To see if the Town will authorize the Water and Sewerage Board to construct a sewer in the following locations: Commencing at the end of the existing sewer on Broadway station 8+35 thence westerly approximately

ARTICLE 2


To see if the Town will authorize the Water and Sewerage Board to construct a sewer in the following locations: Beginning at a manhole in Broadway station 10+05 thence southeasterly in a private way approxi- mately 315 feet, thence westerly across land of John C. Doyle to the center line of Doyle Avenue, so called, a private way approximately 300 feet, also in Doyle Avenue approximately 450. feet, and raise and appropriate a suf- ficient sum of money therefor or authorize the Treasurer with the approval of the Selectmen to borrow or issue notes or bonds therefor; and authorize the Water and Sewerage Board of the Town of Wakefield to take by emi- nent domain under authority of Chapter 377 Acts of 1900 and any other authority thereto enabling them or by purchase, an easement in the whole of the private ways as shown on a plan by Harry H. Denning entitled "Plan showing lots in Westwood Park, Albion Street, Wakefield, Mass." owned by Charles Doyle, March 1941, and approved by the Board of Sur- vey, Town of Wakefield, and on file in the Town Clerk's Office .- Board of Health.

ARTICLE 3


To see if the Town will authorize the Water and Sewerage Board to construct a sewer in the following locations: Commencing at a manhole in Wakefield Avenue station 2+28 thence in Jefferson Road a private way westerly 190 feet to an angle, thence southwesterly approximately 720 feet and raise and appropriate a sufficient sum of money therefor or authorize the Treasurer with the approval of the Selectmen, to borrow or issue notes or bonds therefor; and authorize the Water and Sewerage Board of the Town of Wakefield to take by eminent domain under authority of Chapter 377 Acts of 1900 and any other authority thereto enabling them or by pur- chase, an easement in the whole of the private way as shown on a plan by Gilbert-Varker Corp. Engineers, 31 St. James Avenue, Boston, entitled "Plot Plan Layout of Victory Village, Wakefield, Mass., April, 1942" and on file in the Town Clerk's Office .- Board of Health.

ARTICLE 5


To see if the Town will authorize the Water and Sewerage Board to construct a sewer in Stedman Street from the existing sewer northerly approximately 100 feet, and raise and appropriate a sufficient sum of money therefor or authorize the Treasurer with the approval of the Select- men to borrow or issue bonds or notes therefor .- Board of Health.


On motion by Finance Committee:


Voted: That the Town authorize the Water and Sewerage Board to construct a sewer, as described in Article 5, and raise and appropriate the sum of $550.00 therefor.


On motion by Harry Marshall:


Voted: To take up Article 7 in conjunction with Article 6.


ARTICLES 6 AND 7


Art. 6. To see if the Town will authorize the Water and Sewerage Board to purchase on behalf of the Town a certain parcel of land con- taining approximately 25.65 acres, situated on the southerly side of Bay State Road, bounded and described as follows: Beginning at the north- easterly corner at a point in the southerly side of Bay State Road at the Wakefield-Lynnfield Town Line, the line runs westerly by Bay State Road 641.5 feet, then southerly 515 feet, more or less, by land of John Carlson, thence southeasterly 265 feet, more or less, by land of owners unknown, thence southwesterly 495 feet, more or less, by land of owners unknown; thence northwesterly 258 feet, more or less, by land of owners unknown, to a ditch; thence westerly by Quannapowitt Avenue 226 feet, more or less; thence southerly by a ditch 836 feet, more or less, to the Saugus River and by land of Bernard J. Norton and William A. Gilchrist and Alexander V. Phillips, thence easterly and southeasterly by various courses by the Sau- gus River 1655 feet, more or less, to an iron bolt in a rock which is the

Subject to the right of way for drainage systems of the Town of Reading in accord- ance with Chapter 458 Acts of 1939 as amended and Chapter 79 of the General Laws and raise and appropriate a sufficient sum of money therefor, or authorize the Treasurer with the approval of the Selectmen to borrow or issue notes or bonds therefor .- Water and Sewerage Board.


Art. 7. To see if the Town will authorize the Water and Sewerage Board to construct a well, or wells, erect and equip a pumping station on land described in the previous article together with the necessary mains, gates and hydrants to connect the above mentioned pumping station with the existing water system of the Town and raise and appropriate a suffi- cient sum of money therefor, or authorize the Treasurer with the approval of the Selectmen to borrow or issue notes or bonds therefor .- Water and Sewerage Board.

The Moderator announced that a two-third's vote in the affirmative would be necessary to carry the motion inasmuch as it contained provisions for a bond issue.

The Moderator appointed the following tellers to count the vote:


Gardner Campbell and Frederick G. Gorman for the south section, Maurice F. Walsh and Fitzroy Willard in the center, and Joseph W. Mac- Innis and Cyrus M. Dolbeare for the north section.


RESULT OF THE VOTE: 62 persons voted in the affirmative, and 7 persons voted in the negative.


The Moderator then declared that, two thirds vote having been re- ceived in the affirmative, the motion was carried.


ARTICLE 8


To see if the Town will authorize the Water and Sewerage Board to lay water mains in the following streets: Robert Street approximately 950 feet; also in a new street running southerly from Albion Street known as Doyle Avenue approximately 350 feet; and in Jefferson Road and Hamil- ton Road in Victory Village, so called, located north of Richardson Street, approximately 1570 feet and any other work of like nature, and appropri- ate a sufficient sum of money therefor and authorize the Treasurer with the approval of the Selectmen to borrow such money and issue notes or bonds of the Town therefor .- Water and Sewerage Board.


On motion by Harry Marshall, chairman of the Finance Committee:


Voted Unanimously: That the Town authorize the Water and Sew- erage Board to lay water mains in the following streets: Robert Street, approximately 950 feet; in a new street running southerly from Albion Street, known as Doyle Avenue, approximately 350 feet; and in Jefferson Road and Hamilton Road, in Victory Village, so-called, located north of Richardson Street, approximately 1570 feet, and other extensions in new developments of similar kind; and appropriate $5,000.00 therefor and au- thorize the Treasurer, with the approval of the Selectmen, to borrow and issue notes or bonds therefor payable $1,000.00 each year for five years.


ARTICLE 9


To see if the Town will appropriate the sum of $150.00 for salaries of clerks in Water Department and provide the necessary funds through transfer from balance of appropriation for Water Maintenance, other ex- penses, for the year 1942 .- Water and Sewerage Board.


On motion by Harry Marshall for the Finance Committee:


Voted: That the Town vote to appropriate the sum of $125.00 for salaries of clerks in the Water Department and provide necessary funds through transfer from the balance of the appropriation for Water Main- tenance, other expenses for the year 1942.


ARTICLE 10


To see if the Town will raise and appropriate a. sum of money to resurface Main Street between Water Street and Albion Street and trans- fer available balances in appropriations by the Annual Town Meeting of

1941 under Article 14 and Article 16 to be used in conjunction therewith or separately for the same purpose .- Board of Selectmen.


On motion by Harry Marshall for the Finance Committee:


Voted: That the Town vote to appropriate the sum of $922.82 for resurfacing Main Street between Water Street and Albion Street, said sum to be used for materials only, for purposes called for in the article, and provide necessary funds through transfer from available balances in appropriations of the annual town meeting of 1941 as follows:


Article 14-Main Street Resurfacing $565.19


Article 16-Chestnut Street Rebuilding 357.63


ARTICLE 11


To see if the Town will appropriate a sufficient sum of money for salary of Assistant Superintendent of the Highway Department, which taken together with the amount already appropriated will allow for pay- ment of said salary at the rate of $2,400.00 per year, effective as of March 9, 1942; and provide necessary funds through transfer from balance of the appropriation for Highway Department Other Expense for the year 1942 .- Board of Selectmen.


On motion by Harry Marshall for the Finance Committee:


Voted: That the Town appropriate the sum of $157.80 for salary of Assistant Superintendent of the Highway Department, to allow for pay- ment of said salary at the rate of $2,400.00 per year, effective as of March 9, 1942; and provide necessary funds through transfer from the balance of the appropriation for Highway Department Other Expense for the year 1942.


ARTICLE 12


To see if the Town will vote to raise and appropriate the sum of $459.00 for clerk hire in the office of the Town Clerk in order that there may be one full-time assistant to care for the additional duties in that office caused by the war and defense activities .- Charles F. Young, Town Clerk.


Motion by Harry Marshall for the Finance Committee:


That the subject matter of Article 12 be indefinitely postponed.


The vote on the motion, as counted by the tellers, was: 37 in the af- firmative, and 42 in the negative, and the Moderator declared the motion not carried.


On motion by Charles F. Young :


Voted: That the Town raise and appropriate the sum of $459.00 to carry out the purposes of Article 12.


The vote on the motion, as counted by the tellers, was 46 in the af- firmative, and 40 in the negative, and the Moderator declared the motion carried.

ARTICLE 13


To see if the Town will vote to raise and appropriate the sum of $175.00 for clerk hire in the office of the Board of Registrars .- Board of Registrars. Motion by Harry Marshall for the Finance Committee:


That the Town raise and appropriate the sum of $125.00 for clerk hire for Election and Registration account.


Amendment by Frederick G. Gorman: To strike out the sum of $125.00 and insert in the place thereof the sum of $175.00, as called for in the article.


Amendment voted in the affirmative.


Original motion, as amended, voted in the affirmative.


ARTICLE 14


To see if the Town will vote to raise and appropriate the sum of $125.00 to defray the expense of cards and typing for an alphabetical index of male and female residents of the Town of Wakefield who are twenty years of age or over, as provided for in Chapter 51, Section 4, of the General Laws, Ter. Ed .- Board of Registrars.


On motion by Harry Marshall for the Finance Committee:


Voted: That the subject matter of Article 14 be indefinitely postponed.


ARTICLE 15


To see if the Town will vote to amend its Building By-Laws by adding to Article 9 thereof the following new section, to be known as Section 18: On all new construction of dwelling houses, cellar ceiling shall be strapped, lathed, and cement-plastered .- Joseph W. MacInnis, Building Inspector.


On motion by Frank P. Wakefield:


Voted: That the subject matter of Article 15 be indefinitely postponed.


ARTICLE 16


To see if the Town will vote to repeal Chapter 10 of the By-Laws of the Town of Wakefield and substitute the following by-law therefor, to be known as Chapter 10.


HOUSE NUMBERING BY-LAW FOR THE TOWN OF WAKEFIELD Chapter 10


Sec. 1: In all territory of the Town there shall be allowed one number to every fifty feet along the line of each side of the street, with the excep- tion of the following territory, where there shall be one number to every twenty feet along the line of each side of the street.


Sec. 2:


1. Main Street, easterly side, from center line of Park Street south to center line of Summer Street.


2. Main Street, westerly side, from center line of Lafayette Street to point opposite the center line of Summer Street.

3. Main Street, Greenwood, from center line of Walton Place to Mel- rose line.


4. Main Street numbering shall begin at the northerly end at the Reading line and continue to the southerly end at the Melrose line, odd numbers to be on the right, west side, even numbers on left, east side.


5. Albion Street, from Main Street westerly: One number to every twenty feet to a point 350 feet northeast of the center line of Cedar Street; thence one number to every fifty feet westerly to Stoneham line.


6. Water Street, easterly from Main Street: One number to every twenty feet from Main Street to a line at right angle to Water Street 100 feet easterly from the easterly side of Newhall Court; one number every fifty feet thence to the Saugus line.

The following streets shall be assigned one number for every twenty feet for their entire length, numbers to begin at the end nearest Main Street, or nearest the principal traveled way from which they origi- nate: Center Street, Mechanic Street, Lincoln Street, Smith Street, Rich- ardson Avenue, West Water Street, Armory Street, Foster Street, Foundry Street, Maple Street.


Sec. 3: On all other streets running north or south (with the exception of the streets on which numbering has been established) numbering shall begin at the end nearer the Town Hall, odd numbers to be on the right, even numbers on the left, and all minor lateral streets shall be numbered from one up starting from the main traveled way from which they origi- nate, odd numbers to be on the right, even numbers on the left.


Sec. 4: Streets originating from Main Street shall be numbered from one up, easterly or westerly, from point of origin, odd numbers to be on right, even numbers on left.


Sec. 5: Streets lying west of Main Street, but not originating there- from, shall be numbered from the end nearer the Town Hall, and all streets hereafter numbered or constructed as lateral streets therefrom shall be numbered from one up, odd numbers on right, even numbers on left.


Sec. 6: All streets lying east of Main Street, but not originating there- from, shall be numbered from one up from the end nearer the Town Hall, and all streets hereafter numbered or constructed as lateral streets there- from shall be numbered from one up, odd numbers on right, even numbers on left.

Sec. 7: In all cases, odd numbers shall be on the right and even num- bers on the left from point of origin, except in such cases where estab- lished streets as of the year 1942 already are numbered in conflict with this rule. In such cases, assignment of numbers in isolated cases shall con- form to the system existing as of January 1, 1942, and continue until such time as conditions shall, in the judgment of the Board of Selectmen, war- rant a general re-numbering of such streets.


Sec. 8: In calculating frontages for numbering, there shall be included the width of abutting or intersecting streets, and all intervening parks or public property.


Sec. 9: Where these rules obviously are inappropriate because of exist- ing conditions, the Selectmen shall be guided by a general policy of hav- ing a number begin at the end of the street nearer the center of the town, or nearer the principal traveled way, and in all cases the Board of Select- men shall have the power to exercise discretion, and their decision shall be final.


Sec. 10: Upon being notified in writing by the Board of Selectmen of the assignment of a house number, the owner of the property shall affix a number within 30 days of date of said notice. Said number shall be affixed to the frame of the main entrance, on the lock side, and shall be not less than four nor more than five feet above the door sill. In cases where the set-back of a house or other building is fifty or more feet from the main traveled way, a number shall be affixed to a post or other visible and substantial support, at the entrance to the property.


Sec. 11: It shall be the duty of the Highway Superintendent, or such other person the Selectmen shall designate, to prepare and from time to time correct a series of maps including all public streets and private ways whereon are indicated all buildings fronting on them with the distances and numbers as set forth in the above rules clearly marked. One dupli- cate copy of these maps is to be kept in the vault in the Town Hall.


Sec. 12: Within 30 days from the date on which this by-law legally takes effect, all owners of residential or business property who have not already done so shall provide house numbers in accordance with the fore- going regulations, after being duly notified by the Selectmen or their agent, and failure to comply shall incur the penalty provided under Chap- ter 12 .- Committee on House Numbering.


On motion by Gardner Campbell:


Voted Unanimously: That further reading of the by-law be dispensed with, and the Town vote to repeal Chapter 10 of the by-laws of the Town of Wakefield, and substitute the following therefor, to be known as Chapter 10:
