The earliest authentic record of the Spruce Street Ceme- tery is in the year 1740, when Mr. Nathan Levy obtained a grant of thirty feet square, and in 1752 an addition of thirty feet wide and sixty feet in depth, with the liberty of an alley ten feet wide from Spruce Street, upon his application to John Penn, Chief of the Proprietary Government of Pennsylvania; for which ground Mr. Levy paid an annual tax of "a quit rent of Five Shillings Sterling," or value of coin current of Pennsylvania. In September, 1751, the following notice was inserted in the Pennsylvania Gazette.
"WHEREAS, Many unthinking people have been in the habit of setting up marks and fired several shots against the fence of the Jews' Burying Ground, which not only destroyed said fence, but also a Tombstone in it; there being a brick wall now erected, I must desire the sportsmen to forbear ( for the future) firing against said wall. If they do, whoever will inform, so that the offender be convicted thereof before a Magistrate, shall have twenty shilling reward paid by me.
"Philadelphia, September 12th, 1751.
NATHAN LEVY."
Tradition further records that after the place was walled in, it was often desecrated, not only by marks and shots, but by executions of deserters by British soldiers in front of its gates, during the Revolutionary War. Nathan Levy's remains have been buried there since 1753.
Later (June 21, 1765) an adjacent piece of ground was granted to Mathias Bush by John Penn.
On October 31, 1765, John Lukens, Surveyor General, drew a design of the cemetery and suitably endorsed it as "sur- veyed and resurveyed."
In 1791 the Congregation Mikveh Israel appointed Manuel Josephson, Joseph Simons, Barnard Gratz, Solomon Lyon and Samuel Hays trustees for the burial ground. A document bearing the signature of David Franks reads as fol- lows :
"WHEREAS, Nathan Levy, formerly of this city, merchant, did apply for two pieces of ground for a burial place for his family, which said two pieces of ground was granted to him, as more fully will appear by the records of the Land Office, this is to certify and declare that said application, which was in the name of the aforesaid Nathan Levy, was intended for the use of his family, and also for the use of the Hebrew congre- gation (Mikveh Israel) of this city; it being intended at the time he applied for the same to be a trust for a burial place for the interment of Hebrews. Given under my hand at Philadel- phia, the thirtieth day of November, 1791."
Also another document, drawn in 1793, by direction of Benjamin Levy, of Baltimore, married to Rachel Levy, daugh- ter of the deceased Nathan Levy, and her sister, Philadelphia Levy, recognizes the appointment of the five trustees, reserving to the heirs of the departed Nathan Levy 'the free, unre-

strained and absolute right of burial and all and every honor and privilege of sepulture for themselves only in and upon the above described lot of ground.'" This document proves beyond doubt the absolute right of the Congregation Mikveh Israel to the Spruce Street Cemetery.
Though these public spirited men meant the Cemetery to be the resting place for all their brothers in Israel, their de- scendants were not equally unselfish, and for many years there were dissentions as to the rights of ownership. .
The question was finally settled April 14th, 1828, when the Legislature passed an act giving the burial ground to the Jews of Philadelphia. The names, Samuel Hays, Simon Gratz, Zalegman Phillips and Abraham Myers Cohen, Trustees of the Congregation Mikveh Israel, having been affixed to the peti- tion. Many whose names are synonyms of patriotism and affection found their resting places in this historic Cemetery. Chief among these was Rebecca Gratz, the beauty of whose face and character suggested the heroine of Ivanhoe. Most of her family are also buried here, including her father, Michael, and her brother, Hyman Gratz, through whose be- quest the Gratz College was founded.
The names of Jonas and Zalegman Phillips are notewor- thy, the latter for high standing at the Philadelphia bar, and as Parnas of the Congregation Mikveh Israel, a position previ- ously held by his father, Jonas, whose wife was the grand- audi daughter of Mathias Bush, one of the signers of the Nonim- portation Act. Philanthropy is represented by John Moss, whose unobtrusive charity and kindly nature endeared him to all.
Romance, too, crept into this quiet graveyard in the per- son of Mrs. Aaron Levy, originally a redemptionist, rescued

from slavery, educated and married by Aaron Levy. Space forbids an enumeration of all the historic names inscribed on the tombstones, but such as the Rev. Abraham Israel Keys, Daniel Gomez, Rev. Emanuel Nunez Cavalho, Rabbi Eliezer Joseph Israel, Emanuel Josephson and Reuben Etting are of more than local fame.
Since the purchase of the Federal Street Cemetery, in 1848, the burials in the Spruce Street Cemetery have almost ceased, the last recorded one being Hetty Pesoa, July 3, 1886.
