MOVED : That, for the purpose of financing the con- struction of a Water System, and to enable the Town of Harwich to secure the benefits of the Emergency Relief Ap- propriation Act of 1935, there be raised and appropriated the sum of $260,000.00, that there be transferred from the Surplus Fund unappropriated in the Treasury the sum of $10,000.00, and that the treasurer, with the approval of the selectmen, be and hereby is authorized to borrow the sum of $150,000.00 and to issue bonds or notes of the Town therefor, under authority of and in accordance with the provisions of Chapter 404 of the Acts of 1935, said bonds or notes to be payable in not more than 20 years at such term and maximum rate of interest as may be fixed by the state Emergency Finance Board.


All moneys received by way of grant from the Fed- eral Government on account of this project shall be applied first to meet the cost of construction thereof (including preliminary expenses, and any balance thereof shall be ap- plied to payment of the loan herein authorized.


The selectmen are hereby authorized and directed to accept on behalf of the Town, for use in carrying out such project a Federal Grant of money pursuant to the Emer- gency Relief Appropriation Act of 1935, and the selectmen are authorized to proceed with the construction of said project and to enter into all necessary and proper contracts and agreements in respect thereto, all subject to applicable Federal regulations; and the selectmen are authorized to do all other acts and things necessary or. convenient for ob-

taining said grant, and for making said loan, and for con- struction of said project.


During the debate on this question which was very brief; consisting mainly of explanations of certain aspects of the water question-such as hydrant rentals, increased tax rate, lower insurance rates-Mr. Howard of Boston was given the privilege of the floor and fully explained all questions put before him.


The question was called for and a rising vote was taken with result as follows: YES-163; NO-1.


Article 4. To see if the Town will vote to raise and appropriated the sum of Four Thousand ($4,000.) Dollars for the purchase of material to be used in remodeling the Court Room in Brooks Block, in conjunction with the W.P.A. Project; the cost of labor to be paid for by the Federal Government; and provided also that the Selectmen are able to renew the lease for the said Court Room with the County Commissioners on a basis which in their opinion is favor- able to the Town.


The Finance Committee recommend that this article be accepted and adopted and the sum of $4000.00 be taken from the surplus fund for this purpose. It was voted un- der the motion of Gershom D. Hall, that the recommenda- tions of the Finance Committee be accepted and adopted.


Article 5. To see if the Town will raise and appro- priate the sum of One Hundred ($100.) Dollars to be used by the School Committee to secure estimates for the con- struction of a High School Building. By request.


The Finance Committee recommend that this article be accepted and adopted and that the sum of $100.00 be taken from the Surplus Fund for this purpose. It was voted that the recommendations of the Finance Committee be

accepted and adopted and $100.00 be taken from the Sur- plus Fund.


Article 6. To see if the Town will vote to appoint a Committee of three to make an investigation of School Housing conditions and report to the Annual Town Meeting. By request.


The Finance Committee recommend that this article be accepted and adopted and the meeting voted to accept and adopt the same.


It was also voted that the Moderator appoint the com- mittee called for under this article. As appointed the com- mittee consists of : Roswell H. Nye, Rev. Lynn V. Farns- worth, Rev. Alfred R. Atwood.


A motion to adjourn was made and seconded and this Special Town Meeting was closed at 9:30 o'clock.

To either of the Constables of the Town of Harwich, in said County Greetings :-


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the Inhabitants of said Town qualified to vote in Elections and Town affairs to meet in Exchange Hall in said Town on Monday, Feb. 3rd, 1936, at Nine O'clock A. M., then and there to act on the following Articles :-


Article 1. To choose a Moderator.


Article 2. To choose on one ballot the following Town Officers and Committees: Town Clerk, Town Treas- urer, Tax Collector, for one year; one Selectman, Overseer of Public Welfare and Board of Health, for three years; one Assessor, for three years; three Herring Committee, for one year; one School Committee for three years; three Constables, for one year; one Trustee of Brooks Library, for three years; one Park Commissioner, for three years; a Moderator for one year.


Article 3. To choose all other necessary Town Of- ficers and Committees.


Article 4. To see if the Town will vote to authorize the town treasurer with the approval of the selectmen, to borrow money from time to time in anticipation of the rev- enue of the financial year beginning January 1, 1936, and to isse a note or notes therefor payable within one year, and

to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 5. To hear the report of all Town Officers and Committees, for the year 1935.


Article 6. To see if the town will vote to raise and appropriate such sums of money as may be necessary to defray Town expenses for the ensuing year, and act fully thereon.


Article 7. To see if the town will vote to Instruct its Selectmen to control, regulate and prohibit the taking of Eels, Clams, Quahaugs and Scallops, within the Town limits as provided in Chapter 91, Section 85 and acts and amendments thereto to the revised Laws of Massachusetts, and to make any regulations in regard to such fisheries as may be expedient, and act fully thereon.


Article 8. To see if the town will authorize the Treasurer to assign tax titles owned by the town.


Article 9. To see if the town will vote to erect and maintain three street lights on Queen Ann Road, North Har- wich, from Main Street to the residence of John Nunes, and raise and appropriate a sufficient sum of money for this purpose.


Article 10. To see if the town will vote to raise and appropriate a sufficient sum of money to erect and maintain a street light on the last pole on Oak Street.


Article 11. To see if the town will vote to place and maintain one street light on Willow Street, West Harwich, at a point about midway between Riverside Drive and Bel- mont Road.


Article 12. To see if the town will vote to erect and maintain two Street lights on Sisson Road, between the resi-

dence of James T. Woodward and Carl A. Carlson. By request.


Article 13. To see if the town will vote to place an electric light on Bank Street, about opposite the residence of Arthur W. Tobey, Jr., and act fully thereon. By request.


Article 14. To see if the town will vote to raise and appropriate a sufficient sum of money to install and main- tain one street light on Satucket Road, Harwichport, mid- way between Ayer Lane and Pine Street. By request.


Article 15. To see if the town will vote to maintain a street light at the junction of Lower County Road and Brooks Road, and raise and appropriate a sufficient sum of money for this purpose.


Article 16. To see if the town will vote to raise and appropriate a sufficient sum of money to erect and maintain one arc light in front of the West Harwich Post Office. By request.


Article 17. To see if the town will vote to raise and appropriate a sufficient sum of money to extend the side- walk in North Harwich, from the Post Office to the School Building, on the South side of Main Street, and act fully thereon.


Article 18. To see if the town will vote to raise and appropriate the sum of Five Hundred ($500.) Dollars to con- struct a sidewalk to be hardened with bituminous concrete or hot mix, on the East side of Pleasant Lake Avenue in Harwich Center, from or near the Exchange Hall, thence northerly as far as money will go.


Article 19. To see if the town will vote to construct a bituminous concrete sidewalk on the East side of the Har- wich-Brewster road in Pleasant Lake, beginning at a point thereon abreast the residence of Carrie A. Cahoon and

thence continuing northerly to a point abreast the residence of J. Burleigh Atkins ; and raise and appropriate a sufficient sum of money therefor and act fully thereon.


Article 20. To see if the town will vote to build a curb and sidewalk on the East side of Bank Street, Har- wichport, from the State Highway to the Public Library, and make an appropriation therefor, and act fully thereon.


Article 21. To see if the town will vote to appro- priate the sum of Two Hundred and Fifty ($250.) Dollars to build the sidewalk from where it left off near the prop- erty of Ziek Nickerson on Cross Street, to the intersection of Miles and Cross Streets.


Article 22. To see if the town will vote to raise and appropriate a sufficient sum of money to fill in sidewalk, raise to street level and macadam finish, for a distance of about four hundred (400) feet on the easterly side of Pine Street, from a point opposite Shell Station at Lower County Road to Satucket Road, Harwichport. By request.


Article 23. To see if the town will vote to accept the lay-out of a Town Way in Harwichport, with the bound- aries as reported and recommended by the Selectmen under date of January 23, 1936, and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the land, or interest in land, within lines of said lay-out, to wit: A thirty (30) foot lay-out extending from lower Coun- ty road to the shore, being an extension of Hiawatha Road into Western Avenue, so-called.


Article 24. To see if the town will vote to harden with bituminous concrete or "hot mix" the unfinished por- tion of the sidewalk on Bank Street, Harwich Center, ex- tending from a point opposite Gorham Road to the base of Moody's Hill, and to raise and appropriate a sufficient sum of money therefor. By request.

Article 25. To see if the town will vote to top coat the sidewalk from the residence of Everett B. Mecarta to South Street, and raise and appropriate a sufficient sum of money for said work.


Article 26. To see if the town will vote to discon- tinue as a Town Way the road in West Harwich, known in our town records as the Thomas Ellis Road, more re- cently called the Old Mill Point Road, leading southerly front Lower County Road into the property of the Old Mill Point Club Inc., and to act fully thereon.


Article 27. To see if the town will appropriate the sum of Three Hundred ($300.) Dollars for the purpose of completion of the Town Dock at Pleasant Bay, East Har- wich, and act fully thereon.


Article 28. To see if the town will vote to raise and oppropriate the sum of Two Hundred Twenty-five ($225.) Dollars for a new concrete mixer for town use and act fully thereon. By request.


Article 29. To see if the town will vote to raise and appropriate the sum of One Hundred Thirty-five ($135.) Dollars to purchase a power mower and grass catcher; the said mower to be used at Brooks Park.
