LAW DEPARTMENT


I am submitting herewith my report as City Solicitor for the year 1958. During that year, I have attended every regular meeting of the City Council and some special meetings and whenever requested, have given written opinions and advice to the members of the City Council on any matter at all involving municipal administration. At the request of members of the City Council I have prepared orders when they involved legal technicalities, and during discussions at City Council meetings I gave oral opinions. Upon request, I also attended several meetings of the School Committee and gave that committee written opinions on school matters, besides conferring with the Superintendent of Schools numerous times.


At any time when any of the City officials requested advice or the drafting of legal papers in connection with City affairs, I was only too happy to give the advice and draft the necessary papers . Whenever any claims were filed by employees protected under workman's compensation, I processed them and forwarded the claims to the insurance company involved and to the office of the Industrial Accident Board in Boston.


At the present time, there are several land damage cases pending, the vast majority being hold-overs from the previous administration. One land damage case was tried at the sitting here in Newburyport in April of 1958. At the present time there are no defect cases pending against the City, that is, those that have been entered into Court. There are numerous old claims against persons using our Clam Chlorination Plant and I have collected money from some of those persons owing the City for services rendered at that plant. At the present time, there are still some outstanding claims for clam chlorinating work performed it the plant and if these are not paid, I intend to bring suit. me or two of the City Councilors have suggested to me that the Revised Ordinances of 1937 be brought up to date and of course you realize that this would entail considerable legal research work especially on the traffic ordinance which has been amended numerous times since the original ordinance was passed. If his Honor the Mayor sees fit to appropriate the necessary money for the recordification of these ordinances, I would only be too happy to do so.
