In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote in elections therein, to meet at the polling places in their respective Precincts, to wit:


Polling Place in Precinct 1, Noah Torrey School. Polling Place in Precinct 2, Town Hall.

On Monday, the fourth day of March, 1940, at five forty-five o'clock in the forenoon, then and there to bring in to the Wardens of their re- spective Precincts their votes on the official ballot for a Moderator; Town Clerk; a Town Treasurer; one Selectman for a term of three years; one member of the Board of Public Welfare for a term of three years; one member of the Board of Assessors for a term of three years; one Water Commissioner and Commissioner of Sinking Fund for a term of three years; two members of the School Committee for a term of three years; one member of the Municipal Lighting Board for a term of three years; one member of the Board of Health for a term of three years; one Sewer Commissioner for a term of three years; one Park Commissioner for a term of three years; a Tax Collector; a Tree Warden; two members of the Planning Board for a term of three years; one member of the Planning Board for a term of two years to fill vacancy; two Trustees of Thayer Public Library for a term of two years; and eighty-four Town meeting members as follows: Thirteen Town Meeting members in Precinct 1 for a term of three years; four- teen Town Meeting members in Precinct 2 for a term of three years; fourteen Town Meeting members in Precinct 3 for a term of three years; fourteen Town Meeting members in Precinct 4 for a term of three years; one Town Meeting member in Precinct 4 for a term of two years to fill vacancy; one Town Meeting member in Precinct 4 for a term of one year to fill vacancy; thirteen Town Meeting members in Precinct 5 for a term of three years; one Town Meeting member in Precinct 5 for a term of one year to fill vacancy; twelve Town Meeting members in Precinct 6 for a term of three years; one Town Meeting member in Precinct 6 for a term of one year to fill vacancy.

The polls will be opened at five forty-five o'clock in the forenoon and will be closed at eight o'clock in the evening.


You are further directed to notify and warn the said inhabitants qualified to vote as Town Meeting members, to meet at the Town Hall in said Braintree on Monday, the eighteenth day of March, 1940, at seven forty-five o'clock in the evening, then and there to act upon the following articles, namely :


Article 1. To choose all Town Officers, except those elected by ballot.


Article 2. To hear and act upon the report of the several boards of Town Officers, and committees, and choose any committee the Town may think proper.


Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Article 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1941, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with the provisions of Section 17, Chapter 44, General Laws.


Article 5. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for general munici- pal purposes under the authority of and in accordance with the pro- visions of Chapter 49 of the Acts of 1933. as amended, or take any action relative thereto.


Article 6. To see if the Town will hold its Treasurer harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Select- men.


Article 7. To see if the Town will hold its Collector harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


Article 8. To see if the Town will vote to raise or borrow and appropriate a sum of money for a Reserve Fund for extraordinary and unforeseen expenditures during the current year.


Article 9. To see what sums of money the Town will vote to raise or borrow and appropriate for Interest and Maturing Debt the present year, or take any action relative thereto.


Article 10. To see what sums of money the Town will vote to raise or borrow and appropriate for Insurance on Town property and Work- men's Compensation, or take any action relative thereto.


Article 11. To see what sum of money the Town will vote to raise or borrow and appropriate for the Norfolk County Hospital Assess- ment, for maintenance and repairs.

Article 12. To see what sum of money the Town will vote to raise and appropriate to defray the expenses of the Three Hundredth Anniversary Celebration for Braintree, the same to be expended under the supervision of the Special Committee appointed under Article 53 of the 1934 Annual Town Meeting, or take any action relative thereto.


Article 13. To see if the Town will vote to appropriate the sum of $88.87 to be used by the Tercentenary Committee in 1940, the same to be taken from the so-called Tercentenary Fund, or take any action relative thereto.


Article 14. To see if the Town will vote to raise and appropriate a sum of money to celebrate the Three Hundredth Anniversary of the Incorporation of the Town by the erection of a suitable tablet, or take any other action relative thereto.

HEALTH AND SANITATION


Article 17. To see what sums of money the Town will vote to raise and appropriate for Health and Sanitation, or take any action relative thereto.


Article 18. To see what sums of money the Town will vote to raise or borrow and appropriate for the maintenance and operation of the Water Department, including interest and debt on Water Loans, the same to be taken from the revenue of the Department, and the unex- pended balance of 1939, or take any action relative thereto.

Article 19, To see if the Town will vote to appropriate from the income of the Water Department, the sum of $300.00, for the salaries of the Water Commissioners.


Article 20. To see if the Town will vote to place under the exclu- sive control of the Water Department two parcels now held by the Town on tax title foreclosure proceedings and described as follows :


1. A lot formerly owned by Dennis Crowley and Michael Shea, designated as Plot No. 1 on Plan No. 2054 on file in the Assessors' Office; and


2. A parcel formerly owned by J. L. Emery and shown as Plots No. 1 and No. 2, Lots No. 314 and No. 315 on Plan No. 1053 on file in the Assessors' Office; or take any other action relative thereto.


Article 21. To see if the Town will vote to appropriate from the income of the Electric Light Department, the sum of $300.00, for salaries of the Electric Light Commissioners.


Article 22. To see what sums of money the Town will vote to raise and appropriate for Street Lighting.


Article 23. To see if the Town will vote to include in the Tax Levy for electricity used for street lighting the sum of $13,000.00 as appro- priated under Article 22 of the Warrant for the 1940 Annual Town Meeting, and that said sum together with the income from sales of electricity to private consumers, or for current supplied to Municipal Power, and from sales of appliances and jobbing during the current fiscal year, to be appropriated for the use of the Municipal Light Plant, the whole to be expended under the direction and control of the Municipal Light Board for repairs, renewals, new construction and operating expenses of the plant for the present fiscal year, as defined in Section 57 of Chapter 164 of the General Laws, and that, if said income shall exceed the expense of the fiscal year, such excess shall be transferred to the construction fund of said plant and appropriated and shall be used for such additions to the plant as may thereafter be authorized by the Municipal Light Board.


Article 24. To see if the Town will vote to place under the exclu- sive control of the Electric Light Department a parcel of land now held by the Town on Tax Title foreclosure proceedings described as follows: Lots 20, 21, and part of 22, Plots 61 and 62, on Plan No. 1028 on file in the Assessors' Office, containing approximately 12,500 square feet of land, or take any action relative thereto.


Article 25. To see what sum or sums of money the Town will vote to raise and appropriate for the purposes of the Sewer Department, to be expended by the Board of Sewer Commissioners, or take any action relative thereto.


Article 26. To see if the Town will vote to raise and appropriate the sum of $300.00 for salaries of the Board of Sewer Commissioners.


Article 27. To see if the Town will vote to abandon its easement for sewer purposes through and over land of John E. Buckley et al., running from the northerly side of Union Street to the southerly line of the highway at the new under-pass, so-called, or take any action rela- tive thereto.


PARK DEPARTMENT


Article 28. To see what sums of money the Town will vote to raise and appropriate for the general uses of the Board of Park Commission- ers, or take any action relative thereto.

Article 29. To see if the Town will vote to set apart a portion of Watson Park, on lease, or otherwise, for the use of the Braintree Yacht Club; or take any action relative thereto.


CEMETERIES


Article 30. To see what sums of money the Town will vote to raise and appropriate for the improvement of the Cemetery, or take any action relative thereto.


Article 31. To see if the Town will vote to accept the Charles C. Hill Trust Fund of $100.00, the income to be used for the care of Lot No. 70 in Plain Street Cemetery, or take any action relative thereto.


SCHOOLS & LIBRARIES


Article 32. To see what sums of money the Town will vote to raise and appropriate, for the support of the Public Schools, or take any other action relative thereto.


Article 33. To see if the Town will vote to raise, or borrow, and appropriate sums of money for the purposes of constructing, furnish- ing, and equipping an addition to the High School, and for the making of additions, alterations, and repairs to the present building, and to authorize the Treasurer, with the approval of the Selectmen, to borrow all, or any part, of said sums in accordance with the provisions of any General or Special Acts authorizing the Town to borrow for said pur- poses, or take any other action relative thereto.


Article 34. To see what sums of money the Town will vote to raise and appropriate for the Public Library, or take any action relative thereto.


SOLDIERS' BENEFITS


Article 35. To see what sums of money the Town will vote to raise and appropriate for Soldiers' Relief, State Aid and Military Aid, or take any action relative thereto.


Article 36. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day, or take any action relative thereto.


PUBLIC WELFARE


Article 37. To see what sums of money the Town will vote to raise and appropriate for the Public Welfare Department, including Aid for Dependent Children, and Adequate Assistance to Certain Aged Persons under the provisions of Chapter 118A, Acts of 1931, or take any action relative thereto.


HIGHWAYS


Article 38. To see what sums of money the Town will vote to raise and appropriate for the support of the Highway Department, including labor, repairs and building sidewalks, stone roads and removal of Snow, repairs to highways, Town ways and Bridges; Oiling and Tarring of Streets; purchase of equipment for said department; and collection of rubbish; or take any action relative thereto.


Article 39. To see what sums of money the Town will vote to raise and appropriate for the repair, maintenance and opening of the Quincy Avenue Draw-Bridge, or take any action relative thereto.

Article 40. To see if the Town will vote to accept Lincoln Street, east from Liberty Street, a distance of six hundred ninety (690) feet as laid out by the Selectmen, or take any other action relative thereto.


Article 41. On Petition. To see if the Town will vote to accept for and as a Town way, BERWICK STREET, so-called, as laid out by the Selectmen, and raise and appropriate a sum of money for the improve- ment of said way under a W.P.A. Project, or take any action relative thereto.


Article 42. On Petition. To see if the Town will vote to accept AUDUBON AVENUE, from Ferncroft Road to Vinedale Road, a dis- tance of about six hundred (600) feet, as laid out by the Selectmen, or take any other action relative thereto.


Article 43. On Petition. To see if the Town will vote to accept NEWTON AVENUE, so-called, from the present point of acceptance to Bickford Road, as laid out by the Selectmen, or take any action relative thereto.


Article 44. On Petition. To see if the Town will vote to accept as a Town way SAGAMORE STREET, as laid out by the Selectmen or that portion of it that may be improved by a W.P.A. Project.


Article 45. On Petition. To see if the Town will vote to raise and appropriate a sum of money for the Construction of Sidewalks on Dewey Road from Quincy Avenue, both sides, to Shaw Street; or take any action relative thereto.


Article 46. On Petition. To see if the Town will vote to accept as and for a Town way, AUDUBON ROAD, so-called, from the present line of acceptance easterly to Argyle Road, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 47. On Petition. To see if the Town will vote to accept as and for a Town way, PRIMROSE STREET, so-called, and raise and appropriate a sum of money for improvement and a water main of the said way under a W.P.A. Project, or take any action relative thereto.


Article 48. On Petition. To see if the Town will vote to accept as and for a Town way, STATEN ROAD, so-called, from present line of acceptance westerly to Abbott Street, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 49. On Petition. To see if the Town will vote to accept as and for a Town way, GARLAND STREET, so-called, from Dickerman Lane southerly to Storrs Avenue, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, under a W.P.A. Project; or take any action relative thereto.


Article 50. On Petition. To see if the Town will vote to accept as and for a Town way, WINDEMERE CIRCLE, so-called, approximately 555 feet in a westerly and northerly direction from the present point of acceptance, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 51. On Petition. To see if the Town will vote to accept as and for a Town way, PARKSIDE AVENUE, so-called, from Walnut Street 850 feet easterly, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.

Article 52. On Petition. To see if the Town will vote to accept as and for a Town way, WALNUT STREET, so-called, from Parkside Avenue to Lakeside Drive, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 53. To see if the Town will vote to raise and appropriate a sum of money to construct a sidewalk on the northerly side of Com- mercial Street from Shaw Street to Mill Lane or take any action rela- tive thereto.


Article 54. On Petition. To see what sums of money the Town will vote to raise and appropriate for the purchase or taking by emi- nent domain for highway purposes of the land necessary for the con- struction of a road to be an extension of Storrs Avenue in a westerly direction to Walnut Street, described as follows:


"Beginning at the northeast corner of Walnut Street and Storrs Avenue Extension, so-called, and running in an easterly direction, in a straight line, along land of Murray F. Perry and through land of John Naples, for a distance of about Two Hundred feet to Storrs Avenue as now constructed; thence southerly along Storrs Avenue as now constructed about Forty feet; thence westerly in a straight line through land of John Naples and along line of land of James Fuller about Two Hundred feet to the southeasterly corner of Storrs Avenue Extension, so-called, and Walnut Street. This latter line is parallel to and Forty feet from the first line above described. Thence northerly along Walnut Street, Forty feet, to the point of beginning. This parcel is shown on a plan entitled 'Plan of Land in Braintree, Mass., belonging to Richard Moorey,' by W. N. Chit- tenden, C. E., dated January 2, 1929, recorded with Norfolk Deeds, Book 1957, page 125, described as Storrs Avenue Extension, and is now owned in part by Elsie G. Nickerson, Trustee under a Decla- ration of Trust dated December 27, 1930, and recorded with Nor- folk Deeds, Book 1920, page 54 (for her appointment see Nor- folk Deeds, Book 2183, page 195), and in part by John Naples"; or take any other action relative thereto.


Article 55. To see if the Town will vote to raise and appropriate a sum of money for the improvement of WELLINGTON STREET, so- called, approximately 400 feet easterly from present point of construc- tion, or take any action relative thereto.


MISCELLANEOUS


Article 56. To see if the Town will vote to raise and appropriate a sum of money in addition to sums of money already appropriated, to cover the Town's share for materials, trucking and other necessary expenditures in connection with W.P.A. activities or other Special Aid projects in conjunction with State or Federal Government; or take any action relative thereto.


Article 57. To see what sums of money, in addition to that appro- priated under any other article, the Town will vote to raise or borrow and appropriate for Land Damages.


Article 58. To see if the Town will vote to raise and appropriate a sum of money for the payment of printing and distribution of the Annual Report of the Town of Braintree for 1939.


Article 59. To see if the Town will vote to hear the report of the Committee to study the By-laws, appointed under Article 2 of the Annual March Town Meeting of 1939, and to see what sum of money

Article 60. To see what distribution the Town will vote to make of the income of the Thayer Fund.


Article 61. On Petition. To see if the Town will vote to raise and appropriate the sum of $1200.00 to assist Braintree Post No. 86, Ameri- can Legion, in the maintenance of its Headquarters in the Legion Building, or take any other action relative thereto.


Article 62. On Petition. To see if the Town will vote to renew its lease with Braintree Post No. 86, Department of Massachusetts, the American Legion, of the Legion Building for a term of five years from January 18, 1941, at $1.00 per year, reserving one room for polling pur- poses, or take any other action relative thereto.


Article 63. On Petition. To see if the Town will add a section to Article II of its By-laws, to be known as Section 13, to read as follows:


All town meetings shall adjourn not later than 10:30 P.M. unless, in the opinion of the Moderator, the remainder of the Warrant can be completed by 11:00 P.M. or in any way act thereon.


Article 64. On Petition. To see if the Town will have the Moder- ator appoint a committee annually to investigate costs and doings in Norfolk County and report their findings to each annual town meeting.


Article 65. On Petition. To see if the Town will authorize the Water Department to aid any new industry that comes to town by granting it a temporary reduction in water rates of 50% for a period of three months, or in any way act thereon.


Article 66. On Petition. To see if the Town will direct its offi- cials to be present at all town meetings, prepared to answer all ques- tions that Town Meeting members may ask concerning the operation of their departments since the last annual meeting.


Article 67. On Petition. To see if the Town will request the School Committee to conduct an evening course in Local Government for adult attendance, or in any way act thereon.


Article 68. On Petition. To see if the Town will request the School Committee to include in the High School curriculum a compulsory course in Local Government or in any way act thereon.


Article 69. On Petition. To see if the Town will establish stand- ard office hours for all offices of the town or in any way act thereon.


Article 70. To see if the Town will vote to authorize the Selectmen to sell property, title to which has been acquired by the Town under tax title foreclosure procedure, at public auction, provided notice of such auction sale be published in one or more newspapers published in the Town at least one week before the date of said sale, and to authorize the Selectmen to execute deeds conveying said land.


Article 71. To see what sums of money the Town will vote to raise and appropriate for the expenses of the Planning Board, or take any action relative thereto.


Article 72. To see what action the Town will take on the report of the Committee appointed pursuant to a vote of the 1939 Annual Meeting to consider the matter of Zoning; and to see if the Town will vote to raise and appropriate a sum of money for the expenses of said Committee or its successors in the preparation of Zoning By-Law; or take any action relative thereto.

Article 73. To see what sums of money the Town will vote to raise and appropriate to meet the payment of certain bills contracted prior to January 1st, 1940, or take any other action relative thereto.


Article 74. To see if the Town will vote to raise and appropriate a sum of money for the purchase of the French Estate, so-called, being Plot 6 on Plan No. 1005 on file in the Assessors' Office, or take any action relative thereto.


Article 75. To see if the Town will vote to raise and appropriate a sum or sums of money for the purchase or taking by Eminent Domain of certain lands for Parking Places in the business centers of the Town, or take any action relative thereto.


Article 76. To see if the Town will take any action relative to the designation of the G. A. R. Lot in the Plain Street Cemetery as a general Soldiers' Burial Lot under the jurisdiction of the Selectmen.


Article 77. To see if the Town will vote to convert the Memorial Hall, so-called, into additional office space, and transfer the possession of the various historical relics therein to the Braintree Historical Society or take any action relative thereto.


Article 78. To see if the Town will vote to raise and appropriate a sum of money for the purpose of paying salary of Edward Avery for services as Selectman and member of Board of Public Welfare from May 1, 1938 to December 30, 1938, or take any action relative thereto.


Article 79. To see if the Town will vote to raise or borrow and appropriate a sum of money for the purpose of constructing, furnish- ing and equipping a FIRE STATION located in East Braintree; and to authorize the Treasurer, with the approval of the Selectmen, to borrow all, or any part of said sums and to authorize the proper officers to take any steps which may be necessary to secure an allotment of Federal Funds under P.W.A. or other Federal agency, to supplement any appropriation made by the Town; or take any other action relative thereto.


Article 80. To see if the Town will vote to raise and appropriate a sum of money for the care and maintenance of property acquired by the Town under Tax Title Foreclosure Procedure, or take any other action relative thereto.


Article 81. To see if the Town will authorize the Board of Select- men to secure a suitable location, to be used as a Town Dump, and appropriate any money for the same, or take any action relative thereto.


Article 82. On Petition. To see if the Town will vote to raise and appropriate a sum of money for the purchase or taking by Eminent Domain, of a certain parcel of land containing approximately eight acres, located on the Monatiquot River meadows, in the rear of the Highway Dept. barn, for the purpose of a Dump, or take any other action relative thereto.


Article 83. To see if the Town will vote to authorize and direct the Assessors to use not more than $75,000 from Free Cash toward the reduction of the 1940 tax rate.


Article 84. On Petition. To see if the Town will adopt, and memorialize other Towns and Cities within the Commonwealth, and the Great and General Court, urging them to adopt the substance of the following resolutions, or to see what action the Town will take with reference thereto :-

Resolved: That in the methods to be used in constructing and re- pairing our properties, those methods be adopted which will employ men, rather than utilize machinery to the exclusion of manual labor.


Be It Further Resolved: That in all contemplated projects of larger proportions to be done under contract, a stipulation be included in each contract which shall specify what work is to be done by hand labor, and what is permitted to be done by machinery:


Be It Further Resolved: That, whereas, in process of construction by Government, the mechanical machine used is of course supported by all the human machines, the former dependent, the latter self-supporting when in occupation, when not in occupation is contributing to the sup- port of the mechanical machine out of the earnings of the occupied per- sons; and to maintain a Democracy all members of the Association must have opportunity to grow while contributing to build public luxuries and support a government, we should constantly consider our supporting means.


You are directed to serve this Warrant by posting true and attested copies thereof in three public places in each Voting Precinct in said Town of Braintree, ten days at least before said fourth day of March, 1940, and by publishing the same once each week for two successive weeks in the "Braintree Observer," the first publication to be at least eight days before said meeting.


Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, before said meeting.
