and to determine in each case how and under whose directions the money shall be expended, to impose any conditions and restrictions thereon which the Town may see fit; to determine how much money so appro- priated shall be available for expenditures under General Laws (Ter. Ed.) Chapter 40, Section 5, Clause 34; to determine what, if any, sums so appropriated shall remain available after December 31, 1940; to fix the terms and conditions of any loan or loans authorized to procure any of such funds and to authorize the issue of bonds or notes for the same, and fix the term and rate of interest of any such bonds or notes; to fix such salaries as require to be fixed by the Town Meeting; and to impose such conditions upon the drawing of compensation from the Town as the Town may see fit; or take any other action in relation to any of the foregoing subjects.
ARTICLE 2. (By Direction of the Selectmen.) To see what sum of money the Town will vote to raise or borrow and appropriate for providing co-operation with the Federal Government in unemployment relief and other projects of direct or indirect benefit to the Town or its inhabitants, or take any other action in relation thereto.
ARTICLE 3. (By Direction of the Selectmen.) To see if the Town will vote that of the sum appropriated under Article 2 of this Warrant a definite amount be set apart for the purpose of resurfacing, constructing, altering or repairing sidewalks and curbings throughout the Town or take any other action in relation thereto.
COMMITTEE REPORTS
ARTICLE 4. (By Direction of the Selectmen.) To take any action the Town may desire upon the reports of the several Town Boards and Committees and to appoint or change any Committee that the Town may think proper.
TOWN FINANCES
ARTICLE 5. (By Direction of the Selectmen.) To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for period of less than one year, in accordance with General Laws (Ter. Ed.) Chapter 44, Section 17.
ARTICLE 6. To see if the Town will vote to authorize its Treasurer with the approval of the Selectmen, on or after January 1, 1941, to borrow in anticipation of the revenue of the year 1941.
ARTICLE 7. To see what sum of money the Town will vote from surplus for the use of the Assessors in determining the tax rate for the year 1940 or take any other action in relation thereto.
ARTICLE 8. To see if the Town will vote to authorize the Selectmen to sell or otherwise dispose of any real or personal property of which

the Town may be possessed or seized and for which it has no further use, including all real estate of which the Town has possession or title for non-payment of taxes; to see if the Town will vote to authorize any other department to sell or otherwise dispose of any personal property in its possession and to determine the manner or conditions of such sales, or take any other action in relation thereto.
ARTICLE 9. To see if the Town will vote to authorize its Board of Selectmen to accept conveyances or mortgages of any real or personal property belonging to persons receiving relief from the Town and to dispose of said property in the manner they may judge for the Town's best interest and to authorize them to discharge any encumbrances on said property if they consider it for the best interest of the Town so to do, and to see what sum of money the Town will vote to raise and appro- priate for the discharging of such encumbrances.
STREETS AND SIDEWALKS
ARTICLE 10. (By Direction of the Selectmen.) To see if the Town will accept the several reports of the Selectmen laying out as Town ways the following designated private ways and parts of ways or any of them, to wit :-
Morningside Path. May Terrace Extension. Greenwood Avenue.
Clematis Avenue from Idlewell Boulevard westerly to Pleasant View Avenue.
Russell Road - between Union Street and Central Street. Edgeworth Street from near 887 Pleasant Street to a deadend. Homestead Avenue from Front Street to Summer Street. Candia Street for 600 feet more or less from Academy Avenue to and across Cornish Street.
Nevin Road - extension westerly about 120 feet. Kensington Road.
or any portion of said ways and will authorize the Board of Selectmen to acquire by gift or purchase or take by right of eminent domain in fee or otherwise for all purposes of a public street and highway in and over each of said streets as so laid out and accepted, and to see what sum of money the Town will vote to raise and appropriate for the working of each of the above named streets including the acquisition of the fee above referred to and for the building of any bridges, drains and con- duits or securing easements which may be necessary in connection there- with and to see whether the Town will authorize the Board of Selectmen to accept deeds of any reservation strips existing in connection with any of said Streets, or take any other action in relation thereto.
ARTICLE 11. (By Direction of the Selectmen). To see what sum of money the Town will vote to raise and appropriate to reconstruct, resurface, widen, straighten, relocate or work the following streets, to wit :-
Randolph Street from Weymouth Street to Holbrook Town Line. White Street from land now or formerly of Greensmith Ager Avenue.
Pleasant and Water Streets.
to Forest Street.
Pearl and Evans Street - southerly corner.
Columbian Street, Park Avenue west, Park Avenue, and Ralph Talbot Street known as Route 128.
North Street, or North and Norton Streets.
Middle and Broad Streets - northeast corner.

ARTICLE 12. To see if the Town will take any action upon the report of the committee on the widening of Broad Street made in the Town Report of the year 1931, and to see what sum of money the Town will vote to raise and appropriate for the purpose of widening Broad Street or any portion thereof.
ARTICLE 13. (By Direction of the Selectmen and on Petitions as hereinafter may appear). To see what sum or sums of money the Town will vote to raise and appropriate for the resurfacing, construction or repair of sidewalks and curbings on the streets of the Town as herein- after set forth or take any other action in relation thereto :
(On Petition of Mary E. Riley and others). Riley Avenue, both sides.
(On Petition of Robert D. Crawford and others). Kirkland Road, south side.
(On Petition of William W. Hackett and others). Union Street, westerly side from Bates Avenue to Central Street.
DRAINAGE
ARTICLE 14. To see if the Town will vote to authorize the Board of Selectmen to accept an easement on its behalf from Frank Rubolino -on Pine Street-in accordance with a plan of Russell H. Whiting, Town Engineer, dated November 29, 1939, for drainage purposes, or take any other action in relation thereto.
GOVERNMENTAL AND ADMINISTRATION CHANGES
ARTICLE 15. (On Petition of John W. Field and others). To see if the Town will vote to appoint and instruct a committee of three consisting of the Town Counsel, Representative, and Senator, to be appointed by the Moderator, to seek legislation at the next session of the Massachusetts General Court designating the Town Treasurer, Town Clerk and Town Accountant as Commissioners to administer and manage Weymouth's Municipal Buildings Insurance Fund.
ARTICLE 16. (By Direction of the Selectmen). To see if the Town will vote to amend the last sentence of Section 610 of the By-Laws so that it shall read as follows :-
"Said licenses unless sooner revoked by the Board of Selectmen shall expire one year after the granting thereof and each resident so licensed shall pay therefor a fee of five ($5.) dollars and all other persons a fee of ten ($10.) dollars."
or take any other action in relation thereto.

ARTICLE 17. (At request of Everett E. Callahan). To see if the Town will vote to substitute in the place of Section 301 of the Town By-Laws the following :-
"At the first annual meeting held after the adoption of this change, the voters of the town shall elect by ballot from among their number three persons who shall serve and be known as the finance committee, who shall hold office, one until the expiration of three years, one until the expiration of two years, and one until the expiration of one year from the date of said annual town meeting. Thereafter one such finance commissioner shall be elected annually at the annual town meeting to serve three years therefrom. The members of the finance committee shall serve until their successors are elected and qualified and shall not receive any salary. During the term for which they are chosen they shall be ineligible, either by appointment or election, to any town office other than that for which they have been chosen, nor shall, during any such term, hold any such other office. They shall be sworn to a faithful performance of their duties by the town clerk, or by a justice of the peace."
And to change Section 302 so that paragraph three (3) shall be repealed, or take any other action in relation thereto.
ARTICLE 18. (At request of Zoning Committee). To see if the Town will accept the addition to its by-laws of the Zoning Committee's report, said addition to be known as the Zoning Act; or take any other action in relation thereto.
ARTICLE 19. (On Petition of John W. Field and others). To see if the Town will vote to amend its By-Laws by striking out Section 799 of Article 7 and inserting in place thereof the following :---
Sec. 799. A Board of Appeal of three members and one associate member is hereby created consisting of the Town Engineer, the Town Counsel, a member of the Board of Selectmen appointed by the Board which shall also designate the chairman; and the associate member shall be the chairman of the Planning Board who shall act only in case of a vacancy, inability to attend, or death of a member of the Board of Appeal. Three members of the Board of Appeal shall constitute a quorum.
