Report of the Selectmen for the Year 1939


Since the report of the Board at the end of 1938, the Board has been filled by the addition of a new member to its normal complement of three members. This has enabled your Board to function with the least possible friction and delay, since it is composed of three inde- pendent individuals with no permanent majority alignment, so that decisions in all matters before the Board can readily be disposed of, if not unanimously, by the agreement of any two of the independent members.


The Board has undertaken an innovation which has been very well received by the public, in making and publishing monthly reports of the financial condition of the various departments. This has served to keep the voters and taxpayers currently informed of progress from one annual meeting to the next. The summarization of these monthly re- ports will indicate the very gratifying progress which has been made in the handling of the town's financial affairs, in a manner which will result in the return to the town of several substantial unexpended bal- ances of annual appropriations. We take this opportunity to congratu- late all of the departments which have cooperated to produce this result.


The Selectmen have cooperated with the Chamber of Commerce on at least three important matters. They have done all in their power to attract new industries to Braintree, with the result that two large new plants have been located here within the past year. The transpor- tation problem, with particular reference to the railroad, has received their attention, and one member of the Board, together with the Town Counsel, is now working on that problem in conjunction with the Old Colony Commuters' League. They have also considered and will pre- sent to the Town Meeting, in conjunction with the Chamber of Com- merce, a program for the establishment of parking places adjacent to the shopping centers of the Town.


In conjunction with the parking problem, which is constantly in- creasing in importance, the Board has spent much time in the prepara- tion of a code of traffic and parking regulations for the Town which awaits the approval of the State Department of Public Works before being made effective.


The Board has uniformly opposed billboard advertising along our highways which would impair the beauty of the Town. In this con- nection, they have also required improvements and beautifications of certain business premises operating under permit from the Board.


The Board has held for the convenience of the citizens, regular meetings twice a month and special meetings whenever required. On the problems presented to the Board, they have acted in the best inter- ests of the Town as they have determined that interest to exist and will continue to do so, welcoming any constructive suggestions from the citi- zens as to the management of their affairs.

Norfolk, ss. To either of the Constables of the Town of Braintree. Greetings:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote in elections therein, to meet at the polling places in their respective Precincts, to wit:


Polling Place in Precinct 1, Noah Torrey School.


Polling Place in Precinct 2, Town Hall.


Polling Place in Precinct 3, Legion Building.


Polling Place in Precinct 4, Penniman School.


Polling Place in Precinct 5, Hose House, Allen Street.


Polling Place in Precinct 6, Thomas Watson School.


On Monday, the sixth day of March, 1939, at five forty-five o'clock in the forenoon, then and there to bring in to the Wardens of their respective Precincts their votes on the official ballot for a Moderator, Town Clerk, a Town Treasurer, one Selectman for a term of three years, one Selectman for a term of one year to fill vacancy, one member of the Board of Public Welfare for a term of three years, one member of the Board of Public Welfare for a term of one year to fill vacancy, one member of the Board of Assessors for a term of three years, one Water Commissioner and Commissioner of Sinking Funds for a term of three years, two members of the School Committee for a term of three years, one member of the Municipal Lighting Board for a term of three years, one member of the Board of Health for a term of three years, one Sewer Commissioner for a term of three years, one Park Commissioner for a term of three years, a Tax Collector, a Tree Warden, two members of the Planning Board for a term of three years, fifteen Constables, and two hundred and forty Town Meeting Members as follows: Thirty-nine members from Precinct 1; forty-two members from Precinct 2; forty- two members from Precinct 3; forty-two members from Precinct 4; thirty-nine members from Precinct 5; and thirty-six members from Precinct 6.


The polls will be opened at five forty-five o'clock in the forenoon and will be closed at eight o'clock in the evening.


You are further directed to notify and warn the said inhabitants qualified to vote as aforesaid, to meet at the Town Hall in said Braintree on Monday, the thirteenth day of March, 1939, at seven forty-five o'clock in the evening, then and there to act upon the following articles, namely :

Article 1. To choose all Town Officers, except those elected by ballot.


Article 2. To hear and act upon the report of the several boards of Town Officers, and committees, and choose any committee the Town may think proper.


Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Article 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with the provisions of Sec- tion 17, Chapter 44, General Laws.


Article 5. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for general municipal purposes under the authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933, as amended, or take any action relative thereto.


Article 6. To see if the Town will hold its Treasurer harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


Article 7. To see if the Town will hold its Collector harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


Article 8. To see if the Town will vote to raise or borrow and ap- propriate a sum of money for a Reserve Fund for extraordinary and unforeseen expenditures during the current year.


Article 9. To see what sums of money the Town will vote to raise or borrow and appropriate for Interest and Maturing Debt the present year, or take any action relative thereto.


Article 10. To see what sums of money the Town will vote to raise or borrow and appropriate for Insurance on Town property and Work- ingmen's Compensation, or take any action relative thereto.


Article 11. To see what sum of money the Town will vote to raise or borrow and appropriate for the Norfolk County Hospital Assessment, for maintenance and repairs.


Article 12. To see what sums of money the Town will vote to raise or borrow and appropriate for Street Lighting, to wit - $12,500.00.


Article 13. To see if the Town will vote to raise or borrow and appropriate a sum of money for the payment of printing and dis- tribution of the Annual Report of the Town of Braintree for 1938.


Article 14. To see what distribution the Town will vote to make of the income of the Thayer Fund.


Article 15. To see what sums of money, in addition to that appro- priated under any other article, the Town will vote to raise or borrow and appropriate for Land Damages.

SCHOOLS AND LIBRARIES


Article 16. To see what sums of money the Town will vote to raise or borrow and appropriate for the support of the Public Schools for the present year, or take any other action relative thereto.


Article 17. To see if the Town will vote to raise or borrow and appropriate a sum of money for the purpose of purchasing, or taking, land in Precinct Three; said land being Lot 8 on Assessors' Plan, Num- ber 2031, Plot 24, consisting of 5394 square feet, on Weston Avenue, or take any other action relative thereto.


Article 18. To see if the Town will vote to raise or borrow and appropriate sums of money for the purpose of constructing, furnishing, and equipping an addition to the High School, and for the making of additions, alterations, and repairs to the present building, and to author- ize the Treasurer, with the approval of the Selectmen, to borrow all, or any part of said sums and to authorize the proper officers to take any steps which may be necessary to secure an allotment of Federal funds under P. W. A. or other Federal agency, to supplement any appropri- ation made by the Town; or take any other action relative thereto.


Article 19. To see what sums of money the Town will vote to raise or borrow and appropriate for the Public Library, the present year, or take any action relative thereto.


GENERAL GOVERNMENT


Article 20. To see what sums of money the Town will vote to raise or borrow and appropriate for General Government for salaries and ex- penses for the following department and other purposes, the present year, or take any action relative thereto.

P. A. activities or other Special Aid projects in conjunction with State or Federal Government as may be approved by the Finance Committee, or take any action relative thereto.


Article 22. To see what further sums the Town will vote to raise by taxation and appropriate to meet certain incidental and miscellaneous expenses not otherwise provided for, namely, General Government In- cidentals, the same to be in addition to any sums previously appropriated for said purposes.

PROTECTION OF PERSONS AND PROPERTY


Article 23. To see what sums of money the Town will vote to raise or borrow and appropriate for the protection of persons and property the present year, or take any action relative thereto.


1. Life Guard at Sunset Lake.


2. Building Inspector.


3. Sealer of Weights and Measures.


4. Tree Warden's Department.


5. Moth Department.


6. Fire Department.


7. Police Department.


HEALTH AND SANITATION


Article 24. To see what sums of money the Town will vote to raise or borrow and appropriate for Health and Sanitation the present year, or take any action relative thereto.


Article 25. To see what sums of money the Town will vote to raise or borrow and appropriate for the maintenance and operation of the Water Department, including interest and debt on Water Loans, the same to be taken from the revenue of the Department, and the unex- pended balance of 1938, or take any action relative thereto.


Article 26. To see if the Town will vote to appropriate from the income of the Water Department, the sum of $300.00, for the salaries of the Water Commissioners.


Article 27. To see if the Town will vote to appropriate from the income of the Electric Light Department, the sum of $300.00, for salaries of the Electric Light Commissioners.


Article 28. To see if the Town will vote to include in the Tax Levy for electricity used for street lighting the sum of $12,500.00 as appropriated under Article 12 of the Warrant for the 1939 Annual Town Meeting, and that said sum together with the income from sales of electricity to private consumers, or for current supplied to Municipal Building or for Municipal Power, and from sales of appliances and job- bing during the current fiscal year, to be appropriated for the use of the Municipal Light Plant, the whole to be expended under the direction and control of the Municipal Light Board for repairs, renewals, new con- struction and operating expenses of the plant for the present fiscal year, as defined in Section 57 of Chapter 164 of the General Laws, and that, if said income shall exceed the expense for the fiscal year, such excess shall be transferred to the construction fund of said plant and appropri- ated and shall be used for such additions to the plant as may thereafter be authorized by the Municipal Light Board.


Article 29. To see what sum or sums of money the Town will vote to raise and appropriate for the purposes of the Sewer Department, to be expended by the Board of Sewer Commissioners, or take any action relative thereto.


Article 30. To see if the Town will vote to raise and appropriate the sum of $300.00 for salaries of the Board of Sewer Commissioners.


RECREATION


Article 31. To see what sums of money the Town will vote to raise or borrow and appropriate for the general use of the Board of Park Commissioners the coming year, or take any action relative thereto.

CEMETERIES


Article 32. To see what sums of money the Town will vote to raise or borrow and appropriate for the improvement of the Cemetery the present year, or take any action relative thereto.


Article 33. On Petition. To see if the Town in accordance with Chapter 114, Section 34 of the General Laws, will authorize the use of the following parcel of land for burial purposes as an extension of the present Blue Hill Cemetery. A certain parcel of land situated in said Braintree, bounded and described as follows: Westerly by a Way forty feet wide, shown on the plan hereinafter referred to twelve hundred forty-six and 71/100 (1246.71) feet; Northeasterly, six hundred seven and 44/100 (607.44) feet; and Northerly twelve hundred sixty-six and 42/100 (1266.42) feet by land now or formerly of Robert L. Ryder; Northeasterly by land now or formerly of Peter Cahill, two hundred fifty-six feet; Southeasterly by land now or formerly of Blue Hill Cemetery, four hundred sixty-six and 70/100 (466.70) feet; and South- erly by land of said Blue Hill Cemetery, twenty-one hundred fifty-two and 15/100 (2152.15) feet. Said parcel is shown as lot A on a plan drawn by Roland H. Barnes and Henry F. Beal, Civil Engineers, dated February 1938, filed in the Norfolk Registry District of the Land Court as plan number 11973-B with Certificate of Title No. 21843.


SOLDIERS' BENEFITS


Article 34. To see what sums of money the Town will vote to raise or borrow and appropriate for Soldiers' Relief, State Aid and Military Aid the present year, or take any action relative thereto.


PUBLIC WELFARE


Article 35. To see what sums of money the Town will vote to raise or borrow and appropriate for the Public Welfare Department, including Aid for Dependent Children, and Adequate Assistance to Certain Aged Persons under the provisions of Chapter 118A, Acts of 1931, or take any action relative thereto.


HIGHWAYS


Article 36. To see what sums of money the Town will vote to raise or borrow and appropriate for the support of the Highway Department, including labor, repairs to highways, Town Ways and Bridges; also, for repairs and building sidewalks, stone roads and removal of Snow, Oiling and Tarring of Streets; purchase of equipment for said department, or take any action relative thereto.


Article 37. On Petition. To see if the Town will vote to accept as and for a Town Way, Argyle Road, so-called, from Pleasant View Avenue to Glenrose Avenue, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way; or take any action relative thereto.


Article 38. On Petition. To see if the Town will vote to accept as and for a Town Way, Putnam Avenue, so-called, from Cleveland Avenue 292 feet easterly as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W. P. A. Project; or take any action relative thereto.

Article 39. On Petition. To see if the Town will vote to accept as and for a Town Way, Wayne Avenue, so-called, from Pond Street to Logan Road; and Logan Road from Wayne Avenue to Hoover Road; and Hoover Road from Logan Road to St. Michael Road as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of said way under a W. P. A. Project; or take any action relative thereto.


Article 40. On Petition. To see if the Town will vote to recon- struct Hayward Street from Howard Street easterly to Quincy Avenue, and raise or borrow and appropriate a sum of money for the same, or take any action relative thereto.


Article 41. On Petition. To see if the Town will vote to accept as and for a Town Way, Spencer Street, so-called, from Trefton Drive to Arborway Drive, as laid out by the Selectmen; and raise and appro- priate a sum of money for the improvement of said way, or take any other action relative thereto.


Article 42. On Petition. To see if the Town will vote to accept as and for a Town Way, Faulkner Place, so-called, 730 feet westerly from Washington Street as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W. P. A. Project; or take any action relative thereto.


Article 43. On Petition. To see if the Town will vote to accept as and for a Town Way, Perry Road, so-called, from Burroughs Road to Bower Road, a distance of approximately 172 feet, as laid out by the Selectmen; and raise and appropriate a sum of money for the im- provement of the said way under a W. P. A. Project; or take any action relative thereto.


Article 44. On Petition. To see if the Town will vote to widen Common Street from Washington Street to Sunnyside Avenue, so that it may have a uniform width of forty feet; or take any action relative thereto.


Article 45. On Petition. To see if the Town will vote to accept as and for a Town Way, Sunnyside Avenue, so-called, from the end of Common Street, so-called, approximately 1000 feet westerly, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 46. On Petition. To see if the Town will vote to widen Hobart Avenue, from Washington Street westerly to Tremont Street and Tremont Street southerly to Central Avenue, beginning at Hobart Avenue; and raise and appropriate a sum of money for the same or take any action relative thereto.


Article 47. On Petition. To see if the Town will vote to accept as and for a Town Way, Wilkins Road, so-called, from present line of acceptance to North Bowditch Street, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.
