REPORT OF ANNUAL TOWN MEETING


FEBRUARY 4-5, 1946


HELD IN EXCHANGE HALL, HARWICH CENTER


Article 1. To choose on one ballot the following town officers and committees: Town Clerk, Town Treasurer. Collector of Taxes. Moderator. Surveyor of Highways. Three Constables and three Herring Committee for one year : one Selectman, Assessor, School Committee, Water Commissioner, Cemetery Commissioner, Park Commissioner and Trustee Broadbrooks Free Library for three years.


Article 2. To choose all other town officers and com- mittees.


Complete list is printed on the first pages of this town report.


Article 3. To see if the town will vote to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1946 and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


This article was accepted and adopted as read.


Article 4. To hear the report of all town. officers and committees for the year 1945.


It was unanimously voted to accept the report of the 1945 town officers and committees as printed in the cur- rent report.


Article 5. To see if the town will vote to raise and appropriate such sums of money as may be necessary to defray town expenses for the ensuing year, and act fully thereon.

Article 7. To see if the Town will vote to instruct its Selectmen to control, regulate, and prohibit the taking of eels, clams, quahaugs, and scallops, within the Town limits as provided in Chapter 130, Section 57, as amended by Chapter 329 of the Acts of 1933 and to make any regula- tions in regard to such fisheries as may be expedient, and act fully thereon.


This article accepted and adopted as read.


Article 8. To see if the Town will vote to transfer from surplus revenue or available funds a sum not in excess of twenty thousand dollars (20,000.00) for the purpose of re- ducing the 1946 tax rate and act fully thereon.


Voted that $20,000.00 be transferred from surplus rev- enue or available funds in the Treasury for the purpose of reducing the 1946 tax rate.


Article 9. To see if the Town will vote to raise and appropriate a sufficient sum of money for the use of Harwich Post No. 292, American Legion in proper observance of Memorial Day and Armistice Day and other proper pa- triotic purposes.

Article 10. To see if the Town will vote to raise and appropriate a sum not to exceed one thousand ($1.000.00) dollars to be paid the Cape Cod Hospital for the establish- ment and maintenance of a free bed in the hospital for care and treatment certified by the Selectmen to be residents of the Town and unable to pay for such care and treatement, in accordance with Section 74 of Chapter III of the General Laws, or take any action in relation thereto and act fully thereon.

Article 11. To see if the Town will vote to raise and appropriate the sum of ($700.00) to continue work on Asses- sors Maps and act fully thereon.

Article 12. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 90 Highway Maintenance, or take any action in relation there- on.


Voted to accept the Finance Commission recommenda- tion which was, "That the sum of $750.00 be raised and appropriated to meet the Town's share of the cost of Chap- ter 90, Highway Maintenance and that in addition the sum of $1,500.00 be transferred from the unappropriated avail- able funds in the Treasury to meet the State and County's share of the cost of the work: the re-imbursement from State and County to be restored upon their receipts to un- appropriated available funds in the Treasury.


Article 13. To see if the Town will vote to raise and appropriate a sum of money not to exceed sixteen hundred ($1600.00) dollars, under the provisions of Sub-section 21 of Section 1 of Chapter 371 of the Acts of 1921, and any and all amendments thereof and additions thereto for the employment of a nurse through the Harwich Visiting Nurse Association, Inc.

To see if the Town will vote to raise and appropriate the sum of one thousand ($1,000.00) to pur- chase and equip a new patrol car, to replace the old patrol car now in use, and to authorize the selectmen to sell or trade the patrol car now owned by the Town and the sum received therefrom to be used towards the purchase of a new car, and to act fully thereon.

Article 16. To see if the Town will vote to raise and ppropriate the sum of four hundred fifty ($450.00) dollars for the benefit of the Chase Library Association, and act fully thereon.

Article 17. To see if the Town will vote to raise and appropriate the sum of six hundred ($600.00) for the bene- fit of the Harwich Port Library Association and act fully . thereon.

Article 19. To see if the Town will vote to raise and appropriate the sum of $350.00 for the purpose of keeping the beaches clean and for the repair of the Board Walks used on the Town Beach and act fully thereon.

Article 20. To see if the Town will vote to raise and appropriate the sum of $500.00 for the care and repair of the Town Dock at Round Cove and act fully thereon.

Article 21. To see if the Town will vote to expend the refunded Dog Tax for the support of Brooks Free Library. Accepted and adopted.


Article 22. To see what action the Town will take in regard to the Herring Fisheries for the year 1946 and act fully thereon.

Article 23. To see if the Town will vote to rescind the action taken at the Regular Town Meeting on February, 2, 1931 whereby it accepted Section 1, 3, 6, and 7 and Sections 11 to 16 inclusive, of Chapter 142 General Laws and all Amendments and additions thereto; said act being relative to the Supervision of Plumbing, to take effect at once.


Mr. Flynn was given the privilege of floor to explain the plumbing laws as related to Harwich. It was voted not to rescind action taken at the Annual Town Meeting on February 2, 1931.


Article 24. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect and main- tain 2 street lights on Woodland Road between Bank and Bayview Avenue in Harwichport and act fully thereon.

Article 25. To see if the Town will vote to raise and appropriate a sufficient sum of money to install and mail- tain one street light on Chatham Road in front of the resi- dence of Gardner Loring Rowell and act fully thereon.

Article 39. To see what action the Town will take in regards to the erecting of a new Primary-Elementary School and appropriate such sums as may be necessary and act fully thereon.


It was moved by Joshua A. Nickerson of East Harwich that "A committee of five (5) be appointed by the Modera- tor to prepare plans and a program for a new elementary school building, and that the sum of $500.00 be raised and appropriated for this expense, and that this committee be authorized to make application for Federal Aid in prepara- tory plans and to obtain bids and estimates. This motion was seconded and carried and the following committee was selected ;

Article 40. To see if the Town will vote to raise and appropriate the sum of $8,500. for the installation of a heating system, toilets and other improvements in the Ele- mentary School and act fully thereon.

Article 41. To see if the Town will vote to raise and appropriate the sum of $1,965.00 to insulate the exposed ceiling area of the new High School and act fully thereon.

Article 42. To see if the Town will vote to raise and appropriate the sum of $816.00 to insulate the exposed ceil- ing area of the old High School and Elementary School and act fully thereon.

Article 43. To see if the Town will vote to raise and appropriate the sum of $4,000.00 to purchase the so-called J. O. Hulse lot north of the Schoolhouse yard in Harwich Port, as a continuation through to Pleasant Street.

Article 44. To see if the Town will vote to rescind the action taken under Article 7. of the Special Town Meeting of November 28, 1945 and act fully thereon.


The recommendation of the Finance Committee that the action taken as described in this article be rescinded was accepted and adopted.


Article 45. To see if the Town will vote to erect the Johnson-Ulm Memorial Building, as recommended in the Report of the Investigating Committee at the last Special Town Meeting on November 28, 1945, Article 7, on the so- called Schoolhouse yard lot on Main Street, Harwich Port, instead of on the lot which they recommended, and to land- scape said lot, that the old Schoolhouse be scrapped or used as suggested by the architect; that the memorial funds be used to acomplish this.

Article 46. To see if the Town will vote to dispose of the Johnson-Ulm Memorial Fund by establishing a com- mittee consisting of the High School Principal, the Super- intendent of Schools, and the three members of the School Committee ; said committee to be known as the Johnson- Ulm Memorial Scholarship Committee; that the committee establish two or more scholarships to be given yearly to needy and worthy High School students who wish to fur- ther their education and that the committee meet with the Executors of the Susan J. Ulm estate to agree on other per- tinent details.

Article 47. To see what action the Town will take in regard to having the buildings removed from the school- house lot in Harwich Port, in order to have more space to use for parking automobiles and act fully thereon.


It was voted that the Selectmen sell or otherwise dis- pose of the out-buildings in the schoolhouse yard in Har- wich Port.


Article 48. To see if the Town will vote to raise and appropriate the sum of two hundred and seventy-five dol-

lars, or a sufficient sum, to meet the expense of removing the tree stumps lodges in the Frog Pond areas, so-called, or Brook's Park, and act fully thereon.

Article 49. To see if the Town will vote to raise and appropriate a sum of money to be used in repairing or build- ing a new dock on the Town Landing at Wychmere Harbor and act fully thereon.

Artice 52. To see if the Town will vote to raise and appropriate the sum of $200.00 for band concerts to be held in Brooks Park in 1946.

Article 53. To see if the Town will vote that the Col- lector of Taxes be elected for a three year term.

Article 54. To see if the Town will vote that the Town Treasurer and Town Clerk be elected for a three year term. Indefinitely postponed.


Article 55. To see if the Town will vote to raise and appropriate the sum of four hundred fifty dollars ($450.00) for the purchase of an FM Radio set, to replace the set now on the Forest Fire Truck, as set on truck now is obsolete.

Article 56. To see if the Town will vote to authorize the Surveyor of Highways to purchase and equip a new truck for the Highway Department and to raise and appro- priate the sum of twenty-two hundred ($2200.00) dollars to the purchase of same, and to act fully thereon.

Article 57. To see if the Town will vote to raise and appropriate the sum of two hundred and ten ($210.00) dol- lars to purchase a sand spreader for use of the Highway Department and to act fully thereon.

Article 58. To see if the Town will vote to raise and appropriate the sum of fifty-nine hundred ($5900.00) dol- lars, to build and equip a building to be located on the pro- perty now owned by the Town on Sisson Road, to be of cement and wood construction, said building to be 32 ft. x 40 fe. to be used for the purpose of housing the road equip- ment, and to act fully thereon.

Article 59. To see if the Town will vote to raise and appro priate one thousand dollars ($1,000.00) for the purpose of buying and setting out one hundred (100) shade trees in the seven sections of the Town.
