The searcher only professes to refer you to the papers recorded at the court house which affect your title, and does not pretend to say whether those papers show your title to be good or bad.


Q. If my attorney says the title is good, am I not certain ?


A. You are not. Among the thousands of instruments of record at the court house, one that is vital to your title may be missed by the searcher and your attorney gives his " opinion " upon the title only so far as the abstract shows it.


Q. If my title is perfect on the records, can it be defective ?


A. Yes ; it might still be wholly void as to you.


Q. How can that be ?


A. One of the deeds may have been forged, making it void. A deed may have been made by an attorney in fact whose power was fabricated, making the deed void. A deed executed under a power of attorney after the death of the principal, is void. A deed or power of


attorney executed by an insane person, is void. A deed may be made by a person of the same name as the owner, but having no interest in the land, and it would be void. The whole title may depend upon a foreclosure sale in which all the necessary parties have not been joined in the suit, and their rights consequently not cut off. This has often occurred in Portland. Many of our citizens imagine that a foreclosure sale, or sheriff's sale is equivalent to a guaranty that every- thing pertaining to it is regular and right. Nothing can be further from the truth. Many other equally hazardous things that the records do not disclose, many exist in titles anywhere.


Q. How does a title insurance company discover defects not shown by the records ?


A. The Title Guarantee and Trust Company has collected, and is daily collecting a large fund of information outside of the records, and thus has extraordinary facilities for examining titles, independent of its superior plant.


Q. What does the company do when a title it has insured proves to be defective ?


A. Pays the loss - a loss which would otherwise fall upon the owner.


Q. Would the company decline the insurance if, after examination, it found serious defects in the title ?


A. Most certainly. But if the defects are of such a nature that they can be cured, the company will undertake to have the title per- fected and then issue its policy.


Q. How long does the title policy remain in force ?


A. An "Owner's Policy " runs for all time - a perpetual policy- and premium paid but once. A "Mortgage Policy " runs only during the life of the loan. The Mortgagee's Policy expires when the mortgage is satisfied, with the exception that it becomes an owner's insurance if the fee simple is acquired by the mortgagee under foreclosure.


Q. Are premiums payable annually ?


A. There are no annual or term premiums. One fee pays for the whole time.


Q. What further charges are made for preparing an abstract of title, examination by counsel, etc. ?


A. None whatever.


Q. If I sell do I then lose my insurance, just as with a fire policy ?


A. No, that is a very common mistake. If you keep your policy it insures your warranty as fully as it insured your fee-simple before sale.


Q. If my title is insured and is then attacked, how can I establish my claim under the policy ?


A. Simply hand the summons to the Title Guarantee and Trust Company, and it defends the title at its own cost, and pays the loss if the defense is unsuccessful - you being an "interested spectator."


Q. Can a title insurance policy be used in obtaining a loan ?


A. Certainly. Instead of furnishing the mortgagee with an abstract brought down to date and paying his attorney to examine it, you can take a policy running to him directly, or you can assign to him your owner's policy. The title policy is the quickest, safest and most com- venient of all expedients for settling the question of title of mortgagees, owners and purchasers. 19An exhaustive examination, based upon a superb plant, with a guarantee of free defense and payment of loss, backed by an incorporation of ample capital, is obviously to be preferred to a simple opinion upon a title without guaranty or liability.

Title insurance facilitates the transfer of real estate. Merely tech- nical defects that are not of vital importance, and yet so often block sales, can be insured against.


It saves expense to the mortgagor. When the holder of a Title Insurance Policy mortgages his property, he transfers his policy to secure the mortgage, and gets his money the same day.
