HELD IN EXCHANGE HALL, HARWICH CENTER FEBRUARY 7-8, 1949


Article 1. To choose on one ballot the following Town Officers and Committees: Town Clerk, Town Treasurer, Collector of Taxes, for one year; One Select- man, Overseer of Public Welfare and Board of Health, for three years; One Assessor for three years; three Herring Committee for one year; one School Com- mittee for three years; one School Committe for one year; three Constables for one year; one Trustee of Brooks Library for three years; one Park Commission- er for three years; Moderator for one year; one Water Commissioner for three years; Surveyor of Highways for one year; one Cemetery Commisioner for three years. :


Article 2. To choose all other Town Officers and Committees.

Article 3. To see if the Town will vote to autho- rize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in antici- pation of the revenue of the financial year beginning January 1, 1949, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

Article 4. To hear the report of all Town Officers and Committees for the year 1948.

Article 7. To see if the Town will vote to instruct its Selectmen to control, regulate and prohibit the taking of eels and any or all kinds of shellfish and sea worms within the Town limits, as provided in Chapter 130, Section 52 of Chapter 130 of the General Laws and to make any regulations in regard to such fisheries as may be expedient.

Article 8. To see if the Town will vote to transfer from surplus revenue or available funds a sum not in excess of $20,000.00 for the purpose of reducing the 1949 tax rate and act fully thereon.

Article 9. To see if the Town will vote to raise and appropriate a sufficient sum of money for unpaid bills of 1948, as provided for in Chapter 179 of the Acts of 1941.


Voted that the amount of $9,005.10 be raised and appropriated.


Article 10. To see if the Town will vote to raise and appropriate or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 90 Highway Maintenance, or take any action in relation thereon.


The finance committee's report was accepted and adopted which was:


The Finance Committee recommends that the sum of $1,000.00 be transferred from unappropriated avail- able funds in the Treasury to meet the Town's share of the cost of Chapter 90, Highway Maintenance, and that in addition the sum of $2,000.00 be transferred from unappropriated available funds in the Treasury to meet the State's and County's share of the cost of the work, the reimbursement from the State and County to be restored upon their receipt to unappropriated available funds in the Treasury.

Article 11. To see if the Town will vote to raise and appropriate a sum of money to be used with what- ever State and County funds are available under Chap- ter 90 Road Construction and act fully thereon.


The finance committee's report was accepted and adopted by the following motion :


The Finance Committee recommends that the sum of $5,000.00 be transferred from unappropriated avail- able funds in the Treasury to meet the Town's share of the cost of Chapter 90, Road Construction, and that in addition the sum of $15,000.00 be transferred from unappropriated available funds in the Treasury to meet the State's and County's share of the cost of the work, the reimbursement from the State and County to be restored upon receipt to unappropriated available funds in the Treasury.


Article 12. To see if the Town will vote to raise and appropriate the sum of $500.00 for recreation and entertainment in the form of baseball, by local players.


Accepted and adopted and $500.00 raised and appropriated.


Article 13. To see what action the Town will take in regards to the Herring Fisheries for the year 1949 and act fully thereon.

Article 14. To see if the Town will vote to in- crease the salary of the Supervisor of Highways to the sum of twenty-five hundred dollars and act fully thereon.

Article 15. To see if the Town will vote to raise and appropriate the sum of one thousand dollars ($1,000.00) for the purpose of rebuilding sidewalks, and to act fully thereon.

Article 16. To see if the Town will vote to raise and appropriate the sum of fifty-seven hundred dollars ($5,700.00) for the purpose of widening and re-surfac- ing the so-called Belmont Road leading from Lower County Road to Route 28, and to act fully thereon.

Article 17. To see if the Town will vote to raise and appropriate the sum of eleven thousand dollars ($11,000.00) to purchase a grader for use of the High- way Department, and to act fully thereon.

Article 18. To see if the Town will vote to raise and appropriate the sum of sixteen hundred dollars ($1,600.00) to purchase and install a suitable heating system in the New Highway Department garage, and to act fully thereon.

Article 19. To see if the Town will vote to raise and appropriate the sum of twenty-seven hundred dollars ($2,700.00) for the purpose of purchasing a new truck for the Highway Department and to autho- rize the Surveyor of Highways to sell or trade the truck now owned by the Town and the sum received · from same to be used towards the purchase of a new truck, and to act fully thereon.

Article 20. To see if the Town will vote to raise and appropriate the sum of twenty-seven hundred dollars ($2,700.00) to purchase a tractor equipped with sweeper and bucket loader for use of the Highway Department, and to act fully thereon.


It was voted to accept this article and to raise and appropriate $2,700.00.


Article 21. To see if the Town will vote to raise and appropriate the sum of five hundred dollars ($500 .- 00) for the purpose of purchasing an air compressor for the use of the Highway Department, and to act fully thereon.

Article 22. To see if the Town will vote to raise and appropriate the sum of three thousand dollars ($3,000.00) to widen and re-surface the Town Way starting from Brewster Line on Depot Street in North Harwich, and continue as far as money will allow.

Article 23. To see if the Town will vote to raise and appropriate the sum of two thousand dollars ($2,- 000.00) for re-surfacing Kendrick Road in East Har- wich.

Article 24. To see if the Town will vote to raise and appropriate the sum of fifteen thousand dollars ($15,000.00) for the purpose of relocation, alteration, laying out of Town ways, engineering and surveying of Town property, and to act fully thereon.


It was voted to accept this article and to raise and appropriate $5,000.00.


Article 25. To see if the Town will vote to change the name of School Street in West Harwich, to Bells Neck Road, and to act fully thereon.


Accepted and adopted and name changed to Bell's Neck Road.


Article 26. To see if the Town will vote to raise and appropriate the sum of ten thousand dollars ($10,- 000.00) to be used for the dredging and improvement of the channel at the mouth of Herring River in West Harwich, this sum to be used in conjunction with such sums as are appropriated by the Town of Dennis, and the Commonwealth and or in conjunction with sums allocated by the Commonwealth Division of Water- ways.

Article 27. To see if the Town will vote to raise and appropriate the sum of ten thousand dollars ($10,000.00) to be used with whatever State funds are available to dredge Allen's Harbor and act fully thereon.

Article 28. To see if the Town will vote to instruct the Moderator to appoint a Committee of five to con- sider a use for Brooks Academy building when it is no longer used as a school; and to instruct the Committee to have in mind Town Officers and Recreation or Meeting Rooms for Girl Scouts, Boy Scouts and other charitable organizations and to further instruct said

Committee to report at the next annual Town Meeting and to act fully thereon.


Accepted and adopted and the following committee appointed, Emulous E. Hall, Charlotte P. Sims, Earle F. Bassett, Victor S. Ryder and C. Oscar Carlson.


Article 29. To see if the Town will vote to erect and maintain lights to facilitate parking in the parking lot at Harwichport, known as School House Lot, and to raise and appropriate a sufficient sum of money for same, and to act fully thereon.


Accepted and adopted. Raised and appropriated $90.00.


Article 30. To see if the Town will vote to accept the layout for a common landing in Harwichport at the foot of Wah-Wah-Taysee Road, as reported and recom- mended by the Selectmen under date of January 21, 1949, and to authorize the Selectmen to take in fee by purchase or eminent domain, in behalf of the Town, the lands or interests in the lands within the lines of said common landing place, and for this purpose to raise and appropriate a sum of money.


Indefinitely postponed. Technical error discovered.


Article 31. To see if the Town will accept the laying out of a Town Way at Harwichport, known as Harbor View Road, leading from Hiawatha Road east- erly to Wyndemere Bluffs Road as reported and recom- mended by the Selectmen under date of January 21, 1949 and to authorize and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the lands or interests in the lands within said layout for a Town Way and to raise and appropriate a sufficient sum of money for this purpose.


This article was accepted and adopted as printed and read, the sum of $30.00 was raised and appropri- ated.


Article 32. To see if the Town will accept the laying out of a Town Way at Harwichport, known as Cottage Avenue, leading from Northern Avenue, south- erly to land of Robert W. Chase, as reported and recommended by the Selectmen under date of January 21, 1949 and to authorize and instruct the Selectmen

to take by purchase or eminent domain, in behalf of the Town, the lands or interests in the lands within said layout for a Town Way and to raise and appro- priate a sufficient sum of money for this purpose.

Article 33. To see if the Town will accept the lay- ing out of a Town Way at Harwichport, known as Lincoln Avenue, leading from Northern Avenue south- erly to land of Robert W. Article 39. To see if the Town will accept the re- locating and altering of a Town Way at Harwichport, known as Wah-Wah-Taysee Road, leading from Lower County Road, southerly to a Common Landing, as re- ported by and recommended by the Selectmen under date of January 21, 1949 and to authorize and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the lands or interests in the lands within said Relocation and alteration for a Town

Way, and to raise and appropriate a sufficient sum of money for this purpose.


Accepted and adopted as read. The sum of $12.00 raised and appropriated.


Article 40. Section 1. To vote to accept an Act to improve the method of Municipal Planning, as con- tained in Chapter 340, Acts of 1947 (Chapter 41 G. L. Sections 81A to 81Y inclusive).


Section 2. These regulations shall become· effective immediately upon their acceptance at the Annual Town Meeting.


Section 3. At the current Town Meeting a Board of FIVE members shall be appointed under the pro- visions of Chapter 340, Section 4-81A Acts of 1947 to be known as the Harwich Planning Board.


Section 4. All necessary legal advice for the as- sistance of such a board shall be authorized and pro- cured at the expense of the Town.


Section 5. This Board shall act without compensa- tion.


Section 6. The sum of $300.00 (three hundred dollars) shall be appropriated for the miscellaneous expenses for the organization of the Harwich Plan- ning Board.


This Article was accepted and adopted and the sum of $300.00 was raised and appropriated.


Article 41. Section 1. A permit issued by the Harwich Planning Board shall be required for the erec- tion of any new building. The Board may require such additional information as will assist in granting said permit. Fee for permit shall not exceed $1.00.


Section 2. Any person violating this permit shall be fined the sum of $20.00 for each day of violation.


Section 3. BOARD OF APPEAL. A Board of seven members is hereby created to be known as the Board of Appeal. At the current Town Meeting there shall be elected or appointed ONE member from each postal section of the Town, for the term of one year. At the next Annual Town Meeting there shall be elect- ed or appointed one member from each postal section of the town; one member to serve for one year; one

member to serve for two years; one member to serve for three years; two members to serve for four years ; two members to serve for five years. Thereafter each member shall serve for five years. This Board shall serve without compensation and shall hold meetings whenever deemed necessary. Any person whether or not a party to the proceedings, aggrieved by the de- cision of the Harwich Planning Board, may appeal to the Board of Appeal. The Board shall give a public hearing thereon at which all parties in interest shall have an opportunity to be heard in person or agent. At least fifteen days notice of the time and place of such hearing shall be published in a newspaper of general circulation in the town, and also by notifying by mail of such a hearing, all real estate owners who might be affected. No permit shall be granted with- out considering the effect upon the neighborhood and the town, and if its issuance indicates substantial damage, the permit shall be refused.

Article 42. To see if the Town will vote to raise and appropriate the sum of five thousand dollars ($5,000) for the purpose of remodeling and improving the grounds at Brooks Park in so far as said appropriation will go. This appropriation to be expended under the direction of the Selectmen.


Accepted and adopted with the change that $2,000.00 be raised and appropriated.


Article 43. To see if the Town will vote to raise and appropriate the sum of eighty-five hundred dollars ($8500) for repairs and addition to present fire sta- tion, and to act fully thereon.


Accepted and adopted with the change that $3,000.00 be raised and appropriated.


Article 44. To see if the Town will vote to raise and appropriate the sum of twenty-six hundred dollars ($2600) for needed repairs on Engine No. 1 (Maxim 1928), and Engine No. 2 (Ford 1935) and to act fully thereon.


Accepted and adopted. $2600.00 raised and appro- priated.

Article 45. To see if the Town will vote to raise the salary of the combined position of Fire Chief and Forest Warden from two thousand dollars ($2000) per year to twenty-seven hundred dollars ($2700) per year, and to act fully thereon.


The following motion was accepted and adopted and under this Article $700.00 was raised and appropri- ated. That the salaries of the combined positions of the Fire Chief and Forest Warden be raised from $2000.00 a year to $2700.00, and to raise and appro- priate the sum of $700.00 for that purpose. (The re- maining $2000.00 to be taken care of in the expense of the Fire Department.


Article 46. To see if the Town will vote to raise and appropriate the sum of one dollar ($1.00) to pur- chase from the Harwich Fire Association one Emer- gency Rescue Truck, and to act fully thereon.


It was moved to accept the Article and that $1.00 be raised and appropriated to carry it into effect. Pay- ment to be made on delivery.


Article 47. To see if the Town will vote to raise and appropriate the sum of twenty-three hundred dol- lars ($2300) for the employing of a Town Nurse, and to act fully thereon.


It was moved and seconded that $2300.00 be raised and appropriated to employ a Town nurse.


Article 48. To see if the Town will vote to raise and appropriate the sum of $225.00 for band concerts to be held in Brooks Park in 1949.


Indefinitely postponed.


Article 49. To see if the Town will vote to raise and appropriate a sum of money for Band Concerts to be given by the Chatham Band in Brooks Park in the summer of 1949.


Accepted and adopted. Raised and appropriated $500.00.


Article 50. To see if the Town will appropriate a sum of money sufficient to extend the Water Mains along Smith Street, from North Road to Depot Street in West Harwich.


Indefinitely postponed.

Article 51. To see if the Town will vote to raise and appropriate the sum of twelve thousand dollars ($12,000) to extend the water mains from Lower County Road on Strandway, Pine Lane, Mill Point Road and Riverway in West Harwich, and to act fully thereon.


Indefinitely postponed.


Article 52. To see if the Town will vote to raise and appropriate the sum of $4,000.00 to be used by the Board of Water Commissioners for extending water mains where requested, providing that the estimated income from such extensions is at least 6% of the cost of installing.


The Finance's Committee recommendation was ac- cepted and adopted and $4,000.00 was raised and ap- propriated.
