The Chairman was desired to have the center of Park street gravelled as soon as possible.


A petition from a large number of gentlemen, asking for atten- tion to the correct regulation of time, particularly of the Old South clock, was referred to Messrs. Foster & Weld .-


A petition was received from the butchers occupying stalls in Union street, praying for reduction of rent, in consequence of the embarrassment occasioned by the embargo .-


Voted, that it is not expedient to comply with the request of the petitioners at present .-

SELECTMEN'S MINUTES, 1812.


14 jurors were drawn for the Circuit Court.


· Pursuant to a precept received from Hon. Thomas Dawes Esq. Judge of Probate for the County of Suffolk-inquisition was made into the circumstances of Julia Domblide, single woman & return was made that she was non compos mentis & that it [123.] was advisable that a Guardian be appointed for her.


On application from County Treasurer, it was agreed that he should occupy the room in the Town house adjoining westerly to the Town Treasurers office.


The Chairman & M' Weld a committee to order repairs to West Boston engine house in Hancock street. and to have such repairs made to the fences, as they should judge proper as a compensation for use of the land.


On an invitation received from the government of the Wash- ington Benevolent Society it was agreed to attend the procession of that society tomorrow, at their celebration. -


Boston ss. At a meeting of the Selectmen May 6th. 1812 Present Messrs. Bulfinch, Oliver, Hunnewell, May, Foster, Webb, Weld & Lovering.


Whereas ; Several portions of a drain or common sewer have been laid at sundry times under the direction of the Selectmen from Cambridge street, southerly up Garden street, and from thence branching partly into Southack street, into Myrtle street & Pinckney street. The undertakers whereof have presented the account of the expence, and have prayed [124.] that the Board would cause assessment to be made upon the several proprietors of said common sewer for the proportion which each of them should pay for the benefit derived therefrom .- And the said account having been exhibited, by which it appears that the sum of six hundred, thirty nine dollars, twenty seven cents has been expended in said work, which with thirty two dollars charge of collection amount to six hundred seventy one dollars twenty seven cents. The accounts of the same having been examined & con- sidered by the Selectmen : it is now adjudged by them that the same expence shall be paid by the persons hereafter named & in the proportion & to the amount set against their names respectively .- viz-

Whereas Edward Childs upon application to the Selectmen obtained liberty to lay a common sewer in Poplar street & it hay- ing been made to appear to the Board that the said work has been properly executed & the expence of the same being ascer- tained to amount to two hundred & twenty dollars forty five cents-It is hereby ordered and adjudged by the Selectmen that the several persons who have laid their cross drains into said common sewer or main drain or receive benefit therefrom shall be assessed their proportion of the above expence as follows viz


William Minot, Israel Munroe, M. White, Sam1. Parkman, Edward Childs, Samt. White, Mr - Foster, and Seth Wright, 1 drain, $16.96 each.

[128.] Return was made by M' Edward Wright of the expence of repairing the drain in Belknaps Alley the account whereof being duly examined by the Selectmen was by them allowed; they being informed at the same time that all persons concerned in said drain had been notified according to law & that no objection had been made-Assessment was now made, an order of payment was passed by the Selectmen, as follows, viz .- Whereas, a drain or common sewer has been laid in Bel- knaps Alley conformably to the directions of the Selectmen the whole expence whereof amounts to one hundred and fifty nine dollars thirty three cents, which expence is to be borne by such persons whose drains enter therein & receive benefit thereby : wherefore We, the Subscribers, Selectmen of the said Town of Boston certify that having considered the same expence & by whom & in what manner it ought to be paid Do Adjudge that the same be paid in the proportion following & by the persons hereafter named, viz .-

SELECTMEN'S MINUTES, 1812.


The present meeting was called on occasion of the death of Francis Wright Esq .- when the following resolution was passed and ordered to be printed in the papers .-


Voted. As a testimony of respect for the memory of Francis Wright Esq. deceased, our late associate at the Board of Select- men, we will attend the interment of his remains on Wednesday next. `And request the members of the Board of Overseers, of the School Committee, of the Board of Health, the Fire wards & other Town Officers also to attend .-


On the Petition of a Number of inhabitants, warrant was signed for a Town Meeting on the 11th. instant .-


Boston ss. At a Meeting of the Selectmen June 11th. 1812. Present Messrs. Bulfinch, Oliver, Hunnewell, May, Webb, Weld & Lovering.


The Chairman and Mr. Oliver were empowered to have the street next the ropewalks at the bottom of the Common, raised so as to form a foot walk [132.] six feet wide, with a row of timber on each side & filled between with gravel, as a further security against high tides.


Mr. Hunnewell & Mr. Weld, a committee to confer with the residents on Fort hill-respecting the improving and securing the center part of the hill, and the necessary regulation of the streets -to ascertain the probable expence, & what part thereof the abutters will subscribe .-

On the application from the Hon. Judge of Probate-inquisi- tion was made into the circumstances of Benjamin Bailey-and return was made that the said Bailey was non compos mentis, and that it was advisable that a guardian should be appointed for him.

SELECTMEN'S MINUTES, 1812.


[141.] On a representation from Mr. Bond, that the clock at Doct. Lathrops church was much broken, and could not be made serviceable-it was agreed that the clock formerly belonging to the First Church should be repaired & put up in Dr. Lathrops or Second Church.


Agreed that the rent of the room in the Town house hired by Mr. Henry Messinger, and now occupied by Samuel D. Parker Esq. should be placed at two hundred dollars per annum.


Voted. That Mr. Adam Rupp be employed to prevent persons with horses or otherwise, at the west end of Allen street, going into the water on Sundays, after the hour of 7 in the morning.


The Chairman was desired to confer with Gen. Welles` and consult him upon the proper measures to prevent the practice of drumming in the streets after sunset .-

Mr. Lovering was desired to procure a supply of powder for the Town's use agreeable to the requisition .of the Militia law. and [142.] the Treasurer be desired to give his note for the same, payable in ninety days .-

The Board was occupied in examining into a complaint brought by Stephen Woods against Jonathan Prescott, a constable during the past year, and now a candidate for that office.


Boston Ss : At a Meeting of the Selectmen July 22d. 1812. Present Messrs. Bulfinch, Oliver, Hunnewell, Webb, Weld and Lovering.


A complaint having been presented by Mr. Moses Walbach against Robert Rixford, constable, for misconduct in making a false return on an execution against him. The parties were summoned to attend & were examined when it appeared to the Board that the complaint was without foundation.


Ordered, That the Town Clerk publish in the Boston Gazette & New-England Palladium, the law of this Commonwealth, which empowers the Selectmen to regulate every description of carriages in the streets of this Town; & the Rules and Orders [143.] adopted by them in pursuance of such powers.

CITY DOCUMENT NO. 60.


It is hereby ordered, that from and after Monday, the third day of August next, the following Rules & Orders shall be in force, for the due regulation of carriages in the streets of the Town of Boston, vizt.


Of Hay.


All Waggons, Carts & Sleds with Hay for sale, shall stand in Charles street, in one line on the northerly side of said street ; beginning at the easterly end thereof, by the new hay scales, & to extend as far westerly as shall be found necessary to accom- modate the numbers.


Of Wood from the Country.


The Waggons, Carts & Sleds with wood for sale, shall stand in Common street, from the Burying Ground gate southerly, as far as shall be found necessary to accommodate the numbers : & shall stand in one line along the westerly side of the street leaving the entrance to Park street & the foot passages into the mall, clear and unincumbered.


As many Waggons, Carts & Sleds with wood shall be allowed to stand in Bowdoin Square, & the North Square, as shall, upon experience, be found convenient for the free passage of carriages through those Squares.


And one row of such Waggons, Carts & Sleds shall be allowed to stand on the easterly side of Pond street, leading from Hanover street to Charles-River-Bridge.


Of Hackney Carriages.


Six Hackney Carriages shall be allowed to stand in the North Square, and all other Hackney Carriages shall stand in those streets where their stables are situated, and immediately in front of their [144.] stables, as near to the side walk as possible- provided, that not more than two such Hackney Carriages shall be allowed on any such stand at one time; & that no Carriage shall be washed or cleaned in the streets.


Every hackney carriage shall be numbered on each door thereof, in a conspicuous place, on the outside, with the figures not less than two inches in length ; and such figures shall be painted on the doors or fixed on them in metal plates, & shall not be moveable.


The price and rate of fare to be demanded & received for the conveyance of any person or persons within the limits of the Town, shall be for a single person, twenty five cents; & when more than one person shall be conveyed at one and the same time, twenty cents shall be paid by each & every one of them.


Market Regulations.


All Carts, or other carriages, with provisions of any kind for sale, which shall stand in Dock square, Market Square, Union

SELECTMEN'S MINUTES, 1812.


& Ann streets, shall be under the direction of the Clerk of the Market; all horses shall be taken from such carriages & carried to one of the neighbouring stables, or otherwise removed from the streets by the owners or drivers.


No cart nor other carriages shall be suffered to stand in Court street, Exchange street, or the passage way between Dock Square & Union-street.


No person shall be allowed to stand with vegetables or fruit for sale in Dock Square, until all the stalls in Market Square shall be occupied; and no carts, for sale of articles, shall stand in Cornhill, until Dock Square shall be filled, at the discretion of the Clerk of the Market : & those Carriages which for want of room in Dock Square, shall be obliged to stand in Cornhill, shall be ranged on one side of the street only.


No waggons, carts nor sleds, with hogsheads, barrels, boats, hoop poles, oars, timber, boards, ladders, spouts nor gutters, [145.] wooden nor tin ware, chairs nor baskets, shall be suffered to stand in Market nor Dock squares, in State street, nor any street contiguous thereto ; but shall have a convenient stand on land belonging to the Town, about the middle of Pond street, between the Baptist Meeting-houses.


No carts nor other carriages with provisions for sale, and no chaises not other riding carriages shall stand in State street.


All waggons, carts & Sleds with cider, shall stand in Water street in one line on the north side thereof, & in Adams street on the east side thereof & as many in Liberty square as shall be found convenient for the free passage of Carriages through said square.

All trucks owned by any inhabitant of the Town of Boston, shall be registered in a book to be kept by the Town Clerk for that purpose ; & shall be numbered from number one in succes- sion ; & said numbers shall be distinctly painted on both shafts of said trucks, in black letters & figures at least three inches in length on a white ground.


After such Trucks shall be so registered & numbered, if any owner thereof shall sell, exchange or otherwise dispose of his property therein, the same shall be registered anew in the name of the person purchasing or otherwise owning the same ; & the number shall be renewed as often as they shall become defaced or indistinct.


Twenty trucks, with two horses harnessed to each, shall be allowed to stand in State street : to extend to Merchants row to Long Wharf on the North side ; & from Kilby-street to Broad street on the south side, in the following order :
