Report of the Selectmen


Acting under the instructions of the 1959 Annual Town Meeting the Selectmen carried out the following:


Article 9: Police cruiser purchased from Granite Chev- rolet Co. Inc., Hyannis on their low bid of $1,519.02.


Article 11: Town By-Laws were reprinted in their cur- rent form.


Article 28: Christmas lights were installed on the Main Streets in Harwich Port and Harwich Center.


Article 31: A taking was made at Sand Pond according to a plan approved by the majority of the Selectmen.


Article 32: A majority of the owners of the land involved in this article have indicated that they are unwilling to sell to the town.


Article 33: A taking was made at Skinequit Pond ac- cording to a plan approved by the Selectmen.


Article 34: A lease was drawn with Douglas P. Allison for the use of a portion of his beach property adjacent to the Bank Street Beach.


Article 35: Improvements in the form of additional groin construction and sand fill now being carried on at Red River Beach under Article 40 of 1958. The money appropriated in 1959 will be held for future work in conjunction with the Waterways Division of the Department of Public Works.


Articles 37 & 38: Contracts were awarded on the basis of bids received from Frank Joy of Orleans and concrete ramps constructed at Allen Harbor and Herring River.


Article 39: A new concrete retaining wall was construc- ted on the north side of the Town Dock at Round Cove in East Harwich.


Article 43: A schedule of charges was instituted for docking at the Town Landing at Wychmere Harbor under the supervision of the Harbor Master.

Article 47: Land at Allen Harbor was conveyed back to the original owners as instructed in this article.


Article 71: As in past years a committee was appointed by the Selectmen to observe July 4.


Article 73: Four band concerts by the Orleans Band were held at Brooks Park during July and August.


Article 81: Under this article Bayport Road and Ostable Road were accepted and recorded. The layouts of Orton Road and Brettwood Road in South Harwich and Grassy Pond Road in Harwich Port could not be accepted because of late filing. Additional hearings were held in October and the above roads in addition to Nevins Lane and Arbutus Avenue in West Har- wich are being brought in for acceptance at the next Annual Town Meeting. A special Town Meeting called for this purpose in November failed because a quorum was lacking.


Other projects in the Town are going along in its usual manner. Detail reports of various Town Departments appear elsewhere in this book. We wish to thank all Department heads and all other employees for their cooperation this past year.

TOWN OF HARWICH ANNUAL TOWN MEETING WARRANT


MARCH 7, 1960


THE COMMONWEALTH OF MASSACHUSETTS Barnstable, SS:


To either of the Constables of the Town of Harwich in said County,


Greeting:


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town qualified to vote in elections and town affairs to meet in the High School Auditorium in said Town on Monday, March 7, 1960 at 12 noon then and there to act on Article 1 and afterwards on the following day, Tuesday, March 8, 1960 at 7:30 P.M. to meet in Exchange Hall and act on the remain- ing articles.


Polls will be open at 12 noon and will close at 8:00 P.M.


Article 1. To choose on one ballot the following Town Officers and Committees: Moderator for one year; one Select- man, Overseer of Public Welfare, and the Board of Health for three years; one Assessor for three years; one Recreation Commission member for five years; three Constables for one year; one Trustee of Brooks Library for three years; one Cem- etery Commissioner for three years; two School Committee members for three years; one Park Commissioner for three years; one Water Commissioner for three years and one Plan- ning Board member for five years.


Article 2. To choose all other Town Officers and Com- mittees.

Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to bor- row money from time to time in anticipation of the revenue of the financial year beginning January 1, 1960 and to issue a note or notes therefore payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


Article 4. To hear the report of all Town Officers and Committees for the year of 1959.


Article 5. To see if the Town will vote to raise and ap- propriate such sums of money as may be required to defray town charges for the calendar year of 1960 and to act fully thereon.


GENERAL GOVERNMENT


Article 6. To see if the Town will vote to accept the fol- lowing By-Law:


CLASSIFICATION AND SALARY PLAN


The classification of positions, pay schedules and pro- visions of this by-law shall be known as the Classification and Salary Plan of the Town of Harwich-providing for a scale of wages and salaries and other benefits for employees of the Town (excepting those elected or under the jurisdiction of the School Committee). This plan shall be administered by a Personnel Board.


The following schedule is based on a 44 hour week for pipe layers and laborers of the Water Department and 40 hours a week for all highway laborers.


SICK LEAVE: 1. In the matter of Sick Leave regular full time employees shall be entitled to fifteen (15) days of sickness, or accident leave, exclusive of Sundays and Holidays, without loss of pay. If such sick leave allowance is not used in any particular year it shall accumulate for a period of six (6) years up to a maximum of ninety (90) days, for use in any subsequent year. The date from which accumulated sick leave shall be computed for all present full time employees, shall be the starting date of the employees current period of full time continuous service with the Town. Sick and ac- cident leave shall be payable in cases of bona fide illness or accident not covered by Workmen's Compensation.


2. Employees who are absent because of such illness or accident for a period of more than two (2) days shall be re- quired to present a Doctor's certificate to their Department

Head stating the reason and the period of time the employee will be absent from work.


3. This section is not to be construed by any employee or Department Head as a subterfuge for time off, nor shall it apply in the case of any sickness or accident caused by over- indulgence in alcohol or narcotics, or by employee's mis- conduct.


4. Department Heads shall clearly indicate on their pay- rolls all payments for sick leave.


MILITARY LEAVE: Regular Town employees shall be granted leave of absence, without pay, for duration of tour of duty; and shall also be entitled to the vacation, with pay, due them under the vacation provisions of this plan.


VACATION: 1. Employees shall be granted one (1) week's vacation with pay, if they have actually worked for the Town thirty (30) weeks in the aggregate during the twelve (12) months preceding the first day of June in the first year of employment and two (2) weeks with pay the following years.


2. Vacations shall be granted by the department heads at such times as, in their opinion, will cause the least inter- ference with the performance of the regular work of the de- partments. Vacations must be taken in the year in which they are due, and shall not accumulate from year to year.


3. In the event of termination of employment which is caused through no fault of the employee, provided the em- ployee has been in a continuous full time service of the Town for at least one (1) year; or by reason of retirement; the employee shall be paid, or entitled to time off with pay, for any accrued vacation for one (1) day's regular pay for each full month since the employees preceding vacation, not to exceed two (2) weeks pay. In the event of death of an em- ployee any such accrued vacation pay shall be paid to his estate.


HOLIDAYS: 1. All regular full time employees shall re- ceive time off without loss of pay on the following State legal holidays providing they fall on, or are observed, on a regular scheduled work day: New Years Day, Washington's Birthday, Patriot's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christ- mas.


In case of the fire and police departments, or other de- partments whose personnel is subject to duty seven days a week, those regular employees who are assigned to duty on a holiday shall receieve a compensatory day off.

JURY DUTY: If an employee is called to jury duty he shall receive an amount equal to the difference between his normal compensation and the amount (excluding any travel allowance) received for such duty upon presentation of evidence of the amount so paid.


LEAVE OF ABSENCE: Leave of absence may be granted for valid reasons by a department head, but shall be with- out compensation. In no event shall leave of absence be granted for the purpose of seeking, or trying out, another job.


PERSONNEL BOARD :1. There shall be a Personnel Board appointed to administer the salary administration plan, said Board to be appointed by the Board of Selectmen consisting of three (3) voters, other than employees of the Town, or those serving the Town regularly in any elective or appointed capacity. Each appointee to serve for a period of one year. Members of the Board shall serve without compensation but said Board to have any expense account not exceeding one hundred and fifty dollars ($150.00) annually.


2. The Personnel Board shall from time to time review the work of all positions subject to this salary schedule. Such review shall be so scheduled as to cover all positions at intervals of not more than three (3) years.


3. Department heads shall make recommendations an- nually on all phases of this plan as regards each employee.


4. All employees shall have the right to appeal to the Personnel Board from decisions made by Department heads on matters included in this study and the decision of the Per- sonnel Board shall be final.

Article 7. To see if the Town will vote to raise and ap- propriate the sum of twenty-two hundred dollars ($2,200.00) and to authorize the Selectmen to purchase a new Police Cruiser and Equipment, to trade the 1958 Plymouth cruiser now owned by the Town, the sum received from said trade to be used toward the purchase of the new car and to act fully thereon. By request of the Chief of Police.


Article 8. To see if the Town will vote to raise and ap- propriate the sum of eight hundred and fifty dollars ($850.00) and to authorize the Selectmen to purchase a new radio for the Police Station, the sum received from said trade to be used toward the purchase of the new radio and to act fully thereon. By request of the Chief of Police.


Article 9. To see if the Town will vote to instruct the Selectmen to sell to the highest bidder the obsolete fire truck; namely 1935 Ford Tank Truck and to act fully thereon. By request of the Fire Chief.


Article 10. To see if the Town will vote to raise and ap- propriate the sum of nine hundred and fifty dollars ($950.00) for the purchase of approximately three hundred (300) feet of 21/2" double jacket fire hose and approximately five hun- dred (500) feet of 11/2" double jacket fire hose and to act fully thereon. By request of the Fire Chief.


Article 11. To see if the Town will vote to raise and ap- propriate the sum of seven hundred and ten dollars ($710.00) to purchase six tires for the Rescue Truck and four tires for the Ladder Truck, and to authorize the Selectmen to trade the old tires now owned by the Town, the sum from said trade to be used toward the purchase of new tires and to act fully thereon. By request of the Fire Chief.


Article 12. To see if the Town will vote to raise and ap- propriate the sum of seventy-eight hundred dollars ($7,800) to purchase a new ambulance and equipment for the Fire De- partment and to authorize the Selectmen to trade the 1954 ambulance now owned by the Town, the sum from said trade to be used toward the purchase of the new vehicle and to act fully thereon. By request of the Fire Chief.


Article 13. To see if the Town will vote to raise and ap- propriate the sum of six hundred dollars ($600.00) for the purpose of purchasing a large chain saw for the Pest Con- trol Department and to act fully thereon. By request of the Tree Warden.

Article 14. To see if the Town will vote to raise and ap- propriate the sum of five hundred dollars ($500.00) for the purpose of planting shade trees along town roads under the direction of the Tree Warden and to act fully thereon. By request of the Tree Warden.


Article 15. To see if the Town will vote to authorize the Board of Park Commissioners to perform day labor in the parks at the rate of not less than $1.35 per hour. By request of the Park Commissioners.


Article 16. To see if the Town will vote to raise and ap- propriate the sum of two hundred and fifty dollars ($250.00) to be expended for miscellaneous administrative expenses of the Conservation Commission and to act fully thereon. By request of Francis J. Hibbert and others.


Article 17. To see if the Town will vote to raise and ap- propriate a sufficient sum of money to be used under the di- rection of the Selectmen for expenses incurred in the con- demnation and destruction of old buildings and to act fully thereon. By request of the Board of Selectmen.


Article 18. To see if the Town will vote to raise and ap- propriate the sum of five hundred dollars ($500.00) for the purpose of surveying and bounding various Town properties including roads and to act fully thereon. By request of the Board of Selectmen.


Article 19. To see if the Town will vote to raise and ap- propriate the sum of five thousand dollars dollars ($5,000) for the purpose of reimbursing the County of Barnstable for land damage claims and legal services and to act fully thereon. By request of the Board of Selectmen.
