Ordered, That the said Report be so far accepted, That all the Repairs men- tioned therein be proceeded in as soon as conveniently may be, excepting the second Article relating to the Casemeting the Cover'd way: And that Capt. Jo- seph Wadsworth, and Capt. Jonathan Dowse are appointed a Committee, to take care and see them effected.

The Committee appointed to prepare a Vote on the Report of the Committee relating to White-hall Farm, offered a Draught which was accepted by the House, and the following Vote pass'd accordingly, viz. "Whereas a Plat of a Tract "of Land commonly known by the Name of White-hall Farm, lying in the Town "of Hopkinston, Surveyed & Platted by Joseph Sherman, was presented to this "Court by Joseph Buckminster Esq; and confirmed to him with the following " Proviso : viz.


" Provided the Plat exceed not the quantity of the Grant (being Three Hundred "Acres:) And whereas it appears by the Report of Samuel Thaxter and John "Chandler Esqrs; who were appointed by this Court at their Sessions in May last, "to view the uncertain Bounds of said Farm, That the Land contained in said "Plat, is about Five Hundred Sixty-three Acres, & three quarters.


Resolved, That the Grant of the said Land as Delineated in the said Plat, be Declared Null & Void: And that the Land belongs to this Province as heretofore. Sent up for Concurrence.


An Accompt of Daniel Russel Treasurer of the County of Middlesex, from May 1714. to May 27th 1717. Allow'd by the Court of General Sessions of the Peace in the said County, presented to the House for Allowance. Read & Allowed. Sent up for Concurrence.


The Accompt of John Campbell Post-Master of New-England, amounting to the Sum of l. 87 13 s. 3 d. further considered, and the Report of the Committee thereon, which was accepted by the House, and accordingly,


Resolved, That the Sum of Twenty-six Pounds Sixteen Shillings & Two-pence, be allowed and paid out of the Publick Treasury to Mr. John Campbell the Ac- comptant, in full of his Accompt.

The following Vote sent down from the Board, with the Plat of Deerfield, which was pass'd on in this House the 26th of last Month, viz. The Committee appointed by this Great and General Assembly to consider the Reasonableness for allow- ing [ 41 ] the Plat of Deerfield taken by Order of the House of Representatives, having Maturely considered the Evidences & Pleas there-about, are humbly of Opinion, that the Bounds of the Seven Miles Square granted to Deerfield, shall be and remain according to the Plat now Exhibited to this Great & General Court; provided the Line Run from the North end of said Tract to the great River, be an East Line, by Order of the Committee. N. Byfield.

Ordered, That the Trustees for the Legacy of Mr. Hopkins, be Desired & Im- powred to take care that there be no Strip, or Waste, of the Wood or Timber on the Tract of Land called Whitehall Farm, a Plat whereof has been laid before this Court by Joseph Buckminster Esq; Sent up for Concurrence.


Upon a Question, Moved by the Commissioners appointed to let out the Pro- portion of Bills of Credit belonging to the County of Middlesex, pursuant to an Act Intituled, An Act for the Making & Emitting the Sum of One Hundred Thou- sand Pounds in Bills of Credit on this Province ; Upon the sense of those words in the first Paragraph of the said Act, viz. "Who are to Let out the said Bills to such "of the Inhabitants of this Province as Desire it?


Quest. Whether the Commissioners of each County are thereby Impowred after Three Months to let out any of the said Bills, that may remain in their hands, unto persons not having any Real Estate in the County where the Bills are to be Let, upon good and sufficient Real Security, as the said Act Directs, in any other County of this Province? It pass'd in the Affirmative.


With Direction to the respective Commissioners to be very circumspect & cautious, that the Security they take be good and sufficient.

The Memorial of Joseph Marion Deputy Secretary, praying as entred the 12th currant, Read, and the Report of the Committee thereon, which was accepted by the House, and accordingly,

Ordered, That the said Accompt be allowed & paid as shall be hereafter Di- rected.

Resolved, That Capt. Jacob Thompson, Capt. Benjamin Warren and Capt. John Dyer, be a Committee to Repair to Duxbury notifying the several parties to be present and view the Highway laid out by the said Select Men to Thomas Fish, and Inquire into the Circumstances and make Report to this Court at their Ses- sions in May next, what they think just and proper to be done relating thereto, the charge of the Committee to be born as this Court shall Determine.

A Plat of 3268 Acres of Land, Presented to the House for Confirmation, to fulfil a Grant of 3000 Acres, which this Court at their Session in June last allowed the Town of Sherbon to take up. [ 43 ]


Ordered, That the said Plat be not allowed of, but the said Town is permitted to take as a Plat of 3000 Acres only, at the place where they took the said Plat, by a Surveyor and Chainmen under Oath and present the same to this Court for al- lowance at their Session in May next, and in the mean time the said Town is Im- powred to prosecute any Person that shall cut any Wood or Timber on the said Land. Pursuant to the aforesaid order, we have con- sidered the present affair of Little Hingham, and are humbly of Opinion that it is proper and reasonable that [ 44 ] the dividing Line should be and remain, as stated by the former Committee that went upon the place, all which is humbly Submitted.

W HEREAS this House is Informed, That the Government of Rhode-Island, have fully Impowred the Committee, which they have appointed to Run the Line, between this Province and that Government to Agree, Com-promise, and Issue the Difference between the Governments in that Affair, and finally Set- tle the dividing Boundaries.


Resolved, That if the said Committee shall attend that Service so Impowred; That the Committee appointed by this Court, to joyn in Running the said Line, Be also vested with like Powers, And are hereby fully Impowred, to Agree, Com- promise and Issue, the Difference between the Governments, in the said Affair, and to make a full and final Settlement of the Line between that Government and this; And make Report of their doings to this Court.

At a Great and General Court or Assembly of His Majesty's Province of the Massachusetts-Bay in pem-England, begun & held at )Boston, upon Wednes- day the 29th Day of May, Anno Domini, 1717. and continued by Proroga- tions to Wednesday the 5th Day of February next after.


A Number Sufficient to Constitute a House not Appearing, Mr. Speaker Issued his Warrant to the Representatives of the Towns of Sherborn, Medfield, Wrentham, Bradford, Haverhill, Salisbury, Plympton, Bridgwater, Mid- dleborough, Rochester and Dartmouth, requiring them forthwith to Attend his Majesties Service in the House.


Mr. Secretary Willard, came in and Acquainted the Members present, That his Excellency the Governour, had by and with the Advice of the Councill, Pro- rogued the Court by a Proclamation till to Morrow Morning Ten a clock in the forenoon.

M R. Speaker Sent a Message to his Excellency the Governour, by Mr. Remington, Col. Thaxter, Mr. Lindal and Col. Somersby, to Acquaint him that a Quorum of the House are now Met, ready to attend the Business of the Session.


A Message from the Honourable Board by Samuel Sewall, and Samuel Brown Esqrs; That His Excellency Directs this House to attend him forthwith in the Council Chamber.

GENTLEMEN,


I Had not given You or myself the Trouble of a Winter Sessions, but that thro' the Providence of GOD in the late Sickness, We were obliged to break up the last Sessions, before some Affairs of Importance were finished; and among others a Pro-

posal that was then made for some Additional building to your College at Cam- bridge. I doubt not but that it is very acceptable to you to hear the Sons of the Prophets say, The Place where we dwell is too streight for us! You are very much in the right to have the Interest of Learning much at heart: And therefore, if any further Buildings for that purpose be intended the next Summer, You must make the proper Provision for it this Sessions.


I am glad to find the Trading part as well as the Gentlemen of the Country begin generally to be convinced, that as it was only the Necessity, and great Emergency of our Affairs, that brought us into a Paper Credit; so we shall never be upon a firm and last- ing Foundation, till we Recover and Return to Silver and Gold, the only true Species of Money. And to that End I would propose it to your consideration, whether a certain Clause in the late Act, for Emitting a Hundred Thousand Pounds; whereby the Commissioners are directed to let out any of the Principal Money of the Loan, after it is once paid into the Treasury, unless Repealed or Altered, will not have a Tendency to prolong the Inconvenience we Complain of. I don't intend by mentioning these particulars to confine you to them; but if any thing else of Importance, and for His Majesty's Service, and the Interest of the Gov- ernment, come before You it will I doubt not, meet with a just consideration.


I have been inform'd that vast quantities of Deer were destroyed last Winter, and also in this, even when the Skins and Flesh were not worth fetching: If you don't design they should be entirely Destroyed, some Law must be made, for the preventing them from being killed for a few Years, and a weighty Fine laid upon the Offenders.


I shall only add, that I design it for a short Sessions, and therefore hope You'l give every thing its proper Dispatch.


Ordered, That a Message be sent up to the Board by Capt. Wadsworth, and Mr. Tay, moving that a Day of publick Fasting with Prayer, be Appointed and Sol- emnized throughout the Several Towns of this Province, upon the various occa- sions thereof, particularly the Epidemical mortal Fever that is in most of them. The following Report, Brought down from the Board by Benjamin Lynde, John Clark, Addington Davenport and Adam Winthrop Esqrs; viz.


We whose Names are underwritten being a Committee appointed by the Gen- eral Court to Consider, what is proper to be done in answer to the Memorial laid before them by the Overseers of Harvard College at their last October Sessions, having met at the College in Cambridge, Decemb. 27th 1717. And Inquired into the Accomodations that are there, at present for the Students, Graduates and Undergraduates do find it necessary that some further Building be Erected for

A Report Signed by Penn Townsend, Thomas Hutchinson, Thomas Fitch, Ed- ward Hutchinson, Habijah Savage, Isaiah Tay, Joseph Wadsworth, Charles Cham- bers, Jonathan Dowse, and William Denison, the Committee appointed by this Court in the recess thereof, to receive of the Treasurer, take Account of, and Burn torn and defaced Bills of Credit on this Province, Dated the 30th Day of Decemb. 1717. Shewing that they had then received and burnt to Ashes the Sum of l. 10143. 5 s. 7 d. half penny, neet Bills, Z. 6638 14 5. 5 d. half penny, part thereof was received for Taxes, Impost and Excise, which with the advance of five per Cent, as they were received into the Treasury added thereto amounts to the Sum of l. 6970 13 s. 2 d. and l. 3504 II s. 2 d. the remaining part thereof neet Bills, received into the Treasury without advance, of the Trustees for the Letting out the l. 50000. Bills of Credit, making in the whole the Sum of l. 10475 4 s. 4 d. as they were received into the Treasury. Read and
