Foreword


In undertaking the modernizing of a town report that had not been changed in appearance to any great extent in several years, I fully realized that many difficulties would be forthcoming. The instruction and experience that I received at the University of Massachusetts in a course in the study of municipal governments, however, aided me greatly in effecting the modernizing of our town report.


Through the co-operation of the other members of the Board of Selectmen and the heads of the Town Depart- ments, this volume, I believe, presents the annual reports of your town officers in a more attractive, interesting, and informative manner. May it also serve to show that Mil- ford is a friendly and progressive community, that ex- tends a cordial welcome to prospective industries and residents who wish to come to Milford and prosper.

Report of your Board of Selectmen


The Board of Selectmen is pleased to submit the following report of its main accomplishments during the past year as they more directly affect the townspeople.


Street Lighting


The lighting of the town's streets and sidewalks in past years has not been as good as might be desired. This year, new lights have been installed on Main Street from Water Street to the Hopedale town line and all along East Main Street to Medway Road. Also, throughout the town a change has been made in that bulbs having 100 candlepower have been installed in place of the older ones which were only of the 60 candlepower variety. As a result, the streets and sidewalks of Milford are better lighted now than ever before. This, naturally, tends to decrease the traffic hazard to a great extent. The newly installed lights are a vast improvement and much favorable reaction has been received. Plans have been made for the installation of new shades through- out the town, which will give still better lighting without further cost.


Water


Certain outlying sections of the town have been without water. It is with pleasure that we report that extensions of water mains have been made on Cuniff Avenue, Highland Street, and Upper West Street.


Bus Terminal


For many years Milford has been without a Bus Terminal. We are more than pleased to report that because of our efforts the Johnson Bus Lines, Inc., now have a terminal which accom- modates local and out-of-town shoppers. Needless to say, this terminal will undoubtedly attract more shoppers from surrounding towns, thus bringing more business to the town of Milford. It is desirably and conveniently situated at the corner of School and Pine Streets. This location will eliminate the serious traffic hazard which has existed at Lincoln Square for a long time.

BOARD OF SELECTMEN


Housing


A representative committee was named to investigate the existing housing shortage. The committee members unselfishly gave much of their time and experience in an effort to work out a suitable plan to alleviate the present shortage. A plan was sub- mitted for approval at a special Town Meeting but it was rejected. The plan turned down was one which was formulated under Chap. 372, Acts of 1946, and amendments thereto.


Taxes


When one considers that there was an increase in the tax rate for the year 1947 in almost every municipality in the Common- wealth, it is comforting to know that the Milford tax rate for 1947 was actually reduced. The untiring efforts of our Finance Com- mittee, together with the cooperation of the various town depart- ments, were a major factor in bringing about this most highly satisfying result.


General


1. A permit was granted to the Johnson Bus Lines, Inc., for intown bus service. It is hoped that this additional service will be of benefit to the sections of the town which have been without it.


2. Pine Street, Congress Street from West Pine to West Street, and lower Central Street, have been designated as streets when parking on one side only is permitted. In taking this course, the Board sought the advice of the Police Chief, Fire Chief, and W. W. O'Brien, motor vehicle investigator. The Board strongly believes that serious traffic and fire hazards have been eliminated as a result.


3. In past years there were no signs to warn a motorist that he was approaching a school where children might be crossing the street. The Board took action by having suitable warning signs installed at appropriate locations. This action has resulted in further protection for our school children.


In conclusion, the Board desires to state that it believes much has been accomplished under the present administration and, as a result, Milford has become a better town in which to live. It realizes that much remains to be done. It knows, however, that the people of Milford are not only patient but also intelligent enough to realize that all that remains to be done could not have been done in the course of a single year. Hence, it is our sincere hope that future selectmen, whoever they may be, will strive to make our town a still better one in which to live and a town of which we may all be justly proud.

Report of your Jown Counsel


Notice of ten new claims for personal injuries or property damage against the Town were received as compared with 9 in 1946 and 7 in 1945. Three suits for damages were filed in Worces- ter Superior Court. Appearances were filed on behalf of the Town in 9 cases pending against the Town, and 3 pending cases in which the Town is the plaintiff. Answers and claims for jury trial were filed in these three suits. Only two claims were settled without suit having been brought. For the year 1947, $1,500 was appropriated in the March meeting for the Town Counsel's Depart- ment. Of this amount, $1,225.88 had been expended before I assumed office in March, leaving a balance of $274.12 for the remaining 10 months of the year. For this reason only two claims were settled during the past 10 months. Hence, for this and other reasons, I will recommend that an additional amount be appropri- ated to this account so that legitimate claims, new or pending, may be adjusted where possible and advisable.


In 1947, 30 notices of tax taking of properties for unpaid real estate taxes were prepared at the request of the Tax Collector, as compared with 9 notices in 1946; 6 instruments of redemption were prepared in 1947, the same number as in 1946 and the two preceding years. Two instruments of taking and one disclaimer of tax title were also prepared.


Under a new policy established by the present Board of Select- men with the co-operation of the Town Treasurer, no one was allowed to redeem land where there had been a taking by the Town unless the person redeeming was the owner or an immediate

member of the owner's family. In the latter case, the person redeeming had to show that the owner was either (a) deceased or (b) had no further interest in the land taken.


Three parcels of land which had been foreclosed were sold at public auction to the highest bidder and deeds were prepared and delivered to the new owners. One parcel of land was transferred to a veteran under authority of Article 31.


Of the welfare pending cases with Boston and Worcester, investigation revealed that judgment had been entered in favor of the Town, and hence there are at present 4 pending cases.


Hearing was had on the mandamus case against the Board of Health, and the matter was referred to the master for further hear- ing and report. As a sequel to this case, tort actions were entered against the individual members of the Board of Health in which the plaintiff seeks damages in the amount of $25,000.00. These cases are pending in Suffolk Superior Court.


A criminal complaint brought by the Plumbing Inspector in District Court against an individual for plumbing without a license was prosecuted by this department. The case had not been com- pleted at the time of this report.


Numerous written opinions have been rendered the various Town Departments. In view of the Commonwealth vs. Gilfedder case and my opinion to the Park Commissioners on September 11, 1947, this department has recommended a change in Article 22, Section 19 of our by-laws. Deeds, releases, contracts between the Town and third parties have also been prepared and executed.


Considerable study has been given to the legal problems which are present in connection with the parking meters. It is expected that these problems will be discussed at our Annual Town Meeting under an article pertaining to the acquisition, installation, main- tenance and operation of the parking meters.
