HERRING COMMITTEE REPORT
Board of Selectmen and Voters :
The Herring Committee attended to their usual duties during the spring run and a good number of herring reached the ponds for spawning. During the season the brooks were cleared and the flume at Long Pond com- pleted assuring the passage of the young fish to the sea.
With the strong approval of the state we have de- cided, if possible not to sell the herring right for a period of three years, during which time the run should come back to somewhat of its former size.
The Herring Committee has made a survey of possible sites for a seining pool and hope to have a suitable location before the fisheries are sold again.

REPORT OF THE HARWICH ELEMENTARY SCHOOL BUILDING COMMITTEE
On February 18, 1948, the Harwich Elementary School Building Committee, appointed by the Town Moderator, met for the purpose of organization. Mr. Channing N. Baker was elected chairman, and Mr. Robert S. Stearns, secretary.
The Building Committee, at a meeting on February 27th, 1948, after receiving advice of their counsel, that under Chapter 480 of the General Laws, decided that it would be contrary to the law for them to award a con- tract to the lowest bidder with the omission of the audi-

orium, as voted by the Town, therefore voted to reject all bids and to advertise for new bids omitting the audi- torium.
On March 18th, 1948, the new bids were opened by the Committee and the contract awarded to the Park Construction Company, Boston, Mass.
On or about March 23rd excavation was started.
In August, application was made for such benefits as might be due the Town of Harwich under the School Building Act, as passed by the legislature on July 1st, 1948. To date nothing definite has been received other than the acknowledegment of the application.
The Endur Paint Company, Mr. Baird K. Eaton. Presi- dent, offered, as a gift, the entire chalkboard require- ments of the new school. The Building Committee, and the School Department, considered these chalkboards to be very satisfactory, and accepted the gift.
As of January 1st, 1949, the building is approximately two-thirds completed.

HELD IN EXCHANGE HALL, HARWICH CENTER FEBRUARY 2-3, 1948
Article 1. To choose on one ballot the following Town Officers and Committees: Town Clerk, Town Treasurer, Collector of Taxes, for one year; one Selectman, Over- seer of Public Welfare and Board of Health, for three years; one Assessor for three years; three Herring Com- mittee for one year; one School Committee for three years; three Constables for one year; one Trustee of Brooks Library for three years; one Park Commissioner for three years; Moderator for one year ; one Water Com- missioner for three years; Surveyor of Highways for one year; one Cemetery Commissioner for three years.
Article 2. To choose all other Town Officers and Com- mittees.

Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1948, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

To see if the Town will vote to instruct its Selectmen to control, regulate and prohibit the taking of eels and any or all kinds of shellfish and sea worms within the Town limits, as provided in Chapter 130, Section 52, of Chapter 130 of the General Laws and to make any reg- ulations in regard to such fisheries as may be expedient.

Said appropriation to be added to the appropriation of $3000.00 previously voted under Article 94 of the Warrant for the Annual Town Meet- ing held on Feb. 5, 1946.

Article 16. To see if the Town will vote to accept as a By-Law the building code or building restrictions as rec- ommended by the Building Committe appointed by the Board of Selectmen and act fully thereon.

Article 17. To see if the Town will vote to raise and appropriate a sufficient sum of money to employ an In- spector of Buildings for the year 1948 and act fully there- on.

Article 20. To see if the Town will vote to raise and appropriate the sum of twelve hundred dollars ($1200.00) to continue the planting of shade trees along the Town roads as deemed proper by the Committee established at the 1946 Annual Town Meeting and act fully thereon.

Article 21. To see if the Town will vote to authorize the Selectmen to sell at a sum not to exceed one thousand ($1,000) dollars, the Town owned property in North Har- wich, known as the North Harwich Grade School, to be used as a Portuguese Community Center and act fully thereon.

That title be given to the Harwich Men's Portuguese Club Inc., and the title remain in the Harwich Men's Portuguese Club Inc. as long as the building and land be used as a Portuguese Community Center.
Article 22. To see if the Town will vote to authorize the Selectmen to sell at public auction, the Town owned property in North Harwich, known as the North Harwich Grade School and act fully thereon.

Article 23. To see if the Town will vote to raise and appropriate the sum of six thousand dollars to be added to the sum of five thousand eight hundred fifty (5,850 .- 00), appropriated at last Town Meeting to build and equip a building to be used for the purpose of housing the road equipment, to be located on the property now owned by the Town on Sisson Road, and to act fully thereon.

Article 38. To see if the Town will vote to discontinue a town way (name unknown) in West Harwich leading from Depot Road (opposite Cemetery Road) easterly to School Street, said way being thirty-five feet wide and about three hundred fifty-five feet long and having been accepted in February, 1890 by the Town and recorded in the Town Clerk's Road Book on Page 128.

Article 39. To see if the Town will vote to discontinue a town way known as Factory Road leading from Depot Road (North Harwich) easterly to Chatham Road (Har- wich Centre), said road being thirty-three feet wide and having been accepted May 22nd, 1865, and recorded in the Town Clerk's Road Book on Page 69.

Article 40. To see if the Town will vote to authorize the Selectmen to purchase in behalf of the Town for a Town Bathing Beach, the land in the Village of South Harwich at the foot of Deep Hole Road and being lots N & M & L & J and K as shown on Land Court Plan 10688A and raise and appropriate a sufficient sum of money to be used by the Selectmen for this purpose.
Accepted and adopted - raised and appropriated $2,- 500.00
Article 41. To see if the Town will vote to authorize the Park Commissioners to purchase or take by eminent domain in behalf of the town, for park purposes the land in the Village of East Harwich, at the east end of long Pond, bounded and described as follows : on the north by Eldredge Pond, on the east by a road 333.22 feet. on the south by a Town way 147.00 feet, and on the west by Long Pond, being a part of the land owned by James E. Riley et ux, as shown on Land Court Plan 18389A and to raise and appropriate a sufficient sum of money to be used by the Park Commissioners for this purpose.

Article 42. To see if the Town will vote to authorize the Selectmen to purchase from A. E. Sebbens, two forty- eight foot lots of land at the foot of Pine Ave., Harwich- port, with title to high water mark and rights to low water mark for a Town Bathing Beach and parking lot and to raise and appropriate or take from available funds the sum of $7,000.00 to be used for this purpose.

Article 43. To see if the Town will vote either to trans- fer from surplus funds or to raise and appropriate the sum of $25,000.00 to be set aside to start a fund for the purpose of building a new elementary school at some future date, this fund to be added to at future Town Meetings until a sufficient sum is available to build a new school.
