UNION COUNTY, SOUTH CAROLINA


Some of the first settlements in the up-country (the western half of the state) were created from 1745 to 1760 by immigrants from the Rhine section of Germany, the northern colonies of the eastern seaboard, and the Ulster section of Ireland. However, it wasn't until 1753, 92 years later, after the settlement on the Ashley River (1671) that the Province became interested in attracting settlers into the up-country and a bounty was offered to stimulate immigration. This consisted of a 'headright' of a hundred acres for each man, with fifty acres for each woman and child. The government, moreover, supplied the arrivals with the "the most indis- pensable implements of agriculture". This offer from the government was just opportune for the Scotch-Irish from Pennsylvania and Virginia who had just reached the upper Piedmont valley by way of North Carolina.


About the year 1776 Fairforest Church became the center of activity for Union County. During the Revolutionary conflict the fairforest region of upper South Carolina was a hotbed of pro-British sentiment with the Loyalists outnumbering the Patriots. Open warfare broke out and Fairfor-

est Church became the headquarters for the Loyalist group. This had some effect on the scattering of its membership. After thw war, it became known as Padgetts Creek Baptist Church.


By an Act ratified in 1769, the Province of South Carolina was divid- ed into seven judicial districts : Charleston, Georgetwon, Beaufort, Orangeburg, Ninety-Six, Camden and Cheraws, but it wasn't until 1795 that Pinckney and Washington Districts were established. Pinckney embraced the present counties of Union and York and a part of Cherokee. Washington embraced the present counties of Greenville, Pickens, Oconee and Anderson.


In 1798 the nine districts then existing were divided up into twenty-


four . From Ninety-Six District the districts of Abbeville, Edgefield, Newberry, Laurens and Spartanburg were formed; from Washington District, Pendleton and Greenville Districts were formed; from Pinckney District the districts of Union and York were formed; from Camden District, Chester, Lancaster, Fairfield, Kershaw and Sumter Districts were formed; from Cheraws District, Chesterfield, Darlington. and Marlborough Districts were formed. The district names of Ninety-Six, Washington, Pinckney, Camden and Cheraw were discarded.


From a genealogical standpoint it is important that the researcher understand the make-up of these judicial districts.

THOMPSON, and her children by her first husband, JACOB HOLMES.


No partition of the aforesaid lands had been made in the life- time of said MARY THOMPSON, whereupon WILLIAM THOMPSON and his daughter, LUCINDA B. THOMPSON became entitled to a distri- bution of 2 shares of the above lands with the children of JACOB HOLMES, decd.

On Aug. 1809 ELIZABETH FOSTER, widow, died intestate. Two of said children, SALLY and CLEMMENT, have died intestate since the death of their father, leaving only JOHN, ISAAC, JAMES, JOSIAH, WILLIAM, SINGLETON, ALLEN, ELIZABETH and SUSAN as heirs.

Date : 3rd Monday in Oct 1811


States: GIDEON GLENN of Chester District at his death possessed a per- sonal est. of a negro called BRISTER, two negro girls, DICY and SEAL. Said girls since death of said GIDEON have each . had a child. Also said GIDEON at time of his death had con- siderablo personal estate and died leaving a will.

JESSE SANDLIN Petition for Habeas Corpus


Date: 18 Oct 1814


States : The petitioner, JESSEE SANDLIN, is now confined to the custody of SPARKS, a Lieutenant in the U. S. Army, as an en- listed man.


The petitioner never received the bounty money from the U.S. or any part thereof from Lt. SPARKS or any other person author- ized to give the bounty " .. when he was in his senses and cap- able of acting for himself and that he never was sworn in when at himself nor does he believe that he ever did either receive the bounty or was sworn in regularly as a soldier or enlist. .. "


Court demands Lt. SPARKS bring petitioner before the court on 18th of Oct and declare why he is detained.

States : That he never enlisted in U. S. Army as a soldier to his re- collection. That if he did he must have been intoxicated. When he became sober he found '$5 in his pocket, but didn't know how it got there.

Affidavit of LT. CHARLES A SPARKS


Date: 22 Oct 1814


States: That JAMES V. THOMAS put money into the hands of said SANDLIN in consideration of his enlisting.


Said THOMAS has departed the District under the command of COL. MEANS.


SANDLIN is being held until testimony of said THOMAS is avail- able.


Affidavit of COL. WILLIAM JOHNSON


Date: 18 Oct 1814


States : He was present when JESSE SANDLIN enlisted by JAMES V. THOMAS and saw him give him the money which was the bounty money. That SANDLIN was so drunk that in his opinion he did not know what he was doing and believes SANDLIN was incapable of making any contract.


Believes SANDLIN, because of age and infirmity, would be un- able to perform the duties of a camp. :


Affidavit of WILLIAM HOBSON

Date: 20 October 1814


States : He has known JESSE SANDLIN, JR. for 10 years.


That he has lived on HOBSON's plantation for about 7 years. That SANDLIN drinks a lot and when in that condition is not capable of making a contract.


That said SANDLIN is an infirm man with a withered hand and spits blood in great amounts.


That from his appearance said SANDLIN must be 50 years old or more.


Affidavit of JESSE BROWNING


Date: 20 October 1814


States:


He was present on the 1st day of this month at Lissy's old fields and saw JESSEE SANDERLIN and a "Listing" officer and NATHAN MANS request SANDERLIN to sign a paper. SANDERLIN refused and said he wanted to get off.


They told SANDERLIN that it wouldn't hinder him getting off so SANDERLIN signed.


After SANDERLIN had gone they said they had fixed him at last.


Affidavit of MAJOR D. THOMAS


Date : 20 Oct 1814


States :


He has known JESSE SANDLIN, SR. 12-14 years.


That SANDERLIN drinks a great deal and when in that condition is not capable to act for himself.


That he had seen him that same day he enlisted and he was drunk and not capable of making a contract.


That SANDLIN was 50 years old or older and infirm with rheumat- ism.


Affidavit of LITTLETON CONNELLY


Date: 21 Oct 1814


States : That 1 or 2 days before JAMES V. THOMAS enlisted JESSE SANDLIN he heard THOMAS say, " ... that he would go and get old SANDLIN drunk and swore he would enlist him and his son ... ".


Deponent tried to persuade him not to to which THOMAS said he

. " .. was enlisted and he would be damned if he did not carry as many with him as he could ... "


Result of hearing: Court demands that JESSEE SANDLIN be discharged im- mediately.

FRANCIS FINCHER and wife Writ of Partition


Date: 3rd Monday in Oct 1813


States: DAVID SMITH died on 6 Mar 1806 intestate.


At time of his death he was possessed of following tracts of ."land: 1)2015 ac. lying in Union District, S.C. between the Enoree and Tyger Rivers on waters of Tyger River; 2) 50 ac. between Enoree and Tyger River.


Heirs: SARAH SMITH, widow, now SARAH FINCHER (who since the "death of DAVID SMITH married FRANCIS FINCHER) and 4 children: MATTHEW, JOHN, HANNAH and ELIZABETH SMITH, minors under the age of 21 years.


Commissioners : FRANCIS F. GIST, ISAAC PEARSON, BIRD MURPHY, DANIEL WIL- BANKS, MICHAEL TROUTMAN.

.. JOHN HARRINGTON left a will of which Y. I. HARRINGTON, Esqr. is the executor of the will of DAVID SMITH, who was the executor of the will of JOHN HARRINGTON.


That JOHN HARRINGTON sized at the time of the death in his own right 600 acres on Gilkie (?) and Abbington Creek adjoining the lands of MORGAN, ABRAHAM GUYTON, NICHOLAS COREY, JOHN JEFFREY and others.


Commissioners: NICHOLAS COREY, Esqr., DRURY HARRINGTON, JAPTHA HARRING- TON, JOHN JEFFREY, Esqr., JOSEPH MOORHEAD.


Results : Commissioners decided land should be sold and the money divided among heirs.
