A Petition of Jonathan Head, and Benjamin Head of Little-Compton, shewing, That they had Appealed in Two Actions, from the Judgment of the Inferiour Court of Common [ 24 ] Pleas, holden in Bristol, to the Superiour Court of Judi- cature, and left their Reasons of Appeal Three Days before the time Limitted by the Law, with the Wife of the Clerk of the said Inferiour Court, who promised to deliver them to her Husband, not then at home, but neglected it till within 13 Dayes before the Court, by which means their Reasons of Appeal was quash'd, and Judgment was affirm'd against them, Praying Relief. Sent down from
the Board, pass'd on there, viz June 20. 1716. Read, and Ordered, That the Petitioners be admitted to a new Tryal of their several Actions mentioned in this Petition, at the next Superiour Court, to be holden for and within the County of Bristol. They Filing Reasons of Appeal according to Law, and that the ad- verse Party be served with a Copy of this Petition, and Order, that they may have timely Notice thereof. Sent down for Concurrence.

A Petition of Nehemiah Walter, Pastor, and John Payson, and John Mayo, Deacons of the Eldest Church in Roxbury, praying this Court to Remedy the great inconveniency which the School in the said Town labours under by the Leasing of the Lands, with which it is endowed at a low Rate, for the Term of Five Hun- dred Years, contrary as they suppose, to the pious intention of the Doner. A Petition of Thomas Fitch, Nathanael Carey, Charles Chambers, Samuel Green- wood, and Oliver Noyes, a Committee appointed by this Court to provide Sundry Necessaries for the Train of Artillery &c. Directed by Her late Majesty Queen Anne, to be here provided for the Expedition against Canada, Anno 1711. who for the Sums they advanced in that Service, Received Bills of Exchange drawn by the then Governour, upon the Lord High-Treasury of Great Britain. But none of the said Bills have as yet been excepted. And the Petitioners had the Loan of l. 3812 8 s. 7 d. Granted to them in Bills of Publick Credit out of the Publick Treasury, in consideration of their being in advance for that Service, and which they stand obliged to pay into the Treasury in July next. Presented to the House and Read, praying the further favour of this Court, in continuing to them the said Loan for One Year more; they having now a more hopeful prospect that the said

Bills of Exchange will be paid in some space of time, the Parliament having lately taken them into their Consideration.

A Memorial of Samuel Sewall, John Leverett, Thomas Fitch, and Daniel Oliver, a Committee appointed by the Trustees for the Improvement of Mr. Hopkins his Legacy, presented to the House & Read, praying that the Fee of the Lands in Hopkinston, which has been reserved to the Province may be vested in the said Trustees, to promote the pious intention, of the said Plantation. And That Persons may be forbidden taking up the Meadows, and making Strip and Waste of the Trees and Timber there.
Ordered, That the said Memorial be referred to the next Session for Considera- tion. And the said Trustees are hereby requested, and impowered to take care in behalf of the Province, to prevent any Strip or Waste, on the Lands belonging to the Province, lying in Hopkinston, by prosecuting such Offenders, according to the Laws in that case provided. Sent up for Concurrence.

A Message from the Board by Elisha Hutchinson, Addington Davenport, and Edward Bromfield, Esqrs; proposing that the parts of this Province, Eastward of

York, may be annexed to the County of York, during this Courts Pleasure, for the better Government of such as sojourn or reside there.
And that the House prepare a Bill for that end.

An Accompt of Mr. Jeremiah Dummer late Treasurer of the County of Suffolk, from June 23. 1715. to May 2. 1716. Presented to the House for Allowance.

A Petition of Nathanael Henchman of Boston, Merchant, presented to the House and Read, shewing, that he received of the Ten Thousand Pounds Loan of Prov- ince Bills, Anno 1711 the Sum of Fourteen Hundred Pounds, which he Disbursed to pay off Transports, that were taken up on Her late Majesties Account in the Expedition to Canada the said Year. And took Bills of Exchange on the Lord High Treasurer of Great Britain, for the same, to the Sum of l. 996 18 s. 8 d. Sterling, payable at 30 Dayes sight, but no part of the said Bills is yet paid. Praying the continuation of the said Loan for One Year more.
Resolved, That the Prayer of the said Petition be Granted.

A Petition of Thomas Palmer, Edward Lyde, and 23 others, Merchants, &c. to whom this Court lent of the Bills of Publick Credit, Anno 1711. to enable them to supply the British Troops, then designing an Expedition against Canada, for which Supplies they received of the General and Admiral of the said Expedition, Bills of Exchange on the Lord High Treasurer of Great Britain. Presented to the House and Read, shewing, That as yet no more than Two Thirds of the said Bills of Ex- change are paid. Praying that the Loan of one Third part, of the said Bills of Credit, that are outstanding in their Hands, may be continued to them for One Year more, in which time they have hopes to obtain the Payment of the remain- ing Third part of the said Bills of Exchange, the Parliament having lately taken the same into their Consideration.
Resolved, That the Prayer of the Petition be Granted, in behalf of the Peti- tioners and others alike concerned. Sent up for Concurrence.
A Petition of Andrew Belcher Esq; and Jonathan Belcher, of Boston, Merchants, presented to the House and Read, Praying that Fourteen Hundred Pounds, part of the Sum lent to them in Bills of Credit, out of the Publick Treasury, Anno 17II. to assist them to furnish Stores to General Hill, and Admiral Walker, for the Arms and Fleet under their Command, bound on an Expedition to Canada, may be Lent to them for One Year more, for Reasons therein given.

Resolved, That for the more convenient Administration of Justice, all the Lands, Families and Settlements, within this Province, to the Eastward of the Province of Maine, shall be annexed to the County of York, and shall be part of the same, to all intents and purposes, until this Court shall take further Order. Stoddard from the Committee appointed, Reported, That they had Inspected the Books of the Secretaries Office, and find that between the Death of Mr. Secretary Addington, and the coming of Mr. Secretary Woodward, the Books of the Office had not been Posted up, which Mr. Woodward has had done at a considerable Cost & Charge extraordinary, having imployed Three Persons besides himself therein.
Resolved, That the Sum of Ninety Pounds be allowed and paid out of the Pub-

A Message from the Board by John Clark and Thomas Hutchinson Esqrs, That His Honour the Lieut. Governour, is at the Board and desires the Attend- ance of this House.

I T is by the advice of His Majesty's Council that I meet You at the Time, to which You were Prorogued, tho' I confess it be a very busy Season. And am now to tell You, That the Committee appointed to Sit in the Recess of the General Court, to Consider of the Report of the Committee, of both Houses, for the Promoting the Pro- duce and Trade of this Province (wherein was Projected the Making, and Emitting the Sum of One Hundred Thousand Pounds, in Bills of Credit,) and prepare and lay before this Court, the Draught of a Bill agreeable thereto, have acquainted Me, That they have Prepared a Bill accordingly, and are ready to lay it before this Court, for their Approbation; which I hope if agreed to, will greatly Tend both to the Sup- port of the Government, and the Encouragement of Trade; therefore I chearfully rec- ommend it to You, being very much inclined to do my Country, all the Service that lyes in my Power.
Gentlemen,
I Hear His Excellency Col. SHUTE may in a Short time be Expected, and I shall do my Duty to Him, in giving Him as handsome a Reception as this Government is capable of; And take this Opportunity to acknowledge your Regards to Me, in your Recommendation of Me to Him, for my being Continued in my Post.

Some time since, I received a Letter by the hands of a Norridgawog Indian, wrote by the Friar of that Place, which was very insulting: And which occasioned Me, to Summon His Majesty's Council; and what was done thereon I shall lay before You, and doubt not but will be to your Acceptance. The time of Year will not Admit of a long Session, Wherefore I should be glad, You would in a few Dayes Conclude what lyes before You, that so You may return Home, to the Ingathering of the Remainder of Your Harvest.
