Council took into consideration the case of John Bawers, who is now confined in the jail of this city at hard labour, for having de- frauded Mary Eyre of a quantity of staves and heading, and who hath by his petition prayed Council to grant him a pardon, and the said Mary Eyre having informed Council that the petitioner has made restitution for his proportion of the property taken from her, and that she wishes he may be released ; it was thereupon
Resolved, That the said John Bawers be and he is hereby par- doned, on condition that he leaves this State in five days from the date hereof, not to return.
Mr. Findley was appointed a member of the Board of Property for the present month.
The report of the Committee to whom was referred the memorial of Joshua Elder, Esquire, Deputy Surveyor of the depreciation lands, being read the second time, was adopted as follows, vizt : That at the public sales of the deprecitation lands John Vanderen, sen'r, late of the county of Philadelphia, purchased by himself and agents one hundred and sixty-nine lots of the districts urveyed by the said Joshua Elder, for which he has never either paid the pur- chase money, office or Surveyor's fees, except sixty pounds to the Surveyor.
That it appears by an inquisition taken the seventh day of De- cember, 1786, that said Vanderen was adjudged to be in a State of lunacy at that time, and for more than three months previous there- to, during which time the said purchases were made ; therefore,
Resolved, That the one hundred and sixty-nine lots struck off as above mentioned be considered as reverted to the State, and that the Deputy Surveyor be intitled to have an order for his surveying fees

A letter from Andrew Elliott, Esquire, of this date requesting to be furnished with a copy of the deed given by the Senecas to to Messieurs Butler and Gibson, late Commissioners on behalf of the State of Pennsylvania, for certain lands lying on the south side of Lake Erie, and west of the Conawango river, and the carrying place between Lake Chaughtaughque and Lake Erie, which he conceives will be usefull to him in carrying into execution the resolution of Congress of the sixth of June, 1788, which authorizes a survey of the said tract of land, was received and read ; whereupon, it was
Resolved, That Mr. Eilicott be furnished by the Master of the Rolls with a copy of the said deed properly authenticated.

A return of militia officers for the county of Fayette, from Joseph Terrance, Esquire, the Lieutenant of that county, was received and read, and commissions directed to issue agreeably thereto.
A motion was made by Colonel Smith, seconded by Doctor Wil- kins, and agreed to by Council in the following words to wit :
WHEREAS, By the report of the Receiver General of the Land office, it appears that at the public sales of the depreciation lands in the district surveyed by Joshua Elder, sixteen lots were pur- chased by the Comptroller General on account of the Common- wealth :
And whereas, It appears from the report aforesaid, that four lots were purchased by Ephraim Hart, two by John Peters, and two by Matthias Keely, in the same district, for which the purchase money, office fee, and charges of surveying remains unpaid.
Resolved, That the whole of the said lots be considered as revert- ing to the Commonwealth.

Resolved, That the said James Robinson be and he is hereby pardoned, on condition of his leaving this State in five days from the time of his discharge, not to return.
On motion,
Resolved, That Friday next be assigned for the consideration of the motion which was made by Doctor Gregg, and seconded by Mr. Potts, for a general pardon of the persons who have been attainted of high treason against this Commonwealth.

'T'he keeper of the jail of the city and county of Philadelphia having certified to Council that the time of servitude to which a certain Thomas Varnham was sentenced by the Court of General Quarter Sessions of the said county, is now expired, and that he remains in confinement for a fine of two pounds five shillings which is due to the Commonwealth, and the said Thomas Varnham having by his petition prayed to Council for remission of the same ; it was
Resolved, That the said fine of two pounds five shillings be and the same is hereby remitted.

Of Alexander McGuighen the present Treasurer of the said county, stating the amount of taxes collected and outstanding untill the first day of May, 1790, in the said county.
A petition from James Maxwell, of the county of Chester, for the pardon of his wife Elizabeth, who was among others convicted in the said county in February last of receiving money which had been stolen from a certain Robert Wilkins, and who is now con- fined in the jail of the said county at hard labour for the said offence, was read with a recommendation from a number of respec- table inhabitants of the said county in her behalf, and the said Robert Wilkins having signified to Council his desire that she may be released; it was thereupon,

Of Casper Marche, for his pay for two months' service as a Light Horseman in Colonel Philip Bahm's battalion of Northampton county militia, when called into actual service, for the defence of the frontiers of the said county against the Indians, in the year 1782, amounting to ten pounds seventeen shillings.
Of Mary Wert, for pension due to her from the first of Febru- ary until the first of June, 1790, according to an order of Orphans' Court of the county of Philadelphia, dated the fourteenth instant, amounting to twenty pounds, for which sum an order was drawn on the Treasurer.

Of Captain Paul Knaus, for the pay of five militia men of his company of Northampton county militia, while in actual service, for two months, in the year 1781, on the frontiers of said county, against the Indians, amounting to forty-four pounds two shillings.
Of Philip Vancler, for his pay as a seven months' man, in the Seventh Pennsylvania Regiment of the late Army of the United States, amounting to seventeen pounds ten shillings.
A petition from Barent Jacob, who hath been indicted in the Mayor's Court for selling spirituous liquors by the small measure without licence, stating his case, and praying that Council would be pleased to direct that no further proceedings may be had against him, was read, and the same referred to the Attorney General.
A letter from John Nicholson, Esquire, Comptroller General, dated this day, informing Council that the office of Collector of Excise in the countys of Bedford and Franklin are vacant, by the death of Samuel Crossan in the former, and by the resignation of Richard Parker in the latter, and inclosing an application of seve- ral persons in Bedford county, requesting that Mr. Benjamin Mar- tin may be appointed Collector of Excise in that county, was read, and the further consideration thereof postponed untill Tuesday next.

A letter from the Honorable Thomas Jefferson, Esquire, Secre- tary of State, dated the seventeenth instant, inclosing two copies of each of the following acts and resolutions of Congress, vizt :
An Act for giving effect to the several acts therein men- tioned in respect to the State of Rhode Island aud Providence Plantations ;
An Act for the relief of Thomas Jenkins and company ;
A Resolution respecting the arrears of pay due to the troops of the lines of the States of Virginia and North Carolina; and
A Resolution for the publication of treaties made or which shall be made under the authority of the United States; was received and read, and a letter written by the President to Mr. Jefferson acknowledging the receipt of the said letter and inclosures.

Two letters from Daniel Brodhead. Esquire, Surveyor General, of the twenty-first instant, informing Council that he had appointed Joseph L. Finley to be Deputy Surveyor of the district late Joshua Elder's, in the county of Westmoreland, bounded southerly by the district of John Moore and Benjamin Lodge, westerly by the Alle- gany river, northerly by the line of the late purchase, and easterly by the line of Huntingdon county; and James Hamilton to be Deputy Surveyor of district number four, in the new purchase, on the north side of the West Branch of Susquehanna, bounded south- erly by the said West Branch, easterly by the district of George -Woods, junior, number three, northerly by the State line, and westerly by James Johnston's district, number five; and submitting the said appointments for the approbation of Council, agreeably to act of Assembly passed the eighth of April, 1785, was received and read ; and thereupon
Resolved, That Council approve of the said appointments.
On motion of Mr. Findley, seconded by Mr. Smith, it was
Resolved, That Thursday next be assigned for the choice of a Commissioner to attend on the part of this State the settlement of the accounts of Pennsylvania with the United States.
Upon the second reading of the report of a committee to whom was referred the petition of William Owen for the right of pre- emption to a certain island, lying in the Allegany river, about six miles below the mouth of Kiscomenetas river, containing eighty- four acres and six perches, and the usual allowance of six acres p'r cent, &ca., it was
Resolved, 'That the right of pre-emption to the said island be granted to the said William Owen, provided that he pays for the same within six months from the date hereof, at the rate of twenty- five shillings per acre in funded certificates of this State.
Upon further consideration of the letter received from Mr. Nich- olson, received on the eighteenth instant, relative to the office of excise in the counties of Franklin and Bedford, it was unanimously
Resolved, That Doctor Robert Johnston be appointed and com- missionated Collector of Excise in the county of Franklin, and that Benjamin Martin be appointed and commissionated Collector of Excise in the county of Bedford.
