Wells Drain.


This title is applied to the water course running just west of Pratt Street from Highland Avenue across Franklin Street to Albion Street, thence into the brook. The portion south of Franklin street is covered, or of pipe, and has for many years overflowed the land of George T. Wells, who finally brought suit for damages. This suit was settled by the Mayor and City Solicitor, one of the considerations being that the city should entirely rebuild the drain and cover it the entire distance through land of Wells, to accom- plish which the Board of Aldermen passed the following order :

Be it ordered : That acting under the provisions of law applicable thereto, a main drain, either open or covered, shall be laid or con- structed in the following described right of way as hereinafter set forth, viz :


Beginning at a point on the northerly side of Albion Street at the dividing line between land of George W. Woodland and land of the Melrose Highlands Baptist Society, said point being one hundred

seventy-four and ninety-seven one hundredths (174.97) feet more or less westerly from the junction of the southerly line of Franklin Street with the northerly line of Albion Street measuring along the said northerly line of Albion street; thence along said dividing line between land of George W. Woodland and the Melrose Highlands Baptist Society north, 16 ° 25' 37" east one hundred two and fifty-eight one hundredths (102.58) feet to the southerly line of Franklin Street, said point being four hundred fifty-six and ninety-five one hundredths (456.95) feet from Ashland Street, measuring along the southerly line of Franklin Street; thence across Franklin Street to a point ten (10) feet east of the dividing line between land of Lucy A. Wells and Dan- iel E. Caswell, one hundred and eighteen (118) feet from Pratt Street measuring along the northerly line of Franklin Street ; thence paral- lel to, and ten (10) feet from, said dividing line between land of Lucy A. Wells and Daniel E. Caswell north 20° 26' 17" east one hundred (100) feet to land of Dexter Pratt ; thence in the same course across land of Dexter Pratt parallel to and ten (10) feet from the dividing line between land of said Pratt and Thomas W. Ripley two hundred tweny-five and three tenths (225.3) feet to the southerly line of High- land Avenue.


The above described line is the easterly line of a taking which is ten (10) feet wide.


The above description is intended to conform to plans drawn by W. Dabney Hunter, Eng'r. and Supt. of Public Works, hereto annexed and made a part of this order; that the Treasurer be and hereby is given authority to issue note or notes of the City of Melrose not exceed- ing in the aggregate the sum of $1,315.00 payable in one year from the date thereof at a rate of interest not exceeding 5 per cent. per annum. It is hereby adjudged that the said drain is a necessity for the public convenience and health ; that the city of Melrose, acting under the authority of the Public Statutes, and also under all other provisions of law and every other power it hereto enabling, has taken and hereby does take for the purposes of constructing a main drain in the private lands as hereinbefore specified for the sole use and benefit of the said City of Melrose, the following lots and parcels of land situated in said Melrose, in said County of Middlesex, viz :


A certain lot situated on the northerly side of Albion Street, sup- posed to be owned by George W. Woodland, bounded and described as follows :


Beginning at a point on the northerly line of Albion Street at the di- viding line between land of George W. Woodland and the Melrose High- lands Baptist Society, said point being one hundred seventy-four and ninety-seven one hundredths (174.97) feet westerly from the junction of the northerly line of said Albion Street with the southerly line of Franklin Street, measuring along the said northerly line of Albion Street ; thence north 16° 25' 37" east along said dividing line one hun- dred two and fifty-eight one hundredths (102.58) feet to Franklin St. ;

Wells, Dexter Pratt, Thomas W. Ripley and Daniel E. Caswell; thence along the dividing line between land of Lucy A. Wells and Daniel E. Ripley and Dexter Pratt, and one hundred seventy-seven and eighty-five one hundredths (177.85) feet easterly from the easterly line of Cliff Street measuring along the said southerly line of Highland Avenue; thence south 20° 26' 17" west two hundred twenty and sixteen one hundredths (220.16) feet along said dividing line between land of Dexter Pratt and Thomas W. Ripley to the common corner between land of Dexter Pratt, Thomas W. Ripley, Daniel E. Caswell and Lucy A. Wells; thence along the dividing line between land of Lucy A. Dabney Hunter, Engr. and Supt. of Public Works, here- to attached and made a part of this order; reserving, however, to the owner or owners of the different parcels of which said land forms a part, their heirs and assigns, the right to pass and repass on foot and

with teams over the above described lands, and all other rights not inconsistent with the laying, making, maintaining, and repair of any main or mains or pipes or other necessary appliance of said City of Melrose now or hereafter laid in said lands hereby taken.


Owing to the provisions of the city charter, this order did not go into effect until 30 days after it was passed, and at this time the season was so far advanced that only enough work was done to prevent the flooding of Mr. Wells' land, and the remainder will be completed the coming season.

SIDEWALKS.


In my last report under this head, I called attention to the provisions of the city ordinance relative to sidewalks, with recommendations (see pages 109 and IIO). The Board of Aldermen have acted favorably on one of them, and I wish again to call attention to the provisions of Chap- ter 21, Section 2, and to Chapter 25, Section 19, of the ordi- nances, together with my recommendations of the previous year, with this addition: that within certain sections of the city, or that on certain particular streets (to be enumerated in the ordinance) the material to be used be specified, or particularly designated. My reason for this is that many applicants prefer brick, but feel that their neighbors either have, or probably would have, concrete, and would rather forego their preference in favor of brick in order to conform with surrounding walks.


Two new continuous walks ordered in 1901 have been completed; the curbing ordered on Main street has been set; 31 continuous walks constructed as applied for, and many of the old walks have been repaired.

Walks have been constructed, or curbing set, in front of 31 estates, 16 of which were for new walks, and 15 for curb- ing and rebuilding old walks, the abutters paying for one- half of the improvements.

Continuous Walks.


The concrete walk ordered on the west side of Rowe street, has been completed at a cost of $64.42, one half of which, $32.21, is assessed to the estate of George Lynde.


The brick walk ordered on Lebanon, Lynde and Potter streets has been completed at a total cost of $647.31 for the work done in 1902, and a bill for $376.78, the part charge- able to the Washington school (the only abutter) has been rendered and paid.


The curbing ordered set on the east and west sides of Main street, from Grove street to Foster street, has been completed at an expense of $676.

STREET SPRINKLING.


Chapter 24 of the city ordinances provides that all streets designated by the Board of Aldermen shall be sprinkled by the Engr. and Supt. of Public Works, and also provides that he shall levy an assessment on the abutting estates at the rate of 3 cents per linear foot of lot frontage for occupied land and I cent per linear foot of lot frontage for vacant land.


On April 14th, the Aldermen passed Order No. 1,622, ordering that the following named streets be sprinkled :
