To: His, Honor, The Mayor, and the City Council Subject: City Solicitor's report for the year 1954.
Sirs:
In compliance with Section 4, Chapter 14, of the Revised Ordinances of the City of Newburyport, I am submitting herewith my report as City Solicitor for the year 1954. In the year 1954, I sub- mitted numerous opinions in writing to the City Council and the Mayor, and in addition, I have given oral advice to the City Council, His Honor, The Mayor, and members of the different departments of the City Government. There were several claims against the City for property damage and personal injuries which I settled with the consent of the City Council, during the year 1954. In 1954, I tried two cases in the Superior Court, one being Margaret E. Maguire, wherein the claimant was suing for Four Thousand ($4000.00) Dollars and the jury awarded her Nine Hundred Fifty ($950.00) Dollars. Her husband, John E. Maguire, sued the City of Newburyport in the sum of Four Thousand ($4000.00) Dollars, and this case I succeeded in having dismissed inasmuch as his claim was not a valid one under the Law. Harriet G. Apt sued the City of Newburyport for Four Thousand ($4000.00) Dollars for injuries sustained as a result of a defect in the sidewalk on Congress Street in Newburyport, and I settled this caim for Seven Hundred ($700.00) Dollars. This settle- ment resulted from a conference I had with the Judge of the Superior Court and the plaintiff, Harriet G. Apt. In addition, I brought suit for the City of Newburyport in several cases involving bills owed to the City of Newburyport at the Newburyport Clam Chlorination Plant, in the District Court, and have succeeded in collecting considerable money. In addition, I brought action in the Superior Court in one of the cases and have obtained a judgment against the defendant and anticipating collection of the same by commencement of supplementary process in the District Court to effectuate satisfaction of judgment. Outstanding, is the case of Henry G. Fenders, Jr. against the City of Newburyport, for damage to property on Fruit Street resulting from a tree falling against it. The damage is for Five Thousand ($5000.00) Dollars. Joseph F. Crowley sued the City of Newburyport for Four Thousand ($4000.00) Dollars by an action against the City commenced in the Superior Court, for injuries sustained as a result of an alleged defect in the sidewalk on Greenleaf Street. Margaret K. Spalding brought an action in the Superior Court against the City of Newburyport for a defect on Summer Street, this action is for Four Thousand ($4000.00) Dollars. Her husband, Prescott L. Spalding, also brought action against the City of Newburyport in the sun of Four Thousand ($4000.00) Dollars as a result of injuries sustained by his wife, Margaret K. Spalding. Arthur E. Perley brought an action of contract in the Superior Court against the City of Newburyport in the sum of Ten Thousand ($10,000.00) Dollars, alleging that we violated the terms of the contract entered into between the City of Newburyport and Arthur E. Perley, for renovations to the heating system of the Newburyport High School. I brought an action on behalf of the City of Newburyport against Arthur E. Perley, alleging that he violated the terms of this contract. Another action pending against the City of Newburyport is Lillian M. J. Whitcomb against the City of Newburyport in the sua of Four Thousand ($4000.00) Dollars for personal injuries sustained as a result of her falling on the sidewalk on the Northerly side of Horton Street.

The City of Newburyport also took land by eminent domain, on Low Street for the purpose of establishing a pumping station in rela- tion to the extension of the sewerage system. I did considerable work and the accomplishment of the acquisition of this land by eminent domain.
In addition to my other duties as City Solicitor, I handled several claims by employees for Workmen's Compensation and processed these various claims on behalf of the City. I might mention here, of course, that the Henry Cote case is still outstanding and that there is pending before the Industrial Accident Board, a hearing for the purpose of determining what amount, if any, shall be paid to Henry Cote in addition to other reimbursements and payments made to him for injuries sustained as a result of working for the Water Department for the City of Newburyport. This claim was brought under Section 36 of Chapter 152 of the General Laws, wherein Henry Cote is claiming a specific injury resulting from the accident for which the City of Newburyport may be liable in addition to all other compensation.
On behalf of the City Council, I drew several orders and ordi- nances and in addition, at the request of different councillors, I drew several orders and ordinances during the year 1954. Various department heads and City officials have requested me on several occasions, to draw notices and various other papers for them.
The year 1954 was a very active year for the City Solicitor, and a great amount of time was consumed by the City Solicitor on City business. As a result of notices sent and Court actions commenced by me , a great sum of money was realized on dormant clam accounts. Efforts to collect the balance owed on old accounts are still being continued by me. I attended several Board meetings by the various Boards .on behalf of the City of Newburyport. There were numerous claims against the City of Newburyport for alleged defects in sidewalks resulting in injury or property damage, and other claims against the City of Newburyport in which persons sustained injuries, which I recommended to the City Council that claim be denied in view of the fact that there was no liability on the part of the City.
It is my recommendation that, in view of the fact that there have been numerous amendments to the City Ordinances, that funds should be made available in the future, for the purpose of re-drawing the Ordi- nances, and in that measure, avoid a great deal of confusion resulting from the many amendments to the Revised Ordinances of 1937.
