Voted: That the sum of $80,000 being part of the balance of the Operating Fund of the Municipal Light Department as of December 31, 1960, be returned to the Town Treasury and the Assessors be hereby authorized to use the same in computing the tax rate for 1961, and author- ize the Municipal Light Department to transfer from its Operating Fund $130,810.69 to its Construction Fund the latter sum being the remainder of the balance in its Operating Fund as of December 31, 1960.

To see if the Town will vote to authorize the Board of Assessors to use such free cash as may be in the treasury, or any part thereof, in com- puting the tax rate for the current year.

Special Town Meeting, April 27, 1961
Meeting called to order at 7:34 P.M. by Moderator Roger H. Wingate who read the call for the meeting.
On motion by Fred A. Beyer, Jr .:

ARTICLE 1
To see if the Town will vote to raise and appropriate, or appropriate by transfer from Available balances, and/or authorize the Treasurer, with the approval of the Board of Selectmen, to borrow and issue bonds or notes of the Town so as to supplement the appropriation for Sewer Construction voted under Article 32 of the Annual Town meeting of 1960, or take any other action with relation thereto.

Voted: That the sum of $69,000 be appropriated for the construction of sewers along Vale View Road from a manhole at the intersection of Pros- pect Street northerly approximately 525 feet to a dead-end manhole, and along Oak Street from the existing sewer main at Atwood Street extending easterly towards Nahant Street, including the "Oak Street Trunk Sewer" across private land to Nahant Street, and along Nahant Street norherly to Farm Street and Farm Street northerly to the Mill River near Water Street to the "Farm Street Pumping Station," for the construction of a sewer pumping station at the corner of Farm and Water Streets, and for the construction of a force main from the pumping station along the Mill River westerly to the existing gravity system at Nahant and Hart Streets; that this appropriation is in addition to the appropriation under Article 32 of the 1960 Annual Town Meeting; and that to meet this appropriation the sum of $69,000 be transferred from the Excess and Deficiency Account.

ARTICLE 2
To see if the Town will vote to amend its Zoning By-laws and Zoning Map by changing from a General Residence District to a Business District a tract of land on the easterly side of Main Street in that part of Wake- field called Greenwood by extending the present Business District easterly to a line parallel to and two hundred and fifty feet (250') easterly of the easterly side line of Main Street from the northerly side line of Oak Street to the northerly end of the present Business District.

Kenneth W. Thomson read the report of the Planning Board stating that a hearing on the article was held complying with all legal requirements.
On motion by Mr. Thomson:

ARTICLE 3
To see if the Town will vote to amend the By-laws of the Town by striking Section 17 from Chapter 17 thereof, and inserting the following:
Section 17 - A motion to reconsider any vote must be made before the final adjournment of the meeting at which the vote was passed, but such motion to reconsider shall not be made at an adjourned session unless the mover has given notice of his intention to make such a motion, either at the session of the meeting at which the vote was passed, or by written notice to the Town Clerk within twenty-four hours after the adjournment of such session. There can be no reconsideration of a vote once reconsider- ed or after a vote not to reconsider it.

ARTICLE 6
To hear and act upon the report of the Parking Committee appointed under authority of Articles 5 and 6 of the Annual Town Warrant for the year 1957.

John V. Clancy read the report of the Committee, whose members were Mrs. R. M. Springer, Philip E. Coyle, Jr., Fred W. Bliss, Kenneth W. Odiorne, Burton F. Whitcomb, Robert N. Duffie, Burton C. Parker, Louise Nutile, and John Clancy, recommended that the committee be discharged and a new, unrestricted Parking Committee be appointed whose scope could en- compass the entire parking problems of the Town, rather than the bound- aries of Lincoln, Crescent, and Princess Streets as shown on Plat 17 of the Town Plan.

Voted: That the report of the Parking Committee under auhority of Articles 5 and 6 of the Annual Town Warrant for the year 1957 be accepted as a final report and the committee be discharged and commended.

ARTICLE 8
To see if the Town will vote to authorize and instruct the Board of Public Works to purchase or take by right of eminent domain, a permanent easement for drainage purposes, including maintenance and repair thereof, said easement being bounded and described as follows: beginning at a point of intersection of land of the Town of Wakefield with land now or formerly of Hosmer and land now or formerly of White, the line runs WESTERLY 25 feet; SOUTHERLY 15 feet; EASTERLY 140 feet; NORTH- ERLY 15 feet; and WESTERLY again 115 feet to the point of beginning, all of said measurements being more or less; and to provide therefor the Town raise and appropriate and/or appropriate by transfer from available funds, a sufficient sum of money.
-West Side Elementary School Building Committee. On motion by John Clancy:
Voted: That the subject-matter of Article 8 be indefinitely postponed.
ARTICLE 9
To see if the Town will vote to authorize the Board of Public Works to construct sewer in North Avenue as follows:
Beginning at an existing sewer manhole on North Avenue at Quan- napowitt Parkway and extending approximately 260 feet southeasterly on North Avenue to a dead-end manhole and to see if the Town will raise and appropriate a sufficient sum of money therefor and/or authorize the treas- urer with the approval of the Selectmen to borrow and issue notes or bonds of the Town therefor and/or appropriate by transfer from available balances necessary for the construction, maintenance and repair of said sewer.

ARTICLE 2
To see if the Town will vote to raise and appropriate, or transfer from available funds, a sum of money to pay for the installation of approximate- ly 1321 feet of 8 inch and approximately 25 feet of 6 inch water main in Forest Street, or take any other action in relation thereto.

On motion by Finance Committee:
Voted: To transfer from Excess and Deficiency Account the sum of $1,500.00 to pay for the installation of approximately 1,321 feet of eight- inch and approximately 25 feet of six-inch water main in Forest Street.
ARTICLE 3
To see if the Town will vote to authorize the Board of Public Works to purchase or take by eminent domain proceedings the six-inch sewer line in Walker Terrace, and take an easement for sewer and water three hun- dred feet more or less down Walker Terrace by a width of twenty (20) feet, and see if the Town will extend the sewer in Walker Terrace fifty (50) feet from the present manhole in Walker Terrace toward the end of Walker Terrace, and to raise and appropriate, or transfer from available funds, a sufficient sum of money to carry out the purposes of this article.

ARTICLE 4
To see if the Town will amend its Zoning By-laws by inserting after Section 4A. LIMITED BUSINESS DISTRICTS, a new section numbered 4B. COMMERCIAL RECREATION DISTRICTS reading as follows: Use in Commercial Recreation Districts
In any Commercial Recreation District:
(a) No building or premises shall be erected, altered or used for any other purpose than:
1. Churches, parish houses, convents and similar religious buildings.
2. Schools.
3. Professional and business offices and financial institutions.

4. Restaurants.
5. An enclosed building or arena for indoor athletic activities.
6. An exhibition or assembly hall used for art, scientific, cultural and business exhibitions or conferences, or indoor theatrical performances.

8. Signs pertaining only to a business or other occupancy of the prem- ises.
Set-Back
(b) No part of any building shall be built within 50 feet from the street line on all streets.
Yards
(c) No building shall be built with a distance of less than 20 feet from any side or rear lot line.
Height
(d) No building shall exceed a height of 50 feet.
Area and Frontage of Lot
(e) No building shall be erected or placed on a lot containing less than 40,000 square feet or having a frontage of less than 150 feet on a street, but this provision shall not prevent the construction or placing of a permit- ted building on any lot in a Commercial Recreation District containing a smaller area or a less frontage, provided such lot, on the effective date hereof, does not adjoin any other land of the same owner, available for use in connection with said lot.
Front Yards
A continuous landscaped strip not less than 10 feet wide shall be main- tained between the street line and the balance of the lot, which strip shall be traversed by not more than two driveways, each not more than 30 feet wide and one additional driveway for each 200 feet of frontage in excess of 150 feet.
Off-Street Parking
(g) Off-street parking spaces shall be provided in accordance with the provisions of Section 5B, but not less than the following:
For offices and financial institutions, one space for each 300 square feet of gross building floor area.
For restaurants, one car space for each 30 square feet of floor area used for eating purposes.
For places of public recreation or assembly, one car space for each 3 persons admitted to such place at any one time.
All parking spaces shall be located on the same lot as the building which they serve and shall be located not less than 10 feet from any street line or side or rear lot line.
Any parking area open to the public later than one hour after sunset or earlier than one hour before sunrise shall be sufficient lighted so as to provide a minimum of 2/10 lumens per square foot throughout the area of the lot. All lights shall be covered with a standard globe and shall be shaded in such manner that no disturbing glare is visible to adjacent prop- erty owners or to motorists using the public streets.

One car space shall be deemed to occupy not less than 300 square feet of the total area not occupied by buildings or other structures. No parking space shall be reduced nor shall the attendance be increased at any time so that there are fewer car spaces than one for every 3 persons in attend- ance.
Prohibited Uses
(h) No building or premises shall be used for boxing or wrestling contests, roller skating, public dancing or for a public motion picture theater.
There shall be no loud speakers or other announcement devices audible off the premises.
Approval of Plans
(i) Before a permit is issued for the construction, alteration, moving or enlarging of any building or for the development of any premises under the provisions of this section, the applicant shall submit a site plan and build- ing plans for the proposed project to the Planning Board for their approval. In approving any such application, the Planning Board shall give due con- sideration to the effect of such project on the public safety, to the provi- sions for handling traffic and to parking.
