Article 12 taken up. (Extension of water mains.)


Voted (unanimously), That the sum of $15,000 be appro- priated for the extension of water mains, and for this purpose $5,000 be raised by general tax, and for the balance, $10,000, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $10,000, and to issue bonds or notes of the Town therefor, said notes or bonds to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than five years from the date of issue of the first bond or note, or at such earlier date as the Treasurer and Selectmen may determine.

Voted, That the sum of $16,325 be appropriated for street lighting for the year 1922.


Article 17 taken up. (Engineering work.)


Voted, That the sum of $4,500 be appropriated for the engineering work of the Town, said amount to include $1,800 for Engineer's salary.

Pursuant to the vote of adjournment the Town Meeting members met in the Town Hall on Tuesday evening, April 11, 1922, and were called to order at eight o'clock by the Moderator, John A. Colbert. Two hundred and five members attended the meeting.


On motion of Herbert M. Dutcher, Chairman of the Finance Committee, it was voted, That Articles 18 to 39 (inclusive) be laid on the table, and that Article 40 of the warrant be taken up. .


Article 40 taken up. (Appropriations.)


Voted, That the sum of $12,850 be appropriated for the Sinking Fund. That for this purpose $3,000 be taken from the income of the Water Department, and the balance, $9.850, be raised by General Tax.

ARLINGTON TOWN REPORT


Voted, That the sum of $49,000 be appropriated for pay- ment of interest during the year 1922. That for this purpose the sum of $9,115 be taken from the receipts of the Water Department, the sum of $1,792.99 be taken from available balances and receipts now in the treasury, and the balance, $38,092.01, be raised by General Tax.


Voted, That the sum of $84,000 be appropriated for pay- ment of bonds and notes maturing in 1922. That for this pur- pose $6.35 be taken from funds now in the treasury available for Town Debt, the sum of $14,000 from the receipts of the Water Department, the sum of $20,000 be taken from available balances and receipts now in the treasury, and the balance $49,993.65 be raised by General Tax.


Voted, That the following sums be appropriated for the purposes indicated. The salaries of the elective officers to begin with the March election and those of the appointive officers to begin in April. The salaries of the Town Clerk and the Collector of Taxes shall be on condition that they shall respectively, upon receipt, pay into the Town treasury for the use of the Town all official fees received by them.

Voted, That the sum of $53,885 be appropriated from the income of the Water Department during the year 1922 for maintenance and extensions, including Metropolitan Water Assessments; $14,000 for notes due in 1922; $9,115 for interest on water debt and $3,000 for the Sinking Fund.


Voted, That the several amounts appropriated at this meeting indicated by the various votes and not otherwise pro- vided for be raised by general tax the present year. And that all notes issued under the authority of any vote passed at this meeting shall be issued in accordance with the provisions of Sections 23 to 26, both inclusive, of Chapter 44 of the General Laws and Amendments thereof and Additions thereto.

Article 18 taken up. (Gypsy and Brown Tail Moth Appro- priation.)


Voted, That the sum of $6,300 be appropriated for the year 1922 to be expended under the direction of the Selectmen in suppressing the Gypsy and Brown Tail Moths in the Town of Arlington, in accordance with the provisions of Chapter 132 of the General Laws and Amendments thereof; said amount to include the salary of Superintendent.


Article 19 taken up. (Planting of Trees.)


Voted, That the sum of $3,000 be appropriated for the planting of trees, removal of dead and dangerous trees, and for the trimming and general care of existing trees, during the year 1922, the same to be expended under the direction of the Tree Warden.


Article 20 taken up. (Appropriation for Public Parks.)


Voted, That the sum of $600 be appropriated for the general

maintenance and improvement of the public parks of the Town during the year 1922, and that an additional sum of $800 be appropriated as a special fund for the care and treatment of the trees in Menotomy Rocks Park on account of damage caused by the sleet storm of November, 1921; said sums to be expended under the direction of the Park Commission.


Article 21 taken up. (Pensions.)


Voted, That the sum of $3,898.36 be appropriated for the payment of pensions during the year 1922.


Article 22 taken up. (Selectmen Agents of the Town.)


Voted, That the Selectmen be appointed agents of the Town to institute, prosecute, defend and settle suits, legal pro- ceedings and claims, by, against or involving the interests of the Town, with power to employ counsel therein and, when necessary, in all other legal matters and business appertaining to town affairs during the year commencing March 1, 1922.


Article 23 taken up. (Authority of Treasurer to borrow money.)


Voted (Unanimously), That the Town Treasurer, with the approval of the Board of Selectmen, be and hereby is author- ized to borrow money, from time to time, in anticipation of the revenue of the financial year beginning January 1, 1922, and to issue a note or notes therefor, payable within one year. Any debt or debts incurred under this vote to be paid from the revenue of said financial year.


Article 24 taken up. (Authority of the Collector of Taxes.)


Voted, That the Collector of Taxes be authorized to use all means of collecting taxes for the year 1922 which a Town Treasurer may use when appointed a Collector of Taxes.


Article 25 taken up. (Appointment of Finance Committee.)


Voted, That the Moderator of this meeting appoint a Finance Committee of twenty-one members, three from each of the seven precincts of the Town, to serve until the end of the Annual Town Meeting of 1923, said appointment to be made from names submitted by the Town Meeting Members as follows: within thirty days from passage of this vote the Town Meeting Members from each of the seven precincts of the Town shall nominate three members, two of whom are to be nominated from the present members of the Finance Committee, provided

they will serve, and the other or others shall be newly nominated. No employee of the Town, or person holding an elective town office shall be eligible to serve on this Committee. To this Finance Committee are hereby referred all articles in any town warrant issued during its term of office. Said Committee shall, after due consideration of the subject matter of said articles, report thereon, in print or otherwise, to the Town Meeting, with such recommendations as it shall deem best. Said Com- mittee shall choose its own officers and have power to fill vacancies. The Moderator appointed the following citizens from the various precincts to serve on the Finance Committee : Precinct 1, John S. Kelley, Frederick W. Hill, Frederick O. White; Precinct 2, Henry W. True, Arthur P. Wyman, Jesse C. Fletcher; Precinct 3, Edward A. Geary, Hollis M. Gott, M. Ernest Moore; Precinct 4, Anthony] J. Connelly, Arthur B. Peirce, H. Walter Gleason; Precinct 5, Arthur D. Dickson, William P. Dale, Egbert E. Stackpole; Precinct 6, Walter A. Robinson, Henry E. Merrill, Norman E. Jenkinson; Precinct 7, Alfred L. DeNoyer, Andrew Bain, William S. Warren. The Finance Committee organized as follows, Frederick W. Hill, Chairman; Walter A. Robinson, Secretary.


Article 26 taken up. (Repairs of highways and bridges.)


Voted, That the town ways, highways and bridges be repaired during the ensuing year under the direction of the Board of Public Works.


Article 27 taken up. (Fire protection in school buildings.)


Voted, That the sum of $1,050 be appropriated for the installation of additional means of fire protection in the public school buildings of the town, said appropriation to be expended under the direction of the School Committee.


Article 28 was, on motion of Mr. Dutcher, laid on the table. Article 29 taken up. (Taking of land for park purposes.)


This article required a two-thirds vote and on a rising vote the Moderator declared that the motion of the Finance Com- mittee was lost, ninety-one voting in the affirmative and seventy- two in the negative, one hundred and nine being necessary for a two-thirds vote. Notice was served by Charles B. Devereaux and Warren N. Bixby that they proposed to move a recon- sideration of the vote under Article 29.

Voted, (by a two-thirds vote, 120 "Yes," 60 "No") That the Selectmen be and hereby are authorized and empow- ered on behalf of the Town, to purchase, or take in fee by eminent domain, for the purpose of erecting thereon a build- ing to be used for an engine house, the land bounded southerly by Massachusetts Avenue, westerly by land of Grace L. Whitte- more and another, northerly by Broadway, easterly and north- erly by land of the Town, and easterly by Franklin Street, and more particularly described in Article 30 of the warrant, includ- ing the trees thereon and the structures affixed thereto; that the sum of $23,598.20 be and hereby is appropriated therefor; and that for this purpose $3,598.20 be raised by general tax, and for the balance, $20,000, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $20,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws, and all Acts in alteration or amendment thereof, so that the whole loan shall be paid in not more than ten years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine.

Whittemore et al, and more par- ticularly described in Article 29 of the warrant, for the purpose of a public park, be and hereby is accepted and allowed; that said Board be and hereby is authorized and empowered to take in fee by eminent domain or by purchase or otherwise said land, including the trees thereon and the structures affixed thereto, for the said purpose; that the sum of $6,993, being an amount sufficient for the estimated expense thereof, be and hereby is appropriated therefor; and for this purpose $993 be raised by general tax, and for the balance, $6,000, the Treasurer with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $6,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance . with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in alteration or amendment thereof, so that the whole loan shall be paid in not more than six years from the date of issue of first bond or note, or at such earlier date as the Treasurer and Selectmen may determine.

Article 31 taken up. (Authority of Selectmen to sell land.) Voted unanimously, That the Board of Selectmen be and hereby are authorized and empowered in the name and on behalf of the Town, to sell, at public auction or private sale, the parcel of land located on Aberdeen Road Extension, in said Town, and more particularly described in Article 31 of the warrant; to convey said parcel; and to execute, acknowledge and deliver a proper deed or deeds for that purpose, all for the minimum amount of one dollar for such conveyance and upon such other terms as the Selectmen shall consider proper.

Article 32 taken up. (Acceptance of Daniels Street.)


Voted unanimously, That the laying out of a town way from Massachusetts Avenue to Appleton Street substantially in the location of the private way known as Daniels Street, as more particularly described in Article 32 of the warrant, under the provisions of law authorizing the assessment of betterments, as made and reported by the Joint Board of Selectmen and Board of Public Works, be accepted, said way established and said Joint Board authorized to take land for the purpose of said way; that the sum of $6,361.60 be and hereby is appropriated for the original construction of said way, and that for this purpose $1,361.60 be raised by general tax, and for the balance, $5,000, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $5,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in alteration or amendment thereof, so that the whole loan shall be paid in not more than five years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may ,determine.


Article 33 taken up. (Acceptance of Kimball Road.)


Voted unanimously, That the laying out of a town way from Mystic Street to Walnut Avenue substantially in the location of the private way known as Kimball Road, as more particu- larly described in Article 33 of the warrant, under the provisions of law authorizing the assessment of betterments, as made and reported by the Joint Board of Selectmen and Board of Public Works, be accepted, said way established and said Joint Board authorized to take land for the purpose of said way; that the sum of $5,315 be and hereby is appropriated for the original construction of said way, and that for this purpose $315 be raised by general tax, and for the balance, $5,000, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $5,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in alteration or amendment thereof, so that the whole loan shall be paid in not more than five years from

Voted unanimously, That the laying out of a town way from Mt. Vernon Street to Highland Avenue substantially in the location of the private way known as Gloucester Street, as more particularly described in Article 34 of the warrant, under the provisions of law authorizing the assessment of betterments, as made and reported by the Joint Board of Selectmen and Board of Public Works, be accepted, said way established and said Joint Board authorized to take land for the purpose of said way; that the sum of $7,643.50 be and hereby is appropriated for the original construction of said way, and that for this purpose $2,643.50 be raised by general tax, and for the balance, $5,000, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of $5,000 and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in alteration or amendment thereof, so that the whole loan shall be paid in not more than five years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine.


Voted, That when this meeting adjourns it adjourn to meet on Tuesday evening, April 25, 1922 at eight o'clock.

Article 35 taken up. (Middlesex County, Bureau of Agriculture.)


Voted, That the Town do not appropriate the sum of $300, or any other amount, and do not choose nor elect a director under Article 35 of the warrant.


Article 36 taken up. (Park Commissioners to care for playgrounds.)


Voted, That the Park Commissioners shall have charge of the development and maintenance of such properties as they now control, or such as may be turned over to them by vote of the Town Meetings, from time to time, together with the expenditure of such appropriations as may be voted for this purpose, by said Town Meeting.


Article 37 taken up. (Reservations for Playgrounds.)


Voted, That the Town vote to instruct the Board of Park Commissioners to submit not later than the next annual meeting, a program for the taking of reservations for play- grounds, also plans and estimates of the cost of developing any land now owned by the Town; and that for this purpose an appropriation of $200 be made.

Voted, That the subject matter of Article 38 be referred to the Joint Board of Selectmen and Board of Public Works.


Article 39 taken up. (Number of Selectmen.)


Voted, That the Town do not increase the number of Selectmen from the present number of three, to five or seven.

Voted (on motion of Lindsey K. Foster), That the report and recommendations of the Committee appointed to revise the By-Laws of the Town be received and acted upon.

Voted, That the By-Laws as presented by the Committee and amended by this meeting be adopted as the By-Laws of the Town, subject to the approval of the same by the Attorney General of the Commonwealth.

Voted, That the Committee be given further time on that part of the By-Laws of the Town relating to buildings.


Voted, That that part of the work assigned to the Com- mittee relating to the limitation of particular classes of buildings to specify districts or zones be referred back to the Committee and the Planning Board.


Voted, That the sum of $300 be appropriated for the print- ing of the Town's By-Laws, the same to be expended under the direction of the Committee mentioned in Article 28 of this warrant.

BY-LAWS OF THE TOWN OF ARLINGTON


ARTICLE 1


TOWN MEETINGS


Section 1. The Annual Town Meeting shall be on the first Monday of March in each year and all Town Boards and officers shall report to that meeting.


Sec. 2. The Selectmen shall, before calling a Town Meeting, post a notice of their intention so to do, in each precinct in the Town, at least five days before closing the warrant calling the meeting. A copy of the warrant for a meeting shall be posted in each precinct at least seven days before the day of the meeting and a copy left at every dwelling house in the Town previous to the day of meeting. Notice of the time of the meeting or of the date of the adjourned meeting shall be published in at least one local paper.


Sec. 3. All business of the Annual Meeting, except the election of officers and matters to be determined by ballot, shall be considered at an adjournment thereof, the date of said adjournment to be determined by the selectmen and embodied in the warrant calling the meeting.


Sec. 4. No action shall be taken by any Town Meeting on the report of any Committee, previously chosen, unless the same shall be specified in the warrant calling said meeting.

ARTICLE 2


RULES FOR GOVERNMENT OF TOWN MEETINGS


Section 1. All questions or motions submitted for the consideration of the Town Meeting shall be reduced to writing if required by the presiding officer.


Sec. 2. No person shall speak more than twice upon any question, except to correct an error, or to make an explanation, without first obtaining leave of the meeting, nor until others, who have not spoken upon the question, shall speak if they so desire.


Sec. 3. No person shall speak for more than five minutes for the second time on any subject, if there are other citizens who desire to speak on the subject but have not, without first obtaining leave of the meeting.


Sec. 4. Every person desiring to speak shall arise, address the chair, and on obtaining recognition, shall stand, while speaking, unless the Moderator otherwise directs.


Sec. 5. All votes, unless otherwise provided by law, shall be taken in the first instance by a "Yes" and "No" voice vote. If the Moderator is in doubt as to the vote, or if five voters immediately question the vote, the Moderator shall call either for a standing vote or a roll call.
