For any goods not included in the Manifeft as above, the Mafter is to for- feit a fum equal to their value, unlefs it is made appear to the Collector, Na- val Officer, and Surveyor, or to a Court on trial, that no part of the Cargo was unfhipped, except what is in the report, or that the Manifeft has been loft or miflaid without fraud, or defaced by accident, or incorrect by miftake.


The Mafter of any veffel, bound to any port in the United States, on ar- rival within four leagues of the coaft, or within any bays, harbours, ports, rivers, creeks, or inlets thereof, on demand, to produce fuch Manifeft to the Officer of the Cuftoms first coming on board, and deliver him a copy thereof fubfcribed by the. Matter, aud the officer to certify on the original, that the fame was fo produced, and a copy delivered to him, and the Maf- ter to produce the original, fo certified, to the Officer firft coming on board, on his arrival in the district where the Cargo is intended to be landed, and deliver to fuch Officer a copy thereof, to be provided and fubfcribed by the Mafter, the delivery of which alfo to be certified by the Officer on the origi- nal Manifeft, and the original Manifeft to be delivered afterwards to the Collector.


The penalty for not producing fuch Manifefts and de'ivering copies there- of, or for not informing fuch Officer of the destination of fuch veffel, or giv- ing falfe account of destination is five hundred dollars for each offence.


Any veffel within four leagues of the coaft, or within the limits of a dif- trift, unloading goods, without authority from proper Officers, the Mafter and Mate forfeit one thoufand dollars, and the goods forfeited, except in cafe of accident, neceffity and ftrefs of weather, which fhall be proved be- fore the Collector.


Mafters of veffels receiving goods fo unloaden (except as before excepted) to forfeit treble value of fuch goods, and the fhip, boat, or veffel receiving them are forfeited.


If any veffel arriving within a diftrict, fhall depart, or attempt to depart, from the fame (unlefs to fome more interior port, or by ftrefs of weather) without report made to the Collector, the Matter forfeits four hundred dol- lars.


Any veffel arriving from a foreign port, the Mafter is to report to the Col- lector within twenty-four hours of his arrival, and within forty-eight hours farther to report the name, burthen and loading of fuch fhip, whether in packa- ges or loife, and of the marks, numbers and contents of each package, and place ar places, perfon or perfons, to or for whom they are refpectively configned or deltined, allo the places where the took in her loading, what country built, from what foreign port fhe laft failed, who was Matter during the voyage, and is at the time of the report, and (if a veffel of the United States) who are owners.


Mafters neglecting to make fuch reports forfeit one thoufand dollars.


Ships of war or packets of any Prince or State, and not permitted by fuch Prince or State to carry goods in way of trade, are not required to make fuch report.


Mafters of veffels, after arrival and entry, may proceed to foreign ports, with goods reported for fuch foreign port, without paying duties thereon, on giving bond, and bouds are not required when veffels put in in diftrefs.


Duties only to be paid where goods are landed (on giving bond it fuch vef- fel proceeds to another diltrict )


Collector to furnifh the Mafter, bound to another diftrict, with a copy of huis report. which he is to fhew to the Collector of that diftrict, within twen- y-four hours after his arrival.

Teas from China may be depofited with the Collector, and delivered on payment of duties, for fuch part as is delivered withan eighteen months, and then fold for duties if not paid. But this altered by Act of March 1791, lierein after publifhed.


Officers may fieze within or without their diftriets, perfons tefifting or impeding them forfeit four hundred dollars.


In cafes of drawback, notice to be given to the Collector, by the expor- ter, at least twenty-four hours before Shipping the goods, which are to be infpected and fhipped in prefence of an Officer. And drawback allowed at place of entry only, on all goods exported to any country, without the Uni- ted States, in the original package, and within twelve months after payment made, or fecurity given, for duties, and retaining one per cent. of duties paid and excepting where dutics do not amount to twenty dollars at the leaft.


Bonds with one or more fufficient fecurities to be given, that fuch goods fhall not be relanded in the United States.


Goods not entitled to drawback, until after fix months, and until the exporter fhall produce certificate in writing of two refpectable merchants at the foreign place or port where landed, together with the oath or affirmati- on of the Mafter and Mate of the veffel, certifying the delivery thereof.


In cafe of veffels caft away, or other accident, to produce proteft in due form, or in cafe fuch proteft cannot be had, the oath or affirmation of the ex- porter, or other proof to the fatisfaction of the Collector.


Goods exported for drawback, and relanded, fubject to feizure, together with the veffel, boats, &c. and perfons concerned fuffer fix months imprifon- ment


Salt fish and falted provifions to be fhipped under the fame reftrictions as in cafe of drawbacks, and the bounty to be paid without abatement, but no drawback to be allowed, unlefs it amount to twenty dollars, nor bounty un- let's to three dollars.


The Collector may give credit on bonds due, for amount of drawbacks, if the exporter was the importer of the goods.


Perfons giving or offering a bribe forfeit from two hundred to two thou- fand dollars.


Captains or owners making falfe entry forfeit not exceeding one thoufand dollars, and fuffer not more than twelve months imprifonment.


No goods of foreign growth or manufacture, to be brought into the Uni- ted States unlefs by fea, and not in veffels under thirty tons, on forfeiture of goods and veffel (except to Louifville on Ohio) except houfhold furniture and cloathing of perfons removing to the United States.


Veffels bound to foreign ports, the Mafter is to deliver a true Manifeft on oath and take clearance (but without fpecifying particulars unlefs required) under penalty of two hundred dollars.


By ACT of CONGRESS, for MAKING FURTHER PROVISION for the COLLECTION of DUTIES On TEAS, and to PROLONG the TERM


for PAYMENT of DUTIES On WINES, paffed the third .of March, 1791, it is directed,


That the importer of TEAS may give bond in double the amount of DUTIES, with conditions to pay the fame in two years, the teas to be depofited at the expence and rifk of the importer, with two keys to the ftore, one kept by the importer, the other by the infpector. Teas to be delive.

Duties on difilled Spirits.


red on payment to the inspector of duties, or on Securing payment by bond with furety, if not exceeding one hundred dollars in four months, one hundred to five hundred dol- lars in eight months, and exceeding five hundred dollars in twelve months --- provided the time does not extend beyond the two years originally allowed. For duties not paid in two years, the Collector may fell fo much of the teas as will pay the famc.


The Infpectors permits to go towards fatisfying bond to the Collector.


All teas imported after firft of April, 179!, from any fo- reign port, arc to be landed under care of Infpectors and permit from the Collector, produced to them, and endor- fed with the time when produced, before landing the teas, aud cach cheft, box or package to be marked by the Infpec- tor, with numbers and name of veffel imported in, and a certificate to be given by the Inspector, to accompany cach cheft or package.


Twelve months allowed by this Act for payment of De- TIES ON ALL OTHER WINES (as well as Madeira wine.)


DUTIES ON DISTILLED SPIRITS. After the last day of June, 1791, by Act of Congress of the 3d of March 1791.


The Duties heretofore layed on diftilled Spirits, imported from abroad are repealed.


On all Spirits imported, more than 10 per cent below proof, according to Dicas' Hydrometer

The Mafter of any Veffel having diftilled Spirits on board within 48 hours of arrival, to report the fame to one of the Infoectors of the port, under penalty of 500 Dollars.

The Duties to be paid or fecured before removed, at the option of the proprietor of Diftillery to be paid down with z cents per Gallon abatement, or the whole fecured by Lond payable quarterly.


Before removal the Officer to brand the number and name of Diftiller, place where fituate, quantity of Gallons and proof, and the Duties being paid, the Officer is to grant a Certificate which is to attend each Cafk on removal. If removed without fuch brand's and Certificate, the fame together whith Horfes, Carriages, Veffel or Boat employed in removal forfeited ; the Officer alfo forfeits the value of the Spirits.


No Spirts to be removed from Diftillery except between fun-rife and fun fet. except by confent of and In prefence of the Officer on pain of forfeitui e.


Stills employed in diftilling from materials of growth or product of United States, in any other place than a City, Town or Village, to pay 60 cents for every Gallon of fuch Still including the head.


Duties to be paid in the firff 15 days in January and July.


Proprietor of Stills keeping daily accounts of Spirits diftilled, may on proof by oath or affirmation pay 9 cents' per Gallon on the quantity diffilled, in lieu of duty on Stills


Dusis on defilled Spirits.


Diftillers froin foreign Materials, to have painted or written, in front of the houfe or building ufed for diftilling, and upon the door or entrance of the place where the li- quors are kept, the words " Diftiller of Spirits." And three days before diftilling to make entry of fach Diftillery and building under forfeiture of ico Dollars, and the Spirits.

Stock of Spirits on hand on ift July to be branded by the Officer " Old Stock " And on removal to be accompanied by Certificate from Officer on pain of forfeiting so Dollars.


Every importer of diftilled Spirits on ift july next or with- in three days, to enter all Spirits in poffeffion, to be mark- ed and accompanied with a Certificate in cafe of removal, as is directed above from Diftilleries, on failure of fuch entry to forfeit value of Spirits.


Any Calk with Spirits which ought to be marked, found in poffeflion without fach mark and Certificate may be ficzed and if not proved to have paid Duties or to have been diltilled as aforefaid, forfeited.


Officers in day time, on request may enter fuch Houfes, Stores, &c. entered as aforefaid and take an account and fample, on paying the ufual price for the fame.


For defacing the marks fet as aforefaid on any Cafk, the perfon to forfeit tce Dollars.


No Cafk marked "Old Stock" to be ufed for putting any other Spirits in, nor fhall Diftillers ufc fuch Cafks after 12 months on pain of forfeiting the Spirits, except Cafks of co5 Gallons and upwards not intended to be removed.


Spirits fraudulently hid or concealed are forfeited, and any Indge of United States or Juftice of the peace, on rea- fonable caufes of fufpicion by oath or affirmation inay by Warrant authorife the Officer in day time, in prefence of a Conftable, to enter and feize and carry away the famc.


After the laft of June next, no Spiritvous liquors except Gin or Cordials in cafes. jugs or bottles, to be brought from foreign ports in lefs Cafks than 50 Gallons, on pain of forfeiting Spirits, Veffel and Cargo, except Spirits not cxcccding 4 Gallons for each Seaman.


Every Diftiller of Spirits on which Duty is charged by the Gallon, is to keep a daily account of the Spirits which he fhall fell, fond ont or diftill, to be entered the day after in a book to be furnished them by the Supervifors on demand, and to be returded at the end of each year or when filled up to the Officer of Infection, and the truth of the entries verified by oath or affimation of the perfon making them ; the book to be open to the infpection of Surveyor, who may take minutes ; for every negleft or refufal to Keep fuch: book or fhew the fame, the Biftiller forfeits ico Dols


Penalties are not to extend to perfons having one Still only not exceeding 50 Gallons including the head.

Duties on diftilled Spirits.


· · Any Supervifor or Officer of infection convicted of op- preffion or extortion forfeits 500 Dollars, or imprifonment not exceeding 6 months or both and forfeits liis Office.


No fee to be taken for any Certificatc.


Supervifors or Infpectors neglecting to perform the du- ties enjoined, are fubject to damages to the party fuffering.


Actions for any thing done in purfuance of this Act, are to be commenced within 3 months, and in the County, un- lefs brought in a Court of the United States.


One half of the penalties and forfcitures are for benefit of the perfon making feizure or difcovering the offence.


Counterfeiting or forging Certificates under this Act, ac- cepting or fraudulently altering the fame, the perfon guilty forfeits 500 Dollars.


Taking falfe oath or affirmation, punifhable as for per- jury.


Giving or offering a bribe to Officers, the perfon forfeits not exceeding 500 Dollars.


For obftructing or hindering Officer in execution of his duty, or refcuing or attempting to refcue Spirits after fei- zure, forfeit not exceeding 200 Dollars.


Officer entering into collufion or concurring in fraudulent delivery of Spirits, or for falfe marks or guilty of fraud or embezzlement, forfeits 1000 Dollars, lofs of Office and dif- abled from holding any other Office.

DRAWBACKS.


On any of the Spirits charged with Duties by this Act on exportation, the Duties are to be allowed the exporter ex- cept half a Cent per Gallon, and adding to Spirits diftilled in the United States from Molaffes 3 Cents per Gallon, pro- vided 24 hours notice at leaft be given to the proper Officer of entries to export, and of the number, quantity and marks, place where then depofited and place to and Veffel in which they fhall be exported ; and on examination and if found right the Officer to brand each Cafk, &c. " Exported" and the fame to be fhipped in prefence of the Officer, who is to receive back the Certificate attending fuch Cafk, which he is to deliver to the Collector with a Certificate of fhip- ment, for voucher to pay fuch allowance ; the allowance not to be made unlefs the exporter makes oath or affirma- tion, that the Spirits are to be exported and not relanded, and that the Duties thercon have been paid or fecured and gives Bond with two fureties one of which the Mafter, that the Spirits fhall be landed in fome place out of the United States, and fhall not be relanded in the United States, fhipwreck or accident excepted. not to be paid until 6 months after exportation, and if the voyage of Veffel is altered, the Collector may grant per- mit to reland the fame.


Any Spirits fo exported and relanded in the United States (unlefs by permit from the Collector as aforefaid or in cafc of neceffity or dintrefs, to be immediately made known to principal Officer of Cuftoms) are forfeited with the Ship or Veffel, alfo the Veffel into which the fame may be put after unfhipping.


Drawbacks are not allowed unlefs the Spirits are fhip- ped in Veffels of thirty Tons and upwards.


The Bonds are to be difcharged by producing within one year if to Europe or America, or within two years if to Afia or Africa, a Certificate from the Agent or Conful of the United States if any, or if not from any two known and reputable American Merchants, refiding at the place, or if none, of two other reputable Merchants, of the deli- very of fuch Spirits, the Certificate to be confirmed by oath or affirmation of the Mafter and Mate of the Veffel, to be taken before the chief civil Magiftrate of the place of delivery, or before a perfon within United States qualified to adminifter oathis, and the fame is to include that two American Merchants were not to be found if none fuch are there. In cafe of lofs or capture, proof to made to the fatisfaction of the Collector alfo, where the proofs before. mentioned cannot be obtained when the Duties fhall not amount to one hundred Dollars and if upwards to the fa- tisfaction of the Comptroller of the Treafury.

And it is hereby further ordained and enacted by the au- thority aforefaid, that any waggoner, carter, drayman. porter, wood-fawyer or chimney-fweep, being in the faid city, and unemployed in any actual fervices, who fhall refufe to do and perform any of the fervices aforefaid, in their refpective bufineffes, or occupations, or fhall demand a higher price, or rate, for any fervice, than is hereby fet and afcertained. fhall forfeit and pay for every fuch offence, the fum of one dollar, to be fued for, and recovered before the Mayor or any Alderman-one half of which penalty fhall be for the ufe of this corporation, and the other for thic ufe of fuch perfons as fhall fue for the fame.
