Article 3. On a motion by Mr. Edward F. Page. it was voted that the Town transfer the sum of Eight Hundred and Seventy-two Dollars ($872.00) from the Excess and Deficiency Account and appropri- ate the same for extension of beach and improving safety conditions at Silver Lake Park.

Article 4. On a motion by Mr. Edward F. Page, it was voted that the Town transfer the sum of One Thousand Sixty-seven Dollars and fifty cents ($1,067.50.) from the Excess and Deficiency Account and appropriate the same for maintenance of Lifeguard protection and supervision of traffic and persons, together with necessary incidental equipment for these purposes for Silver Lake Park.

Article 5. On a motion by Mr. Frank W. Dayton, it was voted that the Town accept the provisions of Chapter 108 of the Acts of 1949 which reads as follows: :-


"Section 1. George W. Buck, Tax Collector of the Town of Wilmington, may become a member of the contributory retire- ment system of said town, notwithstanding any provsion of law governing said retirement system that makes him ineligible for membership therein. Upon becoming such member, he shall be entitled to all the rights and privileges of members of said sys. tem which he would have enjoyed if he had become a member of the system on the date when said system became operative in said town; provided, that he first deposits in the annuity fund of said system such amount as the board of retirement under said system may determine in order to establish an account for him in said annuity fund in an amount equal to that which it would be if he had been a member of said system since said date.


"Section 2. This act shall take full effect upon its accept- ance by a majority of the voters of the Town of Wilmington vot- ing thereon in a regular or special town meeting called for the purpose but not otherwise."


Article 6. On motion by Mr. Francis J. Farrell it was voted that the Town of Wilmington be, and hereby is, authorized and empowered to change the names of the following streets as a tribute to deceased individuals for their service to the Country during World War II. These streets, together with their location and the specific name changes authorized, are as follows:

Surveyor of Reading Massachusetts. and dated October 1944 and contains 5.460 square feet more or less, and that the sum of One Thousand Dollars ($1.000.00), be hereby trans- forred from the Excess and Deficiency Account and appropriated for this purpose.

On motion by Me. John J. Nitchie it was voted that the Town purchase for school purposes the parcel of land now owned by William J. Kingman Abhort. surveyor of Reading. Massachusetts and dated Oct- ober. 1944 and contains 5.405 square feet more or less, and that the sam of Eight Hundred Dollars ($800.00), is hereby transferred from the Excess and Deficiency Acebunt and appropriated for this purpose.

Tm Harry J. Ainsworth. Constable of the Town of Wilmington:


Greetings :- In the name of the Commonwealth of Massachusetts and in the manner prescribed in the By-Laws of said Town. you are hereby directed to notify and warn the inhabitants of the Town quali- fied by law to vote in Town affairs to meet and assemble at the Grange Hall on Monday. the Twenty-Fourth Day of October next at S:00 P. M .. to consider and act on the following Articles:


Article 1. To see if the Town will vote to raise and appropriate a sum of money for constructing and originally equipping and furnish- ing a high school building on land owned by the Town on Church Street, determine how the appropriation shall be raised. by transfer from available funds, by borrowing, or otherwise; or take any action relative thereto.


Article 2. To see if the Town will vote to appropriate and trans- fer from Water Revenue Account to Water Department Salaries and Wages Account the sum of Thirty Five Hundred Dollars ($3.500.000) and from Water Revenue Account to Water Department Expense Ac- count the sum of Six Thousand Dollars ($6.000.00) or do anything in relation thereto.


Article 3. To see if the Town will vote to transfer or borrow- subject to the provisions of Chapter 30-the sum of $5.000.00 and appropriate the same to the Welfare Aid Account, or do anything 1x relation thereto.


Article 4. To see if the Town will vote to transfer or borrow- subject to the provisions of Chapter 90 the sum of $1.500.00 and ap- propriate the same to the Aid to Dependent Children Aid Account or do anything in relation thereto.


Article 5. To see if the Town will vote to transfer or borrow- subject to the provisions of Chapter 90 the sum of $2 000.00 and ap- propriate the same to the Veteran's Benefits Account or do anything in relation thereto.


Article 6. To see if the Town will vote to make the following transfers of funds voted for the support of the schools at the annual meeting in March. 1949. namely:


1. The sum of $750. or any amount. from Outlay Account Salaries and Wages Account.

2. The sum of $7,250, or any amount, from Outlay Ac- count to General Expense Account.


or do anything in relation thereto.


Article ". To see if the Town will vote to make the following transfers of funds voted for the support of the Fire Department at the annual meeting in March, 1949, namely:


1. The sum of $500, or any amount, from Salaries and Wages Account to Expense Account.


2. The sum of $96.49, or any amount, from Outlay Ac- count to Expense Account.


or do anything in relation thereto.


Article S. To see if the Town will authorize the Selectmen to turn in the present police automobile, which has been seriously dam- aged in an accident, in part payment for a new automobile for the Police Department, the balance of the purchase price thereof to be paid from funds transferred from Reserve Account for that purpose with the approval of the Finance Committee, or do anything in rela- tion thereto.


Article 9. To see if the Town will vote to transfer from any available funds and appropriate any sum of money for the Police De- partment Expense Account in order to operate the Department for the balance of the year 1949.


Article 10. To see if the Town will vote to transfer from any available funds and appropriate any sum of money for the Unclassi- fied Account or do anything in relation thereto.


Hereof fail not and make due return of this Warrant, or a certified capy thereof, with your doings thereon, to the Town Clerk, as soon as may be and before said meeting.

RECORD OF PROCEEDINGS OF SPECIAL TOWN MEETING HELD OCTOBER 24, 1949


In accordance with the foregoing Warrant. the voters assembled at Grange Hall on the above date. The meeting was called to order at 8:00 P. M. by the Moderator, Mr. Phillip B. Buzzell.


On motion by Mr. Charles H. Black it was voted to dispense with further reading of the Warrant at this time.


Article 1. Motion by Mr. Edward Neilson to raise and appropri- ate the sum of Four Hundred Sixty-seven Thousand Dollars ($467,- 000.00) for the purpose of constructing and originally equipping and furnishing a high school building on land owned by the Town on Church Street; and to meet said appropriation that $2,000.00 be ap- propriated from Surplus Revenue, and that the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $465,000.00 and to issue bonds or notes of the Town there- for payable in not more than 20 years. $200,000.00 of the loan authorized by this vote shall be under the authority of and in accordance with the provisions of Chapter 321 of the Acts of 1947, and $265,000.00 of said loan shall be under the authority of and in accordance with the provisions of Chapter 44 of the General Laws.


The present School Building Committee is authorized to enter into contracts and do all things that are necessary for constructing, equipping and furnishing the said high school building.


Mr. Barrows. The Finance Committee approved $452,000.00. At the request of the Committee (School Building Committee) approved an additional $15,000.00 for grading and paving.

Article 2. Motion by Mr. C. S. Harriman that the Town vote to appropriate and transfer from Water Revenue Account to Water De- partment Salaries and Wages Account the sum of Thirty-five Hundred Dollars ($3,500.00), and to appropriate and transfer from Water Rev- enue Account to Water Department Expense Account the sum of Six Thousand Dollars ($6,000.00).


Voted unanimously in the affirmative.

Two-thirds vote required. Voted unanimously in the affirmative. (164 votes).


Article 5. Motion by Mr. William S. Cavanaugh that the Town vote to transfer or borrow, subject to the provisions of Chapter 90 of the Acts of 1949, the sum of $2,000.00 and appropriate the same to the Veterans' Benefits Account.


Finance Committee approved.


Two-thirds vote required. Voted unanimously in the affirmative. (163 votes).


Article 6. Motion by Mr. John J. Farrell that the Town make the following transfers of funds voted for the support of the school at the annual meeting in March, 1949, namely:


1. The sum of $900.00 from Outlay Account to Salaries and Wages Account.


2. The sum of $7,100.00 from Outlay Account to General Expense Account.


Mr. Barrows explained that the budget to be approved must be in three parts, Outlay, Expense and Salaries, which was the reason for the transfer.


Voted unanimously in the affirmative.

Article 7. Motion by Mr. Joseph Barton that the Town make the following transfer of funds voted for the support of the Fire Depart- ment at the annual meeting in March. 1949. namely:


1. The sum of $500.00 from Salaries and Wages to Ex- pense Account.

There being no further business at motion by Mr. Edward Neilson. it was voted at 10:30 P. M. to adjourn.

To hear and consider the report of the Town Manager Study Committee appointed under Article 22 of the Annual Town Meeting, March 1949, and to see if the town will vote to continue the committee for further study, the said committee to submit its final recommendations, together with any necessary legislation to the next Annual Town Meeting. Requested by the Town Manager Study Com- mittee.


Article 2. To see if the Town will vote to instruct the Moderator to appoint a Committee to consider the general Town By-Laws as pub- lished by the Town Clerk on June 1, 1949, for the purpose of determin- ing the need for revision; to revise the present Building By-Laws; and to draft by-Laws regulating the installation and maintenance of plumbing and wiring; said Committee to make its report at the next Annual Town Meeting. or do anything in relation thereto. Requested by Planning Board.


Article 3. To see if the Town will vote to establish a Planning Board under the provisions of Chapter 41, Section 81A of the General Laws (Ter. Ed.) as amended, and to determine the number of mem- bers of such Board and the length of the terms which they shall serve, or do anything in relation thereto. Requested by Planning Board.

RECORD OF PROCEEDINGS OF SPECIAL TOWN MEETING HELD DECEMBER 19, 1949 AT TOWN HALL, WILMINGTON


In accordance with the foregoing Warrant. the voters assembled at the Town Hall on the above date. The meeting was called to order at 8:10 P. M. by the Moderator.


On motion by Mr. Herbert C. Barrows it was voted to disperse with further reading of the Warrant at this time.


Article 1. Report read by Mr. Irving Appleby. It was moved by Mr. Irving Appleby that the Town vote to continue the committee for further study, the said committee to submit its final recommenda- tions, together with any necessary legislation to the next annual Town Meeting.


Seconded by Mr. Edward J. Curtis. Voted in the affirmative.


Article 2. It was moved by Mr. Edward C. Manning that the Moderator appoint a committee of five to consider the present general Town By-Laws and make such revisions as appear necessary for the better government of the Town, to revise the present Building By- Laws, and to draft By-Laws for the regulation of the installation and maintenance of plumbing and wiring; and to make its report at the next Annual Town Meeting or at a Special Town Meeting to be held before December 31, 1950.


Seconded by Mrs. Susan T. Esler. Voted in the affirmative.


Article 3. It was moved by Mr. Edward C. Manning that the Town accept Section 81A of Chapter 41 of the General Laws, Ter- centenary Edition, as amended, and that the Planning Board be re- organized so that it shall consist of five members who shall also act as Park Commissioners and shall serve for terms of five years each; and that three members be elected at the next Annual Town Meeting by official ballot; one for a term of three years, one for a term of four years, and one for a term of five years; and furthermore, that the powers of the Planning Board under the aforesaid Section 81A be and hereby are vested in the present Planning Board until the elec- tion of the new Planning Board, which shall consist of the three new

members to be elected and the two members of the present Board whose terms will not have expired at the time of the next Annual Town Meeting.


Voted in the affirmative.


There being no further business on a motion by Mr. Irving Apple- by, the meeting was adjourned at 9:00 P. M.

REPORT OF THE CEMETERY COMMISSIONERS


The drouth of the past year took a heavy toll on the grass. In many places the grass is killed and will have to be reseeded.


An additional section is being prepared and will be available this summer. The dry weather has been the cause of many sunken graves and will cause many more in the spring. These will be graded in the spring and a bill will be sent to Lot Owners.


We wish to acknowledge the assistance extended to us by the Welfare department. Acknowledgement and thanks is extended to the Aid To Victory for the Flag they presented to the cemetery.

To the Honorable Board of Selectmen:


In accordance with the requirements of the Town By-Laws, I sub- mit herewith my report as Town Counsel covering the year 1949.


A. On January 1, 1949, there were pending the following actions by or against the Town (exclusive of actions in which the Town was merely summoned as trustee, and in which it had no interest, and of tax lien foreclosure proceedings in the Land Court) :


City of Lowell vs. Town of Wilmington, District Court of Lowell. (Action of contract by City of Lowell to recover the sum of $275.96 for special vocational training of certain pupils.)


City of Lowell vs. Town of Wilmington, District Court of Lowell. (Action of contract by City of Lowell to recover $657.77 plus interest for aid furnished in a public welfare case.)


City of Lowell vs. Town of Wilmington, District Court of Lowell. (Action of contract by City of Lowell to recover $721.90 for aid fur- nished in a public welfare case.)
