A Message sent up to the Board by Capt. Chambers, and Capt. Fullam, That the House have already Voted to Refer the Consideration of Making an Allow- ance to Mr. Agent Dummer, to the next Session. And desire if the business of the Session be finished that the Court may Rise.

The House proceeded to Write their Votes for a Speaker, which being Col- lected and Examined, it appear'd that John Burril Esq; was chosen by a major part of the House, He was accordingly Conducted to the Chair. [ 2 ]


The House proceeded to the Election of a Clerk by written Votes, which being Collected and Examined, it was found that Mr. John White was chosen by a ma- jor part of the House, who was accordingly sent for to the House.

A Message sent up to the Board by Capt. Noyes, and Col. Somersby to report to His Honour the Lieutenant Governour, the Choice the House had made of a Speaker.


A Message from His Honour the Lieutenant Governour by Addington Daven- port and Samuel Brown Esqrs; That the Choice the House have made of a Speaker, is very acceptable to him.


A Message sent up to the Board by Mr. Rogers, and Mr. Trivet, That the House are now ready to proceed to the Choice of Councellors.


Who return'd that the Board is ready to joyn with the House in the Election.


Ordered, That Capt. Noyes, Mr. Cooke, Col. Thaxter, Mr. Rogers, and Mr. William Denison, be a Committee to carry up the Votes of this House for Coun- cellors, and assist in Sorting and Numbring them, together with the Votes of the Board, and to Report to the House the several Elections that shall be made.


The said Committee carried up the Votes of the House for Councellors in the late Colony of the Massachusetts-Bay, and Return'd that Eighteen were chosen by a major part of the Voters.


Then for the late Colony of New-Plymouth, & Return'd that Four were chosen as aforesaid.


Then for the late Province of Maine, and Return'd that Three were chosen as aforesaid.


Then for the Territory between Sagadehoc & Nova Scotia, and Return'd that One was chosen, as aforesaid.


And lastly, for Persons dwelling in any Part of the Province, and Return'd that Two were chosen, as aforesaid.


And Reported the Names of the Persons chosen to be as follows, viz.

A Message from His Honour the Lieut. Governour, by Mr. Secretary Wood- ward, That this House do attend him in the Council Chamber immediately.


Accordingly Mr. Speaker with the House went up; And His Honour the Lieut. Governour made a Speech to the Court, whereof Mr. Speaker obtained a Copy, and with the House Returned to their own Chamber. His Honours Speech was Read, and is as follows, viz.


Gentlemen,


A T our last parting I had little Expectation of now speaking to you from the Chair, believing His Excellency Col. BURGES our Governour would before this time have happily Arrived among us, and I am well assured he may be daily ex- pected, and that he comes with full Resolutions to do his utmost for the Interest of this Province, which he has signified to the Council in divers of his Letters, and has like- wise expressed his grateful sense of the Honourable Provision you have made of so suitable a House for his Reception, in which you have not only obliged him but done much Honour to your selves.


Therefore my time in this Station will in all Probability prove short, yet to the last Moment of it I shall rejoyce to meet with any Opportunity of shewing my Zeal and Affection to the Crown, and the true Interest of my Native Country ; and doubt not but you all come with hearty and sincere Dispositions to promote both in your respective Stations. The good Agreement with the last General Court, gives me great hopes to meet the same in this. And I should esteem it the happiest Circumstance of my Life to have the Honour of delivering up the Government in a perfect Unity between both Houses, which would contribute to your own Reputation and the Disappointment of those few, who have with great Industry endeavoured to prevent it.


Gentlemen,


His Excellency Bragadier Hunter favoured me with the Commissioners of Albany's Report to him, as if the Indians had some Designs of making an Attempt on our Frontiers in the Spring, which I immediately communicated to His Majesty's Coun- cil, who were of Advice that it was proper to reinforce Fort George, as likewise the New Settlement of Arowsick, with Ten Men each, which accordingly I have done. And on Monday last by an Express from the Honourable Lieut. Governour Vaughan, I have received Intelligence that gives further Grounds for Suspicion, and nothing but the General Election prevents me from doing my Duty to my Country in Visiting the Frontiers, and putting 'em into a suitable posture of Defence, but I have dispatched Expresses to the Commanding Officers, to give timely Advice to their several Towns in order to prevent a Surprize ; what other Methods I have taken in this Affair I shall lay before you ; And I think it a proper Season to offer it as my Opinion, that nothing can be of more Service both for the Crown and this Country, than for both Houses to be Unanimous in Supporting and Encouraging the New Settlements.


Gentlemen of the House of Representatives,


I shall Order Mr. Treasurer to lay before you the state of the Treasury, in which I

believe you will find no unnecessary Article of Charge, and therefore have no reason to doubt but you will make all suitable Provision for Support of the Government in the ensuing Year. And as it has pleased Almighty GOD of His Infinite Wisdom and Goodness, to frustrate the Counsels of Evil and Rebellious Traitors in their late Un- natural Rebellion against the best of Kings, which had a Tendency to Extirpate the whole Royal Family ; so now Gentlemen, We have an Opportunity to Congratulate His most Sacred Majesty on this His great Deliverance, by way of an Address ; and to Assure His Majesty of our Constant and Steady Loyalty and Affection to His Person and Government, and that we will with our Lives and Fortunes as we have Opportu- nity, Defend His Rightful Title to the Crown of Great Britain, and the Dominions and Provinces depending thereon, as also to the Protestant Succession as by Law Estab- lished against all Pretenders whatsoever.


Gentlemen,


This is usually the Session for Business, which I shall give all the Encouragement I can to forward, but if upon the Expectation of His Excellency's sudden Arrival you incline to make it short, I shall [ 4 ] readily consent to it. If any proper Methods can be found out for the promoting the produce of this Country, and so consequently the Trade thereof, I shall chearfully concur with you therein. I have nothing more to add, but to express my sincere Wishes that the Crown may long Flourish on the Head of our Soveraign Lord King GEORGE, with all its Ancient Prerogatives, and that it may from Him descend to His Illustrious Family to lasting Posterity.


Isaac Winslow Esq; brought down from the Board several Letters that had been Express'd to His Honour the Lieut. Governour from the Eastward, Importing Apprehensions of a Rupture with the Indians there, which were read and sent up.


Ordered, That Mr. Payne, Col. Basset, Mr. Anthony Stoddard, Capt. Chambers, Mr. Rogers, Mr. Thomas, Capt. Gallop, Mr. Hammond, and Major Stoddard be a Committee to Examine and Audit the Treasurers Accounts, and make report to the House.


And then the House Adjourn'd till to Morrow Morning Nine a Clock.

H Is Honour the Lieutenant Governours Speech Read again.


Ordered, That William Denison, Elisha Cooke, Oliver Noyes, William Basset, and Edmund Goffe, Esqrs ; with such as the Honourable Board shall ap- point, be a Committee to prepare and lay before the Court, the Draught of a Humble Address to His Majesty, in the Name of this Court. The Address when finisht, to be Transmitted to His Excellency Col. Elizeus Burges our Governour, and in case of His Absence to the Right Hon. Mr. Secretary Stanhope.

The following Vote sent down from the Board, viz. In Council, May 31st. 1716. Upon Reading the Expresses from the Eastward, giving just Grounds to suspect the Indians intend mischief to our Frontiers, which we conclude is fomented by false Reports of a War likely to break out between Great Britain and France. It being much for His Majesty's Service, and the Security and Peace of this Prov- ince, that some Method be immediately taken for undeceiving the Indians in that matter.


Advised, That some Discreet Person, with an Interpreter, be forthwith Dis- patched to their Head Quarters to let them know, that we justly take Umbrage at the suspicious Words and Deportment they have lately been guilty of, con- trary to the Peace Established, That we are desirous to remain in Peace, but if they against their Faith & Allegiance, Commit any Hostilities, they must expect to be treated as Rebels and Enemies to the Crown of Great Britain. Yet if they act upon supposal of a War with France, we do assure them there is no War to be Expected, but a perfect Amity between the Two Crowns. That the Pretender has been driven out of Great Britain, his Forces wholly Defeated, and he with his Ad- herents, ordered by the Regent, to Depart the Dominions of France.

Read and Concurr'd, and further Advised, That some British News-Papers be sent, to be Read and Interpreted to the Indians, to satisfy them of Peace between the Two Crowns.


A Message sent up to the Board by Capt. Noyes, Col. Goffe, and Col. Somersby, desiring that this House may be informed, whether the Votes of this Court for Demolishing of Casco Fort, and the removing of the Stores from thence, have been Attended and Complyed with.


Mr. Secretary Woodward brought down the Council Book, and shewed, That in Answer to the Memorial of Capt. Samuel Moodey, laid before His Honour the Lieut. Governour in Council, the further proceeding in that Affair had been suspended till the meeting of this Court, and then withdrew.


This House being informed, That the Votes of this Court to Demolish Casco Fort and Remove the Stores from thence are not yet fully Complyed with: which this House Apprehend may be of dangerous Consequence, by exposing His Maj- esties Stores, and the few People that still remain there, contrary to the Acts of this Courts, to the Insults of the Indians.


Resolved, That His Honour the Lieutenant Governour be desired, to direct a full Performance of the Votes of this Court in that Affair, and order the removing of the Stores to Boston, and the intire Demolition of the Fort, and Houses therein without delay.

By several Messages that Pass'd between the Houses, it was Agreed, That the Person, to be sent to the Head-Quarters of the Eastern Indians, pursuant to the Vote of this Day be Mr. John Watts, and Capt. John Gyles. [ 5 ]

Ordered, That Mr. Cooke, Col. Thaxter, Col. Goffe, Capt. Chambers, Capt. Gardner, Col. Somersby, Mr. Thomas, Col. Basset, Major Stoddard, Capt. South- worth, and Mr. Hammond be a Committee to consider and propose to the House, such Method as they think most effectual to obtain a true and just Valuation of the Rateable Estate of this Province, in order to a more just and equal Levying of Taxes upon the several Towns.


A Petition of Mary Woodcock Widow, Relict of William Woodcock, late of Attle- borough, Deceas'd, Presented to the House and Read, Praying that she may be enabled to Sell some Lands, that were her said late Husbands, for her Support and Maintenance in her old Age.


And after Debate, The Question being put, Whether the Prayer of the Petition be Granted ?


It pass'd in the Negative.


A Petition of Combs Humphry of Marblehead, presented to the House and Read, Praying that he may be allowed Wages for Two Years & Nine Months, that he was in Captivity at Canada, having been taken in the Service in the late War, and that he may be reimbursed Three Pounds he expended in his Sickness there, and Five Pounds he paid for his Ransom. Committed.


A Petition of Jacob Davis, John Riggs, William Hascell, & others, living on the Westerly side of Annasquam-River, and Little-River in Glocester, Presented to the House and Read, Praying that they may be set off, and Erected into a distinct and separate Precinct, for the Support & Maintenance of the Gospel Ministry, according to the Bounds therein described.


A Petition of Peter Coffin, and Fifteen others, Inhabitants of the Town of Glocester, dwelling on the Westerly side of Annasquam-River, Presented to the House and Read, Praying, That a Precinct may not be Constituted as is prayed in the aforementioned Petition, for Reasons therein alledged.


The following Vote pass'd & entred on the Petition of Jacob Davis, John Riggs, &c. viz.


Ordered, That the Petitioners serve Peter Coffin, and others, whose Names are Subscribed to a Petition accompanying this, Desiring that the Prayer thereof may not be Granted, with a Copy of this Petition; and notify them that they may be heard before this Court on Tuesday the Twelfth Instant, if they continue to object against the same.

A Report of John Cushing, Edmund Quincey, George Leonard, Henry Hodges, & Jacob Tompson, a Committee appointed by this Court to divide the Town of Bridewater, into Two Precincts, sent down from the Board, pass'd upon there, viz. In Council June 1. 1716. Read and Accepted.

A Petition of John Bridgham & Twenty Nine others, presented to the House & Read, Praying that a Tract of Land containing the Quantity of Seven Miles square, lying between, and contiguous to the Towns of Sutton, Marlborough, Worcester, Lancaster & Assanamisco, may be Granted to them (excepting the Grants already made within the said Bounds) and be Constituted a Township.


A Message from the Board, That the House now come up to the Council Cham- ber, to attend a Hearing appointed to be this Day on the Petition of Isaac Wonno, and Joshua Shantum Indians, Agents for Ketteticut, between them and the Town of Bridgewater.


Mr. Speaker and the House went up accordingly, and both Parties being fully heard, were dismist, and Mr. Speaker with the House return'd to their own Chamber.


And then the House Adjourn'd till to Morrow Morning Nine a Clock.

A Draught of Orders and Instructions to Messieurs Watts and Gyles, and to the Master of a Sloop to attend them Eastward, sent down from the Board. Read.

Resolved, That the Sum of Six Pounds be allowed and paid out of the Publick Treasury to Combs Humphry the Petitioner, in full of his Petition.

A Petition of John Sterns, and Five others, the Committee for the great Bridge in Billerica, presented to the House and Read, Shewing That the said Bridge is so far gone to Decay, that there is a necessity of its being speedily rebuilt, praying the Court to give their Direction, in what manner it shall be rebuilt, and main- tained for time to come, there having been formerly an Act of this Court for the Building of the said Bridge


Ordered, That the said Petition be referred to the Justices, in their Quarter Sessions in the County of Middlesex: And that a Bill be drawn accordingly.

A Petition of Josiah Chapin of Mendon, Esq; presented to the House and Read, praying as entred the Eighth of June last; what was then and since acted on that his Petition, not having pass'd through the Court.

An Accompt of Ebenezer Lewis, Treasury of the County of Barnstable, for the Year 1715. having been pass'd by the Court of Quarter Sessions in the said County. Presented to the House for Allowance. Read and Allowed.
