States: THOMAS BRANDON and SAMUEL SIMPSON who were the securities for DAVID OLIPHANT and GEORGE GORDON, Administrators of the estate of JAMES OLIPHANT, decd. state in a petition that they fear they will injure in their suretyship by the way and manner DAVID OLIPHANT has conducted himself in the management of the. estate. He has taken the greatest part of the estate and removed the same to Charleston

without anytime rendered to the Court an account of his receipts and expenditures of said estate. DAVID OLIPHANT has been guilty of waste in said estate. It is ordered that the citation be served on said DAVID OLIPHANT by the sheriff of Charleston District summoning said OLIPHANT to appear before the Court of Ordinary in Union County on 17 July 1796 to answer charges.

States: That the administration of the estate of JAMES OLIPHANT, late of this county, decd. on 5 Jan 1793 was granted to DAVID OLIPHANT and GEORGE JORDAN as next of kin to the deceased. The court has decreed that the personal estate of said decd. should be publicly sold for cash on 2nd Monday in February to answer the emergencies of said estate. The greatest portion of the estate came into the hands of DAVID OLIPHANT who did not make returns or accountings to the court on the receipts and expenditures of the estate, there- fore he is to do so without further delay. This citation is to be served on said DAVID OLIPHANT by the sheriff of Charleston District requiring him to appear in Court at Union County on the 16th of July next with said accountings.

States: Is one of the administrators of the estate of JAMES OLIPHANT, late of the county of Union, decd. and District of Pinckney, Planter, decd.
That letters of administration granted him and DAVID OLIPHANT as next of kin in January, 1793.
That the estate was appraised and the Court ordered the same to be sold at the plantation of the deceased on the 2nd Monday in February following for ready money.
That the sale took place and that the following property was pur- chased of the estate VIZ 16 very valuable negroes, 4 horses, a large collection of books, and a wagon.
The reason for buying the property was because of the scarsity of cash in that part of the country and the property would not sell to the best advantage for the curators.
There were two executions against the estate that were not satis- fied.
The property was delivered into the hands of DAVID OLIPHANT and was to be taken by him down to Charleston as it would bring a better price there.
DAVID OLIPHANT was-suppose to sell the property and satisfy the debts and had entered into a written agreement saying he would do so.
DAVID OLIPHANT sold the property but did not pay the estate's debts neither does the deponant know how OLIPHANT desposed of the prop- erty but is apprehensive that he has converted it to his own use by his imprudence and bad conduct in the administration of the estate.
Said DAVID OLIPHANT never made any returns to him or the court of ordinary.
