Article 4. On a motion by Mr. Frederic Melzar it was voted that the Town Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to borrow ·money from time to time in anti- cipation of the revenue of the financial year beginning January 1, 1950 and to issue a note or notes therefor, payable within one year, and co renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 5. On a motion by Mr. Hobart Spring it was voted that in the language of the article the Town raise and appropriate the sum of One Thousand Dollars ($1,000.00) to pay for insurance indem- nity for the protection of the officers and employees of the Highway, Cemetery, Fire and Police Departments of the Town against loss by reason of their liability to pay others for bodily injuries including death and property damage, at any time resulting therefrom, caused by the operation, within the scope of their official duties or employ- ment of motor vehicles owned by the Town.


Article 6. On a motion by Mr. William S. Cavanaugh it was voted that the Town raise and appropriate the sum of Five Hundred Dollars ($500.00) for the observance of Memorial Day, and that the Moderator appoint a Committee who shall have charge of such observance.


Article 7. On a motion by Mr. Frederic P. Melzar it was voted that the Town authorize the Board of Selectmen, to sell at Public Auction in the evening, properties taken by the Town under Tax Title foreclosure procedure, and be authorized to execute all documents necessary to carry out the purpose of this vote, provided however, that before any sales are made, due notice of the time and place shall be given by advertising in the local paper and Lowell Sun at least four- teen (14) days before the sale, and deeds executed hereunder must be recorded within twenty (20) days of their execution. But, it is further provided that the Board of Selectmen may at any time sell and convey (and without advertising the same) any such foreclosed property to any former owner or other party who has had a legal interest in the same upon receipt of a sum equal in amount to all unpaid taxes, interest

and expenses which have accrued upon such property or properties to the date of such sale.


Article 8. On a motion by Mr. William S. Cavanaugh it was voted that the sum of One Thousand Two Hundred Forty-nine Dollars and Forty-two Cents ($1,249.42) be raised and appropriated to pay unpaid departmental bills of previous years.


Article 9. On a motion by Mr. Kenneth M. Lyons it was voted that the Town raise and appropriate the sum of One Hundred Dollars ($100.00) the money to be expended under the direction of the 4-H Town Committee, serving in co-operation with the Middlesex County Extension Service, under the provisions of Sections 40 to 45, Chapter 129, General Laws of Massachusetts.


Article 10. On a motion by Mr. Frederic Melzar it was voted that the Town raise and appropriate the sum of Five Hundred Dollars ($500.00) for the purpose of renewing under the authority of Section 9 of Chapter 40 of the General Laws as amended the lease of the American Legion Clubhouse in Wilmington for the purpose of pro- viding suitable headquarters for the Wilmington Post of the American Legion.


Article 11. On a motion by Mr. Kenneth M. Lyons it was voted that the Town raise and appropriate the sum of Five Hundred Dollars ($500.00) for the purpose of leasing under authority of Section 9 of Chapter 40 of the General Laws as amended the Veterans of Foreign Wars Clubhouse on Main Street in Wilmington for the purpose of pro- viding suitable headquarters for the Wilmington Post of the Veterans of Foreign Wars of the United States.


Article 12. On a motion by Mr. Kenneth Lyons it was voted to raise and appropriate the sum of One Thousand Five Hundred Dollars ($1,500.00) for the purpose of surveying and laying out the following streets:

Article 16. Motion by Mr. Simon Cutter that the Town vote to raise and appropriate money to reimburse the Chief of Police, Paul J. Lynch, for hospital, medical and nursing bills, incurred in the sum of Two Thousand One Hundred Sixty-one Dollars and Three Cents ($2161.03), as a result of an accident which occurred on September 9, 1949, while in the course of duty; with the understanding that the Board of Selectmen, may, upon the recommendation of payment of said sum, obtain from said Chief of Police, an Agreement to reim- burse the Town for said amount, when and if he recovers to the full value of his claim against the party who caused his damage, and if he does not receive full value of his claim, then to reimburse the Town in proportion thereto: that the proportionate part to be reimbursed to the Town shall be determined by the Board of Selectmen and the Chief of Police, or in case they cannot agree by arbitration, by a committee of three, one to be appointed by the Board of Selectmen, one by the Chief of Police and by last two named.


Mr. Barrows. Point of order. According to Section 100 of Chapter 141, General Laws, this cannot be done.


Moderator ruled that the money may be appropriated at this time, subject to the approval of the Selectmen and the amount subject to the approval of the Selectmen.


Voted in the affirmative. Motion declared carried by the Moderator.


Article 17. On a motion by Mr. Willie B. McIntosh it was voted to raise and appropriate the sum of One Thousand Five Hundred Dollars ($1500.00) to rebuild Cross Street as laid out by the County Commis- sioners in the year 1939.

Article 18. Motion by Mr. John H. Tautges that the Town vote to accept Shady Lane Drive from Middlesex Avenue to Sprucewood Road and Oakdale Road for its entire length as laid out by the Board of Selectmen and appropriate the sum of One Thousand Dollars ($1000.00) to put said street into passable condition.


Mr. Barrows. Point of order. The streets are not accepted.


Mr. Buzzell. Unless the streets have been laid out by the Board of Survey and plans filed with the Town Clerk, cannot be acted on. Moderator ruled motion out of order.

Article 20. Report of the Water Main Extension Advisory Com- mittee was read by Mr. Kenneth M. Lyons. On a motion by Mr. Lyons it was voted that the report be accepted as read and that the Town raise and appropriate the sum of Four Thousand Four Hundred and Forty Dollars ($4440.00) for the purpose of extending a public water main in Ayotte Street and Crest Avenue for a distance of 888 feet, and One Thousand Six Hundred Dollars ($1600.00) for the purpose of restoring said street to the same or equivalent condition prior to this installation; the sum of Five Thousand Two Hundred and Fifty Dollars ($5250.00) for the purpose of extending a public water main in Beech Street for a distance of 1,050 feet, and One Thousand Six Hundred and Thirty-five Dollars ($1635.00) for the purpose of restoring said street to the same or equivalent condition prior to this installation; the sum of Seven Thousand Five Hundred Dollars ($7500.00) for the purpose of extending a public water main in Ballardvale Street for a distance of 1500 feet, and One Thousand Seven Hundred Dollars ($1700.00) for the purpose of restoring said street to the same or equivalent condition prior to this installation; the sum of One Thou- sand Dollars ($1000.00) for the purpose of extending a public water main in Nassau Avenue for a distance of 200 feet, and Five Hundred Dollars ($500.00) for the purpose of restoring said street to the same or equivalent condition prior to this installation; to appropriate the balance of Two Thousand Twenty-six Dollars and Thirty Cents ($2026.30) remaining from the 1946 Water Main Extensions, to ap- propriate an additional sum of Two Thousand Nine Hundred and Seventy-four Dollars ($2974.00) to complete the water main installa- tion on Glen Road and One Thousand Eight Hundred Dollars ($1800.00) to restore said street to the same or equivalent condition prior to this installation, all requiring a total expenditure to be raised and appro- priated of Twenty-eight Thousand, Three Hundred Ninety-nine Dollars ($28,399.00).

Article 21. On a motion by Mr. Joseph J. Barton, Chief of the Fire Department, it was voted that the Town raise and appropriate the sum of Five Hundred Fifty Dollars ($550.00) for the purchase of a resus- citator.


Article 22. Motion by Mr. Joseph J. Barton, Chief of the Fire Department, that the Town vote to raise and appropriate the sum of Four Thousand Three Hundred and Fifty Dollars ($4350.00) for a new fire alarm system. Motion lost.


Article 23. On motion by Mr. Simon Cutter it was voted that there is a need for a housing authority in the Town of Wilmington, and to provide for the organization of such authority in accordance with Section 26K of the Housing Authority Law, Chapter 121 of the General Laws of Massachusetts.


Article 24. On a motion by Mr. Irving Appleby it was voted that the Town establish a special committee consisting of five members, to make a thorough study of the refuse disposal problem of the Town. with special reference to the present Town Dump, and to report their findings and any recommendations on or before the second Monday in March, 1951. Committee to be appointed by the Moderator.


Article 25. Ruled out of order by the Moderator. Can only be done by amendment to the By-Laws.


Article 26. On a motion by Mr. William S. Cavanaugh it was voted to raise and appropriate the sum of Four Thousand Dollars ($4000.00) to purchase one truck for the Highway Department and authorize the sale or turnin of one of the highway trucks as credit toward such purchase. Finance Committee approved.


Article 27. On a motion by Mr. William S. Cavanaugh it was voted that the Moderator appoint a committee of three to make a general study for the purpose of establishing a suitable memorial to the veterans of all wars, and report later.


On a motion by Mr. Herbert C. Barrows it was voted to adjourn. 12:15 A. M.

In accordance with the foregoing Warrant, the meeting was called to order at 3:45 P.M., by the presiding officer, Kenneth M. Lyons, Chairman of the Board of Selectmen. To the Constable of the Town of Wilmington: Harry J. Ainsworth


Greetings :- In the name of the Commonwealth of Massachusetts and in the manner prescribed in the By-Laws of said Town. you are hereby directed to notify and warn the inhabitants of the Town qua- lified by law in vote in Town affairs to meet and assemble at Villanova Hall on Monday. the sixteenth Day of October next at 8:00 P. M .. to consider and act on the following ARTICLES-


Article 1. To hear the reports of Committees and act thereon.


Article 2. To see if the Town will vote to transfer the sum of Five Thousand Dollars ($5.000) from the Old Age Assistance Aid Ac- count to the Aid to Dependent Children Account. or do anything in re- lation thereto. Submitted by the Board of Public Welfare.


Article 3. To see if the Town will vote to raise by transfer from any available funds, and appropriate. Three Thousand Dollars ($3.000) to the Veteran's Benefits Account. or do anything in relation thereto. Submitted by the Board of Selectmen.

Article 4. To see if the Town will vote to raise by transfer from any available funds, and appropriate, Four Thousand Dollars ($4,000) to the Water Department Salaries and Wages Account and Five Thou- sand Dollars ($5,000) to the Water Department Expense Account, or do anything in relation thereto. Submitted by the Water Commis- sioners.


Article 5. To see if the Town will vote to appoint a committee to study available locations, to obtain preliminary plans, and an es- timate of the cost involved for the construction of a new Fire Depart- ment building and to report not later than the next Annual Town Meet- ing and to transfer from available funds, and appropriate, any sum of money for the expense of such committee or do anything in relation thereto. Submitted by the Board of Selectmen.


Article 6. To see if the Town will vote to transfer the sum of One Hundred Dollars ($100) from the Police Department Ambulance Ac- count to the Police Department Expense Account and to raise by trans- fer from any available funds, and appropriate, Two Hundred Dollars ($200) to the Police Department Expense Account. Submitted by the Board of Selectmen.


Article 7. To see if the Town will vote to acquire for Cemetery purposes a strip of land approximately twenty-five (25) feet in frontage and approximately three hundred and eight (308) feet in depth, on Wildwood Street adjoining the present Wildwood Cemetery land, sup- posed to be owned in part by William Russell and in part by Alden N. Eames; and raise by transfer or otherwise and appropriate any sum of money therefor, or determine any other terms of such purchase or acquisition, or any other form of consideration therefor; or do any- thing in relation thereto. Submitted by the Cemetery Commissioners.


Article 8. To see if the Town will vote to transfer the sum of One Thousand Dollars ($1,000) from the Highway Department's Salary & Wages Account to the Highway Department's Snow Removal Ac- count, or do anything in relation thereto. Submitted by the Board of Selectmen.


Article 9. To see if the Town will vote to transfer and appro- priate the sum of Five Hundred Dollars ($500) from the Highway Department's Expense Account to purchase a new Baker Snow Plow and two (2) extra sets of plow blades for the Highway Department, or do anything in relation thereto. Submitted by the Board of Se- lectmen.

To see if the Town will vote to accept the following streets as laid out by the Board of Selectmen and approved by the Planning Board: Washington Street, Shady Lane Drive, Oakdale Road, Wiser Street, Laurel Avenue, Linda Road, and Central Street and vote to transfer the sums of Eight Hundred Dollars ($800) from Ballard- vale Street Account, Eight Hundred Dollars ($800) from Glen Road Account, Five Hundred Dollars ($500) from Chapter 90 Maintenance Account, and Two Thousand Dollars ($2,000) from tlie Highway De- partment's Salary and Wages Account to the Highway Department's Expense Account for the purpose of putting said streets into passable condition. Article 11. To see if the Town will vote to raise by transfer from available funds, and appropriate, Five Thousand Four Hundred Dollars ($5,400) for repairs and alterations to the Town Hall, or do anything in relation thereto. Submitted by the Board of Selectmen.


Article 12. To see if the Town will vote to fix the salary of the Town Treasurer for the current year, or to declare that in voting a salary of $2,000. for the Treasurer at the Annual Town Meeting in March 1950 it was the intent that said salary be effective from Jan- uary 1, 1950. Article 13. To see if the Town will take any action relative to apportioning the amount appropriated for Assessor's salaries for the current year at the last Annual Town Meeting between the several members of the Board, or relative to fixing the salaries of such indi- vidual members, or do anything in relation thereto. On petition of Susan T. Esler and others.


Article 14. To see if the Town will vote to transfer from any available funds, and appropriate, an amount of money to pay for an expert appraisal of the taxable real estate in the Town and authorize the Assessors to make a contract or contracts for said appraisal in accordance with the provisions of Section 4 of Chapter 40 of the Gen- eral Laws as amended by Chapter 521 of the Acts of 1950, or do any- thing in relation thereto.
