In all cases where an ad valorem duty shall be charged, it shall be calculated on the nett cost of the article, at the place whence im- ported (exclusive of packages, commissions and all charges) with the usual addition, established by law, of twenty per centum on all mer- chandise, imported from places beyond the Cape of Good Hope, and of ten per centum on articles imported from all other places.


( For three years next ensning the thirtieth day of June next, a duty of twenty-five per centum ad valorem ; and after the expiration of the three years aforesaid, a duty of twenty per certum ad valo -. . rem : Provided, that all cotton cloths, or cloths of which cotton is the material of chief value (excepting nankeens imported directly from China) the original cost of which at the place whence imported with the addition of twenty per cent. if imported from the Cape of Good Hope, or from places beyond it, or of ten per cent. if imported from any other place, shall be less than twenty-five cents per square yard, shall with such addition, be deemed and taken to have cost twenty-five cents per square yard, and shall be charged 'with duty accordingly ; Provided also, that all unbleached and uncolored cotton twist yarn, or thread, the original cost of which shall be less than sixty cents per pound, shall be taken and deemed to have cost sixty cents per pound, and shall be charged with duty accordingly ; and all bleached or co- lored yarn, the original cost of which shall have been less than seventy- five cents per pound, shall be taken and deemed to have cost seven- ty-five cents per pound, and shall be charged with duty accordingly :

And Provided further, that cotton peice goods, imported in ships or vessels of the United States, which shall have sailed from the United States before the passage of this act, and shall arrive therein between the thirtieth day of June, one thousand eight hundred and sixteen, and the first day of June one thousand eight hundred and seventeen, the original cost of which cotton peice goods, at the place whence imported, shall have been less than twenty-five cents per square yard, shall be admitted to entry, subject only to a duty of thirty-three and a third per centum on the cost of the said cotton peice goods in India, and on the usual addition of twenty per centum on that cost.


Sec. 4. And be it further enacted. That there shall be allowed a drawback of the duties, by this act imposed, on goods, wares and merchandise imported into the United States, upon the exportation thereof, within the time and in the manner prescribed by the existing laws, subject to the following provisions, that is to say, that there shall not be an allowance of the drawback of duties in the case of goods imported in foreign vessel from any of the dominions, colonies, or possessions of any foreign power, to and with which the vessels of the United States are not permitted to go and trade ; and there shall not be an allowance of the drawback of duties for the amount of the additional duties by this act imposed on goods imported in vessels not of the United States ; and there shall not be an allowance of the draw- back in the case of foreign dried and pickled fish, and other salted pro- visions, fish oil or playing cards ; and there shall be deducted and re- tained from the amount of the duties ou goods exported with the be- nefit of drawback (other than spirits) two and a half per centum, and that there shall be retained in the case of spirits exported with the benefit of drawback, two cents per gallon upon the quantity of spirits, and also three per centum on the amount of duties payable on the im- portation thereof. But, nevertheless, the provisions of this act shall not be deemed in any wise to impair any rights and privileges, which have been or may be acquired by any foreign nation, under the laws and treaties of the United States, upon the subject of exporting good from the United States, with a benefit of a drawback of the duties payable upon the importation thereof.


Sec. 5. And be it further enacted, That after the thirtieth day o! June next, in all cases of entry of merchandize for the benefit of draw. back, the time of twenty days shall be allowed from the date of the entry, for giving the exportation bonds for the same . Provided, tha the exportation shall, in every other particular, comply with the regu lations and formalities, heretofore established for entries of exporta tion for the benefit of drawback.


Sec. 6. And be it further. enucted, That the duty on the tonnage o vessels, and the bounties. advances, and drawbacks in the case of ex porting pickled fish, of the fisheries of the United States, in the cas of American vessels employed in the fisheries and in the case of ex porting sugar renned within the United states, shall be and continu the same as the existing law provides. Provided always that thi provision shall not be deemed in any wise to impair any rights ag

privileges, which have been, or may be acquired by any foreign na- tion, under the laws and treaties of the U. States, relative to the duty of tonnage on vessels.


Sec. 7. And be it further enacted, That the existing laws shall ex- tend to, and be in force for the collection of duties imposed by this act, on goods, wares and merchandise, imported into the United States; and for the recovery, collection, distribution and remission of all fines, penalties, and forfeitures, and for the allowance of the draw- backs and bounties by this act authorised, as fully and effectually as if every regulation, restriction, penalty, forfeiture, provision, clause, matter and thing, in the existing laws contained, had been inserted iu, and re-enacted by this act. And that all acts, and parts of acts which are contrary to this act, and no more, shall be and the same are here- by repealed.


Sec. 8. And be it further enacted, That the act passed the third day of March, one thousand eight hundred and fifteen, entitled " an act to repeal so much of the several acts imposing duties on the ton page of ships and vessels, and on goods, wares and merchandise im- ported into the United States, as imposes a descriminating duty on tounage between foreign vessels and vessels of the United States, and between goods imported into the United States in foreign vessels and vessels of the United States," shall apply and be in full force as to the discriminating duties established by this act on the tonnage of fo- reign vessels and the goods, wares, and merchandise therein imported.

When the duties on goods imported, where the sum payable by one person or co-partnership, shall amount to more than 50 dollars, the following credit is allowed by law, except where any bond on which the person or co-partnership entering such goods, wares or merchandise, are either principal or security, being due, remains un- discharged.


Ou all articles of the produce of the West Indies, or from places north of the equator, one half in three and the other half in six months.


On Madeira, and all other wines, twelve months.


On all goods, &c. from Europe, (wines and teas excepted) the one third in eight, one-third in ten, and one-third in 12 months.


On all goods, &c. (wines and teas excepted) from any other place than Europe, the West Indies and north of the equator, the one half in six months, one-fourth in nine months and one-fourth in. twelve months.


'Teas " from China or Europe may be deposited at the option of the importer or importers (to be determined at the time of making entry therefore) either to secure the duties thereon, on the same terms and stipulations as on other goods, wares and merchandise imported, or to give his or her, or their bond, to the collector of the district, where any such teas shall be landed, in double the amount of the du- ties thereupon, with condition for the payment of the said duties in two years from the date of such bond : which bond shall be accepted by such collector without surety, upon the terms following : that is to say, The teas, for the duties whereof such bond shall be accepted, shall be deposited at the expense and risk of the said importer or im- porters, in one or more store house or store houses, as the case may require to be agreed upon, &c. The said teas to be delivered upon bond being given with one or more surety or sureties, to the satisfac- tion of the collector, " if the same shall not exceed 100 dollars, in four months ; if above 100 dollars, and not exceeding 500 dollars, in 8 months ; or if the same shall exceed 500 dollars, in 12 months," so that the term of credit shall not extend the period beyond two years from the time of depositing the said teas ; any teas remaining after the said term of two years, to be sold by the collector, who shall return the surplus (after paying the duties) to the owner or owners thereof.


Sec. 65. When bonds given for duties shall become due, and not discharged, the collector to prosecute without delay ; and in case of insolvency or death, the United States to be the first' creditor, and any executor, administrator, assiguee, or any other person shall pay- ing any debt due by the person or estate, from whom or for which they are acting previous to the debt or debts due to the United States being first fully satisfied and paid, shall become answerable in their own person and estate for the same, or part thereof remaining unsa- tisfied.


Sureties on all bonds given for duties, shall in case of insolvency or death of the principal, "have and enjoy the like advantages, priori- ty or preference for the recovery and receipt of the said money out

of the estate and effects of such insolvent, or deceased principal, as are reserved to the United States."


When bonds are prosecuted for the recovery of duties due to the United States, judgement to be granted at the return term, " unless the defendant shall in open court, the United States attorney being present, make oath or affirmation, that an error has been committed in the liquidation of the duties demanded upon such bond, specifying the errors alledged to have been committed, and that the same have been notified, in writing, to the collector of the district prior to the commencement of the return term aforesaid."


On all bonds upon which suits shall be commenced, an interest shall be allowed at the rate of six per cent. per annum, from the time when said bonds became due until the payment thereof.


Sec. 33. Duties to be paid where goods are landed, and bonds to be given for securing the duties, if the whole or part of the cargo is destined to different districts.
