I submit herewith my twentieth annual report as Clerk of the Town of Hamilton.


During the year 1963 the elections and town meetings consisted of the Annual Town Meeting and Election, a detailed report of which is printed in this town report.


A list of births, marriages and deaths recorded during the year is also included as part of the Clerk's report.


I take this opportunity to express my sincere appreciation to Mrs. Barnes and Mrs. Trussell for the efficient and loyal service in their work, and to all the people of Hamilton who have assisted me in any way during the year.

The Moderator, Mr. Paul F. Perkins, opened the meeting at quarter past eight (8:15) in the evening on Monday, March 4, 1963.


Reverend Lloyd Chorpenning offered the invocation.


Moderator: "The first business of the meeting is Article 2. To choose and appoint all other Town Officers in such manner as the Town may determine."


Moved by Mr. William Mackenzie and duly seconded: "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor, and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately following."


Voice vote. Motion carried.


Moved by Mr. William Mackenzie and duly seconded: "That Harold M. Dodge, George Morrow, William W. Bancroft and Ernest M. Barker be elected Field Drivers for the ensuing year."


Voice vote. Motion carried.


Moved by Mr. William Mackenzie and duly seconded: "That Theo- dore E. Johnson, Ernest R. MacGregor, Ernest M. Barker and Lawrence Foster be elected Measurers of Wood, Lumber and Bark for the ensuing year." "

Article 3. Moderator: "To hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any other action thereon or relative thereto."


Moved by Mr. Lawrence Stone and duly seconded: "That the reports of Town Officers and of the Finance and Advisory Committee and all other committees as printed or inserted in the Town Report for 1962, be received and placed on file."

Article 4. Moderator: "To raise and appropriate money for Schools, Highways, and all other Town expenses and determine the manner of expending the same."


Mr. Clark Sears: "As chairman of the Finance Committee it is my duty to come up here each year and start the meeting off with what I do hope will be a brief statement. Since 1952 the tax rate in Hamilton has gone from $38.00 to $81.00 last year, a rise in the same proportion that has happened in most of the town and cities in this part of New England. Our own rise in the tax rate I believe has been as the result of two things.

One is the overall cost of living which we all know has gone up steadily since the war and during the war and it is still going up. The second thing has caused our tax rate to go up is the big rise in the population in the Town of Hamilton. Today our population is over 5,000 and in 1950 or right after the war I believe it was under 3,000. This all means that more people coming in demand more services. There are more children in town. We have had to build new schools and provide the teachers to take care of the children. With the rise of the cost of living plus the general increase in population resulting in the increased cost of education, we just had to have our tax rate go up in order to pay our bills. This is going to continue this year. I want to remind you of that fact and although we had a budget for the Regional School last year we only had 1/4 of opera- tional costs in the school. This year we are going to have to increase our tax rate to take care of the other eight months of operational budget. One thing I would like to talk about tonight before we get into the budget or the articles and that is the fact that this year for the first time there was formed in town a town employee's association. They came to us at one of our meetings and wrote us a letter and asked for a meeting. We met with them and they had in their letter an overall 5% raise in wages and salaries. At the meeting with us they also discussed their future plans and what they would like now if they could do it. One of those was the articles or I should say question which you are going to find on your ballot next Tues- day and in that they are asking the town to adopt a statute which the state has approved in which the town will pay half of the cost of the life in- surance and other health benefits. We think that this is something the town employees deserve and we as the Finance Committee approve it and we hope that this Tuesday the question will be answered "yes". There is also another matter about which they asked us and that you are going to find under Article 19 tonight. This is something that I have been asking for since I have been on the Committee. Every year we have the problem as to what to do about wages and salaries. There is no schedule, no mini- mum or maximum salary established in the town for any department or as the town as a whole and I have asked for it in the last two reports and I have recommended that the town do something about having a person- nel board. I believe that with a personnel board we could iron out all the deficiencies that now exist and what the salary should be. As it is now the only thing that we can do is vote as a committee an across the board raise in salary or say no raise in salary because I cannot see any way where we could pick out one department and say now this department here has done a good job and push them up to where they belong and forget the other departments. Since 1956 the average wage and salary in the town has been raised 40% . I think if you will check through your past records you will find that salaries in 1956 and then compare them with salaries that were paid in 1962 have all gone up an average of 40%, some are higher and some are lower. I am not talking especially about that tonight except to still bring before you the problem that we have had, and as I see it as chairman of this committee that year after year we have no real way of saying who should have a raise higher than some of the others.

Again this year we are recommending an across the board raise. We feel the men deserve it but we can't pick out one group over another. We had quite a discussion on the problem. We checked through and found that according to statistics presented to us from Washington the overall raise in the cost of living has gone up 2.9 this year. We accordingly in our proposed budget have included a 3% raise for every employee in the town with the exception of the School Committee. Their raises are taken care of by the School Committee itself.


Moderator: "As has been our established custom I shall read the appropriations recommended by the Finance and Advisory Committee. If anybody wishes to debate or question any item he need simply to say 'hold' and then we will take up the items which have been held in order after the other items have been approved as a whole. If you wish to read these items as I read them they are set forth beginning on page 98 in your Annual Report. There are a few items which have been changed since the report has been printed and I will read the corrected figures as I come to them.

"That the various appropriations recommended by the Finance and Ad- visory Committee, as they have just been read by the Moderator, except- ing the items passed, be approved and the sums recommended be and hereby are appropriated, and that the meeting now proceed to the con- sideration of the items passed."

Moderator: "We now proceed to consider the several items which were held. Item 22, Item 23 and Item 24 relating to the police department salaries, chief's salary and five officers, and wages part time and spare officers have been held by Chief Frederick."


Chief Frederick: "I move the amendment Mr. Moderator on the Items 22 which recommends the appropriation of $5,485.78 to read $5,860.00. I also move the amendment Item 23 which reads $21,836.54 to read $24,344.00. I move the amendment of Item 24 which recom- mends the appropriation for $6,450.00 to read $7,405.00.


I have been a member of the Police Department in the Town of Hamilton for over 35 years. For many of those years I have served as your Chief of Police. Tonight for the first time in a long period of service to our community I am appealing to you for support of a wage program which our Finance Committee does not feel it can support. I announced several weeks ago my intention to fight for a just wage and made it clear I would bring the problem directly to the voters. The men of our depart- ment in comparison to other police officers in this area and by comparison to other employees in the town are underpaid and by a considerable amount. A full-time patrolman in Hamilton puts in 48 hours a week- 48 hours every week. He gets only $78.00 for his week's pay. Their take home pay is below $70.00 which figures to less than $1.50 an hour. If you approve the amendment which I have brought before you you will enable these men to receive the same wage as a member of the Highway, Water, Park, Health and the Fire Departments. These men are not asking for any more than just what the town laborers get. They don't feel they are any better than town laborers and they don't feel they are below and all they are asking is to receive the same wage and a week's pay they can get by with. With this action they will receive $1.90 an hour or $94.00 a week for 48 hours. Under this program a full-time sargeant and a full- time inspector will receive $6.00 a week more than a regular patrolman. That is all he gets for being superior and all the extra time he puts in working. I will also be able to pay the part-time patrolman $1.90 an hour,

the same that is paid for part-time officers in Wenham. A part-time officer isn't even asking as much as the laborer in the Town of Hamilton gets. As he is satisfied with it we will go along with that. My salary will be $115.00 a week for six days a week. It must also be noted I am on call 24 hours a day, seven days a week and seven nights with no extra pay. I am on salary and I average every day nine hours a day which is 54 hours a week in the station or in the square and for the rest of the time I am on call.


Mr. Lamson: "In view of the importance of this I would like to move that the vote be taken by secret ballot."


Voice vote. Motion lost.


Moderator: "The vote is on the motion that the amendment, that Item 22 which recommends the appropriation of $5,485.78 be $5,860.00, that Item 23 which recommends the appropriation of $21,836.54 for Salary of the five officers be increased to $24,344.00 and that Item 24 which recommends the appropriation of $6,450.00 for wages part time and spare officers be changed to read $7,405.00. All those in favor of this motion please say 'aye'."


Voice vote. Motion carried.


Moderator: "The next item held is 38 which is the salary of the tree warden of $2,632.00.


Remarks by Mrs. Neary and Mr. Mackenzie.


Moderator: "If there is no further discussion on Item 38 which is the salary of the Tree Warden, we will vote on the recommended appro- priation of $2,632.00.


Voice vote. Item appropriated.


Moderator: "The next held item is 79-Extension of Mains."


Mr. Clark Sears: "Under Article 12 later tonight we are going to discuss this service of extension of mains. I would like to hold this article until after we have voted or talked about Article 12 in the warrant."


Moderator: "It has been moved that consideration of this item 79 Extension of Mains, be postponed until after consideration of Article 12. If there is no objection the chair will permit that motion for postponement until Article 12."


Moderator: "To see if the Town will vote to raise and appropriate the sum of $4,750. for Chapter 90 Highway Construction."


Moved by Mr. Lamson and duly seconded: "That the Town raise and appropriate the sum of $4,750. for Chapter 90 Highway Construc- tion on Bridge Street and Walnut Road to be expended for the Town's share of the work, and that available funds be used to carry on the work

until the Town is reimbursed for the State and County share of the work."


Voice vote. Motion carried.


Article 6. Moderator: "To see if the town will vote to raise and appropriate the sum of $1,000 for Chapter 90 Highway Maintenance."


Moved by Mr. Lawrence Lamson and duly seconded: "That the Town raise and appropriate the sum of $1,000 for Chapter 90 Highway Maintenance on various streets, to be expended for the Town't share of the work and that available funds may be used to carry on the work until the Town is reimbursed for the State share of the work."


Voice vote. Motion carried.


Article 7. Moderator: "To see if the Town will vote to purchase a new Cruiser-Ambulance for use of the Police Department provide for the turning in of the present cruiser toward the purchase price thereof and to raise and appropriate a sum of money therefor."


Moved by Mr. Lawrence Stone and duly seconded: "That the Town purchase a new Cruiser-Ambulance for use of the Police Department, and that the present cruiser be turned in toward the purchase price thereof, and that the Town raise and appropriate the sum of $2,000 for the bal- ance of the purchase price, and that the Board of Selectmen be and here- by is authorized and empowered to take all necessary action to make such purchase on behalf of the Town."


Voice vote. Motion carried.


Article 8. Moderator: "To see if the town will vote to trasfer the sum of $2,000 from the Cemetery Sale of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery."


Moved by Mr. John Walke and duly seconded: "That there be trans- ferred from the Cemetery Sale of Lots and Graves Fund the sum of $2,000 to the Cemetery Account for improvements of the Town Ceme- tery."


Voice vote. Motion carried.


Article 9. Moderator: "To see if the Town will vote to purchase a tractor with backhoe and loader attachments and raise and appropriate a sum of money therefor."
