ANNUAL TOWN MEETING WARRANT


FEBRUARY 3, 1941


THE COMMONWEALTH OF MASSACHUSETTS Barnstable, ss.


To either of the Constables of the Town of Harwich, in said County, Greetings :-


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the Inhabitants of said Town qualified to vote in Elections and Town Affairs, to meet in Exchange Hall in said Town on Monday, February 3, 1941, at 7 o'clock A. M., then and there to act on the following Articles :-


Article 1. To choose on one ballot the following Town Officers and Committees: Town Clerk, Town Treas- urer, Collector of Taxes, for one year; one Selectman, Overseer of Public Welfare and Board of Health, for three years; one Assessor for three years; three Herring Com- mittee for one year; one School Committee for three years ; three Constables for one year; one Trustee of Brooks Library for three years; one Park Commissioner for three years; Moderator for one year; one Water Commissioner for three years; Surveyor of Highways for one year ; one Cemetery Commissioner for three years.


Article 2. To choose all other Town Officers and Committees.


Article 3. To see if the town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1941, . and to issue a note" or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

Article 4. To hear the report of all Town Officers and Committees for the year 1940.


Article 5. To see if the town will vote to raise and appropriate such sums of money as may be necessary to defray town expenses for the ensuing year, and act fully thereon.


Article 6. To see if the town will vote to instruct its Selectmen to control, regulate and prohibit the taking of Eels, Clams, Quahaugs and Scallops, within the town limits as provided in Chapter 130, Section 57, as amended by Chap. 329 of the Acts of 1933 and to make any regula- tions in regard to such Fisheries as may be expedient, and act fully thereon.


Article 7. To see if the Town will vote to raise and appropriate a sufficient sum of money for unpaid bills which were authorized as an emergency under Section 31, Chapter 44, by vote of the Selectmen under date of Decem- ber 1940.


Article 8. To see if the Town will vote to raise and appropriate the sum of Two Hundred ($200.) Dollars for the use of Harwich Post No. 292 American Legion, in the proper observance of Memorial Day and Armistice Day.


Article 9. To see if the Town will vote to raise and appropriate a sum of money not to exceed Sixteen Hundred ($1,600.) Dollars, under the provisions of Sub- Section 21 of Section 1 of Chapter 371 of Acts of 1921, and any and all amendments thereof and additions thereto for the employment of a nurse through the Harwich Visiting Nurse Association, Inc.


Article 10. To see if the Town will raise and ap- propriate a sum not exceeding Five Hundred ($500.) Dol- lars for the establishment and maintenance of a free bed in the Cape Cod Hospital for the care and treatment of persons certified by the Selectmen to be residents of the town and unable to pay for such care and treatment, under the provisions of General Laws Ter. Ed. Chapter 111, Sec- tion 74.

Article 11. To see if the Town will vote to raise and appropriate the sum of Six Hundred ($600.) Dollars for the benefit of Chase Library. West Harwich.


Article 12. To see if the Town will vote to raise and appropriate the sum of Six Hundred ($600.) Dollars for the benefit of Harwichport Library Association.


Article 13. To see if the Town will vote to raise and appropriate the sum of Two Hundred Fifty ($250.) Dollars for the purpose of providing five Band Concerts, to be given by the Junior Community Band and other Cape musical organizations during July and August at Brooks Park.


Article 14. To see if the Town will vote to raise and appropriate the sum of Two Thousand ($2,000.) Dollars to be expended in connection with W.P.A. work, said money to be expended under the supervision of the Selectmen.


Article 15. To see if the Town will vote to expend the refunded dog tax for 1940 for the support of Brooks Library.


Article 16. To see if the Town will vote to raise and appropriate the sum of Fifty ($50.) Dollars to care for the Town Docks and Floats at Wychmere Harbor, Harwichport and Pleasant Bay, East Harwich, and act fully thereon.


Article 17. To see if the Town will vote to raise and appropriate the sum of Four Hundred ($400.) Dollars for keeping, as far as possible, the beaches clean at West Harwich, Harwichport, and South Harwich; also care of raft at foot of Bank Street, Harwichport, and act fully thereon.


Article 18. To see if the Town will vote to raise and appropriate the sum of Five Hundred ($500.) Dollars to be expended by the Cemetery Commissioners for the . care of the old cemeteries of the town.


Article 19. To see what action the Town will take in regard to disposing of the Herring for the year 1941, and act fully thereon.

Article 20. To see if the Town will vote to raise and appropriate a sufficient sum of money to paint the water tank on Kildee Hill, Harwichport, and act fully thereon.


Article 21. To see if the Town will vote to ap- propriate the sum of One Thousand Seven Hundred Dollars ($1,700.) to be used for extensions to the Town Water System when requested, applicants for extensions must guarantee the town six (6) per cent income on the invest- ment. To see what action the Town will take and act fully thereon.


Article 22. To see if the Town will vote to accept the provisions of an agreement with the New England Telephone & Telegraph Co., regarding the location of a portion of the door-step and fire escape at Brooks Block on the Company's land, and authorize the Board of Trus- tees of the Brooks Free Library to execute said agreement on behalf of the Town.


Article 23. To see if the Town will vote to accept the provisions of a certain agreement with the New Eng- land Telephone & Telegraph Co., whereby the Town re- leases to said Co. any rights of way by adverse use or otherwise which the Town has over said Company's land, and accepts a granted right of way in a certain place as shown on said agreement and a plan therewith, and author- ize the Board of Trustees of the Brooks Free Library to execute said agreement in behalf of the Town. Said rights of way are appurtenant to the Brooks Block land and lie in the rear of said Company's central office in Harwich.


Article 24. To see if the Town will vote to raise and appropriate and equip a 750 gal. Triple Combination Pumper, for Fire Department use, and act fully thereon.


Article 25. To see if the Town will vote to raise and appropriate the sum of Two Hundred ($200.) Dollars to stock ponds and streams with fish and for the feeding and propagation of game within the town limits, and that a committee of three be appointed by the chair to have charge of the work.

Article 26. To see if the Town will vote to raise and appropriate a sufficient sum of money to lay water mains on Neel Road from State Road southerly to resi- dence of Howard Lang; on Walther Road easterly from Neel Road to end of public way; on Saquatucket Bluffs Road westerly from Neel Road to residence of Charles B. Rowley, and act fully thereon.


Article 27. To see if the Town will vote to rescind the action taken under Article 49 of the Town Warrant for the Annual Town Meeting of 1938 and adopt in place of that action the following By-Laws :- No business shall be transacted at any Town Meeting unless there is a quo- rum present, which quorum shall be five per cent of the registered voters of the Town, except Special Meetings which are called to transfer appropriations from one town department to another. At such special meetings fifteen such registered voters shall constitute a quorum provided that a number less than a quorum may from time to time adjourn the same but at such meetings no other business shall be transacted unless the required five per cent of registered voters are present. This By-Law shall not apply to such parts of meetings as are devoted exclusively to the election of town officers.


Article 28. To see if the Town will vote to raise the necessary money to install and maintain a street light at the intersection of Sequattom Lane and Satucket Road, Ayerlayne, Harwichport.


Article 29. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and maintain one street light at corner of Bank Street and Fenwick Road, Harwichport.


Article 30. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and maintain one street light on Grey Neck Road between Main Street and Lower County Road, near the residence of George A. Yule. By request.


Article 31. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and

maintain one street light at the corner of Grey Neck Road and Lower County Road, near the resident of Helen M. O'Brien. By request.


Article 32. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and maintain one street light at the corner of Earl Road and Lower County Road. By request.


Article 33. To see if the Town will vote to author- ize the Selectmen to negotiate a lease of the West Harwich School building to Harwich Post No. 292, American Legion, as provided by the General Laws, and act fully thereon. By request.


Article 34. To see if the Town will vote to raise and appropriate a sufficient sum of money for the purpose of laying a watermain on Cottage Avenue from the pres- ent watermain on Northern Avenue, and to act fully there- on.


Article 35. To see if the Town will instruct its Board of Public Welfare to appoint a welfare agent, who would be responsible to the board, and whose duties would be (a) to investigate every application coming before the welfare board, rendering an opinion as to its worthiness for the guidance of the board; and (b) to keep all records and perform all other clerical work for the board; and (c) to make periodic visits to the homes of those on tem- porary aid, with the purpose of investigating conditions within the homes and of giving helpful advice relative to matters of general welfare, such agent to have- qualified for the Civil Service requirements necessary for those handling Federal relief funds; and to see if the Town will vote to raise and appropriate a sufficient sum of money for the salary and expenses thereof, and act fully thereon.


Article 36. To see if the town will vote to hold the annual town election on a street floor, preferably in the Exchange building, and to act fully thereon.


Article 37. To see if the voters will vote to raise the annual election tellers' salary forty (40c) cents an hour, and to act fully thereon.

Article 38. To see if the voters of the Town of Harwich will vote to incorporate in the By-Laws of said town the following articles :-


Rules, Regulations, and Requirements for Tourist Camps, Tents and Trailers in the Town of Harwich.


Section 1. For the purpose of this by-law certain words and phrases are defined, certain provisions shall be construed as herein set forth unless it shall be appar- ent from the context that a different meaning is intended.


(A) TOURIST CAMP OR PARK SITE: is any place where two or more overnight cabins, tents or trailers are located ; or any premises designed or intended for the purpose of supplying the public a location for overnight cabins, so called tents or trailers.


(b) OVERNIGHT CABINS, TENTS AND TRAIL- ERS. An overnight cabin, tent or trailer under this by-law is constructed primarily for overnight or weekly occupancy and provided with living quarters for such use, when determined by the Selectmen or licensing authorities to be of such structure and use, it shall be termed an overnight cabin, tent or trailer. Any dwelling occupied by the owner, lessee or rented for dwelling purposes may be used for the taking of roomers or lodgers and shall not be termed an over- night cabin, tent or trailer.


(c) . UNIT. A unit is a section of ground in any tour- ist camp used or designed for use as a location for a single overnight cabin, house car, tent or trailer and shall contain not less than 600 square feet in area, and . no unit shall be permitted to accommodate more than one overnight cabin, tent or trailer.


Section 2. It shall be unlawful for any person to estab- lish or maintain or permit to be established or maintained upon any property or park site owned or controlled by him a tourist camp in the Town of Harwich unless there exists a valid permit therefor granted by the Board of Selectmen; or the local licensing authorities shall have

granted a license therefor after a public hearing, notice of the time and place of which hearing shall have been given by the local licensing authorities or the Selectmen at the expense of the applicant by publication not less than seven days prior thereto in a newspaper published in the representative district if there is any published in the English language therein, otherwise in the city or town wherein the land on which said license is to be exercised is situated and also notice by the applicant by registered mail not less than seven days prior to such hearing to all owners of real estate abutting on said land, and in compliance with the provisions of this by-law. The application for such a permit shall be accompanied by plans of the proposed or existing tourist camp showing the location of all building, driveways, toilet facilities, baths, laundry facilities, slop sinks and other improve- ments, and such permit may be granted to any one meet- ing with the requirements as outlined and when it is determined by the Board of Selectmen or the local licens- ing authorities that it is a public necessity and conve- nience and determined by them not detrimental to the locality in which the tourist camp is to be established. A minimum annual permit fee of Ten Dollars ($10.00) per ten (10) units or fraction thereof, tourist camps, shall be paid before said permit shall be issued.


Section 3. PLUMBING AND SANITARY REQUIRE- MENTS. All tourist camps, tents and trailers shall meet with the rules, regulations and requirements of the Board of Health of the Town of Harwich.


Section 4. LICENSE OR PERMIT. Any holder of a license or permit who fails to maintain compliance with the requirements of the Board of Health or compliance with the regulations and by-laws of the Town of Harwich governing the conduct of the business of such licensee or permittee, the Selectmen or licensing authorities may, after hearing or opportunity therefor, modify, suspend, revoke or cancel such license or permit.

Article 39. To see if the Town will vote to raise and appropriate the sum of Two Hundred Seventy Five ($275.) Dollars for the purpose of purchasing a new snow- plow for the road department and to authorize the Sur-


veyor of Highways to sell or trade the old snowplow now owned by the town and the sum received from the same to be used towards the purchase of a new snowplow, and to act fully thereon.


Article 40. To see if the Town will vote to resur- face where needed and rebuild where needed, the sidewalks in the business section of Harwichport; raise and appro- priate Eight Hundred ($800.) Dollars for the same, and act fully thereon.
