Any person applying for a building permit who wishes to be relieved from any operation of the provisions of the By-Laws may make applica- tion in writing to the Building Inspector, specifying what waivers he desires made in his favor and the reasons therefor. This application with any accompanying specifications, plans, and maps, shall be sub- mitted by the Building Inspector together with his written recommenda- tions thereon, to the Board of Appeal for final decision. ARTICLE 24. To see if the Town will vote to authorize the Board of Selectmen to accept on its behalf the gift of a piece of property from D. Arthur Brown and described as a passageway about 200 feet in length connecting Elinor Road and Georgia Road or take any other action in relation thereto.
ARTICLE 25. (At request of the Planning Board). To see what sum of money the Town will vote to raise and appropriate for con- structing a public parking space or playground or both, on land owned by the Town known as Bicknell Meadow in East Weymouth, and authorize the Board of Selectmen to acquire by gift or purchase or take by right of eminent domain, a parcel of land from Pleasant Street to said Meadow as a right of way or take any other action in relation thereto.
ARTICLE 26. (At request of the Planning Board): To see if the Town will vote to raise and appropriate and authorize the Board of Selectmen to acquire by gift, or purchase, or take by right of eminent domain or otherwise for public parking Purposes, certain land with buildings thereon lying on the northerly side of Washington Street and the westerly side of Commercial Street, in the rear of the business section in Washington Square, according to plan of Russell H. Whiting, Town Engineer, or take any other action in relation thereto.
ARTICLE 27. (At request of the Planning Board). To see what sum of money the Town will vote to raise and appropriate for the con- struction of a retaining wall along Wessagusset Road in the vicinity of the Wessagusset Yacht Club and located according to plans of Russell H. Whiting, Town Engineer, dated September 23, 1935, or take any other action in relation thereto.
ARTICLE 28. (On Petition of Everett E. Callahan and others). To see what action the Town will take, if any, relative to the construction of a Laban Pratt Memorial Hospital.

ARTICLE 33. To see if the Town will vote to raise and appropriate the sum of $600. for the purpose of maintaining, during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931.

To see what sum of money the Town will raise and appropriate for the purpose of stocking the ponds and other inland waters, located within the Town limits, with fish and of liberating game, in accordance with Chapter 142, Section 1 of the Acts of 1938, or take any other action in relation thereto.

To see if the Town will vote to authorize the Board of Selectmen to take by gift, purchase or right of eminent domain in fee or otherwise parcels of land located in that part of Weymouth known as the Old City and bounded as follows :-
Easterly by Union Street; Northerly by Central Street; Northwesterly by Main Street; Westerly by Old Colony Railroad; and Southerly by the Rockland Line;
for the purpose of establishing a Municipal Airport and to see what sum of money the Town will vote to raise and appropriate for said purpose or take any other action in relation thereto.

ANNUAL TOWN MEETING
March 4, 1940
Pursuant to a warrant duly issued the annual meeting of the in- habitants of the Town of Weymouth represented by its duly elected and qualified town meeting members was held at the hall of the Wey- mouth High School, East Weymouth, on Monday, March 4, 1940, 208 town meeting members being checked by police stationed at the doors for that purpose.
The meeting was called to order at 7:45 o'clock in the evening by Daniel L. O'Donnell, annual moderator.
The attested copy of the warrant for the meeting was read, after which the Rev. Fr. Edward Harrington, curate of the Sacred Heart Church was called upon to invoke the Blessing of the Ruler of the Universe upon the deliberations of the meeting.
Those Town Meeting Members not previously sworn were at this time sworn by the Moderator.
Mr. Sandy Roulston, Chairman of the Board of Selectmen moved the adoption of the following memorial, relative to the death of Clayton B. Merchant and a copy to be sent to his widow.
MEMORIAL
Mr. Clayton B. Merchant, for more than twenty years Clerk of the Town of Weymouth, died June 5, 1939.
His service to the Town was not only long, but fruitful. In duties of an intricate nature, he was always careful and exact in recording the proceedings of our Annual Town Meetings, as well as in his other offices. He gave to our Town that loyal and faithful service so appre- ciated by its citizens. He was never known to shirk his duty and always confirmed to the spirit as well as the letter of the law.
And so a grateful citizenry wishes by this Memorial not only to express their appreciation of the worth of Mr. Merchant, but also desires to have this appreciation inscribed upon the records of the Town to the end that future Town Meetings may have recourse to our acknowl- edgment of a duty well performed by a faithful public official and be inspired thereby to the same high regard for the performance of public duty.
The motion of Mr. Roulston was unanimously adopted.
The Moderator then called for consideration of the articles in the warrant.
BUDGET
ARTICLE 1. Mr. Raymond Stein, Chairman of the Appropriation Committee moved that Article 1 be considered item by item. So voted.
Mr. Field moved: To provide for the salaries, operation and ex- penses for the fiscal year of the Town's several departments and activi- ties, for certain improvements, and to meet certain requirements of the law, the several sums hereinafter set forth are hereby appropriated for the several purposes and subject to the conditions hereinafter specified, all such sums to be raised by taxation in the levy of the current year unless some other source of revenue is specified.

Item 1. For all expenses of the Appropriation Com- mittee. Of this sum $100. is reserved for use only in case of a special Town Meeting. The motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tenta- tively adopted.

Item 2. Mr. Field moved: For the salaries and all ex- penses of the Selectmen's Department. $ 3,930.00
Of this sum $2,700. shall be for the salaries and · all expenses of the Selectmen; not exceeding $480. shall be for the services of a clerk who may be a Selectman, and $150. payable to the Board of Selectmen shall be for perambulating the Town's bounds during 1940. The motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
Item 3. Mr. Field moved: For the salaries and all ex- penses of the Town Accountant's Department. $ In this sum provision is made for increasing the salary of a clerk to a rate of pay not exceeding $1,196. per year. Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and ten- tatively adopted.

Item 4. Mr. Field moved: For the salaries and all ex- penses of the Treasurer's Department. Not exceeding $1,636. of this total appropria- tion shall be for clerical assistance and in this latter sum provision is made for increasing the wages of a clerk to a rate of pay not exceeding $832. per year. Mr. Callahan moved an amendment to Mr. Field's motion : That the sum now held in escrow by the Treasurer for the Town Clerk's Department, be released to Nellie Greaney.

5. Mr. Field moved: For the compensation of the Tax Collector and all expenses of the Tax Col- lector's Department $ 9,184.00
The compensation of the Tax Collector shall be five and one-half mills on each dollar of taxes collected and the Selectmen shall be authorized and instructed to insure the Tax Collector in the sum of $15,000. for Robbery Insurance.
Mr. Cate moved the following amendment to Mr. Field's motion : ... and the tax collector is hereby instructed to arrange dates and places in each precinct of which seasonable notice shall be given for the more convenient pay- ment of their taxes by the taxpayers of the town.
Mr. Cate's amendment was voted.

Item 6a. Mr. Field moved: For the salaries and all ex- penses of the Assessors' Department. $ 10,509.00
In this sum provision is made for increasing the salary of a clerk to a rate of pay not ex- ceeding $624. per year.
Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
6b. Mr. Field moved: For equalization of prop- erty valuations.

This sum shall be payable to the Assessors for their services and expenses in performing this work.

That the sum of $60.85 be added for the purpose of compensating Nellie Greaney for extra duties performed in 1939, and that the Town Clerk be instructed to obtain release of that sum for the purpose specified. $ 60.85
Mr. Callahan's amendment adopted. Mr. Field's motion, as thus amended, was unanimously and tentatively adopted.
Item 10. Mr. Field moved: For Elections and Registra- tions of voters. $ 6,190.00
To be divided as follows: For election ex- penses $3,350., for registration expenses $2,840., in the latter amount $100. additional compensation for the year 1940 only is voted the Clerk of Registrars, and not exceeding $640. shall be for the wages of an Office Clerk at a rate not exceeding $832. per year.
Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and ten- tatively adopted.

Item 11. Mr. Field moved: For all expenses of the Engineering Department. $ 5,500.00
This sum includes the Town Survey and placing of bound stones on existing Town ways, the making of Street Surveys, and such engineering work as may be authorized by the Selectmen. The motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
Item 12. Mr. Field moved: For all expenses of the Planning Board. $ 300.00 Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tenta- tively adopted.
Item 13. Mr. Field moved: For the maintenance and upkeep of the Town Hall and War Memorials at the Civic Center including the grounds, to be expended under the direction of the Selectmen. $ 8,830.00
Provided that all toll calls of the Water Depart- ment and for the agencies set up under Article 2 shall be paid out of their respective appro- priations. Of the total sum $254. shall be for the purchase of a cabinet and a new linoleum, and $1,500. shall be for waterproof- ing the Town Office Building as outlined to the Appropriation Committee by the Clerk of the Board of Selectmen, and that this work be underwritten by at least a 5 year bond. Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and ten- tatively adopted.
Item 14. Mr. Field moved. For the maintenance of the Civil War Soldiers' monument and the King Philip War Memorial including the grounds; to be expended under the direction of the Selectmen. $ 100.00

Item 15. Mr. Field moved: For the salaries and all other expenses of the Police Department. In this sum provision is made for the disposition of motor vehicles and purchase of others by the Chief. Item 19. Mr. Field moved: For all services and expenses of Gypsy Moth and all other insect pest exter- mination to be expended under the direction of the Gypsy Moth Superintendent. $ 4,000.00
Of this sum $1,000. shall be used for work on private property for which the Town shall be reimbursed.
Mr. Hebert moved to amend the motion made by Mr. Field by increasing the sum to be ex- pended from $4,000. to $4,500.

Item 20. Mr. Field moved: For the salary of the Tree Warden and all expenses incurred in the care of shade trees. $ 1,950.00
Of this sum $250. is allocated for special emergency work and $200. for the purchase of trees. Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
Item 21. Mr. Field moved: For Street Lighting. The Electric Lighting Committee is hereby instructed to contract with the Weymouth Light and Power Company for Street Lighting. Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and ten- tatively adopted.

Item 22. Mr. Field moved: For the salary and all other expenses of the Harbor Master. $ 1,200.00

Item 23. Mr. Field moved: For the salaries and all other expenses of the Board of Health. Of this sum the following specific appropria- tions are made : $1,000.00 shall be for the supplies and services of dentists;

5,000.00 shall be for payments as re- quired to the Norfolk County Tuberculosis Hospital;
1,040.00 and not exceeding this sum shall be for the services of a dental hygienist and $200. additional for her expenses;
1,800.00 shall be for the maintenance of the Town dumps including the services of an attendant whose wages shall not exceed 621/2 c per hour;
1,800.00 shall be for plumbing inspections but the services and all expenses of the plumbing inspector shall not exceed an amount equal to that collected for all plumbing permits plus $250. ;
250.00 shall be for all expenses of con- ducting the diphtheria clinic;
50.00 shall be for all expenses for the protection of the public from rabies;
on and after December 15th any unexpended balances in the above accounts may be treated as one fund.

Item 24. Mr. Field moved: For the employment of Nurses.

The Board of Selectmen are hereby authorized to contract with the Weymouth Visiting Nurse Association to furnish the services of one or more nurses in case such services are a proper charge against the town.
Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
Item 25. Mr. Field moved: For the maintenance of the Norfolk County Tuberculosis Hospital. $ 16,448.83
Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.
Item 26. Mr. Field moved: For Garbage Removal. $ 4,000.00 The Board of Health is authorized to contract for the disposal of garbage from April 1, 1940 to April 1, 1941.
And in addition to this sum the Board of Health may use whatever unexpended balance remains in the existing appropriation from prior years for the same purpose.
Motion of the Appropriation Committee, as made by Mr. Field, was unanimously and tentatively adopted.

Item 27. Mr. Field moved: For Public Welfare. Of this entire appropriation the sum to be used for all salaries and expenses of administration under this item, excepting the Town Infirmary, shall not exceed $8,409. of which $1,962. shall be charged against Aid to Dependent Children administration. $2,000. of this administra- tion sum and $1,000. of the Appropriation for administration under item 28 aggregating and not exceeding $3,000. shall be for the salary and expenses of the Welfare Agent appointed under the provisions of Chapter 7, Acts of 1938. Provision is also made for increasing the salaries to be paid from the administra- tion sum under this item as follows: One Clerk to a rate of pay not exceeding $1,196. per year, another Clerk to a rate of pay not ex- ceeding $884. per year, an Investigator to a rate of pay not exceeding $1,300. per year; and from the sum of administration the Town Accountant shall transfer to the Town's gen- eral fund an amount equal to whatever monies are made available by the State or Federal Government for any administrative expense for the fiscal year under this item.
