with Chapter 31 of the General Laws of the Commonwealth of Massachusetts.

Dollars per annum. so long as she shall remain unmarried, to be paid in equal monthly installments.

Article 19. To see if the Town will vote to petition the General Court of Massachusetts to authorize the town to pay Mary G. Snow, widow of Wil- liam B. Snow, a former employee of the Fire Department, an annuity for life in the sum of twelve hundred dollars ($1200.00) per annum to be paid in equal monthly installments.

Article 23. To see if the town will vote to amend the General By-Laws of the Town by inserting therein the following provisions:


ARTICLE X Oversight Committee


Section 1. An Oversight Committee is hereby established, consisting of six (6) members, one (1) member from, and representing each pre- cinct.


Section 2. Members of this Committee shall be appointed by the Board of Selectmen, in the first instance, two (2) for terms of one (1) year, two (2) for terms of two (2) years, and two (2) for terms of three (3) years, and their successors shall be appointed for three (3) year terms. Any vacancy shall be filled in like manner by the Selectmen.


Section 3. Members of this Committee shall serve without pay, but shall, subject to an appropriation, be reimbursed for their legitimate expenses.


Section 4. The objectives of this Committee shall be:


(a) to provide the citizens of the town with intelligent infor- mation on the town's administrative practices, through a regularly published quarterly Town Bulletin in mimeo- graphed form, to be made available at the Town Clerk's Office.


(b) to overcome public apathy in town affairs, by affording "letter-box" communications to the Bulletin, whereby the citizens express their views concerning better town gov- ernment. The Committee shall excercise its descretion in abbreviating these expressions of opinion.


(c) to suggest specific drafts of any new by-laws, which in the opinion of the Committee, would better effectively regulate the operations of the town, and its several departments.


(d) to compile statistics on wages, salaries, pensions, allow- ances, overtime, etc., paid to officers and town employees, with corresponding statistics, where available, for other communities.

Section 5. The Committee shall have full authority to carry on its investi- gations, and to inspect and make notations from all papers, contracts, books, etc., of the town, that appear of value to the Committee, and shall receive the assistance of the department heads in obtaining such desired information.

Article 24. To see if the Town will vote to petition the General Court of Massachusetts to amend its Charter by changing the term of office of the members of the Board of Selectmen from a one (1) year term to staggered three (3) year terms.

Article 25. To see if the Town will vote to amend its General By-Laws to provide:


All Town Officers shall pay all fees received by them by virtue of their office into the Town Treasury.

Article 26. To see if the Town will vote to accept an Act of the Legis- lature passed in the year 1959 placing certain offices and positions in the Town of Swampscott under the Civil Service Laws and Rules as follows:


"Section one (1) of Chapter 82 of the acts of 1958 is hereby amended by striking out the first sentence and inserting in place thereof the following sentence: The provisions of Chapter thirty-one of the General Laws shall, upon the effective date of this act, apply to all offices and positions in the town of Swampscott which are not already classified under said laws, includ- ing all clerical and custodial employees, employees of the school lunch pro- gram, the town accountant, the health agent and the clerks employed by the treasurer, the collector of taxes and the clerk of the town."

Article 27. To see if the Town will vote to amend the Zoning By-Laws to bring Article IV Section 3 Sub. Paragraph 5 in accord with the changes made by the 1958 Town Meeting in the "Table of Height and Area Regula- tions and Front, Side and Rear Yard Requirements" by replacing the present Sub-Paragraph 5 with the following:


5. The requirements of the "Table of Height and Area Regulations and Front, Side and Rear Yard Requirements" referred to in Article IV Section 1, need not apply, except as to set back to lots of less than the required area for the district in which they are located, provided such lots have been duly described by deed recorded with the Registry of Deeds or assessed as sep- arate parcels prior to March 23, 1948, the date of the passage of this By- Law or provided such lots have been duly described by deed recorded with the Registry of Deeds or assessed as separate parcels between March 23, 1948 and March 26, 1958 and conformed to the area and frontage require- ments of the By-Law governing that period. Buildings on such lots shall con- form to the regulations applying in the district of comparable lot size as follows:


Lots in the Residence A-1 district of area of at least 15,000 sq. ft. and below 20,000 sq. ft. shall have buildings complying with the requirements for Residence A-2 district.


Lots in the Residence A-1 or A-2 districts of area of at least 10,000 sq. ft. and less than 15,000 sq. ft. shall have buildings complying with the tab- ular data for Residence A-3 district.


Lots in any district of less than 10,000 sq. ft. shall have buildings con- forming to Article IV, Section 3, sub-sections 4A and 4B of these By-Laws and to Article III, Section 3 of the building By-Laws of the Town.

The exceptions permitted in this sub-section apply only to the require- ments of the "Table of Height and Area Regulations and Front, Side and Rear Yard Requirements" and in no way affect any other regulations in this By-Law.

Article 28. To see if the Town will vote to amend the Zoning By-Laws by amending Article VI, Section 5 by addition of a new paragraph after the present (a), as follows:


"a-1. Permit in Districts A-3, B-1, and B-2 conversion of a single family house, containing at least 1800 sq. ft. of floor area devoted to living and sleeping quarters, exclusive of basement rooms and open attic, to accommo- date not more than two families, provided the exterior character of a single family house be maintained, except for the addition of any necessary doors at the first floor level required by Building Code for entrance and safety under multiple occupancy and provided the lot area is at least that required for new construction in the particular district."

Article 29. To see if the Town will vote to purchase a new pumper with a 750 gallon capacity to replace the 1949 pumper and to appropriate the nec- essary money therefor or take any action relative thereto.
